MyPillow CEO Mike Lindell is suing the FBI and Department of Justice for seizing his mobile phone outside a Hardee's in Mankato, Minnesota, and accusing the authorities of violating his constitutional rights.
Lindell sent Insider a copy of the lawsuit in which Attorney General Merrick Garland and FBI Director Christopher Wray were listed as defendants.
Represented by a legal team including conservative lawyer Alan Dershowitz, Lindell's suit claims the FBI violated his "First, Fourth, Fifth, and Sixth Amendment" rights. He is also demanding that his cell phone be returned and that any information obtained from his phone by the FBI or DOJ not be released.
The lawsuit gives a detailed account of Lindell's side of the incident, in which he describes driving home at 4 a.m. on September 13 with a friend after going duck hunting in Minnesota. Per the suit, Lindell's group was at a Hardee's in Mankato sometime in the late morning when they found themselves boxed in by FBI officers.
Lindell's team wrote that the FBI must have had him under surveillance because he had not made his location at the Hardee's publicly known.
The filing also stated that Lindell began "fearing for his and his friend's lives" as FBI officers approached their vehicle. Per the filing, a conversation then ensued between Lindell and the officers about "Dominion Voting Systems," indicted Mesa County clerk Tina Peters, and Lindell's private plane travel. The officers also seized Lindell's phone.
Lindell told Insider last week that the phone seizure was linked to an investigation into Mesa County Clerk Tina Peters, a pro-Trump Colorado election official accused of facilitating an election-data leak.
Lindell has been linked to Peters, who was accused in April of accepting a private plane ride from the business owner. Lindell also told Insider that he'd been helping to pay off Peters' legal fees, with some funds coming from his "personal money" that was redirected through a fundraising platform called the Lindell Legal Offense Fund.
Lindell's team further claimed in their filing that the MyPillow CEO had been subjected to "unlawful detention" and that the agencies had been "unreasonable" when executing the search and seizure warrant.
A representative from the DOJ attached to Lindell's case told Insider that their office had no comment on the matter.
Speaking to Insider on Tuesday, Lindell said he was suing over what he thought was the "worst violation" of his rights.
"It's horrible. Can you believe they did that to your friend?" he told Insider.
Lindell told Insider that had the FBI approached him at night, he would have "bashed" his way through their cars with his pickup truck.
"Because I would have thought they were bad guys there. There was no sign that they were law enforcement, the way they surrounded me like that," he said, adding that he believed the agency had been "weaponized" by the government.
However, Lindell maintained that he would not have minded being detained by the FBI.
"I don't care if I get arrested or anything or if they're going to bring me in," Lindell said. "So I can get the word out to get rid of the voting machines, you know that? I'd do whatever it takes."
Lindell continues to be highly involved in pushing former President Donald Trump's false claims of voter fraud in the 2020 election. For one, he is bankrolling a nationwide effort to stop the use of electronic voting machines. He is also embroiled in a $ 1.3 billion lawsuit filed against him by the voting-technology company Dominion and a suit filed by the voting-systems company Smartmatic.

A top UN nuclear watchdog official said the "physical integrity" of southern Ukraine's Zaporizhzhia nuclear power plant — caught in the center of intense hostilities and fighting — has been "violated."
"It is obvious that the plant and physical integrity of the plant has been violated several times," International Atomic Energy Agency Director General Rafael Mariano Grossi told reporters on Thursday, according to media reports, including The Guardian.
Grossi returned on Thursday from a highly anticipated inspection of the plant, which is occupied by Russian forces and is the largest in Europe.
"There were moments where fire was obvious, heavy machine gun, artillery, mortars, at two or three times — really, very concerning, I would say, for all of us," Grossi said in a video captured by freelance journalist Sergio Olmos.
Grossi and a crew of IAEA inspectors arrived at the plant Thursday afternoon to investigate the facility's safety and security after facing delays caused by heavy shelling in the area. Leading up to the visit, the agency said its mission faced the dangers of increased military activity but said it wouldn't stop them from completing an inspection of the site.
"Of course, there is a lot more to do — my team is staying on," Grossi said in a video message after touring the plant. "Most importantly," he added, the IAEA is "establishing a continued presence" at the facility.
The IAEA's visit comes after weeks of shelling around and at the plant, causing damage to the physical facility, triggering power disconnections, and forcing the plant — which is staffed by Ukrainian civilians — to shut down at times. Kyiv and Moscow have traded blame for various attacks.
Western intelligence has accused Russia of using the plant's protected status as a shield, which has left Ukrainian forces reluctant to attack. Watchdog agencies, including the IAEA, have warned that fighting severely raises the risk of a major accident or nuclear disaster and have pushed for international inspections to assess the plant's stability.
Meanwhile, the European Union has sent millions of anti-radiation tablets to Ukraine so it can protect civilians living near the plant if an accident triggers the release of radiation.

