Stockholm is becoming a sanctuary for the rich https://briefnews.eu/stockholm-is-becoming-a-sanctuary-for-the-rich/ https://briefnews.eu/stockholm-is-becoming-a-sanctuary-for-the-rich/#respond Wed, 01 Nov 2017 18:56:35 +0000 http://briefnews.eu/stockholm-is-becoming-a-sanctuary-for-the-rich/ stockholmChris Jackson/Getty Images

  • Stockholm’s rent prices have skyrocketed in the last decade because of its new status as a tech city.
  • IKEA property developer Jonas Spangenberg is worried that there is a shortage of affordable housing.
  • Sweden is unlike its neighbor, Finland, which has fixed prices in its municipalities in order to help apartment renters.

It’s no news that Stockholm’s housing market has gone bananas: After Toronto, the Swedish capital faces the world’s highest risk of being in a housing bubble, according to UBS. Apartment prices have more than doubled in the past decade, even despite historic levels of new construction.

No surprise then, that the land under the new flats gets expensive too. But in the last 12 months, land prices have all but lost touch with reality in Stockholm.

“With these land prices, you won’t get any apartments that normal people could afford,” says Jonas Spangenberg, CEO of Boklok, a property development joint venture between Ikea and Swedish construction firm Skanska, to Dagens Industri.

People sitting at the docks in Stockholm, Sweden.Tommie Hansen/FlickrFor the biggest seller of all, the municipality of Stockholm, its good news: revenues from land sales have in the last three years gone from $ 30 million (SEK 255 million) to $ 500 million (SEK 4,2 billion), a growth of 1500 percent, reports Di.

Spangenberg believes this results in Stockholm becoming a sanctuary only for the rich.

This graph, by Nordic banking group Nordea, shows how real estate prices have developed in Stockholm since 1875 (notice the spike). This price surge is now being felt in the land purchase business. Tweet by Chief analyst Nordea Markets, Anders Wallström.

Jonas Spangenberg is worried the sky-high land prices will create an acute shortage of cheap housing in the Swedish capital, and that “in the longer term, the municipality will lose its competitiveness, when large groups of people [are excluded],” the Boklok CEO says.

Boklok, founded in the 90s as a joint venture between Ikea and Skanska, develops sustainable housing concepts. The company builds around 1000 new housing units per year across the Nordics. Boklok says it abstainins from building apartments in Stockholm, in favor of cheaper municipalities.

According to Håkan Falk, in charge of property development at the City of Stockholm, the land price surge
is the result of a general spike in housing prices — and growing interest in the city’s land. Di speculates that new developers, keen on getting new projects in the portfolios, have contributed to a “full-blown speculative bubble”.

“There are many players who I have never heard of. I have not the slightest idea who they are,” says Johan Skoglund, the CEO of property developer JM, to Di.

The open bidding model of Stockholm stands in stark contrast to Finland’s, where many municipalities set a fixed price on land. In this model, those developers who are able to offer the cheapest living prices for apartment buyers, win.

In central Stockholm, a square meter of land intended for high-rise flats now costs around $ 4750, according to Di. In, Helsinki, Finland, prices range between $ 500 and $ 2900, according to Rakennuslehti.

The list envisions transforming the Green Card system, beefing up border security and facilitating deportations.

The measures on the list released by the White House late Sunday are necessary to compensate for damages that would be inflicted by the Deferred Action for Childhood Arrivals (DACA) program, if it is to stay intact, according to White House legislative affairs director Marc Short.

“These priorities are essential to mitigate the legal and economic consequences of any grants or status to DACA recipients,” Short said.

The plan calls for funds for the construction of President Trump’s Mexico border wall, and would allow the deportation of unaccompanied children arriving illegally in the US, impose more rigorous checks on asylum applicants, make it harder for gang members to sneak into the US and ensure swift removal of all immigration offenders, with a particular focus on visa overstayers. The latter are considered the main source of undocumented immigrants in the US, according to the report by Center for Migration Studies.

The legislation, if passed, would also see a crackdown on sanctuary cities, which would be banned from receiving any grants provided the US Departments of Justice and Homeland Security.

