Washington’s decision to include 12 Russian UN mission employees to the list of diplomats expelled from the US over the Sergei Skripal case, is “absolutely illegal and contradicting all international agreements and conventions on diplomatic relations,” Gatilov told RIA Novosti.

“This is absolutely unlawful because… those diplomats are accredited at the United Nations and have a completely different status. They work as representatives of Russia at the UN, but not with the US government,” he explained.

The envoy said that the US used “unscrupulous methods” to put pressure on Russian diplomats at the UN long before announcing the expulsion on Monday. One of these means was through the “non-renewal of visas for our diplomats working in New York,” he said.

“By doing so, they create a situation, in which people are unable to travel outside the US for personal or official purposes and then return to their place of work because their visa expired and the entry to the US is closed for them,” Gatilov said.

The envoy said that he knew of four or five Russian diplomats at the UN whose visas have not been prolonged for six months, despite the fact that all the required documents had been filed in time. “There was simply no reaction from the American side,” he said, adding that all attempts to clarify the situation by the Russian side were also ignored.
US Ambassador to Russia, Jon Huntsman, earlier said that expelling Russians from the UN would be a complicated affair, as it would require getting approval from UN Secretary-General Antonio Guterres.

Gatilov described the expulsion of the Russian UN staff as “an unfriendly act towards our country,” saying that Washington has behaved “indecently… not the way the host country, which accommodates diplomats working at the UN, should act.”

According to the envoy, such persecution of Russian diplomats would be “hardly possible” at the UN office in Geneva, Switzerland.

“We believe that the local authorities have more sanity” and understand the special status of those working at international organizations, he said. “Rationally thinking people do not succumb to such provocative methods.”

Earlier this week, the US announced it would expel 60 Russian diplomats and close Russia’s consulate in Seattle, as President Donald Trump’s administration answered the UK’s calls to punish Russia over its alleged involvement in the poisoning of former double agent Skripal and his daughter, Yulia, on British soil. In a tit-for-tat response, Moscow said on Thursday that 60 American diplomats would have to leave the country and the US consulate in St. Petersburg was being shut down.

In early March, the Skripals were poisoned in Salisbury with what is claimed to be a Soviet-designed nerve agent, A-234 (also known as ‘Novichok’). Without a proper investigation being carried out, London accused Moscow of being behind the attack, expelled Russian diplomats and introduced other restrictions against the county. Windows 10’s data collection allegedly violates Dutch privacy law https://briefnews.eu/windows-10s-data-collection-allegedly-violates-dutch-privacy-law/ https://briefnews.eu/windows-10s-data-collection-allegedly-violates-dutch-privacy-law/#respond Sun, 15 Oct 2017 20:52:17 +0000 http://briefnews.eu/windows-10s-data-collection-allegedly-violates-dutch-privacy-law/

Microsoft has already caught flak over claims that Windows 10’s data collection is still overly aggressive, but it’s now facing a direct legal challenge over how it handles your info. The Netherlands’ Data Protection Authority has determined that Windows 10 violates the country’s data protection law even after tweaks that came with the Creators Update. Allegedly, Microsoft doesn’t “clearly inform” you of the type of data it’s using and the reasons why that data is needed. Moreover, officials believe that Windows’ default settings prevent you from offering true consent to data gathering.

Windows defaults to the full data sharing during the installation process, and encourages you to simply accept those terms. Just because you didn’t change those settings doesn’t mean you gave permission, the DPA said. The regulator also contended that the Creators Update didn’t honor some users’ existing privacy preferences, and that Microsoft doesn’t make it clear that the Edge browser is continuously collecting app and browsing data using the default settings.

Not surprisingly, Microsoft has taken issue with the findings. In its response to the DPA, it illustrated point-by-point “concerns” with the Dutch authority’s statement. It maintained that Windows 10 informs you about the data it collects and how that info is used, although it acknowledged that you may have to dive into the privacy agreement or “learn more” sections (that is, the sections few people read) to get a full understanding. It also argued that it needs at least some device data to understand compatibility problems (there are hundreds of millions of Windows users, after all) and look for repeated app crashes that might hint at security holes. And as you might expect, Microsoft doesn’t agree that its approach to software defaults prevents people from giving true consent.

Microsoft does plan to work with the authority to take care of violations, although the disputes suggest that the two sides aren’t about to come to an agreement in the immediate future. Whatever happens, this Dutch claim could have far-reaching implications. Unless Microsoft is willing to make a version of Windows 10 with privacy changes just for the Netherlands, you may see it alter data collection policies worldwide.