When Amazon CEO Jeff Bezos decided to accuse David Pecker, the CEO of National Enquirer’s parent company, of blackmail on Thursday, he chose an interesting way to do it: a post on Medium.
Medium is a blogging media site founded by Evan Williams, one of the founders of Twitter. Bezos also tweeted about his blog post, to his 834,000 followers, so that’s a double score for technologies created by Williams and used by Bezos in this drama. (Just in case you haven’t been following closely: intimate photos and text messages between Bezos and the woman he was having an affair with were obtained by the Enquirer, which published some of the trove and threatened to publish others).See the rest of the story at Business Insider

The world was shocked by Chinese scientist He Jiankui’s recent claim that he’d brought to term twin babies whose genes — inheritable by their own potential descendants — he had modified as embryos. The genetic edit, He said, was meant to make the girls resistant to HIV infection.
Scientists within China and across the world responded to the announcement with a mixture of incredulity and alarm.See the rest of the story at Business Insider

The European Court of Human Rights (ECHR) is the latest to deem the UK government’s mass surveillance program unlawful. Judges ruled the “bulk interception regime” violated the right to privacy and freedom of expression. It said there was “insufficient oversight” over what communications UK agencies were collecting and also noted that there were “inadequate” safeguards for the protection of confidential journalistic sources.
A previous judgement from a 2016 UK tribunal also found British intelligence agencies GCHQ, MI5 and MI6 broke privacy rules by amassing large amounts of UK citizens’ data without proper oversight.
The ECHR judges wrote: “In view of the potential chilling effect that any perceived interference with the confidentiality of journalists’ communications and, in particular, their sources might have on the freedom of the press, the Court found that the bulk interception regime was also in violation of article 10.”
In the wake of Edward Snowden‘s revelations, three applications from Big Brother Watch, the Bureau of Investigative Journalism, Amnesty International and nine other human rights charities were joined together and lodged. They centred on complaints about powers given to security services under the Regulation of Investigatory Powers Act 2000 (RIPA) — which was later replaced with the Investigatory Powers Act (IPA) in November 2016. That bill has yet to come into effect — with the UK government currently redrafting it after it was deemed incompatible with EU law — and was therefore not considered in the court’s assessment.
The ECHR, however, diverged from the applicants over the issue of sharing intel with foreign governments, ruling that it did not violate either the right to a private and family life, or to free speech. A government spokesperson told The Independent it “will give careful consideration to the Court’s findings.”
In a statement, Big Brother Watch director Silkie Carlo called the decision a “landmark ruling”, while warning of the dangers posed by the incoming IPA. “This judgment is a vital step towards protecting millions of law-abiding citizens from unjustified intrusion. However, since the new Investigatory Powers Act arguably poses an ever greater threat to civil liberties, our work is far from over.”
Amnesty International also (cautiously) welcomed the judgement, writing that it “does have some room for improvement, as it does not go far enough in condemning bulk surveillance.” It continued: “[the ruling] permits national governments a “wide margin of appreciation” in deciding whether to engage in bulk interception and greenlights vast intelligence sharing with the US National Security Agency (NSA).”

