New court documents filed by special counsel Robert Mueller’s office and unsealed on Friday show that Paul Manafort made extensive edits to an op-ed written by a pro-Russia Ukrainian operative that painted a flattering picture of Manafort’s highly controversial lobbying work.
Mueller abruptly pulled out of a bail agreement his office had reached with Manafort’s legal team when one of his special agents, Brock Domin, discovered that Manafort had been helping to write an op-ed in violation of a court gag order.
Domin obtained an email from Manafort to his longtime associate Konstantin Kilimnik, a Russian-Ukrainian citizen believed to have ties to Russian intelligence. In that email “was a printed copy of the Microsoft Word file attached to Manafort’s e-mail, which contains the draft ‘op ed’ for Oleg Voloshin,” Domin wrote.
“The Microsoft Word document has red tracked changes, of which ‘paul manafort’ is listed as the electronic author.”
The author of the op-ed, which was published by the Kyiv Post on Thursday, was Oleg Voloshyn, a former spokesman for Ukraine’s ministry of foreign affairs under the pro-Russian president Viktor Yanukovych.
Voloshin initially told Bloomberg that Manafort had “absolutely nothing to do” with the article.
“It is totally mine,” he said. He added that he had written it because he was angry about a McClatchy report published late last month detailing Manafort’s many trips to Russia between 2005-2011, while he served as a top Yanukovych adviser.
“I was just annoyed at a McClatchy publication that falsely claimed Manafort had derailed Association Agreement with the European Union,” Voloshin said.
The court filings unsealed on Friday show that Manafort did more than just read the draft op-ed and fix typos: He inserted big-picture themes that portrayed him as having advised Yanukovych to befriend the west and move away from Russia.
“Also, during these early months, VY [Viktor Yanukovych] implemented other important policy changes that signaled he was serious about moving Ukraine into the western orbit,” Manafort wrote.
“HERE NEED TO ADD a couple of major reforms VY brought to country in order to position Ukraine to apply for membership,” he continued. “Reforms that changed a Soviet based legal economic framework to a western one (increase of NATO exercises/nuclear deal/”
He also added the line: “Even at the end of the process Manafort was engaged in helping the Europeans and the Ukrainians negotiate the final terms” of Ukraine’s prospective association agreement with the EU.
Manafort’s allies have insisted that his work in Ukraine was centered around drawing it closer to the West. But when Yanukoych was ousted in 2014 over his decision to derail the EU Association Agreement in favor of working more closely with Russia, Manafort continued to align himself with Yanukovych’s cronies. He helped form a political party, the Opposition Bloc, that was even more aligned with Russia than Yanukovych’s disbanded Party of Regions.
One of Manafort’s daughters, Andrea, went so far as to indicate in a text message that Manafort had advised Yanukovych to order the bloody crackdown on protesters in 2014.
“That money we have is blood money,” she wrote in a series of texts that were hacked and published online earlier this year. Her father confirmed to Politico that the texts were authentic.
“You know he has killed people in Ukraine? Knowingly,” she continued, according to the texts. “As a tactic to outrage the world and get focus on Ukraine.
The text exchange continued: “Remember when there were all those deaths taking place. A while back. About a year ago. Revolts and what not. Do you know whose strategy that was to cause that, to send those people out and get them slaughtered.”
Mueller’s office wrote in a court filing that they were asking the court to unseal the draft op-ed and Domin’s Declaration because it had already been published (Voloshin gave it to TPM earlier this week.)
“Because the op-ed has now been published, the reasons for sealing the declaration have been rendered moot, and we submit that public docketing of those materials is appropriated,” the government wrote. “Counsel for Manafort does not consent to the filing of the attached response and has not taken a position on the unsealing request.”
Mueller’s office also asked the court to deny Manafort’s request to modify his conditions of release from house arrest and GPS monitoring. The government pulled out of the modified bail agreement proposed last week when it learned that Manafort was still making changes to the op-ed as recently as November 30.
Manafort’s attorney argued on Thursday that Mueller was violating Manafort’s First Amendment “rights to defend himself and his reputation, and to correct the public record” by making edits to the op-ed.
The government wasn’t buying it.
“That is incorrect,” prosecutors wrote on Friday. “The ‘substantial [governmental] interest in preventing prejudice to an adjudicative proceeding’… does not disable a district court also from shielding against prejudice caused by ‘the creation of a ‘carnival atmosphere’ in high-profile cases,’ even when the defendant—rather than an attorney—is the one creating that atmosphere.”
They concluded that because Manafort’s conduct “raises serious concerns about his trustworthiness,” the court should deny the motion to release him from home confinement.
“Bail is fundamentally about trust,” they wrote.

