Update 8/28/18: A judge has ordered an injunction to block Redbox from selling digital download codes for Disney movies. Read on for our original article from December 2017, which has been updated with new information at the bottom.
The Walt Disney Company hasn’t exactly been making the most level-headed decisions lately, but here’s something I think they have a right to be a little miffed about. The company has filed a lawsuit to halt Redbox from selling digital download codes for Disney movies in its kiosks across the country. Does Redbox stand a chance of winning this? Find out more about Disney suing Redbox below.
According to The Wall Street Journal (via Variety), Disney has sued Redbox to stop the DVD rental company from selling digital download codes for its films. Redbox and Disney haven’t had a distribution deal together since 2012, so Redbox has been buying Disney DVD and Blu-ray combo packs themselves and renting them out to customers. Those combo packs come with a digital download code, which Redbox has been separately packaging and selling to customers since October, when they launched a service offering those codes for sale in their kiosks.
The problem for Redbox is that the fine print on the combo packs includes the phrase, “Codes are not for sale or transfer,” and that’s exactly what they’re doing. A Redbox spokesperson responded to the lawsuit by saying, “While we don’t comment on pending litigation, we feel very confident in our pro-consumer position.” Unless there’s a loophole that I’m missing, I’m not quite sure how Redbox thinks they’re going to win this one. The Disney legal department is pretty damn powerful, and they’re not only asking Redbox to stop selling their movies, but “asking for damages of up to $ 150,000 per title sold by Redbox for ‘willful infringement’ (or monetary damages to be determined at trial), and also wants Redbox to fork over the money it has made from sales of its movies.” Depending on how many Disney films Redbox has sold thus far, that could be a tremendous amount of money.
The timing here may not be completely coincidental. Last month, Disney Movies Anywhere added multiple other Hollywood studios to its home video app and rebranded as “Movies Anywhere,” and of course Disney is also on the precipice of launching its own streaming service full of Disney, Marvel, Pixar, and Lucasfilm movies and brand new original content – including a live-action Star Wars TV series. This might be a situation in which Disney is looking to clear away some of its competition before they blast into the marketplace…but again, from the outside, it seems as if Redbox is blatantly breaking a copyright law, so they’re probably right to go after them.
There’s still a possibility that this gets settled out of court, but I almost hope it doesn’t because I’d love to hear Redbox’s reasoning for how they think they’re justified in this case.
Update: Variety reports that after Disney’s first attempt to block Redbox from selling these codes failed, the studio reworked the language for the release of Black Panther to be far more detailed, and that convinced the judge to issue an injunction.
“Because Redbox did not obtain an ownership right to any digital content when it purchased Combo Packs, Disney has adequately shown that it is likely to succeed on its claim that Redbox encouraged Redbox customers to infringe Disney’s copyrights by redeeming Codes in violation of the license terms set forth on the redemption sites,” he wrote.
According to Variety, “the injunction applies to any combo packs that use the language on the Black Panther DVDs”, but it’s unclear if the studio is going to be able to stop Redbox from selling Disney download codes for older movies that don’t have that language in place.

Do you still partake of physical media for movies – and have you made the leap to 4K? If so, Redbox has some good news: they’re going to start renting 4K movies…but only for certain titles, and in certain markets.
With so many streaming options available, it can be easy to forget that Redbox is still out there renting out physical copies. But they are, and now they’re trying to sweeten the pot. Per Variety, Redbox “is now offering 4K Ultra HD Blu-ray disc rentals — but it’s starting with only four titles, available in limited quantities in just six U.S. markets.”
Those 4 titles are:
These 4K titles will be available at 2,500 Redbox kiosks in New York City, Los Angeles, Seattle, Austin, Detroit, and Miami, and renting them will cost you $ 2.50 a pop, which is a bit more than the $ 1.75 charge for DVDs and the $ 2 rental fee for regular Blu-rays.
This is essentially a test-run for Redbox, as they plan to offer more 4K titles in the future, including Red Sparrow, Pacific Rim Uprising, and the new Tomb Raider movie that everyone already forgot about.
I suppose the question now is: do you care? While I remain a strong proponent of physical media, I also know that most people seem to be content with streaming their entertainment. Streaming quality has improved greatly over the years, but Blu-ray still looks better, and 4K looks even better than that. But it seems as if only a certain group of people actually care about that – they choose convenience over quality. As for the people who do prefer physical media to streaming, I feel like they tend to buy their physical media rather than rent it. (Redbox also offers On Demand titles, but that’s still the beta stage.)
Redbox is counting on movie watchers wanting to rent 4K discs in addition to purchasing them, though, which is why they’re rolling this idea out. “We wanted titles that would have high interest going forward — they’re all action-related and incredibly visually stunning,” said Redbox CEO Galen Smith. “As a consumer, I want to pay a slight premium to get the best possible experience.”
Once the 4K titles begin to be rented, Redbox will “use the data it collects to calibrate inventory and distribution of 4K titles”, so if this idea works out, you can expect even more 4K discs to appear in more and more Redbox kiosks.