The number of Immigration and Customs Enforcement (ICE) officers will rise by 10,000, in addition to the current 20,000, and an extra 300 federal prosecutors will be hired to tackle the immigration challenge, according to the document, which calls the existing number of staffers “grossly inadequate.”

‘Anathema to Dreamers’

The plan did not sit well with the Democrats, who slammed it for being extremely severe on immigrants and not allowing any room for compromise.

“The administration can’t be serious about compromise or helping the Dreamers if they begin with a list that is anathema to the Dreamers, to the immigrant community and to the vast majority of Americans,” House Democratic leader Nancy Pelosi and Senate Democratic leader Chuck Schumer said in a joint statement, calling the demands “far beyond what is reasonable.”

The term Dreamers refers to undocumented migrants who were brought to the US as children.

The Congressional Hispanic Caucus (CHC), consisting of Congressional Democrats of Hispanic origin, decried the newly-unveiled immigration principles as “draconian and anti-immigrant.”

Trump has recently announced his intent to repeal DACA, which protects “Dreamers,” by March 2018, while giving Democrat lawmakers six months to pass a law that would regulate the status of the recipients, some 800,000 people who were granted protection from deportation by President Barack Obama’s executive action in 2012.

Trump’s decision was met with protests, with several Democratic-led states threatening to sue the president.

The Department of Homeland Security’s Immigration and Customs Enforcement agency rebuked Gov. Jerry Brown, D-Calif., on Friday for enacting a statewide sanctuary law for illegal immigrants, and said the decision will prompt a higher number of raids that target that population.

“Governor Jerry Brown’s decision to sign SB54 and make California a sanctuary state for illegal aliens – including those who have committed crimes – will undermine public safety and hinder ICE from performing its federally mandated mission. The governor is simply wrong when he claims otherwise,” acting ICE Director Tom Homan said in a statement.

“ICE will have no choice but to conduct at-large arrests in local neighborhoods and at worksites, which will inevitably result in additional collateral arrests, instead of focusing on arrests at jails and prisons where transfers are safer for ICE officers and the community,” Homan added. “ICE will also likely have to detain individuals arrested in California in detention facilities outside of the state, far from any family they may have in California.”

The new state law was signed into law Thursday and prevents law enforcement in any jurisdiction of the state from asking people about their immigration status. It also prohibits state and local officers from responding to ICE requests to detain an illegal immigrant who has been arrested for committing a crime for 48 hours until the person can be transferred into federal custody.

“It also bans unconstitutional detainer requests and prohibits the commandeering of local officials to do the work of immigration agents,” Brown wrote in a statement about the California Values Act.

However, Homan said the decision will “negatively impact” the agency’s operations in the state to such an extent that ICE may incidentally arrest others who would not initially be targeted as they conduct enforcement operations of criminal and noncriminal illegal immigrants.

“Despite the severe challenges that this law creates for ICE, we remain committed to our public safety mission and we will continue to do our sworn duty to seek out dangerous criminal aliens and other immigration violators. ICE seeks straightforward cooperation with all sheriffs and local elected officials. This misguided legislation will severely undermine those efforts,” Homan added.

The Trump administration warned against the first-of-its-kind law, but the trendsetting state may have a national impact.

Beginning in January, Senate Bill 54, dubbed the California Values Act, will prohibit local law enforcement from asking about immigration status “during routine interactions” or complying with “unconstitutional” detainer requests from federal immigration officers.

In a signing statement accompanying the bill, Brown explained that the bill also prohibits the federal government from using local authorities “to do the work of immigration agents.”

Law enforcement officers will also be prohibited from detaining an individual on a hold request from the federal government unless there is a felony or warrant, or they have been convicted of one of 800 crimes listed in the state’s TRUST Act.

Additionally, officers will be prohibited from arresting an individual solely based on a civil immigration warrant, becoming deputized as immigration agents, or participating in joint task forces with the federal government if the primary purpose is immigration enforcement.

Last month, US Attorney General Jeff Sessions publicly urged Brown to veto the bill, calling it “unconscionable.” Sessions and other officials with the Trump administration have come out against “sanctuary jurisdictions,” citing a connection between illegal immigrants and increases in violent crime.

