GOP Rep. Michael McCaul of Texas on Sunday said that while he wouldn't personally take classified materials to his personal residence, he argued during an interview that "a different set of rules" applied to former President Donald Trump.
During an interview on ABC's "This Week" with co-anchor Martha Raddatz, McCaul — a former federal prosecutor and the ranking member of the House Foreign Affairs Committee — said that while he had extensive experience handling sensitive documents, he also had never served as Commander-in-chief.
"You know, I have lived in the classified world most of my professional career, I personally wouldn't do that," he said of transporting classified materials to his residence. "But I'm not the president of the United States."
He continued: "He has a different set of rules that apply to him. I know they were taken out of the White House while he was president and whether or not he declassified those documents remains to be seen. He says he did. I don't have all the facts there."
Last month, the FBI searched Trump's Mar-a-Lago residence in Florida, where federal officials retrieved several boxes of classified and top secret documents.
The subsequent release of the search revealed that agents were looking for documents connected to potential violations of the Espionage Act, which bars the unauthorized removal of defense-related information that could aid a foreign government. Trump is also being investigated for possible obstruction of justice violations.
The documents — regardless of whether or not they were considered to be classified — were supposed to be turned over to the National Archives upon the former president's departure from the Oval Office, per the Presidential Records Act.
Last month, Trump said that the documents taken by agents were "declassified," but over a dozen ex-Trump, White House officials disputed his claims.
McCaul later in the interview remarked that he "didn't have all the facts" regarding the FBI search.
"I know they were taken out of the White House while he was president and whether or not he declassified those documents remains to be seen," he said. "He says he did. I don't have all the facts there."
"There is a process for declassification. But again, the president's in a very different position than most of us in the national security space. We — the relevant committees on the Hill — have asked for briefings on this to find out what was so important here from a national security standpoint that would merit such an extreme measure to have a search warrant on a former president of the United States," he added.

This was a notable and worrying example of Ofcom’s orchestration of the media in this matter by publicizing without notice to RT the provisional findings for its decision in this case, in a statement made on April 18. This was before it had heard, let alone had time to consider, RT’s representations on its preliminary view. This gives rise to grave concern over the fairness of Ofcom’s process and agenda. The concern is heightened as Ofcom is using powers that exist for protection against serious matters to find a breach in relation to this trivial teething problem – a veritable sledgehammer to crack a nut.

Jamaica has declared a State of Emergency after the government reports a number of shooting incidents in St James Parish.
Tourists are warned to stay in their hotels if holidaying in the area, with approximately 200,000 tourists from the UK travelling to the Caribbean island every year.
But is it still safe to travel to Jamaica?
The Foreign and Commonwealth Office (FCO) has warned Britons that a “major military operation” is taking place and that they should stay in their hotels.
The website states: “A State of Emergency has been declared in St James Parish which includes Montego Bay.
“This will lead to more intensive law enforcement activities in response to recent violence including shooting incidents.
“You should follow local advice, including restrictions in selected areas. You should limit your movements outside of resorts in the area at this time, and exercise particular care if travelling at night.
“Travel to and from the airport or for excursions should be undertaken with organised tour operators, and transport should be arranged or provided by the resort hotels.”
However it does not warn against travelling to the region at this current time and instead warns British travellers to be cautious and listen to public announcements.
Association of British Travel Agents (ABTA) Sean Tipton told the BBC that the incidents are mainly “directed at local people,” and that it hasn’t affected tourists as of yet.
Jamaica’s prime minister Andrew Holness confirmed in a press conference earlier this week that the warnings were to “restore public safety.”
Chief of Defence Major General Rocky Meade confirming that gangs were being targetted in regards to the shootings.
Gang shootings to the area are reported to be on the rice, as Jamaican publication the Gleaner stated there were 335 in St James parish last year.
This year, an increase in killings has increased from 23 to 38, compared to 2017.
International travel expert Nick Harris of Simpson Millar solicitors, said: “UK tourists are now quite rightly concerned about outbreaks of violence and those due to fly out in the coming days are now trying to cancel their trips over safety fears.
“This is a very worrying time for tourists caught up in this war on crime.”

