DC District Judge John Bates on Friday upheld his earlier ruling from April 24, that found the White House’s decision to scrap the policy, which has shielded about 800,000 migrants from deportation since it was adopted in 2012, was “arbitrary and capricious.”
“The Court therefore reaffirms its conclusion that DACA’s rescission was unlawful and must be set aside,” he wrote in a 25-page opinion on Friday.
The court argued that the memorandum issued by Homeland Secretary Kirstjen Nielsen in June, that was supposed to offer a legally sound explanation for the government’s action, failed “to elaborate meaningfully on the agency’s primary rationale for its decision: the judgment that the policy was unlawful and unconstitutional.”
Bates contended that although the memo provides several new reasons for the court to review its decision, the majority of them “simply repackage legal arguments previously made.” The only one “bona fide (albeit logically dubious) reason” offered by Nielsen was not enough to sway the court’s opinion, Bates wrote, since it was “articulated nowhere in DHS’s prior explanation for its decision” and hence cannot come into play now.
Calling the renewed justification provided by the department “a hodgepodge of illogical or post hoc policy assertions” that “simply will not do,” the court at the same time stressed its ruling does not mean that the DHS is not entitled to rescind the program in principal, but that it “must give a rational explanation” if it wants to do so.
Bates, who in April gave the government a 90-day window so that DHS could come up with what the court will perceive as an adequate rationale to shut down DACA, on Friday provided the Trump administration with only 20 days to decide if it will appeal the ruling and seek a temporary stay in execution.
The decision is an important landmark in the litigation over DACA’s validity, that saw the Trump administration being challenged by multiple lawsuits across the country. Should the ruling come into force, The White House will have to restart the DACA program in full.
In his April ruling Bates wrote that if the DHS fails to issue a memo that would prove that the program was unlawful and unconstitutional, as insisted by the government, “the Rescission Memo will be vacated in its entirety, and the original DACA program will be restored in full.”
Since US President Donald Trump rescinded the Obama-era program on September 5, the White House has been embroiled in numerous legal battles. While the administration has won some, with Trump praising Judge Roger W. Titus of Maryland, who ruled in March that the President was within his authority to rescind the executive order issued by his predecessor, it has suffered more losses so far.
A California court in January ordered to partially restart the program, while a New York judge in February issued an injunction ordering the government to maintain DACA, although that will not require DHS to accept new applications. Several government appeals are still pending in US courts.
Bates’ ruling was applauded by The National Association for the Advancement of Colored People (NAACP), a plaintiff in the case, which called it a “huge victory.”
“This represents a powerful victory against attempts to dehumanize immigrants who are law-abiding and productive residents of the United States and who were long ago brought to this country as children through no fault of their own,” NAACP President and CEO Derrick Johnson said.