Senate Democrats yesterday asked the Federal Communications Commission to investigate Verizon’s throttling of firefighters during California’s largest-ever wildfire.
US Sens. Dianne Feinstein (D-Calif.) and Kamala Harris (D-Calif.) also sent a letter to Verizon, accusing the carrier of misleading the fire department in its marketing of unlimited data. Additionally, the Democrats sent letters to the other major carriers asking for commitments that they won’t throttle the data of public safety officials while they are responding to emergencies.
Though FCC Chairman Ajit Pai eliminated net neutrality rules, the commission maintains a revised version of a transparency rule that requires carriers to publicly disclose enough information about network management practices and commercial terms of service “to enable consumers to make informed choices regarding the purchase and use of such services.”
]]>Richard Heffron III, 39, of Bath, Maine, was convicted last year for violating a protection order arising from abuse. He did so by posting messages on his Facebook page about his former girlfriend that he was forbidden by state law to contact. In fact, at the time when the threatening rants were posted, the female victim was no longer his Facebook friend and has blocked him from her page.
In Maine, just like in many other states in the US, a person may seek court protection to help stop domestic violence. A restraining order allows the protected person to ask for police intervention if the individual it targets tries to come near or communicate with them.
After Heffron’s posts popped up in the news flow of their shared Facebook friends, the ex-girlfriend reported it to the local police. The force then charged the 39-year-old with violating the court-mandated restriction. Heffron was then convicted by a local court last year and was sentenced to three weeks in jail and one-year probation.
He appealed the conviction on the grounds that his Facebook comments were free speech. Heffron argued that his social media posts did not constitute direct or indirect contact with the woman.
On Tuesday, the Maine Supreme Judicial Court rejected the appellant’s arguments. “The court correctly determined that Heffron’s communications with the protected person fell short of those that deserve constitutional protection,” Justice Jeffrey Hjelm wrote, noting that the conviction “did not place his First Amendment rights at risk.”
Commenting on the verdict, James Mason, Heffron’s attorney, expressed “disappointment”, noting that there was “no evidence” that his client “ever intended to have these comments reach” his former partner.
“It lets people know that they do need to be careful about what they post on the internet,” Mason said, according to AP. “It makes it clear that you have limited First Amendment protections on the internet, especially on Facebook.”

The Israeli Defence Forces (IDF) says it intercepted an Iranian-built drone launched from Syria by Hezbollah which illegally entered Israeli airspace on Tuesday.
IDF intelligence says the unmanned aerial vehicle was launched from Damascus Military Airport by Lebanon’s Hezbollah movement and infiltrated Israeli airspace over the Golan Heights.
BREAKING: A short while ago, the IAF intercepted a UAV that attempted to infiltrate Israeli airspace in the Golan Heights
— Israeli Air Force (@IAFsite) September 19, 2017
In a strongly-worded statement, a spokesman for the IDF said it will respond swiftly to any incursions on its airspace.
“Our message is that the IDF will not allow any violation of Israeli sovereignty,” said Lt. Col. Jonathan Conricus.
“We will not allow Iranian forces, Hezbollah, Islamic Jihad, or Shiite militias of any kind to approach Israel’s borders. We will defend our borders, and if any such attempts to violate our sovereignty will be made, we will respond swiftly.”
Israel views Hezbollah – which has a suspected arsenal of more than 100,000 rockets and thousands of fighters – as its one of its main threats.
The IDF says the drone was being used for a reconnaissance mission along the border and in the Golan Heights. The Israeli Air Force says it intercepted it in the demilitarized zone between Israel and Syria and shot it down using a Patriot missile.
The incident comes a day after the US opened its first official permanent military base in Israel. The move is being interpreted as an effort to send a message to Israel’s enemies.
In a speech at the official opening Maj. Gen. John Gronski, deputy commander of US Army National Guard in Europe, said the base “symbolizes the strong bond that exists between the United States and Israel.”
Earlier this month the Israeli army carried out its largest drill in 20 years, simulating a war with Hezbollah.

President Donald Trump will disregard the recent Senate bill imposing new sanctions on Russia because it violated the constitutional requirement that revenue legislation originate in the House of Representatives, the White House has said.
On June 15, the Senate voted 98-2 to impose new sanctions against Russia and codify the existing ones into law, in order to tie Trump’s hands when it came to the sanctions policy. In doing so, however, they apparently violated the origination clause of the US Constitution, which requires that any bill raising revenue originates in the House.
“There is no new bill at this time,” White House press secretary Sean Spicer told reporters on Monday, asking if they were referring to the bill that “the Senate parliamentarian ruled didn’t follow proper procedure.”
The Senate sanctions bill would have been a “significant shift of power” from the executive branch to Congress, in the words of Senator Bob Corker (R-Tennessee), chairman of the Senate Foreign Relations Committee. It targeted Russia’s energy sector, individuals accused of cyberattacks, and companies supplying arms to the Syrian government.
Though the Senate has been sharply divided along partisan lines, the sanctions bill received bipartisan support, with only Senators Rand Paul (R-Kentucky) and Bernie Sanders (I-Vermont) opposed.
The House is now looking into its own version of the bill, Spicer said, but declined to comment on what it might look like.
“When it comes to how the president works,” Spicer said, “he doesn’t telegraph what he’s going to do on a lot of these things.”
The question came in reference to several tweets by Trump on Monday morning, in which he blasted his predecessor Barack Obama for doing nothing about alleged Russian attempts to influence the 2016 presidential election because he thought that Democratic nominee Hillary Clinton would win.
The reason that President Obama did NOTHING about Russia after being notified by the CIA of meddling is that he expected Clinton would win..