Three class action complaints have been filed against Intel over the Meltdown and Spectre CPU security flaws that were discovered by researchers earlier this year and widely publicized earlier this week.
The three lawsuits—filed in California, Indiana, and Oregon (PDF)—cite not just the security vulnerabilities and their potential impact, but also Intel’s response time to them. Researchers notified Intel about the flaws in June. Now, Intel faces a big headache. The vast majority of its CPUs in use today are impacted, and more class action complaints may be filed beyond these three.
The three complaints also cite suggestions that devices using Intel’s CPUs will see significant slowdown as a result of addressing the security flaws. However, that point is in some dispute. In the course of its various public efforts to mitigate damage and address concerns, Intel has publicly said in a statement that these concerns are overblown:

Ronaldo has four years remaining on his current contract but has regularly been linked with a move away from the Bernabeu.
His tax evasion case in the summer led to suggestions he had grown frustrated with life in Madrid and he wasn’t happy with the lack of support shown from club officials.
Florentino Perez later defended Ronaldo’s situation, leading to speculation cooling over Ronaldo’s possible exit.
And he proved his worth for Real once again in their Club World Cup final against Gremio yesterday, scoring the winner with a sensational free-kick.
The Portugal international was questioned whether he would see out his career in the capital of Spain, and he admitted it is not up to him.
“If it is possible, yes, I would like to retire in Madrid,” Ronaldo said.
“But things don’t depend on me. What depends on me is what I do on the pitch.
“When I say ‘possible’, I do not make the decisions in the club. The other things don’t depend on me.”
Ronaldo has now scored seven times in the Club World Cup, more than any other player in the tournament.
And he expressed his delight at adding another personal record to his name as well as another trophy.
“I am very happy because we own a trophy we really wanted. Madrid has never won five trophies in a year.
“We are very happy, this is very natural.
“Obviously, I am very happy to know I got another record as a top scorer in the Club World Cup.
“I talk on the pitch – that is my work.
“I always try to give my best and people enjoy my football.
“I want to enjoy and keep on motivating myself to keep on playing, train and enjoy football.
“That is what I enjoy the most.”

Alaska, the final frontier, may be the next oil industry goldmine thanks to aggressive drilling, changing environmental policies, and a bullish administration. Not all Alaskans, however, are on board with the transition, and the issue is now more divisive than ever.
Take for example, the polemic Hilcorp, the fast-growing and assertive Houston-based company that while keeping a low public profile, has made a name for itself within the energy industry as a money-making powerhouse. Though the company is less than 30 years old, Hilcorp founder Jeffery Hildebrand has swiftly become a billionaire. His employees are some of the best-paid in the business, famously receiving six-figure bonuses for meeting output goals.
Their extreme success, however, comes at a high cost to the same oil-rich terrain that’s putting money in their pockets. Hilcorp is not just famous among energy moguls – it’s also infamous in environmentalist circles. The corporation has adopted an acquire and exploit strategy that has racked up a sizable number of environmental violations in Alaska and elsewhere.
Less than three years after Hilcorp began its operations in Alaska, the Alaska Oil and Gas Conservation Commission had already documented 25 violations of their regulations, culminating in the chair of the commission writing in a strongly worded letter that “Hilcorp’s conduct is inexcusable.”
In the past Alaska has encouraged small companies to explore for oil within their state with incentives like a cashable oil tax credit program, instated under Sarah Palin in 2007. However, just last month the state legislature voted to end the program, some voters citied that the program was, by any other name, a tax hike, and some stated that the incentive and its subsequent draw of prospectors in Alaska had gone too far.
In fact, in the last few years after the bottoming out of oil prices, the state has made very minimal payments on outstanding tax credits and owes almost $ 1 billion to oil companies, a staggering sum that comprises nearly a quarter of the entire state budget. Already this summer, two different oil companies announced that they’re freezing projects in Alaska because the state has failed to pay them for promised reimbursables.
While Alaska has damaged its reputation as a worthy business partner in the oil industry, it’s likely that drilling won’t decline much. In fact, it will probably continue to boom. In May, Donald Trump announced that opening the vast Arctic National Wildlife Refuge to oil and gas drilling is among his top priorities, and was featured prominently in his 2018 budget proposal.
Ultimately, it’s up to congress whether this change in protected status will come to pass, but it is indicative of a larger political zeitgeist that this regime change was brought with it. Whether or not the Arctic National Wildlife Refuge is subject to drilling, it is clear that this administration favors oil and is less concerned about environmental regulations – positions that are quite attractive to the oil industry and likely to make companies a bit bullish in their plans for the next four years.
It’s hard to say what Alaska’s oil future will be. Their economy is completely tied up in the oil industry, but that’s not as safe of a bet as it once was. In 1977 Alaska was responsible for almost a fourth of US oil. Today, the state only produces between 6 and 7 percent. From 2007-2014, Alaska was flush with cash as oil hovered around $ 100 a barrel. Today, as oil hovers around $ 50 per barrel, the state is wallowing in billions of dollars of debt and boasts the highest unemployment rate in the nation.
For many, this is the time to double down on oil and bring back the jobs that the industry provided during the state’s oil production heyday. This dream isn’t an impossible one, with oil prices slowly recovering and the recent discovery on major oil on the North Slope by three different companies. The question is, is this the future that Alaska wants, forever at the whim of the pump? Or will they prefer to turn their back on corporate interests and forage a new future in the wilderness of the final frontier?

