Motorway driving law – Can you be fined for getting out of your car during a traffic jam?

Motorways in the UK are prone to congestion and traffic jams especially during peak times or when there has been a serious accident.

Certain accidents or incidents that occur on motorways on the road could cause traffic to standstill for hours.

Sitting in a hot car for hours while you wait until the road reopens sounds pretty unappealing but can you legally get out of your car and walk around?

Here is what the law says you can and can’t do.

Can you get out of the car during a traffic jam?

While there is no law preventing motorists from getting out of the car during a traffic jam, the AA recommends drivers remain in their car in traffic, no matter how slowly it is moving.

Motorcycles or emergency vehicles could still weave in and out of traffic and pose a potential risk to other drivers.

Can you eat while in a traffic jam?

It is not against to eat or drink (non-alcoholic) beverages while on the road but a driver could still land a fine.

You could be prosecuted for careless driving if authorities believe that the snack is distracting you from driving.

Can you use your mobile phone while stationary?

Mobile phone driving laws prevent motorists from using a device while the engine is turned on.

To be able to use a mobile phone while in your car you must be safely parked and switch the engine off.

There is only one instance when drivers can use their phone while driving, which is iff you need to call 999 or 112 during an emergency and it is unsafe or impractical dos top.