There may be a Bill Ackman insider-trading trial on the way.
You may recall that investors in Allergan Pharmaceuticals are suing the billionaire hedge fund manager and Valeant Pharmaceuticals over their 2014 attempt to buy Allergan in a hostile takeover. These investors claim that they were kept in the dark as Ackman built his position in Allergan, and then collaborated with Valeant on an attempted hostile takeover of the company.
Ackman and Valeant wanted the case thrown out, but a California judge just denied the request, at least tentatively. That means, unless the judge changes his mind or the parties can come to a settlement outside of court, this matter will go to trial.
Pershing Square is not commenting on the matter.
Shareholders in Allergan, including the State Teachers Retirement System of Ohio, sued Ackman and Valeant on the basis of SEC Rule 14 e-3. Basically, it says if company A is planning to take over company B, anyone with knowledge of that takeover can’t trade company B shares once things are in motion.
And here’s the trade they’re applying it too — which was admittedly, even to observers at the time, pretty strange:
During the 2014 hostile takeover attempt, instead of buying Allergan outright, Valeant teamed up with Ackman, who purchased a large chunk of Allergan shares.
Ackman’s stake was disclosed alongside Valeant’s hostile takeover offer, and — surprise! — the billionaire said he would vote his newly acquired Allergan shares in support of the sale to Valeant.
Ackman then pulled out the activist-investor playbook to pressure Allergan to accept an offer from Valeant. He wrote nasty letters describing Allergan’s “incredibly inappropriate” behavior as it sought to fend off the takeover by a company that was known for slashing research-and-development spending and jacking up drug prices.
That didn’t work.
Allergan was eventually rescued by a white knight and Ackman — still an Allergan shareholder — made a bundle (about $ 2.6 billion by one count). Valeant profited a great deal too, because as part of its deal with Ackman meant it got a portion of his profits.
The rest is investment history. Ackman, who hadn’t invested in Valeant during the Allergan attempt, became one of its biggest shareholders. So Pershing Square was one of the worst hit when high-flying Valeant collapsed 90% from 2015 to 2016 after fraud was discovered at the company.
Ackman has since left Valeant. Valeant itself has stabilized. But this case remains the way Ackman and Valeant could still see all their gains washed away

Verizon is disconnecting another 8,500 rural customers from its wireless network, saying that roaming charges have made certain customer accounts unprofitable for the carrier.
The 8,500 customers have 19,000 lines and live in 13 states (Alaska, Idaho, Iowa, Indiana, Kentucky, Maine, Michigan, Missouri, Montana, North Carolina, Oklahoma, Utah, and Wisconsin), a Verizon Wireless spokesperson told Ars today. They received notices of disconnection this month and will lose access to Verizon service on October 17.
“These customers live outside of areas where Verizon operates our own network,” Verizon said. “Many of the affected consumer lines use a substantial amount of data while roaming on other providers’ networks and the roaming costs generated by these lines exceed what these consumers pay us each month.”