‘Major impediment’: PACE says Ukraine education law violates ethnic minority rights https://briefnews.eu/major-impediment-pace-says-ukraine-education-law-violates-ethnic-minority-rights/ https://briefnews.eu/major-impediment-pace-says-ukraine-education-law-violates-ethnic-minority-rights/#respond Thu, 12 Oct 2017 19:24:38 +0000 http://briefnews.eu/major-impediment-pace-says-ukraine-education-law-violates-ethnic-minority-rights/ A new Ukrainian education law fails to “strike a balance” between the official language and those of minorities, the Parliamentary Assembly of the Council of Europe (PACE) said in a resolution, adding that it is not conducive to “living together.”

PACE expressed its concerns over the articles relating to education in minority languages in the law recently adopted by Kiev. It “entails a heavy reduction in the rights previously recognized to ‘national minorities’ concerning their own language of education,” according to the document.

“The new legislation does not appear to strike an appropriate balance between the official language and the languages of national minorities,” the resolution adopted by PACE on Thursday says. The document was supported by 82 members of the 110 who took part in the vote, RIA Novosti reports. Only 11 parliamentarians opposed it while 17 others abstained.

The resolution further says that the Ukrainian education act “is not conducive to ‘living together,’” which particularly encompasses the principle of non-discrimination. PACE noted that any country’s measures aimed at promoting its official language must “go hand in hand with measures to protect and promote the languages of national minorities.”

The assembly said it “deplored” the fact that no consultations with the national minorities in Ukraine were held ahead of the adoption of the law. It further “expressed dissatisfaction” that the text of the legislation was submitted to the European Commission for Democracy through Law (Venice Commission) for an opinion only after it was approved by the Ukrainian parliament – the Supreme Rada – and signed by the president, Petro Poroshenko.

The resolution called on Kiev to ensure that there is enough “flexibility” in the planning and implementation of the educational reform to “avoid hasty changes prejudicing the quality of education provided to pupils and students belonging to national minorities.”

It also asked the Ukrainian authorities “to fully implement” the recommendations of the Venice Commission, which it is expected to deliver by the end of 2017. The controversial legislation adopted by the Supreme Rada on September 5, and signed by Poroshenko on September 27, is still causing concern in neighboring European countries.

The head of the Hungarian delegation at PACE, Zsolt Nemeth, accused Kiev of being at odds with European values and said that the newly adopted law could lead to instability in the western Ukrainian regions. He also called on European countries to “continue to exert pressure” on Ukraine to make it “stay within the framework of European values,” as reported by TASS.

Moldovan MP and also PACE member, Vlad Batrincea, said that Kiev is cherry-picking European values. Ukraine acts as if it had a “menu in a restaurant,” the MP said, adding that Kiev adopts some European norms but pretends it is unaware of others.

Following the adoption of the law, Romania cancelled a state visit to Ukraine by President Klaus Werner Iohannis and refused to host a parliamentary delegation from Ukraine in protest.

Moldovan President Igor Dodon warned that Ukraine’s Moldovan and Romanian minorities risked “denationalization” under the new law, while Hungary called it a “stab in the back.”

Later, Hungarian Foreign Minister Peter Szijjarto threatened to block Ukraine’s EU integration under the Eastern Partnership program in response to the adoption of the law.

The legislation is expected to affect at least 400,000 children studying in 735 Ukrainian schools which offer instruction in minority languages. The majority of these children are ethnic Russians, but other minorities in Ukraine include Romanians, Hungarians, Moldovans and Poles.

Under the newly adopted law, only children in grades 1-4 would be allowed to learn the curriculum in their native tongues in Ukraine starting from 2018, and by 2020 even that will no longer be legal.

Atari claims that a commercial for Nestle’s Kit Kat candy bars violates the copyright and trademark rights of Breakout, Atari’s iconic 1975 video game.

Nestle’s 30-second spot “leverage[s] Breakout and the special place it holds among nostalgic Baby Boomers, Generation X, and even today’s Millennial and post-Millennial ‘gamers’ in order to maximize the advertisement’s reach,” say Atari’s lawyers in the complaint (PDF), filed Thursday in a California federal court.

“Nestle simply took the classic Breakout screen, replaced its bricks with KIT KAT bars, and invited customers to “Breakout” and buy more candy bars,” the complaint states.

