‘Arbitrary and capricious’: Judge strikes down Medicaid work requirement in Kentucky https://briefnews.eu/arbitrary-and-capricious-judge-strikes-down-medicaid-work-requirement-in-kentucky/ https://briefnews.eu/arbitrary-and-capricious-judge-strikes-down-medicaid-work-requirement-in-kentucky/#respond Fri, 29 Jun 2018 22:53:22 +0000 http://briefnews.eu/arbitrary-and-capricious-judge-strikes-down-medicaid-work-requirement-in-kentucky/ A federal judge has ruled against Kentucky’s policy that would impose a work requirement on Medicaid recipients, temporarily halting the efforts to roll back the program’s expansion under Obamacare.

When the Health and Human Services (HHS) secretary approved Kentucky’s request, he had not considered the effect it would have on medical coverage, US District Judge James Boasberg ruled on Friday.

The HHS had “entirely failed to consider” Kentucky’s estimate that 95,000 persons would be removed from Medicaid rolls over the five-year course of the project, Boasberg said, adding that this goes against the central objective of Medicaid, which is helping the state provide medical assistance to its citizens.

“This signal omission renders his determination arbitrary and capricious,” he concluded.

The program, called Kentucky HEALTH, was scheduled to go into effect on July 1. Several other states had followed suit and applied for waivers from the HHS, in an effort to scale back the expansion of the program mandated under the 2010 Affordable Care Act, also known as Obamacare.

“Even if Kentucky were able to ‘unexpand’ Medicaid (far from a foregone conclusion), Plaintiffs would have, at minimum, momentary relief,” Boasberg wrote in the ruling.

Because many of the plaintiffs suffer from various chronic conditions such as diabetes, hypertension and mental health issues, they fear that even a temporary implementation of the work requirement “could cause serious harm,” the judge said, explaining his decision to send the program back to HHS for further review.

While the push to repeal and replace Obamacare failed in the Senate last year, the Trump administration has sought to roll back many regulatory aspects of the law, from tax penalties to Medicaid expansion.

The decision notes that Kentucky applied for the program in July 2017, and received approval on January 12, 2018. It is unclear, though, who actually made the approval decision – Tom Price, who resigned in September 2017, or Acting Secretary Eric Hargan, who was running HHS on the date of the approval. The current HHS chief, Alex Azar, was sworn in on January 29. The case names him as the defendant.

Patch Tuesday drops the mandatory antivirus requirement after all https://briefnews.eu/patch-tuesday-drops-the-mandatory-antivirus-requirement-after-all/ https://briefnews.eu/patch-tuesday-drops-the-mandatory-antivirus-requirement-after-all/#respond Wed, 14 Mar 2018 09:49:42 +0000 http://briefnews.eu/patch-tuesday-drops-the-mandatory-antivirus-requirement-after-all/

In the immediate aftermath of the Spectre and Meltdown attacks, Microsoft created an unusual stipulation for Windows patches: systems would only receive the fixes if they had antivirus software installed and if that antivirus software created a special entry in the registry to indicate that it’s compatible with the Windows fixes.

This was due to the particularly invasive nature of the Meltdown fix: Microsoft found that certain antivirus products manipulated Windows’ kernel memory in unsupported ways that would crash systems with the Meltdown fix applied. The registry entry was a way for antivirus software to positively affirm that it was compatible with the Meltdown fix; if that entry was absent, Windows assumed that incompatible antivirus software was installed and hence did not apply the security fix.

This put systems without any antivirus software at all in a strange position: they too lack the registry entries, so they’d be passed over for fixes, even though they don’t, in fact, have any incompatible antivirus software.

HQ Trivia scraps $20 minimum requirement to withdraw prizes https://briefnews.eu/hq-trivia-scraps-20-minimum-requirement-to-withdraw-prizes/ https://briefnews.eu/hq-trivia-scraps-20-minimum-requirement-to-withdraw-prizes/#respond Sun, 28 Jan 2018 02:36:10 +0000 http://briefnews.eu/hq-trivia-scraps-20-minimum-requirement-to-withdraw-prizes/

Got a few bucks sitting in HQ Trivia limbo these past couple of months? You’ll be happy to hear this, then: the app no longer requires a minimum balance for withdrawal. You can get your prize money no matter how small it is, so you don’t have to endlessly try to win again and again just to be able to collect $ 20. HQ Trivia, which debuted to great success late last year, is a trivia app that takes on a gameshow format. Gameplay is live, and you can only play at specific times twice a day.

While you do win real money if you get all the answers in a round correctly, the app made it incredibly tough to collect. In addition to the $ 20 minimum, you’ll also have make a withdrawal within 90 days or lose what you’ve already won. As anybody who’s ever played HQ Trivia will tell you, it’s not easy to win multiple times, and it’s even harder to rack up prizes. Although each round’s prize money is worth thousands of dollars, there are so many players that each winner usually just get a couple of bucks. Now that you can withdraw your money no matter the amount, you can finally treat yourself every time you win… even if it’s just something from McDonald’s dollar menu.