Abrams has a huge task ahead of him.
Not only does he have the enormous pressure of bringing home a beloved franchise with a single storyline which will span nine movies and five decades.
He also faces the extraordinary rift in the fandom which created a major backlash after The Last Jedi, with many fans unhappy over the direction taken by Rian Johnson and Kathleen Kennedy.
Episode 9 has officially started filming and Abrams posted the first image earlier today.
Abrams posted a shot of film equipment with the comment: “Bittersweet starting this next chapter without Carrie, but thanks to an extraordinary cast and crew, we are ready to go. Grateful for Rian Johnson and special thanks to George Lucas for creating this incredible world and beginning a story of which we are lucky to be a part.”
The nod to George Lucas ties in with other comments made recently to Rolling Stone which stressed how Abrams was determined to honour the spirit in which he made The Force Awakens.
The following major quote will leave many fans reassured that Abrams will move away from some of the tone and plot decisions made by Johnson
Abrams said: “The opportunity to sort of take what we had learned, to take the feeling of who these characters are and what they are and give them a final chapter that felt in the spirit of what we begun? It was too delicious of an opportunity to pass up.”
Whatver anyone’s views on Episode 7 and 8, there is no mistaking that the two movies are very different tonally and in intentions.
Abrams stayed true to Lucas’ original tone and also laid groundwork for Snoke and Rey’s parentage as the two new central themes. Rian Johnson appeared to disregard much of this, which infuriated and alienated a major part of the original fanbase.
Can Abrams pick up where The Last Jedi left off and somehow continue the story and win back the boycotting fans?
The director also appeared to acknowledge that Episode 7 was not perfect. Many fans felt it was too much of a rerun of Episode 4.
He added: “When the opportunity presented itself to finish a story that we had begun with these new characters, to tell the last chapter of their story, it felt like there was a chance to do it in a way where we could go beyond, and do better than we did in VII. I learned so much in that movie and I saw that this was a chance to sort of realize something that we hadn’t quite achieved – and part of that was it was simply the beginning of these new characters and their story.”
We’re big fans of The FJ Company here at Autoblog. The outfitter builds some pretty sweet restomod Toyota off-roaders. Late last year, we were lucky enough to drive a 1981 Toyota Land Cruiser FJ43. It was a big dose of nostalgia right to the pleasure centers of the brain. While that particular FJ — the company’s Signature model — would set you back at least $ 200,000, The FJ Company does offer vehicles with less eye-watering price tags. No matter the cost, each model is painstakingly and meticulously restored and modernized. The video above goes through the entire build process.
These truly are restored classics. The frame and steel bodywork is all original, though both have been overhauled and cleaned to perfection. Classic looks are complimented by a number of modern upgrades. Non-Signature models get a rebuilt version of a Toyota 2F inline-six. The Signature gets a new 4.0-liter Toyota V6. Each model is equipped with a new Toyota five-speed manual, power steering, disk brakes up front, Old Man Emu suspension and Vintage Air climate control. Each one also gets a full roll cage.
Beyond that, it’s all up to the customer. The FJ Company’s website has a pretty extensive configurator. Options include bucket seats, a painted hardtop, new lighting, a winch and much more. You could lose track of time perfecting your dream FJ. We definitely have.

The 17-year-old swimmer tipped to be the breakout star when the pool action ignites on Thursday has almost comically been caught in a warm-hearted interstate tug of war.
Broadcaster Channel Seven called her an “ex-Tasmanian” when she won her first gold at the recent trials, local media is riding the bandwagon with “Queensland’s Arnie” and she has never been anything but Launceston’s own in the parochial Apple Isle.
PERKINS:Pearson happy to play her part
HEARTBREAKING: Games diver forced to retire
That her proud Tasmanian background is recognised at all is far better than the organisers could muster for the opening ceremony of the 1982 Commonwealth Games at Brisbane’s then-QEII Stadium.
In centre field, when hundreds of kids formed a huge map of Australia with coloured cardboard squares above their heads poor Tasmania was forgotten or had rejoined the mainland for the first time in more than 10,000 years.
Then-Tasmanian Premier Robin Gray fumed, so it will be intriguing to see if any updated map representation returns Tasmania’s island status at tonight’s opening ceremony on the Gold Coast.
Titmus has embraced the support of her new home state since arriving in Queensland to train in 2015 yet you don’t have to dig very deep to realise how proudly her Tasmanian heart beats.
Her TV fix, when training and sleep will allow, is My Kitchen Rules and who else would she follow but Tasmania’s truffle-farming siblings Henry and Anna Terry.
“I suppose I’m a Queenslander now but I want to do it for Tassie as well because it’s where I got my start and the people are so supportive,” Titmus said.
“Even going back to my home town late last year for a junior Dolphins clinic, the people at the Launceston Aquatic Centre opened up the pool two hours early just so I could train solo with my coach.
“I don’t get the time to watch MKR too much but when I do I’m going for the truffle farmers and to watch the drama rather than the cooking.”
What drama awaits in the outdoor pool at Southport on the first finals’ night tomorrow will certainly strongly feature the engaging teenager whose toughest medal race will be her first.
She is the meet’s dominant distance swimmer on paper but shifts a gear to race top sprinters for the 200m freestyle gold, including defending Commonwealth Games champion Emma McKeon, who has sharpened since finishing second at the trials and putting a shoulder niggle behind her.
Titmus knows she has the training background if not the top-level racing experience over 200m to be in the hunt for the first of four possible gold medals at the Games.
“My coach Dean (Boxall) is probably hardest on me of any of his swimmers to do that bit extra and I like it,” Titmus said.
“I want absolutely nothing left in the tank after a training session.”
That’s how the Tasmanian Queenslander in Aussie colours races as well. All out for gold.