Last month, Disney filed a lawsuit against Redbox claiming that the rental company was violating Disney’s copyrights. Redbox buys the Disney discs it rents at retail and when those discs come with download codes for digital copies, Redbox sells them to its customers. But Disney says that’s against its terms of sale and requested an injunction, any profits Redbox made from those sales and $ 150,000 per copyright infringement. Redbox has now clapped back, Variety reports, filing an opposition to Disney’s complaint and injunction request.
In its argument, Redbox says that Disney’s request has no legal basis and that the lawsuit is just an attempt to hurt its competition. “By this motion, Plaintiffs seek to stifle competition to more smoothly launch Disney’s own digital content streaming service, maximize the price other services like iTunes and Amazon (and their customers) pay for Disney movies, and secure a greater market share for Hulu — the viewing service Disney will control as part of its $ 52 billion acquisition of 21st Century Fox,” said Redbox. It also calls Disney’s methods “anti-consumer” and “anti-competitive.”
Redbox says that it’s protected by the first-sale doctrine, which allows for the resale of used items, such as DVDs, and that the doctrine applies to the resale of the download codes. It also said in its opposition that it had invested over $ 700,000 and a year’s worth of work into setting up its system to sell digital movie download codes and that an injunction would significantly harm the company.
Disney’s motion will be heard in a Los Angeles court on February 5th.

This week, Redbox, the company behind all those movie rental kiosks, extended its distribution deal with Universal, . The studio had previously held fast on a 28-day window between when it released movies for home purchase and when people could rent them from Redbox. Now, that window has been eliminated. The new terms apply to both the physical locations as well as the company’s new streaming service, which was announced earlier this month.
This matches recent deals that Redbox has put in place with other film studios. Both Sony and Lionsgate have similar same-day rental licensing agreements, while Warner and Fox have a week-long window. Disney has long been a holdout for Redbox; the rental company has found itself in some hot water after selling the digital download codes that came with the Disney movies it purchased. That lawsuit is still ongoing.

Redbox, the company behind those movie and game-renting machines you see outside of grocery stores and Walmarts, is starting to offer Switch games. Right now this is just for select cities: Seattle, San Antonio and Portland, Oregon. But it could expand across the U.S. if the Switch games prove popular in those locations.
After the collapse of traditional renting stores like Blockbuster, Redbox’s kiosks took over as the primary way Americans pay for short-term movies and games. The inclusion of Switch titles is another sign of outside companies getting on board with Nintendo’s home console/portable hybrid.
The Switch has proven to be a success since launching in March. It was the top-selling system in August in the U.S. and has been home to some of the best-selling games of the year, including The Legend of Zelda: Breath of the Wild.
Switch games at Redbox will cost as much to rent as PlayStation 4 and Xbox One titles: $ 3 a day. Redbox’s offerings will include Mario + Rabbids: Kingdom Battle, Pokkén Tournament DX, Lego Ninjago, and more.

This year Redbox is trying to make a resurgence, adding kiosks after a few years of shrinking availability. Of course, if it’s going to draw people in for disc rentals over streaming, it will need to provide the movies they’re looking for and renewed studio licensing deals will help make that happen. This week it renewed an agreement with Sony Pictures that secured its movies, once again, for rental at Redbox the same day they go on sale, while Lionsgate made a similar arrangement a couple of weeks ago. As Home Media Magazine notes, recent renewals with Warner and Fox bring their movies to the box a week after they go on sale, leaving Universal as the lone holdout still insisting on a 28-day window.
The simple fact is that physical media isn’t bringing in as much money as it used to, and studios are more flexible about methods that will keep people using discs instead of Netflix. Of course, Redbox still trails the availability of streaming video-on-demand in many cases, but it’s also much cheaper, at just $ 2 or so for a Blu-ray copy.

Redbox has spent years trying to reduce its dependence on disc rentals, and not without reason. You don’t have much as incentive to rent from a kiosk when online video (including from Redbox) is just a heartbeat away. That doesn’t mean the company is giving up on the idea, though — in fact, it just made a fresh commitment to the concept. CEO Galen Smith has revealed that Redbox will add a net total of 1,500 new DVD kiosks across the US, and will add more still in 2018. Don’t think of this as an attempt to pretend the internet doesn’t exist, mind you. Instead, it’s about a smarter use of resources.
It’s true that Redbox has pulled thousands of kiosks in the past four years. However, Smith says those were all “underperforming” machines. The new hardware is theoretically going to locations where they’re more likely to turn a profit… and Redbox is still quite profitable, according to the CEO. That and its new corporate structure lifts some of the expectations. Ever since a private equity company (Apollo Global Management) bought Redbox parent Outerwall in late 2016, Redbox has been a more independent outfit without the pressures it had before. It can invest as much as it needs, and it can focus more on raw cash flow from each kiosk.
The challenge, of course, is making sure that those kiosks offer something you can’t get by firing up Netflix or iTunes. Smith notes that Redbox still has coveted rental deals for most of the major movie distributors (Disney is the notable exception, but Redbox can still buy the discs), and paying $ 1.50 to $ 2 for a physical rental beats a few dollars through a download-based rental service. The danger may simply be that people are unaware of Redbox. It’s planning a renewed marketing push, but it could be hard for Redbox to draw your attention when you’re happy to sit on your couch.