Paul Merson, who played 423 games for Arsenal, says the club are only interested in making money which is why Arsene Wenger looks set for another two years in charge despite not winning the title since 2004.
The issue led to fans fighting among each other in the terraces during the 2-2 draw with Manchester City on Sunday, but in the eyes of Merson the board are carrying blithely on.
“There is an arrogance of Arsenal over how this could happen,” the Sky pundit said.
“Are the board worried about fans fighting each other? I don’t think there is anyone there thinking ‘we have to stop this’.
“They will look and go ‘let them fight, if they don’t come back next year there is a list that long of people who want season tickets’. It sickens me.”
Meanwhile, Alan Smith, the talisman of the George Graham era, feels at the very least it is time for Wenger to relinquish some of his powers.
“It might make some sense to have a director of football to share the load, instead of him being a control freak who wants to have a handle on everything,” he said.
“He needs to concede some of that power and listen to other people’s opinions a bit more.”
Last week, Volkswagen’s CEO Matthias Mueller effectively shut down Fiat Chrysler CEO Sergio Marchionne’s idea of the two automakers merging. However, it seems Mueller has softened, if only just, to the idea. According to Reuters, the CEO said in a press conference he is “not ruling out a conversation.” However, he did say that he would like Marchionne to discuss with him directly the possibility rather than to the media.
Though this statement certainly doesn’t mean such a merger is happening, it’s far more open than when he said outright the company isn’t in any talks with anyone at the moment. His new stance also indicates that there may be people (lawyers, accountants, etc.) behind the scenes working out possible ways a merger could work.
And even though this new development makes the prospect of of a merger between the two companies a bit less bleak, it’s still a long way from the “will they, won’t they” relationship between GM and FCA. FCA’s pursuit of GM involved emailing CEO Mary Barra and the threats of a hostile takeover, the latter of which resulted in some awkward statements about hugs. Only time will tell if VW becomes open enough for Marchionne to talk about hugs again.

]]>A former US solicitor general said this week that what will be key to whether President Donald Trump is victorious defending his immigration moratorium in the court system is whether the executive order is interpreted solely based on the text of the document.
Charles Fried, who served as solicitor general under President Ronald Reagan and is now a Harvard law professor, told Business Insider that things may not bode well for Trump if the court decides to consider statements he made along the campaign trail about banning Muslims from entering the country.
“What shadows any such effort is the question whether these executive orders have to be interpreted within the four corners (purely on the text of the documents) … or whether various statements — including statements by candidates, including statements by advisers, including 3 a.m. tweets — whether those bare on the constitutionality in the sense that they are considered competent evidence of the intent of the order,” Fried said.
If the executive order is viewed “within the four corners,” Fried said he believes it “is really pretty secure.”
“If you let in all this other stuff, who knows,” he said.
In late December of 2015, Trump announced that he would seek an indefinite ban on Muslims entering the US if he won the election. From then on, Trump made a number of statements related to the barring of Muslims from entering the country, at times backing away from the severity of his initial remark.
Following the implementation of his travel ban last month, Trump said Christians would be given preferential treatment. Additionally, one of his top surrogates and advisers, former New York mayor Rudy Giuliani, told Fox News that Trump was looking for a way to do such a Muslim ban “legally,” and enlisted Giuliani to help figure out exactly how to do so. Giuliani later walked back the comment.
At the heart of the matter is the fact that presidents have the authority to suspend entry to groups of individuals deemed to be detrimental to the United States, while, as the 9th Circuit Court wrote in its Thursday decision, the First Amendment prohibits any “law respecting an establishment of religion” and the Equal Protection Clause “prohibits the government from impermissibly discriminating among persons based on religion.”
The states arguing against Trump’s executive order, Washington and Minnesota, used Trump’s past statements to make the case that it was discriminatory based upon religion. But the 9th Circuit Court, in its ruling, did not make a determination on whether the executive order was discriminatory.
Fried said “there are great dangers” about bringing Trump’s and his advisers’ past statements into consideration.
“Because candidates say all kinds of things, and this president says all kinds of things,” the Harvard law professor explained. “Some of which, he contradicts himself with within the next 10 minutes. So a court might be tempted in that context to say, ‘we’re not going to look at any of this stuff, it’s just the text of the order [that will be reviewed].'”
Although he said he “wouldn’t go that far” and say the order was constitutional based alone on the text of the order, Fried did say the the “four corners” interpretation would boost the Trump administration’s chances of success.
“I would say that it has a very much better chance,” he said.
Reince Priebus, White House chief of staff, said Friday that the administration would be “fighting out this case on the merits.” Trump has vowed to take the case to the Supreme Court.
The White House is additionally reportedly considering retracting and replacing the executive order with one that is altered slightly and not under a temporary restraining order.