Fiat Chrysler Automobiles (FCA) may want your classic Italian car. The automaker has just launched a new initiative, Reloaded by Creators, that aims to buy, restore, and sell some of the most significant vehicles from the company’s history. Focusing on Italian brands (the company has shown no interest in your slant-six Plymouth Valiant), the project aims to bring Alfa Romeos, Fiats, Lancias, and Abarths back to life while building the company’s own collection of historic cars.

Numerous auto manufacturers have recently announced programs for either reproducing or restoring older vehicles. The Mercedes-Benz Classic workforce at the company’s museum restores and sells what it calls All-Time Stars, Pagani Rinascimento is restoring and maintaining Zondas, Lamborghini’s Polo Storico is perfecting its classics, Jaguar is remaking D-types, and Land Rover Reborn is revamping Series 1 models. Mazda will even inject fresh juice into first-generation (NA) Miatas, and now FCA equally sees opportunity in this space.
–
–
Officially announced at the 2018 Rétromobile classic-car show in Paris, the Reloaded by Creators program is a compilation of services offered by the FCA Heritage division. Customers could previously request certificates of origin and factory restoration for certain vehicles, but this is the first time the company will scout, acquire, and sell certified classic restorations.
–
Claiming to have been “inspired by the modus operandi of art museums,” FCA has opened the program with five classics, which are already available for purchase: a 1991 Alfa Romeo Spider, a 1973 Lancia Fulvia Coupe Montecarlo, a 1981 Pininfarina Spidereuropa (née Fiat 124 Spider), a 1989 Alfa Romeo SZ, and a 1959 Lancia Appia coupe. According to FCA, the Alfa Spider, the Montecarlo, and the Pininfarina are “ultimate classics,” which means they are the last types of their series that were built and are restored to the fullest extent both mechanically and cosmetically. FCA chose the SZ and Appia as “unusual” and interesting custom cars. Each ride comes with a Certificate of Authenticity, the first time that Alfa Romeo and Fiat have offered such documentation, according to FCA.

FCA is not selling these vehicles just for the fun of it. It hopes the cash acquired from the classic-car sales will fund more exhaustive and thorough searches for other classic cars. Specific historically important vehicles that are discovered in the process will be added to the company’s own heritage collection. Fiat Chrysler has more information on the available vehicles here.

Twenty-one states and the District of Columbia today kicked off a lawsuit to overturn the Federal Communications Commission’s repeal of net neutrality rules. Advocacy groups are also suing the FCC.
The states suing the FCC are New York, California, Connecticut, Delaware, Hawaii, Illinois, Iowa, Kentucky, Maine, Maryland, Massachusetts, Minnesota, Mississippi, New Mexico, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, and Washington. That’s every US state with a Democratic attorney general. Republican state attorneys general did not join the petition.
“The petition is the first step by states to attempt to block the FCC’s decision, and it will allow the attorneys general to move forward with the appeal in the future,” said an announcement from Washington State Attorney General Bob Ferguson.

