President Donald Trump’s choice of Sam Clovis to head the USDA’s top science post breaks with the US Code, according to the Union of Concerned Scientists. Clovis is a well-known skeptic of climate change and has no natural science degree.
Pending Senate confirmation, Clovis will be the next undersecretary for research, education and economics at the US Department of Agriculture, following an announcement from USDA Secretary Sonny Perdue late Wednesday.
Dr. Clovis is a 25-year Air Force veteran and former college professor. He has degrees in business, political science and public administration, and, as a conservative radio talk show host in Iowa, was an early advisor to President Donald Trump on the campaign trail.
His nomination had been expected, but that didn’t make it any less controversial.
The Union of Concerned Scientists, a non-profit science advocacy group, called the nomination “illegal” Thursday, citing the US Code description of the position.
US law states the appointed person shall be “from among distinguished scientists with specialized training or significant experience in agricultural research, education, and economics.”
“Clovis has no such training or experience,” the group said on their website, “and is therefore legally and scientifically unqualified to direct nearly $ 3 billion a year in research grants.”

During a run for the US Senate in 2014, Clovis told Iowa Public Radio that he was “extremely skeptical” of conclusions that climate change is primarily driven by human activity.
“I have looked at the science and I have enough of a science background to know when I’m being boofed,” he said.
USDA Secretary Perdue said in a statement accompanying the announcement of Clovis’s nomination that he “looks at every problem with a critical eye, relying on sound science and data, and will be the facilitator and integrator we need.”
The Union of Concerned Scientists urged Trump to rescind the nomination, but there was no word on any impending legal action if he did not.

Animal rights advocates are angry over the United States Department of Agriculture’s sudden decision to remove the publicly available results of inspection reports about animal treatment at research laboratories and private facilities. The agency says the data will only be available through Freedom of Information Act requests.
The USDA released a statement on Friday that points to court rulings and privacy laws as the reasoning for the removal of the reports and records of enforcement actions against violators of the Animal Welfare Act and the Horse Protection Act. “We remain equally committed to being transparent and responsive to our stakeholders’ informational needs, and maintaining the privacy rights of individuals with whom we come in contact,” the statement reads.
According to Science Magazine:
The reports apply to 7813 facilities that keep animals covered by the law. Roughly 1200 of these are research labs, which are often housed at major academic centers or run by government agencies themselves, including the National Institutes of Health, the Food and Drug Administration, and the Centers for Disease Control and Prevention. Although the act covers animals like dogs and chimpanzees, it does not cover rodents like laboratory mice.
USDA inspectors routinely visit facilities and upload inspection reports like this one to the agency website several months later. Labs, companies, and others covered by the act are also required to file annual censuses like this one cataloging the number and kinds of animals in their care.
Inspection reports contain little, if any, personal information about individuals.
Justin Goodman, director of the anti-animal research non-profit White Coat Waste Project in Washington DC, told Nature, “Claiming ‘privacy’ is a smokescreen to unjustifiably evade critical transparency about government operations.” He went on to tell Science, “[These are] basic data about animal use and compliance that taxpayers have a right to access, particularly when it comes to taxpayer-funded labs.” He also said that these reports were traditionally heavily redacted anyway.
USDA spokesperson Tanya Espinosa has not specified what private information is being protected with this move but said that it is the result of a year-long comprehensive review. Whether or not the decision specifically comes from the Trump administration is unclear. The new White House has come under criticism for removing information related to LGBTQ issues, civil rights and healthcare from its website. The administration has also reportedly begun removing climate change data from the EPA’s website.
Animal rights organizations as well as journalists have often used the database to track the treatment of animals buy private and government funded research labs, circuses and zoos.
In recent years, a 2012 Boston Globe article about Harvard’s primate research facility was sparked by information from the database. A 2014 article by the New Yorker explored the abuse of goats at a Santa Cruz Biotechnology company. In both cases, the facilities were subsequently shut down.
The general public has also used the database to find information about dog groomers’ and pet stores’ practices. Seven states have laws on the books that require pet stores to use the USDA information to evaluate puppy breeders. It’s unclear how the removal of the info will affect those laws.
The USDA’s spokesperson claimed that redacting all of their documents properly wouldn’t be possible. The statement does specify that, “If the same records are frequently requested via the Freedom of Information Act process, APHIS may post the appropriately redacted versions to its website.” FOIA requests can often take years to fulfill if they are approved.
The Human Society released a statement that made its position clear: “This action benefits no one, except facilities who have harmed animals and don’t want anyone to know.”

The USDA released somewhat startling data regarding the purchases made by Supplemental Nutrition Assistance Program, commonly referred to as food stamps, recipients. The study found that 20 percent of SNAP benefits were being used to purchase “junk foods” which include “sweetened beverages, desserts, salty snacks, candy and sugar.” The most popular junk item purchased with food stamps benefits was soda pop accounting for 5 percent of all food stamps transactions. Now many health organizations and states are asking for soda pop and junk foods to be restricted for recipients while soda manufacturers have banded together to oppose such restrictions.
The USDA report outlines exactly what is most likely in the carts of families who utilize the Supplemental Nutrition Assistance Program. Prior to this report, it was really unknown what individuals were purchasing with the program that has few guidelines outside of items needing to carry a nutritional label instead of a supplement label. However, the study has offered a rare look into the shopping carts of millions and showcased what many believe to be an underlying problem with obesity in America.

The report found that while the most money was spent on meat, poultry, and fish, the second biggest ticket item was soda pop. Soda accounted for 5 percent of total expenditures costing $ 608 million in SNAP charges. The New York Times reports that many feel that such a large chunk of money going to one industry is tantamount to a government subsidy and should be restricted.
Marion Nestle, a professor of nutrition, food studies, and public health at New York University, called the findings “shocking” claiming that we should consider the implications of the study as a whole.
“In this sense, SNAP is a multibillion-dollar taxpayer subsidy of the soda industry.”
The controversy over food stamp restrictions is not new. In fact, cities, states, medical groups, and nonprofit organizations have asked for the USDA to help improve the health of the 43 million poorest Americans in the country by restricting the purchase of junk foods with SNAP benefits. Despite the pleas, the USDA has long held the position that banning certain foods would be “unfair” to food stamps users and that it would cause too much red tapes for families that just need help with food purchases.

David Ludwig, the director of the New Balance Foundation Obesity Prevention Center at Boston Children’s Hospital, says he disagrees with the USDA claims noting that no one would suggest that people on food stamps shouldn’t be able to choose the foods they want to eat. However, he says something must be done about products that “undermine public health.”
“No one is suggesting poor people can’t choose what they want to eat. But we’re saying let’s not use government benefits to pay for foods that are demonstrably going to undermine public health.”
It should come as no surprise that the soda and candy industry are heavily opposing any restrictions on food stamp purchases when it comes to nutritionally controversial food items. In fact, the candy and beverage industries have banded together on the cause opposing any regulations that would restrict food purchase access to SNAP users.

While food stamp users do use a substantial amount of benefits on soda, Kevin Concannon, the U.S.D.A. under secretary for food, points out that soda consumption is high among those not on food stamps as well.
“Sweetened beverages are a common purchase in all households across America. This report raises a question for all households: Are we consuming too many sweetened beverages, period?”
So where do food stamps users stand in comparison to non-food stamps households in soda consumption? The study found that food stamps households purchased soda pop as the second most commonly purchased item just below meat and poultry, whereas, non-food stamp households placed soda pop fifth on the list behind meat, vegetables, cheese, and fruits.