This is not the first time the nation’s most populous state has defied the federal government. In 1996, California became the first US state to legalize medical marijuana. Since then, 29 states and the District of Columbia have passed laws legalizing marijuana in some form.

READ MORE: California bill to create sanctuary state passes key legislative hurdle

Legislators in 15 states and the District of Columbia have introduced similar immigration “sanctuary” bills in 2017, while another 33 states are considering legislation to prohibit them, according to the National Conference of State Legislators.

“Sanctuary policies endanger us all, and especially the federal immigration officers who are forced to pursue criminal aliens outside of jails and prisons,” Sessions said in a speech to federal law enforcement officials in September.

Sessions has threatened to withhold federal grants to “sanctuary jurisdictions” that do not allow federal immigration authorities access to local jails and give the Department 48 hours notice before releasing anyone wanted for immigration violations. That policy was temporarily blocked by a federal judge after being challenged by the city of Chicago, Illinois.

However, Brown said that the bill does not “prevent or prohibit Immigration and Customs Enforcement or the Department of Homeland Security from doing their own work in any way.”

Federal immigration officers are “free to use their own considerable resources” when enforcing federal law in the state. Brown also said that the bill does not prohibit local sheriffs from cooperating with deportation proceedings from federal immigration officers or letting them into their jails to conduct interviews.

“These are uncertain times for undocumented Californians and their families, and this bill strikes a balance that will protect public safety, while bringing a measure of comfort to those families who are now living in fear every day,” Brown wrote in his signing message.

In the weeks after the November 2016 presidential election, California Senate President Pro Tem Kevin de Leon introduced Senate Bill 54 as a direct response to President Donald Trump’s campaign policies on immigration.

“We will not stand idly by as President Trump and Attorney General Jeff Sessions seek to divide this nation by scapegoating honest, hardworking families and casting immigrants as threats to be neutralized,” de Leon said in a statement following Brown’s signing.

Asked for a comment about the bill, White House Press Secretary Sarah Huckabee Sanders said the Trump administration is “spending every day we can trying to find the best way forward.”

“The President will be laying out his responsible immigration plan over the next week,” Huckabee Sanders said at Thursday’s press briefing. “And I hope that California will push back on their governor’s, I think, irresponsible decision moving forward.”

More than 10 million immigrants live in California, more than any other state in the US, according to the American Immigration Council.

There are an estimated 2.3 million undocumented immigrants living in the state, according to the Public Policy Institute of California (PPIC), a nonprofit, nonpartisan think tank.

Brown also signed 10 other immigration bills on Thursday, meant to “enhance housing, school, workplace and civil protections for California’s immigrants.”

The other bills prohibit landlords from reporting their undocumented tenants, ban employers from authorizing federal immigration raids at the workplace, and allow students whose parents were deported to continue attending California schools.

“This action protects public safety and ensures hard-working people who contribute to our state are respected,” Brown said in a statement.

Since Trump was elected US president, there have been three different ballot initiatives that would require the state Legislature to ask Congress for a federal constitutional convention in order to make California an independent state. The measure, known as “Calexit,” gained support from one-third of residents in the Golden State, according to a Reuters/Ipsos opinion poll in January.

A U.S. district judge struck down a lawsuit Wednesday filed by Texas Attorney General Ken Paxton to enforce the state’s recently-passed ban on sanctuary cities.

The Attorney General filed the suit in anticipation of push back after Republican Gov. Greg Abbott signed the sanctuary city ban in May. While Judge Sam Sparks dismissed the lawsuit Wednesday, it is not an end to the issue, as another lawsuit filed in June by the city of San Antonio will now take center stage on the question of the ban’s constitutionality, The Texas Tribune reported Wednesday.

“We were first to file a lawsuit concerning SB 4, filed this case in the only proper court, and moved quickly to consolidate other lawsuits against SB 4 in Austin,” Paxton said in a statement. “The health, safety, and welfare of Texans is not negotiable. We’re disappointed with the court’s ruling and look forward to pressing our winning arguments in the San Antonio cases and beyond (if necessary) on this undoubtedly constitutional law.”