Do e-cigarettes help smokers quit or glorify a potentially unhealthy habit?
Public health experts are divided on the question, but a new study is the first of its kind to suggest that for some people, the devices could help more than they hurt.
The paper, published in the journal Addictive Behaviors, looks at how patterns of quitting smoking have changed across America since e-cigarettes — devices that vaporize liquid nicotine rather than burning tobacco and creating tar — were introduced in 2010.
Researchers at Columbia University and Rutgers University looked at two years of data from an annual, nationwide household survey and homed in on two groups of people: current smokers and former smokers who quit during or before 2010, the year e-cigarettes were introduced.
Among the roughly 15,500 adults the researchers looked at, those who said they used e-cigs daily were far more likely to have quit regular cigarettes than the people who said they’d never tried e-cigs. In fact, over half of daily e-cigarette users had quit smoking in the past five years, compared to just 28% of those who had never tried them.
Looked at another way, the single strongest predictor of someone in the survey having quit smoking was daily e-cigarette use.
“Our findings suggest that frequent e-cigarette use may play an important role in cessation or relapse prevention for some smokers,” Daniel Giovenco, an assistant professor of sociomedical sciences at Columbia University’s Mailman School of Public Health and the lead study author, said in a statement.
The study builds on previous observational research suggesting that e-cigs could help smokers quit. A large study of 160,000 people spanning more than 15 years and published in the journal BMJ in July last year suggested that smokers who used e-cigarettes not only tried to stop smoking more frequently but also succeeded (for at least a few months) more often than those who didn’t use them.
Still, these studies are observational and have limitations. Because observational studies look at groups of people and their behavior over time, it’s hard to say for sure that other conflicting factors aren’t influencing the outcomes they examine. It’s also worth pointing out that the study didn’t address whether e-cigs might appeal to people who would otherwise not smoke or vape at all.
Plus, e-cigs aren’t risk-free: some of the devices have been found to contain ingredients like diethylene glycol (used in antifreeze) as well as formaldehyde, both of which have been linked with cancer. Studies also suggest that frequent e-cig use could raise your risk of heart disease.
This is why researchers emphasize that more studies are needed — preferably studies that explore details about the kinds of e-cig devices people are using as well as why and how frequently they use them.
“Uncovering patterns of use at the population level is a critical first step in determining if [e-cigarettes] may present any benefits to public health,” said Giovenco.

The White House released a broad set of financial disclosures that showed the assets for as many as 180 senior officials on Friday evening.
The information outlines the sizable wealth of many members of the Trump administration which closes in on a cumulative $ 12 billion, according to a December Bloomberg report.
Officials including White House chief strategist Steve Bannon, and advisers Jared Kushner and Reince Priebus listed assets they held at the time they began working for the government, a little more than two months ago. Since then, staffers may have divested from some of those assets, resigned from prior jobs, or recused themselves from holdings that may potentially create conflicts of interest.
Here’s a look at what the Trump administration’s financial disclosures show, based on data gathered at the time they entered public service.

Steve Bannon, the White House chief strategist and perhaps its most controversial figure, appeared to be among the wealthiest in the Trump administration.
According to The New York Times, Bannon’s biggest asset is a private consulting business that received income from multiple investments valued between $ 5 million and $ 25 million.

Reince Priebus, the White House’s chief of staff, reportedly earned $ 225,000 in salary and $ 100,000 in bonuses from the Republican National Committee in 2016.
On top of this salary, a significant portion of his earnings came about after a $ 450,000 equity buyout from his law firm.

]]>Sears revealed “substantial doubt” about its ability to stay in business in an annual report filed late Tuesday.
“Our historical operating results indicate substantial doubt exists related to the company’s ability to continue as a going concern,” the company said in the report.
“Going concern” refers to a company’s ability to stay in business.
Sears said its efforts to generate cash by selling or licensing brands like Kenmore and Diehard, as well as selling valuable real estate, should mitigate that doubt and satisfy its estimated cash needs for the next 12 months.
But the company said it can’t make any guarantees.
“However, we cannot predict, with certainty, the outcome of our actions to generate liquidity, including the availability of additional debt financing, or whether such actions would generate the expected liquidity as currently planned,” the report said.
To be sure, the going concern statement appeared in the “Risk Factors” section of Sear’s annual report — a place where companies often lay out worst case scenarios — but Sears and Kmart have been bleeding cash for years.
The company’s annual revenues have dropped nearly 40% since 2013 to $ 22 billion last year. Its losses grew nearly 5% to $ 607 million in the most recent quarter, and same-store sales, or sales at stores open at least a year, fell 10.3%.
To raise money and stay in business, Sears has been selling off real estate and brands like Craftsmen.
But the company warned that it may be at the end of its rope in terms of acquiring additional liquidity.
“If we continue to experience operating losses and we are not able to generate additional liquidity through the mechanisms described above or through some combination of other actions, we may not be able to access additional funds under our domestic credit facility and we might need to secure additional sources of funds, which may or may not be available to us, the company said. “Additionally, a failure to generate additional liquidity could negatively impact our access to inventory or services that are important to the operation of our business.”