Trump's transgender ban violates Constitution, military lawsuit says https://briefnews.eu/trumps-transgender-ban-violates-constitution-military-lawsuit-says/ https://briefnews.eu/trumps-transgender-ban-violates-constitution-military-lawsuit-says/#respond Wed, 09 Aug 2017 21:32:45 +0000 http://briefnews.eu/trumps-transgender-ban-violates-constitution-military-lawsuit-says/ Five anonymous transgender members serving in the US military are suing President Donald Trump, claiming his military transgender ban violates constitutional protections of the Fifth Amendment.

Two advocacy groups filed the lawsuit on Wednesday in US District Court in Washington, DC, according to Reuters.

The suit was filed against President Trump, Defense Secretary Jim Mattis and other top officials, on behalf of the five, who said the ban violated the rights of service members’ due process and equal protection under the Fifth Amendment, and asks the court to declare Trump’s directive unconstitutional and to issue injunctions to stop its implementation.

In a Twitter post on July 26, Trump said the US government “will not accept or allow transgender individuals to serve in any capacity” in the military, a reversal of Pentagon policy that the lawsuit said was made without consulting senior military commanders.

The plaintiffs are all listed as Jane Does to protect their identities. Three are soldiers in the Army, one is in the Air Force, and one is serving on active duty in the Coast Guard.

Among the plaintiffs, Jane Doe 1 submitted her prospective resignation rather than been involuntarily terminated as transgender. Jane Doe 2 was concerned the ban may result in early termination of her contract with the military. Jane Doe 3 expected to deploy to Iraq son and had intended to extend her contract. Jane Doe 4 received medical treatment for her gender transition and hoped to reach her 20-year service benchmark and Jane Doe 5’s livelihood depends on the military.

Trump’s announcement cited healthcare costs and unit disruption as the rationale for banning transgender service members. Critics said the ban appealed to Trump’s religious, conservative base.

The complaint argues Trump’s ban contradicted findings in a Rand Corporation study commissioned by the Pentagon that found allowing “transgender people to serve would cost little and have no significant impact on unit readiness.”

The Rand study suggests there are currently between 1,320 and 6,630 transgender people actively serving in the US military.

The ban also reverses Pentagon policy instituted in 2016 that allowed transgender people to serve openly in the military, stated the complaint.

The policy change led the plaintiffs, and others, to follow protocol and inform their chain of command that they were transgender and did so under the knowledge that the US promised “it would permit them to continue to serve their country openly,” for those who had built their lives around their military service.

“Execution of the President’s directive will result in an end to service by openly transgender service members and has already resulted in immediate, concrete injury to Plaintiffs by unsettling and destabilizing plaintiff’s reasonable expectation of continued service,” stated the complaint.

The Jane Does are being represented by attorney from GLBTQ Legal Advocates & Defenders and the National Center for Lesbian Rights.

The American Civil Liberties Union said it was preparing its own lawsuit.

“The ACLU send a letter to the White House [on Tuesday] formally informing them that we intend to sue and telling them to preserve all documents related to their planned ban on trans military members in preparation for our forthcoming lawsuit,” Ryan Karerat, communications strategist for the ACLU, according to the Huffington Post.

Joseph Dunford, the chairman of the Joint Chiefs of Staff, said in a memo a day after Trump’s tweets that there would be no change in policy until Mattis received an official order from the president.

That order has yet to be issued.

“In the meantime, we will continue to treat all of our personnel with respect,” Dunford said.

Utah’s ‘ag-gag’ law unconstitutional & violates free speech – Federal judge rules https://briefnews.eu/utahs-ag-gag-law-unconstitutional-violates-free-speech-federal-judge-rules/ https://briefnews.eu/utahs-ag-gag-law-unconstitutional-violates-free-speech-federal-judge-rules/#respond Sat, 08 Jul 2017 02:43:47 +0000 http://briefnews.eu/utahs-ag-gag-law-unconstitutional-violates-free-speech-federal-judge-rules/ A federal judge in Utah has sided with animal rights activists who argued that a law prohibiting undercover investigations of agricultural operations was unconstitutional. Activists contend that similar laws in other states “will fall like dominos.”

In a Friday ruling, US District Judge Robert Shelby struck down Utah’s “agricultural operation interference” law, otherwise known as the ag-gag law, declaring it a violation of free speech rights.

“Utah undoubtedly has an interest in addressing perceived threats to the state agricultural industry, and as history shows, it has a variety of constitutionally permissible tools at its disposal to do so,” Shelby said in the ruling. “Suppressing broad swaths of protected speech without justification, however, is not one of them.”

In 2012, Utah approved a law that made it a class B misdemeanor to photograph or record an agricultural operation without consent from the owner. It also prohibited obtaining access under false pretenses, such as seeking employment with the intent to record or leaving a recording device at an agricultural operation without consent from the owner.

