WASHINGTON (AP) — Neil Gorsuch became the Supreme Court’s newest member a year ago this Tuesday. President Donald Trump’s pick for the high court, its 113th justice, has now heard more than 60 cases on issues including gerrymandering, fees paid to unions and the privacy of certain cellphone records.
It’s generally unwise to predict anything about a justice so early into his or her tenure, with few opinions written and votes in a small number of cases. But so far Gorsuch has been what Republicans believed and hoped he would be — a reliably conservative vote.See the rest of the story at Business Insider

Enlarge / U-35 under construction at Kiel in 2013. The sub—like all the others in Germany’s fleet—is currently in for repairs. (credit: Bjoertvedt )
Germany has a submarine problem. During a test dive in October, the Deutsche Marine’s U-35 struck something (probably a rock) with one of its four “X-rudders,” the steering planes on its rear fins. The damage required the submarine to be towed back to a shipyard in Kiel for repairs—where it joined three other German navy submarines currently drydocked. The U-35 was the Deutsche Marine’s only working submarine prior to the collision. The remainder of the German submarine fleet is in port at the German naval base in Eckernförde—waiting for dry docks in Kiel to open up.
Germany has a total of six submarines, all of the Type 212 class. These “hybrid” subs—also operated by the Italian navy—are powered by a combination of a diesel engine and nine proton exchange membrane (PEM) fuel cells. They are among the quietest, most advanced non-nuclear submarines in the world. Because their fuel cells are “air independent propulsion” (AIP), these subs can operate submerged for weeks without surfacing. And since the PEM cell “engines” have no moving parts other than the electrically powered screws, they’re incredibly stealthy when submerged. They can also operate in waters as shallow as 17 meters deep (55 feet), making them ideal for patrolling the waters of the Baltic.
But because of backlogs in repairs and a series of unfortunate events, only two of the Type 212 class are not currently under repairs—and they are not ready for active service:
]]>British submarines could face the same fate as Argentina’s lost ARA ‘San Juan’. In his damning 2015 expose on failures aboard Trident, Royal Navy whistleblower William McNeilly warned UK subs share the same faults as the missing vessel.
According to Argentinian media, the final message from the missing submarine was received on November 15. The distress signal said that seawater had entered the ventilation system, causing a battery on the diesel-electric submarine to short-circuit and spark a fire. Forty-four crew members were on board with only an estimated 10 days’ worth of oxygen. The submarine has not been recovered.
In March 2015, naval engineer McNeilly leaked a dossier to WikiLeaks detailing severe safety and security failures aboard the UK’s Trident nuclear-armed submarines and at their base at Faslane in Scotland. He was dishonorably discharged and narrowly avoided criminal prosecution.
In the report – under the heading ‘disaster waiting to happen’ – McNeilly detailed the structural and mechanical failings of the UK submarines; failings that could lead to the same outcome as the lost ARA ‘San Juan’. “I literally warned about water in DC (Direct Current) compartments causing fires and being likely to sink a submarine, a couple of years before submarine ARA ‘San Juan’ made its final call,” he told RT.
McNeilly’s report details a conversation he had with a SWS Navigation Supervisor, recounting a story spookily similar to what is believed to have happened on the missing Argentine submarine. “I got him to tell me about his experiences onboard. He [said he] has experienced four floods and fires onboard,” McNeilly said in his report. “He told me the worst was a flood in the DC equipment space. The whole back section was submerged in electrified water, from the 10 [kilowatt] motor generators.”
According to McNeilly, if naval officers had followed official protocol they would have wound up at the bottom of the ocean, lost forever. “[The SWS Navigation Supervisor] said they were lucky they didn’t follow the normal emergency operating procedure for that incident,” he said. “Due to where the flood was coming from, if they had followed the normal procedure the submarine would’ve been lost.”
The UK’s Trident subs could easily become death traps for British crewmen if McNeilly’s report is to be believed. The whistleblower detailed the severe structural failings of the Trident vessels, warning that above-acceptable levels of condensation could have deadly consequences.
“There was water dripping from the roof onto all sorts of electrics. They told me that there’s a problem with the system and the condensation levels are 15 percent higher than they should be at,” said McNeilly. “I then told them ‘there’s a pump in AMS1 that sprays water on an electrical distribution box.’ One of them said ‘that’s a bit of a design flaw.’ They laughed and changed the subject.”
When the report was initially published, the Royal Navy tried to discredit the former weapons engineer, dismissing the report as utter nonsense. Over the years, claims made in McNeilly’s exposé have been repeatedly proven correct. The UK government has not acted on his warnings.
“The world has seen my warnings about submarine hazards,” McNeilly told RT. “They refused to listen. Now they see the consequences of being ignorant.”

The seven satellite calls recently detected by Argentine officials searching for the missing submarine, the ARA San Juan, have not helped determine the vessel’s location. The signals were “intermittent and weak,” naval commander Gabriel Galeazzi said, as cited by Reuters, and “could not help determine a point on the map to help the search.” The failed calls, lasting from four to 36 seconds, were detected on Saturday, but it remains unclear when they were made. US satellite company Iridium Communications, whose device is on board the sub, has said the calls from it were made Wednesday. However, it is possible that the vessel had another company’s equipment on board. The San Juan went missing on Wednesday, and an extensive search operation off Argentina’s coast has been under way since.

