The Winkevoss twins are back in the news for their involvement in the cryptocurrency world, but this time they likely wouldn’t want to celebrate. The New York Times has learned that the two sued crypto investor and ex-convict Charlie Shrem for allegedly stealing 5,000 bitcoins in 2012 — no small amount when they’d be worth roughly $ 32 million today. The Winklevoss Capital Fund sent Shrem $ 250,000 in 2012 to buy bitcoins on its behalf, but delivered $ 189,000 worth based on the price at the time. The figure was lost in a larger dispute over an investment in Shrem’s BitInstant, but it’s clearly more important now.

Cameron Winklevoss said the lawsuit was prompted by learning of Shrem’s spending spree since leaving prison for his part in selling bitcoin to Silk Road drug buyers. In the space of the past year, Shrem bought a $ 2 million Florida house, two powerboats and two Maseratis (among other acquisitions) despite saying he went to prison virtually broke. He most likely made those purchases using the stolen bitcoins, according to the lawsuit. Shrem’s post-prison initiatives haven’t really panned out — both an initial coin offering and a crypto currency card ended up returning money to investors after promised partnerships didn’t materialize.

An investigator in the case has backed up the twins’ case, noting that 5,000 bitcoins were transferred to bitcoin wallets using addresses linked to Shrem.

Shrem’s attorney has denied the allegations in the lawsuit, claiming that “nothing could be further from the truth” and promising that Shrem would “vigorously” defend himself. This isn’t likely to deter the Winklevoss brothers, though. While the two hold nearly a billion dollars in cryptocurrency, $ 32 million is nothing to sneeze at. As it is, they’ve succeeded in freezing some of Shrem’s funds as part of the case — they’re already committed to getting to the bottom of what happened.

Two of the world’s most famous bitcoin investors, the Winklevoss twins, have now sued a longtime figure in the world of bitcoin, Charlie Shrem.

Shrem was released from prison in 2016 after he was convicted for aiding and abetting an unlicensed money-transfer business—sending $ 1 million in bitcoins that ended up on the notorious drug website, Silk Road.

According to the new lawsuit—which was filed in federal court in Manhattan in September 2018 and only recently unsealed—Winklevoss Capital Fund (WCF) hired Shrem in late 2012 to purchase bitcoins on its behalf.

Gemini, the cryptocurrency exchange founded by the famous Winklevoss twins, has extended a scheduled maintenance of its site after a massive bitcoin sell-off.

The company said Friday night that its site would undergo maintenance from 8:00 a.m. to 1:00 p.m. ET Saturday, adding that users shouldn’t expect “downtime.” Still, the site appeared to be down for some users during the period, preventing folks from accessing their cryptocurrency accounts. 

At around 1:00 p.m. ET the company said the maintenance would continue:

The outage coincided with a massive bitcoin sell-off, which shaved more than $ 1,500 of its price, according to Markets Insider data. By 1:22 p.m. ET, bitcoin was trading down 11% against the US dollar at $ 14,305 a coin. The outage infuriated some users who were unable to move their coins around as bitcoin’s price slid. One person criticized the firm for not giving users enough notice on the original maintenance:

Founded in 2015 by Tyler and Cameron Winklevoss, who reportedly own a billion dollars of bitcoin, Gemini is one of the best-connected firms in the cryptocurrency space. Cboe Global Markets is partnering with the exchange for its bitcoin futures contracts, which are set to go live Sunday.

When volumes have increased on Gemini, the firm has faced challenges staying online.

Earlier this month, the firm showed many users a “504 Gateway Time-out” message, which meant its servers were not responding to requests. The company posted on its status page that “systems are currently experiencing degraded performance.”

The exchange also experienced outages lasting as long as 10 hours in August, according to reporting by Quartz.

“This is not the first scaling challenge we’ve encountered, and it won’t be the last,” Gemini said in a blog post. “We’re continuing to improve our performance and infrastructure monitoring so we can anticipate potential problems more quickly in the future.”

Gemini did not respond to a request for comment.

The price of bitcoin against the US dollar was up almost two percent, reaching $ 1,287.27 as of 1:34pm GMT. The digital currency had a strong start to the week, with prices gaining more than $ 35 since Sunday.

On Tuesday, the US Securities and Exchange Commission (SEC) announced it would reconsider its decision over ETF. Last month, it denied the Winklevoss’ application to list the company on the Bats BZX exchange which is one of the largest US equities market operators.

“The Commission hereby establishes that any party to the action or other person may file a written statement in support of or in opposition to the Disapproval Order on or before May 15, 2017,” the SEC said in a statement.

Bitcoin has been on a steady rise for the past month, up around 23 percent. It reached the all-time high of $ 1,325.81 in March.

Experts say the price rise has been supported by a number of factors including Japan’s recognition of bitcoin as a legal currency and the Russian government’s comments about cryptocurrencies.

Russia’s Deputy Finance Minister Aleksey Moiseev said this month bitcoin and other digital currencies could be recognized in the country by next year. The central bank is working with the government to develop rules against illegal transfers, he added.

Cryptocurrencies still have a lot of opponents, who argue that transaction anonymity and lack of a supervisory body makes them the perfect vehicle for money laundering.

A plan from the Winklevoss twins that would have allowed stock traders to buy and sell Bitcoin without setting up a personal Bitcoin wallet has been denied by the US Securities and Exchange Commission. In an order handed down on Friday, the commission declared that the unregulated nature of Bitcoin markets would have made the proposed fund too difficult to monitor, and therefore ripe for fraudulent activity.

As The Verge notes, the proposed Winklevoss Bitcoin Trust Exchange-Traded Fund (ETF) would have created a common stock fund tied to the price of Bitcoin. Traders who purchased shares of the Bitcoin Trust ETF would be investing in the cryptocurrency’s value, without actually owning — or being able to spend — any Bitcoin themselves. Although experts speculated that the price of Bitcoin would double if the Winklevoss ETF was approved, the price of Bitcoin actually sank dramatically after the SEC’s announcement.

While the SEC ruling is definitely a setback for the currency’s official acceptance, it’s unlikely to have a longterm effect on Bitcoin values overall and several hours after the SEC’s announcement, Bitcoin values had started to bounce back. Meanwhile, two other ETFs that were awaiting an SEC ruling are also unlikely to win approval. “We remain optimistic and committed to bringing COIN to market, and look forward to continuing to work with the SEC staff,” Tyler Winklevoss told CNBC. “We began this journey almost four years ago, and are determined to see it through. We agree with the SEC that regulation and oversight are important to the health of any marketplace and the safety of all investors.”