In the ruling, Shelby stated that several states have enacted ag-gag laws since the 1990s in response to animal rights advocates “conducting undercover investigations to expose animal abuse at various facilities.”

Shelby cited several investigations, including one where activists filmed workers “forcing sick cows into the ‘kill box’ by repeatedly shocking them with electric prods, jabbing them in the eye, prodding them with a forklift, and spraying water up their noses,” Shelby wrote in the ruling.

That investigation later led to the largest recall of meat in US history.

While attorneys for the state argued that the First Amendment does not guarantee free speech rights to people on private property, Shelby noted that lawmakers who crafted the bill said the law was drafted to target “vegetarian people that [are] trying to kill the animal industry.”

A spokesman for Utah Attorney General Sean Reyes’ office told KSTU that they are “reviewing the opinion and considering our options.”

In 2015, the US District Court of Idaho also ruled that Idaho’s ag-gag law violated the First and Fourteenth Amendments. Both rulings were the result of lawsuits led by the Animal Legal Defense Fund (ALDF).

“These unconstitutional laws will fall like dominos,” Stephen Wells, executive director of the ALDF, said in a press release. “Ag-Gag laws are flagrant attempts to hide animal cruelty from the American people, and they unfairly target activists trying to serve the public’s interest.”

The original lawsuit was filed by ALDF and People for the Ethical Treatment of Animals (PETA) after activist Amy Meyer became the first person to be arrested and charged under the law.

In 2013, Meyer, the director of the Utah Animal Rights Coalition (UARC), was charged with violating the ag-gag law for filming a front-end loader moving a sick cow at the Dale T. Smith Meatpacking Company in Draper, Utah. She was on public property at the time, but the state still brought charges against her. However, the case was later dropped after public outcry.

“I was shocked when I was the one charged with a crime instead of that animal abuser,” Meyer said in a statement. “It should never be a crime to tell the story of an animal who is being abused and killed, even if it’s for food. Today’s court ruling is a vindication for anyone who stands up for what’s right and tells the truth.”

President Putin “regards the strikes as aggression against a sovereign nation,” his spokesman Dmitry Peskov said, noting that the president believes the strikes were carried out “in violation of international law, and also under an invented pretext.”

Peskov also insisted that “the Syrian army doesn’t have chemical weapons,” saying this had been “observed and confirmed by the Organization for the Prohibition of Chemical Weapons, a special UN unit.”

Putin sees the US missile strike on Syria as an attempt to distract attention from civilian casualties in Iraq, Peskov added.

“This step deals significant damage to US-Russian ties, which are already in a deplorable state,” Peskov said.

Trump’s trade policy violates basic rules of behavior we teach in kindergarten https://briefnews.eu/trumps-trade-policy-violates-basic-rules-of-behavior-we-teach-in-kindergarten/ https://briefnews.eu/trumps-trade-policy-violates-basic-rules-of-behavior-we-teach-in-kindergarten/#respond Sat, 04 Mar 2017 04:50:20 +0000 http://briefnews.eu/trumps-trade-policy-violates-basic-rules-of-behavior-we-teach-in-kindergarten/ KindergartenFlickr / woodleywonderworks

In kindergarten, most children are taught lessons they are meant to carry through the rest of their lives. This is where they are socialized, and become humans capable of working with other humans.

They learn lessons like,”treat others the way you want to be treated;” “don’t bully;” and “play nice with others.”

The Trump trade agenda, which was published this week, violates all of those principles in the name of creating a more prosperous America.

Worse yet, it erodes away at the fabric of the global economic order. It claims that Americans on both sides of the aisle “rejected the way in the framework of rules governing international trade operates.” These are incredibly complex rules and agreements most Americans have never really considered.

So let’s stick with the kid’s stuff.

Treat people the way you want to be treated

The White House is constantly saying that the US — the richest country in the world with the largest military on the planet — is being treated unfairly.

And the administration’s trade agenda makes pains to establish the US’s ability to govern itself, and ignore trade rules set up by the World Trade Organization (WTO), whenever it wants.

“Americans are subject to US law — not WTO decisions,” it says.

Dan DiMicco, the senior adviser who led President Donald Trump’s trade transition team, told Business Insider’s Allan Smith, that the WTO simply “wasn’t working for us.”