Microsoft announced today that it’s getting out of the online music business. Music purchases in the Windows Store will cease, and the Groove Music Pass subscription service is also ending.
The company says that it will continue to develop the Groove Music app (formerly known as Xbox Music) for playing local and owned music (including files stored on OneDrive), but the music subscription capabilities will be removed from the app.
Existing Music Pass subscribers will be able to migrate their playlists and collections to Spotify in app updates that are going to become broadly available on October 9. Users will have until January 31, 2018 to migrate. Owned music bought from the store will also have to be downloaded (and backed up!) by that date.
]]>A joint Russian-Chinese naval force of more than a dozen military vessels, including submarines, will participate in the upcoming second stage of the Joint Sea-2017 naval drills in the Sea of Japan and Okhotsk.
The drills will kick off Monday and continue for a week, according to the spokesman for Russia’s Pacific Fleet, Vladimir Matveev.
“The second stage of the Russian-Chinese naval exercise Joint Sea-2017 will involve 11 surface vessels, two submarines, four deep-submersible rescue vehicles, four anti-submarine planes and four deck helicopters,” Matveev told reporters Friday.
The Russian Pacific Fleet is represented by the large anti-submarine ship Admiral Tributs, cutting-edge modern corvette Sovershenny, the rescue vessel Igor Belousov equipped with deep-submersible rescue apparatus AS-40, two diesel submarines and a number of support ships. China rolled out the destroyer Shijiazhuang, the frigate Daqing, the submarine support ship Changdao with deep-submersible rescue vehicle Elar-7.
The drills will consist of two parts – on land and sea. Russian and Chinese marines will be training together at the Gornostay test grounds near Russia’s Far Eastern city of Vladivostok. The second part will be naval, taking place in the waters of the Sea of Japan and Okhotsk.
The first stage of the drills, aimed at furthering cooperation between the two fleets in countering security threats at sea, took place in July in the Baltic.
“This is the first visit of the Chinese fleet to Baltiysk in the history of the Russian-Chinese relations,” Russian Baltic Fleet spokesman Roman Martov said at the time.
The drills have been held regularly since 2012, and their goal is improving security in the world’s oceans, as well as strengthening cooperation between the navies of the two countries.

The Confederate submarine CSS H. L. Hunley bears the distinction of being the first submarine to ever sink an enemy ship. But the Hunley, a work of state-of-the-art engineering for its time, never returned from that mission on February 17, 1864. Instead, after exploding a “torpedo” below the waterline of the Union sloop-of-war USS Housatonic in Charleston Harbor, the sub was lost at sea.
Just how the sub was lost had been a mystery for over a century. The Hunley would not be found again until it was discovered on the floor of Charleston Bay in 1995. The sub was recovered five years later—largely intact, with the remains of its crew all at their stations. Based on the findings of Clemson University archaeologists who examined and restored the sub, it did not appear any attempt was made by the crew to escape.

British Defence Secretary Michael Fallon insists he has “complete confidence” in the safety of Britain’s nuclear submarines, but refused to deny that they run on the Windows XP operating system that has been exploited in a major global cyberattack.
Since Britain’s National Health Service (NHS) was walloped by the WannaCry ransomware, fears have arisen that the country’s military could also be susceptible because of its outdated computer systems.
Friday’s attack affected 48 NHS trusts, forcing doctors unable to access patient files to cancel operations, and ambulances to divert to hospitals where systems were not down.
The Guardian reported last year that the UK’s Trident nuclear program operates on a variant of Windows XP, which has been at the center of the global ransomware outbreak.
Speaking to BBC’s The Andrew Marr Show on Sunday, Fallon was asked if Trident nuclear submarines still run on XP, which Microsoft has stopped supporting.
“We never comment on the different systems, obviously for reasons of security, that our submarines use,” Fallon explained. “Our vanguard submarines, I can absolutely assure you, are safe and operate in isolation when they are out on patrol and I have complete confidence in our nuclear deterrent,” he said.

When Marr asked: “So there is no possibility of a malware attack against the military as we’ve seen against the NHS?” Fallon only provided a partial answer, focusing on the Trident system instead of the military as a whole. “I can assure you the nuclear deterrent is fully protected,” he said.
Although Microsoft stopped supporting its XP, Office 2003, and Exchange 2003 systems in 2014, the US Navy signed a contract with the company in 2015 to extend maintenance of the largely defunct operating systems. A US government tender said the $ 9.1 million deal was struck to give the Navy “time to migrate from its existing reliance on the expiring product versions.”
Marr also questioned the defence secretary on comments he had previously made suggesting that Britain would launch a “strike first” using nuclear weapons on an enemy.
“The key to the nuclear deterrent is to leave uncertainty in the mind of any potential adversary,” Fallon explained. “If he’s looking at a country to attack as to what kind of response he can expect – it’s to leave ambiguity in the mind of your enemies. That’s why we never rule out whether we would apply first or not,” he said.
