The judicial body said this could be done without changing the terms of London’s membership in the bloc.

The European Court of Justice (ECJ) opined in a document issued on Monday that Britain can reverse Article 50, which stipulates the way a member state leaves the bloc. The potentially important ruling comes only one day before the House of Commons votes on Prime Minister Theresa May’s Brexit deal with the EU.

“When a Member State has notified the European Council of its intention to withdraw from the European Union, as the UK has done, that Member State is free to revoke unilaterally that notification,” the court’s decision reads.

By doing so, the respective state “reflects a sovereign decision to retain its status as a Member State of the European Union.”

That said, this possibility remains in place “as long as a withdrawal agreement concluded between the EU and that Member State has not entered into force.” Another condition is: “If no such agreement has been concluded, for as long as the two-year period from the date of the notification of the intention to withdraw from the EU.”

The case was opened when a cross-party group of British politicians asked the court whether an EU member such as the UK can decide on its own to revoke the withdrawal process. It included Labour MEPs Catherine Stihler and David Martin, Scottish MPs Joanna Cherry Alyn Smith, along with Green MSPs Andy Wightman and Ross Greer.

They argued that unilateral revocation is possible and believe it could provide an opening to an alternative to Brexit, namely holding another popular vote to allow the UK to remain in the EU.

“If the UK chooses to change their minds on Brexit, then revoking Article 50 is an option and the European side should make every effort to welcome the UK back with open arms,” Smith, the SNP member, was quoted by Reuters.

However, May’s environment minister, Michael Gove, a staunch Brexit supporter, denounced the ECJ ruling, insisting the cabinet will not reverse its decision to leave. “We will leave on March 29, [2019]” he said, referring to the date set out in the UK-EU Brexit deal.

The UK has the power to unilaterally stop the Brexit process, the EU’s top legal advisers have said, contradicting statements from London that stated Article 50 could only be stopped with agreement of all 27 EU member states.

The advocate general, in a report prepared for the European Court in Strasbourg, stated that the UK could suspend the already triggered two-year Article 50 process, according to a lawyer for the group that brought forward the case.

“Advocate General Campos Sanchez-Bordona proposes that the Court of Justice should declare that Article 50 … allows the unilateral revocation of the notification of the intention to withdraw from the EU,” the bloc’s top court’s statement read.

The Advocate General’s opinions are not binding, judges will now decide on whether or not to accept his advice, though the have a tendency to do so in most cases.

  • The US has pledged “appropriate actions” against the people it is now connecting to the killing of journalist Jamal Khashoggi.
  • Secretary of State Mike Pompeo told reporters that the US has “identified at least some of the individuals responsible, including those in the intelligence services, the Royal Court, the foreign ministry, and other Saudi ministries.” 
  • Pompeo said the US is already revoking visas and mulling sanctions. 
  • Trump on Tuesday described Khashoggi’s killing at the Saudi consulate in Istanbul as one of the worst cover-ups in history. The president said he will leave the decision to punish the Kingdom with Congress.  

The US pledged that it is taking “appropriate actions” against those responsible for journalist Jamal Khashoggi’s death. 

Khashoggi, a green-card holder and resident of Virginia, was killed during a visit to the Saudi Consulate in Istanbul, Turkey, earlier this month. Riyadh has admitted that Khashoggi was murdered, but claimed it was the result of an altercation gone wrong as part of a “rogue operation” unknown to the Saudi leadership.

  • US District Judge Amy Berman Jackson has scheduled a hearing for June 15 to decide whether to revoke bail for Paul Manafort, the former chairman of President Donald Trump’s campaign.
  • Manafort has been on supervised release since he was first indicted by the special counsel Robert Mueller’s office last year.
  • But the FBI on Monday accused Manafort of attempting to tamper with witness testimony and subsequently asked the court to revoke or restrict the terms of Manafort’s release.

France has initiated a procedure to revoke the Legion of Honor awarded to Syrian President Bashar Assad, an official of the French presidency told BFM TV broadcaster on Monday evening. “The Elysee [palace] confirms that a disciplinary procedure to withdraw the Legion of Honor of [President] Assad has been launched,” the official said.