Spark’s ruling essentially determines that the question of the ban’s constitutionality will be decided by San Antonio’s lawsuit rather than the state government’s. But the question being considered is the same: whether cities have the right to direct local officers against working with federal immigration officials.

U.S. District Judge Orlando Garcia presides over the cities’ lawsuit. He held a seven-hour hearing June 26, but has yet to issue a ruling.

San Antonio City Councilman Rey Saldana announced the city’s lawsuit without a vote from the city council in June, and a slew of other Texas sanctuary cities have joined the lawsuit since. Saldana, who has praised his father for immigrating to the U.S. illegally, filed the suit with the Mexican American Legal Defense And Education Fund (MALDEF).

A MALDEF spokesperson called the law “hateful” and “misguided,” arguing the city’s “loss of control” over its police department would result in residents being asked about their immigration status, which MALDEF says violates the 14th Amendment.

But Texas argued to Garcia that San Antonio’s case should be thrown out and law allowed to stand.

“There is an ongoing debate in the country about federal immigration law,” Assistant Attorney General Darren McCarty told Garcia in court. “That is a healthy and appropriate debate, and it should be decided in legislatures and Congress. Where it is not appropriate to decide it — respectfully, your honor — is in litigation.”

CHICAGO (Reuters) – Chicago on Monday sued to prevent the Trump administration from enacting new policies that would withhold money from so-called sanctuary cities that deny U.S. immigration officials access to local jails.

The lawsuit filed in U.S. District Court claims that the federal policies force the city to choose between its constitutional rights and funding for law enforcement.

“These new conditions also fly in the face of longstanding City policy that promotes cooperation between local law enforcement and immigrant communities,” the lawsuit said.

The policies also include a requirement that local law enforcement give federal authorities 48 hours notice before releasing anyone wanted for immigration violations.

Democratic Mayor Rahm Emanuel said on Sunday that the city would file the lawsuit, escalating a pushback against a federal immigration crackdown launched by Republican President Donald Trump’s administration.

The lawsuit came nearly two weeks after U.S. Attorney General Jeff Sessions said the Justice Department would bar cities from a certain grant program unless they allowed immigration authorities unlimited access to local jails and give the 48 hours pre-release notice.

Chicago and its high murder rate have been frequently criticized by Trump, and cracking down on illegal immigration was a major theme of his 2016 presidential campaign.

The Justice Department said on Sunday that more Chicagoans were murdered last year than residents of Los Angeles and New York combined, and cited comments by Sessions last week saying sanctuary cities “make all of us less safe.”

Justice Department spokeswoman Sarah Isgur Flores said in a Sunday statement: “It’s especially tragic that the mayor is less concerned with that staggering figure than he is spending time and taxpayer money protecting criminal aliens and putting Chicago’s law enforcement at greater risk.”

How Massachusetts became a sanctuary state https://briefnews.eu/how-massachusetts-became-a-sanctuary-state/ https://briefnews.eu/how-massachusetts-became-a-sanctuary-state/#respond Sat, 29 Jul 2017 20:03:02 +0000 http://briefnews.eu/how-massachusetts-became-a-sanctuary-state/ us ice immigration customs enforcementWikimedia/Duffman

The Trump administration’s crackdown on undocumented immigrants has been facilitated by a tool called an “immigration hold.” Immigration and Customs Enforcement officers can issue so-called ICE detainers when a state or local law enforcement agency is poised to release an undocumented immigrant from custody.

If an agency agrees, it may hold the individual in custody for up to two days so ICE agents can transfer him or her to an immigration detention facility and initiate deportation proceedings.

On Monday, the Massachusetts Supreme Judicial Court unanimously ruled that state court officers are not legally permitted to comply with ICE detainers. The logic of its decision extends to all commonwealth law enforcement officers—meaning that Massachusetts is now, effectively, a sanctuary state. While this is the first state Supreme Court to prohibit local law enforcement from honoring ICE detainers, it probably won’t be the last. On Tuesday, I spoke with Massachusetts American Civil Liberties Union legal director Matthew Segal about the significance and potential impact of the SJC’s ruling. Our conversation has been edited for clarity.