A Democratic effort to reinstate net neutrality rules has won support from a Republican senator and could pass in the Senate if just one more Republican breaks with the GOP.
A Congressional Review Act (CRA) resolution from Sen. Ed Markey (D-Mass.) to reverse the Federal Communications Commission’s net neutrality repeal would need votes from all Democrats and two Republicans in order to pass through the Senate. Sen. Susan Collins (R-Maine) today became the first Republican senator to pledge support for the repeal reversal.
“Senator Collins does not support the FCC’s recent decision to repeal net neutrality rules, and she will support Senator Markey’s legislation that would overturn the FCC’s vote,” a spokesperson for Collins told The Hill and other news outlets today.
]]>Iran could have better relations with Saudi Arabia, but Riyadh must first stop its military intervention in Yemen and distance itself from Israel, Iran’s president told lawmakers. The two nations are regional powerhouses deadlocked in a conflict.
The confrontation between Iran and Saudi Arabia is multi-layered, rooted in religious, economic and political differences between the two. But, according to Iran’s President Hassan Rouhani, relations between the two may improve, if the Saudis take a certain course of action.
“Saudi Arabia should suspend its bombardment of Yemen and stop looking for contacts with the Zionist regime,” he said in an address to parliament on Sunday as cited by Iran’s Press TV. “We want Saudi Arabia to stop two things, the misguided friendship with Israel and the inhuman bombardment of Yemen.”
Rouhani said if these two conditions are met, relations between Iran and Saudi Arabia may be restored. Riyadh severed formal relations with Tehran in January 2016 in response to an attack on its embassy in the Islamic Republic. The diplomatic facility was seized by a crowd of angry protesters, who wanted revenge for the execution of prominent Shiite cleric Sheikh Nimr al-Nimr days earlier. The diplomatic rift came amid a long period of escalating tension between the two Muslim nations.
The crisis came months after the death of masses of pilgrims in Saudi Arabia-controlled Mina in September 2015. Of the estimated 2,400 pilgrims killed in the stampede over 460 were Iranian nationals. Iranian officials accused the Saudis of negligence and a failure to uphold their responsibility as custodians of Islamic holy sites. The criticism was branded as an attempt to play politics in Riyadh.
Saudi Arabia and Iran accuse each other of various misdeeds, including sponsoring terrorism, twisting the arms of third countries in the region, waging propaganda campaigns against each other and being unfaithful to the tenets of Islam, with the nations being champions of the two major sects of the religion. They are also on opposite sides in their relations with the United States, with Shia Iran having been a sworn enemy of Washington ever since the 1979 revolution and Sunni Saudi Arabia being a key military and trade partner for America.
READ MORE: Israeli minister reveals contacts with Saudi Arabia ‘to curb Iran’
The remarks by Rouhani came after senior Israeli officials indicated that their government was involved in clandestine cooperation with some Arab countries, including Saudi Arabia, and was willing to do even more to curb the growing influence of Iran. Tehran has succeeded in furthering its goals in the region lately, Middle East observers say, gaining a better foothold in Iraq and Syria and defending Lebanon from a perceived attempt by Saudi Arabia to undermine the positions of Hezbollah militant movement.

Steve Smith’s side remain in a commanding position leading by 268 after England were shelled out over 215 runs short of the hosts’ first innings total.
But James Anderson and Chris Woakes at least sent the tourists back to the dressing room wondering whether a miracle awaits them on day four of this Test, taking two wickets apiece as Australia wobbled.
Nightwatchman Nathan Lyon and Peter Handscomb held out a late charge but Australia’s top four, including captain Smith, were all sent packing.
It may be a long shot but an outside chance is better to cling to than no chance at all which, at one stage yesterday, seemed the most likely.
At 39-1 Australia appeared to have weathered the new ball storm but Anderson and Woakes got the pink ball moving in the second half of the final session to inject a semblance of hope.
If England do go on to lose this match, it will be in their first innings batting and bowling effort that it slipped away.
England coach Trevor Bayliss had called for Joe Root’s side to “bat big and long” suggesting they needed to go stretch their first innings into day four.
But a top order collapse in the morning session undermined that hope. And despite some lower order resistance England managed to bat two sessions and four overs, failing even to get to the follow-on target of 243.
It was a minor triumph for England that Australia captain Steve Smith decided his bowlers had spent just that little bit too long in the field to enforce with England all out for 227 in 76.1 overs.
Craig Overton had shown England’s failing top order what could be done with a some courage against the short ball and intent against spin ending up unbeaten at the close and top scoring with 41.
His partnership with Chris Woakes, which added 66 for the eighth wicket, was not a thing of beauty, but it was effective. Moreover, it will have made uncomfortable viewing for those already back in the England dressing room.
James Vince, Root, Alastair Cook, Moeen Ali and Jonny Bairstow were all guilty of poor shot selection, execution or a combination of both. Only Dawid Malan of the top seven got a really good ball, the always dangerous Pat Cummins getting one to jag back at him and flicking the glove.
The upshot of their shortcomings was by the time Overton came to the crease, when Bairstow became the second of three consecutive caught and bowled dismissals, England were already struggling big time at 142-7.
Overton’s confidence will have been done no harm by the fact he was the leading wicket taker in Australia’s first innings (for all that they came at a cost of 105) but his grit under fire with the bat was impressive.
Cummins was not the only threat with Josh Hazlewood cranking up his pace to the lower fringes of 90mph and the fastest man in the middle Mitchell Starc varying his angles between head and toes and both with unerring accuracy.
Yet Overton and Woakes kept their eye on the ball, ducking at times and taking it on at others, and showed what plenty of locals had been suggesting, namely that England had had the best of the pitch and conditions here and still failed.
There is still a bit of life left in the Test but England will need to produce some magic to get anything out of it.