Assad was made a knight of the Legion of Honor (Legion d’Honneur in French), the country’s highest decoration, back in 2001, when he met former French president Jacques Chirac. At that time, he had just succeeded his father Hafez Assad, who had ruled Syria for several decades.

A resolution was adopted in 2010 to make it easier to strip foreign recipients of the award, if they had committed “acts inconsistent with the honor,” according to BFM TV. Under French laws, the prestigious decoration is automatically withdrawn if the recipient is sentenced to at least one year in prison.

Previously, France revoked the awards given to American cyclist Lance Armstrong, British designer John Galliano and also Harvey Weinstein, after allegations of sexual harassment by the Hollywood producer surfaced.

The news comes on the heels of the latest missile strikes on Syria, conducted by the United States, Britain and France. The US-led attack hit three targets in Syria, a research center and military bases the coalition said were linked to Damascus’ chemical stockpiles, and was launched in response to an alleged chemical attack in Douma on April 7.

French president Emmanuel Macron defended the strike against Syria, conducted without any UN resolution, claiming that Paris was not acting unilaterally and that it was “the international community” that legitimized the military action. “We have complete international legitimacy to act within this framework,” Macron asserted in the interview, broadcast by BFM TV, RMC radio and Mediapart. “Three members of the Security Council have intervened.”

In a follow-up interview, Macron said he urged his US counterpart Donald Trump to limit the size of the strikes, adding, however, that he persuaded him to keep American troops in Syria for the long-term.

Last year, though, he produced more measured statements on Syria. Speaking to eight European newspapers, Macron argued that there is currently no viable alternative to Assad, who is preventing Syria from turning into a failed state. “I have not stated that Bashar al-Assad’s departure is a pre-condition for everything because nobody has shown me a legitimate successor,” he maintained at the time.

Israel has announced plans to effectively expel the Al Jazeera network from the country, revoking journalists’ credentials, shutting the company’s bureau in Jerusalem and pulling its broadcasts from national cable and satellite television networks.

Israeli Communications Minister Ayoub Kara announced the measures Sunday at a news conference. Journalists and representatives from Al Jazeera were not permitted to attend.

“We are going to set measures in order to illustrate our war on terrorism, on radical Islam and our solidarity with the sane Arab world,” Kara stated.

While the proposal will not take immediate effect, Kara confirmed that both the Arabic and English versions of the news channel will be shuttered once the proposal is passed in the Knesset (Israel’s parliament).

“I am the only one [in government] who is an Arabic speaker, who understands Arabic and my native language is Arabic. You cannot fool me with Al Jazeera English and Al Jazeera Arabic. I know how to identify how disturbing reporting becomes incitement instead of being free speech,” he added.

Kara claimed that such extreme measures are ostensibly intended to improve journalistic practice in the country by creating “a situation that channels based in Israel will report objectively.”

“We have based our decision on the move by Sunni Arab states to close the Al Jazeera offices and prohibiting their work.”

“I congratulate the Minister of communications, Ayoob for my guidance took today in line with practical steps to stop the activity of incitement in Israel,” Israel’s Prime Minister Benjamin Netanyahu said of Kara’s proposal on Twitter.

In July, Netanyahu announced that he was working to shut down the network which he accuses of stoking tensions and inciting violence in Israel, particularly at the al-Aqsa mosque where six Palestinians and five Israelis, including two police officers, have been killed in recent clashes.

“This attack on Al Jazeera is really an attack on all critical independent journalism.” Aidan White, director of the London-based Ethical Journalism Network told Al Jazeera.

The network’s offices in the Palestinian territories of Gaza and the West Bank city of Ramallah would not be affected.

The network will not give up its Jerusalem bureau without a fight, however.

“Al Jazeera deplores this action from a state that is called the only democratic state in the Middle East and considers what it has done is dangerous,” an unnamed official with Al Jazeera told the AFP.

The broadcaster “will follow up the subject through appropriate legal and judicial procedures,” he added.

Saudi Arabia and Jordan have both shut Al Jazeera bureaux this year as part of the ongoing ‘cold war’ playing out in the Gulf, which culminated in the full blockade of Qatar.

Egypt banned the Al Jazeera network and several other websites that were critical of the government in May and broadcasts have also been blocked in the UAE.