Mark Joseph Stern: How did this case begin?

Matthew Segal: Sreynuon Lunn is an undocumented immigrant who was charged with unarmed robbery under state law in state court. That charge, however, was dismissed, and at that point, Lunn should’ve been free to go. But instead, court officers complying with an ICE detainer kept him in a holding cell for several hours so that ICE officers could take him into federal custody. Lunn argued that these Massachusetts court officers broke state law by holding him on an ICE detainer when he was otherwise entitled to be free.

And the court agreed.

The SJC asked the question this way: When state officers receive an ICE detainer from the federal government, are they being asked to do something illegal under state law? And the SJC’s answer to that question was: Yes, they are. No Massachusetts law allows Massachusetts officers to detain individuals because the federal government has issued an ICE detainer—which is, after all, a request, not a command. So when officers comply with these requests, they are acting unlawfully.

U.S. President Donald Trump delivers remarks about his proposed U.S. government effort against the street gang Mara Salvatrucha, or MS-13, to a gathering of federal, state and local law enforcement officials in Brentwood, New York, U.S. July 28, 2017. REUTERS/Jonathan ErnstThomson ReutersThe Trump administration often implies that undocumented immigrants are criminals simply for living in the United States without papers. This ruling would seem to contradict that.

Generally speaking, immigration is a civil matter, and merely living in the U.S. without documentation is not a crime. “Unlawful presence” is a civil offense, not a criminal one. So the SJC focused on the authority of Massachusetts officers to arrest people for civil infractions that don’t rise to the level of criminal conduct. This distinction was crucial to the opinion because law enforcement officers, especially those in Massachusetts, have more limited authority to arrest people for civil infractions. The SJC explained that ICE detainers ask state officers to arrest people without warrants for an offense that isn’t even a crime. And it held that Massachusetts officers simply lack the legal authority to do that.

Monday’s ruling involves only officers of a court. Why has the ACLU interpreted it to apply to all Massachusetts law enforcement officers?

It’s true that the facts that gave rise to this case involve court officers. But there’s a really important part of the opinion in which the SJC addresses the authority of court officers to make arrests. It says that when court officers are working in courthouses, they have “the same power to arrest as Massachusetts police officers.” That essentially means that there is no meaningful difference between a court officer and any other Massachusetts officer acting on state or local authority. It means that if it’s illegal for a court officer to make a certain arrest, then it is equally illegal for another state or local officer to make that same arrest. It’s just not possible to read this opinion and conclude that it is illegal for court officers to arrest based on ICE detainers but somehow not illegal for other Massachusetts officers to do so.

What’s the potential significance of this decision outside of Massachusetts?

The ruling highlights the fact that the federal government is currently asking local law enforcement officers to take noncitizens into custody in violation of their own state laws. The administration argues that ICE detainers are about “friendship” and “comity” between states and the federal government. But friends don’t ask friends to violate their own laws and constitution, and that’s what we’re really seeing here.

The SJC recognized that, and I don’t think its view is unique to Massachusetts at all. We’ve already seen a number of decisions from all over the country questioning whether local law enforcement officers can take people into custody based solely on ICE detainers. What’s historic about Monday’s decision is that it is the first decision by the highest court of a state to say this. And civil rights advocates will continue to litigate this issue elsewhere.

Speaking of, I want to pause here to give some credit to the advocates involved. The Massachusetts ACLU did not litigate this case at the SJC, right?

We represent Lunn in federal court, where we’re fighting for an injunction barring the government from redetaining him without first establishing that his removal has become reasonably foreseeable. He was born in a refugee camp in Cambodia, which does not regard him as a citizen—yet the government has repeatedly detained him, with no real chance of deportation. We want the court to make it stop.

In state court, we filed an amicus brief in support of Lunn on behalf of Massachusetts criminal defense attorneys. He was represented by Emma Winger and Alyssa Hackett, both public defenders, and Mark Fleming of the National Immigrant Justice Center.

How do you think Monday’s ruling will play into Attorney General Jeff Sessions’ political and legal assault on states that refuse to comply with his campaign against undocumented immigrants?

