SITTING in his office in the Wrigley Building overlooking the Chicago river in 2012, Richard Sandor, who has spent his career inventing financial products, was reading about the scandals surrounding the London Interbank Offered Rate (LIBOR), an array of interest rates set daily by a club of banks in Britain and used to price trillions of dollars’ worth of loans, derivatives and more. “This is stupid,” Mr Sandor recalls saying to a colleague. “Let’s make a bet; LIBOR will lose its pre-eminence.”

Two years later the Federal Reserve reached the same conclusion. It formed a group, the Alternative Rate Reference Committee, which has created a new benchmark dollar interest rate, the Secured Overnight Financing Rate (SOFR). Since April, SOFR has been used for a handful of bond offerings by large institutions including the World Bank, MetLife and Fannie Mae. Central banks in Britain, the euro zone, Japan and Switzerland are also constructing new benchmark rates.

The measure is reportedly aimed at preventing the Russian state-run company from seizing nearly half of the Texas-based refiner in case of a complete default by its current owner, Venezuela’s state oil corporation PDVSA. The near-50 percent share was offered to the Russian oil major as collateral for a $ 1.5 billion loan in 2016. The remaining 50.1 percent of shares in the US refinery is collateral to holders of PDVSA’s 2020 bond.

Citgo reportedly refines nearly 749,000 barrels per day. The company owns nine pipelines and 48 petroleum storage terminals, located from Texas to Maine. Launched in 1910 by an Oklahoma businessman, Citgo was bought by PDVSA in 1990.

The investors have applied for a license from the US Treasury’s Office of Foreign Assets Control (OFAC), the agency quotes one of the initiators as saying. The request was reportedly submitted in early October and has already received technical approval. The group is said to be waiting for a response from the President’s administration.

“The administration should recognize that if it doesn’t do something pro-active here, it will face limited options under almost any scenario, whether it is an attempt to foreclose by the current lienholder, further restrictions on Venezuelan crude oil imports into the US, or even in the event there is a positive political change in Caracas,” said the unnamed investor. “This is a private sector solution to a public policy problem.”

Washington had initially sounded the alarm over the issue in April 2017, when several Congressmen warned the White House of an imminent risk connected to the probable takeover of Citgo by the Russian firm, which is currently under US sanctions. Head of Rosneft Igor Sechin said at the time that the company had no plans to take control of the refinery. Rosneft had reportedly invested in some oil enterprises in Venezuela, owning up to 40 percent stakes in five joint ventures in the country.

  • While Republicans are still arguing over details, it appears they have enough votes.

The final vote on the massive Senate Republican tax bill is fast approaching on Friday as GOP leaders scrambled to make last-minute changes to their bill, a somewhat final version of which emerged in the early evening.

Republicans appear to have the votes to pass the TCJA, but the situation is still fluid. Sen. John Cornyn, the second-ranking Senate Republican, said Friday morning that Republicans had enough votes to pass it. Sen. Bob Corker, a Republican holdout on the TCJA, said the bill would likely get through with or without his vote.

“I realize that there’s probably enough votes right now to pass it,” Corker told reporters.

Senate Majority Leader Mitch McConnell has attempted to appease deficit hawks, moderates, and members concerned about small business, all while keeping the TCJA within Senate rules.

The last-minute changes continued into Friday evening, as Republicans have yet to file the final version of their bill. The vote on Friday would come just three weeks after the bill, the Tax Cuts and Jobs Act (TCJA), was introduced.

8:37 pm: Marco Rubio makes a final pitch for his change to the child tax credit.

Sen. Marco Rubio took to the Senate floor to make the case for his amendment that would make the child tax credit refundable up to the amount of payroll taxes, making the credit more generous.

To pay for the change, Rubio wants to cut the corporate rate to 20.94% instead of the 20% proposed in the Republican bill. The TCJA already proposes to increase the credit to $ 2,000 from $ 1,000 under current law.

There was a possibility that Democrats could support the amendment, also backed by GOP Sen. Mike Lee. But Democratic Sen. Sherrod Brown later said on the floor that bipartisan talks broke down because the Rubio amendment would only be temporary.

In a sample provided to Business Insider, the final version of the bill has numerous handwritten notes in the margin of pages. A few pages were even crossed out with a pen.

Democratic lawmakers are complaining about what they say is unreadable handwriting on Twitter.

“Trying to review the #GOPTaxScam but they are making hand-written changes to brand new text as we speak – can anyone else read this?” Sen. Dick Durbin tweeted.

6:00: An amendment to the tax bill could give big breaks to large partnership firms.

An amendment introduced by Sen. John Cornyn would allow publicly traded partnerships (PTPs) to take the pass-through business deduction. According to Victor Fleischer, a tax-law professor at the University of San Diego, this could apply to some private equity firms but an aide to Cornyn denied that this would benefit those firms.

Additionally, energy master limited partnerships could also be able to take the deduction according to Fleischer. Many MLPs are based in Cornyn’s home state of Texas.