‘Star Trek: Bridge Crew’ drops its VR headset requirement https://briefnews.eu/star-trek-bridge-crew-drops-its-vr-headset-requirement/ https://briefnews.eu/star-trek-bridge-crew-drops-its-vr-headset-requirement/#respond Tue, 26 Dec 2017 09:45:41 +0000 http://briefnews.eu/star-trek-bridge-crew-drops-its-vr-headset-requirement/

There’s no question that Star Trek: Bridge Crew benefits from VR — it helps fulfill that fantasy of helming a starship. Most people don’t have the VR headset you need to play the game, however, which makes gathering a crew rather difficult. Red Storm and Ubisoft’s solution? Make the game playable for everyone. It just released a “non-VR” update that makes the game playable for anyone with a PS4 or sufficiently capable PC. You can play with others whether or not they have headsets, and there are even graphical enhancements for non-VR players to take advantage of the lighter processing requirements.

We’ve seen a few games drop VR requirements before, but this is still an unusual move when many games are adding VR modes. It’s not surprising that the developers would branch out, though. While VR headsets are increasingly affordable, there’s no question that the majority of gamers don’t have them. That makes VR gaming a tough sell, and it’s not a very sustainable business. Unless studios can afford to experiment, they may have little choice but to write games for regular players first and tack on VR support as a bonus.

I'm A Celebrity 2017: Former star reveals shocking injuries due to this jungle requirement https://briefnews.eu/im-a-celebrity-2017-former-star-reveals-shocking-injuries-due-to-this-jungle-requirement/ https://briefnews.eu/im-a-celebrity-2017-former-star-reveals-shocking-injuries-due-to-this-jungle-requirement/#respond Fri, 17 Nov 2017 10:21:44 +0000 http://briefnews.eu/im-a-celebrity-2017-former-star-reveals-shocking-injuries-due-to-this-jungle-requirement/

As the prepare for their arrival in camp they will ditch their glamorous wardrobe’s in favour of the required brown shirts and bright red trousers.

Now, one former contestant has opened up about the jungle uniform revealing that they sustained a number of injuries as there is one major problem with the clothing.

Speaking on this morning, Tony Hadley, who appeared on the 2015 series, said that he left the jungle feeling unwell after he was forced to wear the camp attire.

“I’ll tell you what the problem with that stuff is,” he commented. “It doesn’t dry, it is really hard to dry.

“So, when I came out I had an ear infection, a throat infection and a bit of trench foot. I took a picture of my foot and was like, ‘Oh my God!'”

However, despite the hard-to-dry clothing, Tony insisted he would return to the show, noting: “I loved every minute of it. I would go back tomorrow.”

Meanwhile, fellow former contestant Sinitta added that she thought she would be stripping down to her bikini every day, but she actually spent most of her time in the jungle wrapped up.

She explained: “I wore every item of clothing. I had every item on and tucked in.”

Their comments on the jungle uniform come after it was reported that the stars are required to wear red socks to hide unsightly insect bites.

Jungle medic Bob told Woman’s Own that the bright footwear is used to disguise any blood that may be on show.

starts Sunday on at 9pm while Lorraine airs weekdays on ITV at 8.30am.

Apple iPhone X preorders begin with 5-week shipping delays and requirement to pick a carrier https://briefnews.eu/apple-iphone-x-preorders-begin-with-5-week-shipping-delays-and-requirement-to-pick-a-carrier/ https://briefnews.eu/apple-iphone-x-preorders-begin-with-5-week-shipping-delays-and-requirement-to-pick-a-carrier/#respond Fri, 27 Oct 2017 09:38:34 +0000 http://briefnews.eu/apple-iphone-x-preorders-begin-with-5-week-shipping-delays-and-requirement-to-pick-a-carrier/

So it begins. The clock struck midnight on the West Coast of the United States, and the preorder frenzy for the iPhone X began. And this round of preorders offered some interesting twists.

It appears from Apple’s website that when customers in the U.S. purchase one of the phones, they are required to select a carrier: AT&T, Sprint, Verizon Wireless, or T-Mobile. The iPhone 8, by contrast, still offers a “buy without a carrier” option through the purchasing wizard.

Even when picking a carrier, users still pay the full price: $ 1,149 for the 256GB version and $ 999 for the 64GB version. Some carriers were offering promotions, however. Verizon was offering a $ 300 discount if new users signed up for a $ 40 per month unlimited plan.

For those paying full price, the iPhone would presumably come unlocked — though that wasn’t explicitly stated on the Apple website, and customers expressed some confusion about this.

Of course, people were feverishly reloading the Apple website in order to place their order as midnight approached. A few super early birds managed to land a delivery date of Nov. 3, the first official day Apple says the iPhone X will ship.

But within minutes that delivery date started slipping:

And slipping:

This is not surprising, given widespread reports about the challenges Apple faced developing the iPhone X and complications with suppliers and manufacturers. Apple will likely get this sorted out eventually. The questions now are: How strong will demand be? And how long it will take Apple to catch up to that demand?

There has been speculation that orders for the other new iPhones, the 8 and 8 Plus, have been weaker than expected. Those phones went on sale in late September. Analysts assumed that part of the reason for the weak response was that consumers were holding out for the iPhone X to become available.

We might get more insight into that question next week when Apple is scheduled to report earnings.