The decision shows that Sessions’ attempt to shame agencies that reject ICE detainers is totally unsupported by law. How on earth can the federal government shame state officials for following their own states’ laws? It will now be clear that when Massachusetts law enforcement agencies decline to take someone into custody on an ICE detainer, they aren’t picking a fight with the administration; they’re honoring the laws of Massachusetts. And that, of course, is exactly what they should be doing.

ICE’S acting director has praised president Donald Trump for “taking the handcuffs off law enforcement” adding, that 10,000 more agents will be hired. Thomas Homan also warned that he plans to crack down on the “ludicrous” so-called sanctuary cities.

“In the America I grew up in, cities didn’t shield people who violated the law,” the 30-year immigration enforcement veteran said in an interview with the Washington Examiner.

Homan says he feels empowered, as Trump has “taken the handcuffs off law enforcement.”

The Immigration and Customs Enforcement’s acting chief also said that under Trump, illegal border crossings have decreased 70 percent and arrests in the US have increased 40 percent.

Sanctuary cities are loosely defined as jurisdictions with policies which limit cooperation between local law enforcement and federal immigration agents. Some sanctuary cities include Austin, Chicago, New York and San Francisco.

“You can like President Trump, not like him, like his policies, not like his policies, but one thing no one can argue with is the effect they’ve had,” Homan told the Examiner.

He also expressed appreciation for the president’s “true interior enforcement strategy” that makes it “uncomfortable” for law breakers.

“What I want to get is a clear understanding from everybody, from the congressmen to the politicians to law enforcement to those who enter the country illegally, that ICE is open for business,” he stated, the Examiner reported.

Homan is a native of New York and took his first job in immigration during the administration of former President Ronald Reagan. He was announced by the president as the new chief of the immigration agency back in January.

Sessions began his speech on Wednesday saying that the DOJ will begin to focus on the “increase in violent crime, vicious gangs, an opioid epidemic, threats from terrorism, and human traffickers.”

“The first and most important job of this government – and any government – is to protect the safety and the rights of its people. If we fail at this task, then every other government initiative ceases to be important,” Sessions said, according to the DOJ.

Sessions claimed that the crime rate has been going down since the 1990s, until two years ago, when the murder rate increased 10 percent across the nation in one year. He went on to say that under President Donald Trump, the DOJ is “getting serious” about securing the border and enforcing immigration laws.

He then went on to blame so-called “sanctuary cities” for the rise in violent crime.

“I want to be clear about this: local police are not the problem. I know that you want to help. The problem is that politicians have forbidden you to help,” Sessions said. “That makes all of us – and especially police officers on the front lines – less safe.”

Sessions said cities such as Philadelphia, Boston, and San Francisco “are protecting criminals rather than their law-abiding residents,” adding that he is not sure if Las Vegas should be considered a “sanctuary city.”

In 2016, a memo from the DOJ listed Clark County as a “sanctuary” jurisdiction that would be investigated to determine if it is complying with federal immigration policy. However, Sessions said that he is willing to review their status.

“You know there’s some list that was prepared before I became attorney general of cities and areas that are not – they’re sanctuary cities and not in compliance,” Sessions said, according to the Las Vegas Sun. “We are reviewing that. I’m not sure that was accurate and we’re going to get on that quickly.”

Sessions said that he spoke with Clark County Sheriff Joe Lombardo who enrolled his officers in ICE’s 287 G program, which allows local deputies to enforce immigration law

“This is just the type of force multiplier that we need,” Sessions said. “We will work to strengthen our partnerships with you – law enforcement on the front lines. You are ultimately the most effective resources that we as a country have in this effort.”

If Las Vegas is not removed from the list, they might be subject to a bill that was passed by the House two weeks ago. The No Sanctuary for Criminals Act would block any “sanctuary” jurisdiction from receiving certain federal grants from the Department of Justice and the Department of Homeland Security.

In April, Metro general counsel Liesel Freedman wrote a letter to the Justice Department, stating that the Las Vegas Metro Police Department “in its law enforcement and detention activities are in compliance” with federal immigration policies.