…and did not want to “rock the boat.” He didn’t “choke,” he colluded or obstructed, and it did the Dems and Crooked Hillary no good.
— Donald J. Trump (@realDonaldTrump) June 26, 2017
“There is no collusion and no obstruction” involving the Trump campaign, the president said, adding, “I should be given [an] apology!”
During the campaign, Clinton accused Trump of being a Russian puppet. After losing the election in November, her campaign blamed alleged Russian interference, accusing Moscow of being behind the hacking and publication of emails from the Democratic National Committee and Clinton’s campaign chair John Podesta. The latter were published by WikiLeaks every day in the month preceding the election.
In January, the director of national intelligence published a joint report with the CIA and the NSA accusing Russia of “influencing” the election, but the declassified report contained no evidence to back those accusations up.

An independent investigation has found that White House social media director Dan Scavino violated federal law when he asked Trump supporters to help “defeat” a Republican congressman.
Scavino, who oversees President Donald Trump’s official social media accounts, violated a provision in the Hatch Act of 1939 when he posted a tweet calling on Trump supporters to defeat Representative Justin Amash (R-Michigan) in a primary election, the Office of Special Counsel (OSC) has concluded.
On April 1, Scavino tweeted from his personal account that Amash was “a big liability” and encouraged the #TrumpTrain to “defeat him in primary.”
Days later, the Citizens for Responsibility and Ethics in Washington (CREW) sent a letter to the OSC, requesting an investigation.
The Hatch Act prohibits federal employees from using their positions to publicly support or oppose political candidates.
On Friday, CREW published a letter from Ana Galindo-Marrone, chief of the OSC’s Hatch Act Unit, who “concluded that this activity violated the Hatch Act.”
“Accordingly, we issued Mr. Scavino a warning letter,” Galindo-Marrone stated in the June 5 letter. “In addition, we note that Mr. Scavino was recently counseled about the Hatch Act by the Office of the White House Counsel.”
Galindo-Marrone added that a review of Scavino’s Twitter account did not reveal any further violations since April 1. However, Galindo-Marrone warned that Scavino was advised that any further violation will be considered “to be a willful and knowing violation of the law.”
“The rules are clear that government officials aren’t allowed to use their position for campaign activity,” CREW Executive Director Noah Bookbinder said in a press release. “OSC has made clear with this ruling that they are going to enforce these important rules and work to keep the government free from inappropriate politics.”
As a leading member of the House Freedom Caucus, Amash helped derail Trump’s first attempt to repeal the Affordable Care Act, also known as Obamacare.
Trump lashed out at the Freedom Caucus on March 30, when he tweeted they will “hurt the entire Republican agenda if they don’t get on the team, & fast.”
The Freedom Caucus will hurt the entire Republican agenda if they don’t get on the team, & fast. We must fight them, & Dems, in 2018!
— Donald J. Trump (@realDonaldTrump) March 30, 2017
Amash responded at the time with a tweet from the Twitter account he uses for Congressional purposes.
“Bring it on. I’ll always stand up for liberty, the Constitution & Americans of every background,” Amash tweeted, including a link to donate to his campaign.

— Justin Amash (@justinamash) April 1, 2017
Bookbinder said Amash’s tweet was also a violation of the Hatch Act.
“In the case of Scavino and Amash, it appears that they both are in the wrong,” Bookbinder said, according to an April press release.
Government employees who violate the Hatch Act are subject to a wide range of penalties, according to the Office of Government Ethics, including “removal, reduction in grade, debarment from Federal employment for a period not to exceed 5 years, suspension, reprimand, or an assessment of a civil penalty not to exceed $ 1,000.”