Politicians on both sides of the aisle have criticized the WTO before, but DiMicco and the Trump agenda both take that criticism to new heights. The plan calls WTO rules “a challenge” and questions the 1994 Uruguay Round Agreements Act, which basically says the US will play by WTO rules. If we violate them, we’ll fix the problem or pay a fine, just like everyone else.

Throwing that into question throws into question the entire purpose of the agreement. It leaves the WTO so toothless that we might as well withdraw.

“If we were to withdraw, we would withdraw from the tariff zone for member nations and tariffs would go up a lot,” said Lee Branstetter, a professor of economics and trade specialist at Carnegie Mellon. “US firms would face an enormous temptation to shift as much of their production to WTO nations as soon as possible.”

What’s weird about this aggressive stance is that a page later, the document calls for other nations to follow our rules and expect retaliation for any measures that “cause or threaten material injury to a domestic industry.”

Why? Because we have laws against them that are supported by the WTO.

And on CNBC on Friday, Commerce Secretary Wilbur Ross said he was “shocked” to find out there were billions of dollars from trade rulings favorable to the US sitting with the WTO. He thinks we should go get that money.

So which is it? Do we respect the WTO or do we not? If we don’t, in Kindergarten you would learn that you can’t really expect other people to do so either.

Wilbur Ross TrumpREUTERS/Mike Segar

Don’t bully

The agreement also calls for the US to open up foreign markets that have raised barriers to US goods. It’s unclear how the administration plans to do this aside from saying that it’s “time for a more aggressive approach” including “applying the principle of reciprocity to countries that won’t open their markets.”

That’s called starting a trade war, or, what kindergarteners know as bullying.

It also probably won’t work.

“What happens to US manufacturing when Boeing can’t sell airplanes,” Branstetter offered, “Or when GE can’t sell industrial equipment? It would be an enormous blow… to the part of manufacturing that has the brightest future.”

And yes, they can retaliate. Look at everything China alone imports from the US (via Deutsche Bank) below:

china imports from USDeutche Bank

The can “apply reciprocity” as soon as we do, and that wouldn’t be nice at all.

Play nice with others

Another big part of the trade agenda is ripping up multilateral agreements (like NAFTA) and instead negotiating bilateral agreements. This has largely been panned by trade experts as expensive. Branstetter told Business Insider that it would take decades to renegotiate the deals we’ve arranged in groups, one on one.

“This sort of takes the stupidity we’ve heard up to now and amplifies it by a factor of 2 or 3 or 10,” he said.

Worse yet, tearing up trade deals makes the US untrustworthy. People don’t want to do deals with people who will just tear them up and walk away later.

There are things we do domestically that make us untrustworthy outside too. Last month the Wall Street Journal reported that the Trump administration asked members of the Commerce Department to change trade data to look like the US had a bigger deficit with other countries. The Trump trade agenda rails against countries like South Korea and China, where the US has a trade deficit.

But as the WSJ points out, trade deficits are simply not a measure of economic health. The US ran a trade surplus during the Great Depression, and you all know how our economy was going at that point. However, ideologues within the administration like Peter Navarro, head of the White House National Trade Council, and the Steve Bannon, are obsessed with these meaningless metrics.

The worst part of that, is they become a reason to feel hostile toward other nations when there needn’t be one. That comes across clearly in the trade agenda document. Getting angry at someone for playing by the rules is not playing nice. Nobody wants to play with someone who doesn’t play nice.

The American Civil Liberties Union (ACLU) issued a warning to Jeff Sessions, shortly after he was confirmed as attorney general on Wednesday night.

“Jeff Sessions confirmed as attorney general. If he violates the Constitution, we’ll sue,” the organization said in a tweet.

The ACLU is a nonpartisan, nonprofit organization that defends individual rights. The statement follows concerns by lawmakers and civilians who argued that Sessions lacked the judgment to serve as the nation’s top cop.

The organization had a similar warning for President Donald Trump after he won the US presidential election in November, promising its “full firepower” should Trump seek to undermine the Constitution or violate Americans’ rights with the proposals he campaigned on.

Opponents have pointed to Sessions’ record as an Alabama senator and state attorney general — and his vocal support of Trump as indications that he might be a rubber stamp for the Trump administration.

Civil-rights groups and law-enforcement watchdogs contended that Sessions could seek to undo protections for people who engage in lawful protests.

Debate over his nomination culminated in an all-night session on the Senate floor Tuesday, when Sen. Elizabeth Warren of Massachusetts was forced to sit down when she attempted to read a 1986 letter from the widow of Martin Luther King, Jr., who was critical of Sessions.

Warren put Sessions on notice after his confirmation Wednesday night.
