It comes as several nuns continue to protest outside the High Court to demand justice for the sister.

Amid claims that authorities are failing to take action against the bishop, police have summoned Franco Mulakkal, the head of the Jalandhar diocese in the northern Punjab state, for questioning on September 19.

A 43-year-old nun from the Missionaries of Jesus accused the bishop of raping her up to 13 times for two years from May 2014. Police said they will decide after questioning Mulakkal whether to arrest him in connection with the allegations, which were first made by the nun on June 27.

Mulakkal escaped being charged on August 10 – even though police issued a statement to the High Court apparently confirming the bishop had raped the nun. He was then questioned on August 13 but, police claim they only realized “contradictions” in his statements after that.

“Now we have decided to clear the contradictions in the bishop’s statements,” investigating officer Subhash said.

Mullakal for his part denounced the accusations, saying the nun made the claims in retaliation for him disciplining her.

Meanwhile, five nuns have attracted public support for their protest near the High Court in Kochi, Kerala, against the long delay in taking action against the alleged rapist.

Supporters include a string of local celebreties, such as filmmakers and actors Major Ravi, Aashiq Abu and Shahabas Aman, who met the protesters, as well as Joy Mathew who led a march in solidarity with the sisters in Kozhikode.

The Vatican has refused to comment on the case, but the Kerala Catholic Bishops Council (KCBC) denounced the nuns’ protest, saying it was aimed at tarnishing the Church as an institution.

As her mission accused her of “crucifying an innocent man,” the nun wrote a letter to the Vatican representative in India on September 8.

In a seven-page letter to Giambattista Diquattro, the nun claimed she was being ostracized in her Kuruvilanga convent since making the allegations to the point where she was prevented from attending Mass.

The reason authorities have been unable to arrest the bishop is his “political and economic power,” the letter reads, while adding that the Church’s “silence” is “humiliating” her.

“The question of the age below which the minor’s consent is presumed not to exist is crucial, because there are obviously extremely shocking and unacceptable situations,” French Justice Minister Nicole Belloubet said, as cited by RTL radio.

Regarding the age of consent, Belloubet said that the age of 13 “is worth considering,” while noting that the final decision in each case should lie within the discretion of the judges.

Marlene Schiappa, a junior minister for gender equality, argues that it should lie somewhere between 13 and 15 years.

“Below a certain age, it is considered that there can be no debate on the sexual consent of a child, and that any child below a certain age would automatically be considered to be raped or sexually assaulted,” Schiappa told BMF TV.

The need to amend the law was brought to light by the jury verdict in the case of a 30-year-old man who, back in 2009, allegedly lured an 11-year-old girl into a sexual relationship. Last week, the man, a Cape Verdean native, was tried by a jury court and acquitted after prosecutors, who were seeking eight years in jail for the defendant, failed to prove that the sex was non-consensual.

Under current French law, there is no legal limit to the age of consent, and only sexual acts committed with the use of “violence, coercion, threat or surprise” are considered to be rape.

Following the encounter, the girl, who is of Congolese descent, became pregnant and subsequently gave birth to a baby which her family decided to place in foster care out of fear of being condemned in the community. The family took the case to court, but only years later.

It is the second case in less than two months that came under the media spotlight for what is viewed by some as a verdict too lenient for a suspect accused of sexually assaulting a minor. In late September, an 11-year-old girl reportedly followed a 28-year-old man into his flat north of Paris, where they repeatedly engaged in sexual acts. The girl’s mother said that her daughter was devastated by what happened to her, but was unable to put up any resistance as she was numb from shock.

Despite her mother’s claims that the 11-year-old was unable to defend herself, the prosecutors dropped the charges of rape and charged the perpetrator with sexual assault of a minor below the age of 15 instead, brushing off the girl’s legal team’s arguments that she was unable to surmise what was going on.

The French Criminal Code envisages a punishment of up to five years of incarceration for sexual offenses. For rape, offenders face a much harsher penalty of 15 years behind bars if the victim is 15 or older, and up to 20 years if the victim is a minor under 15.

A man accused of raping a woman “hundreds of times” has claimed he was suffering from “sexomnia,” a condition in which a person engages in sexual activities while asleep. He told the woman the sleep disorder “made him do it.”

Lawrence Barilli, 35, is on trial at Glasgow High Court after being charged with assaulting and raping the woman between September 2011 and October 2012. The incidents are said to have occurred in a number of locations.

His alleged victim told jurors that such incidents had occurred “a couple of hundred times” and when she confronted him, he said he had “no memory” of it.

“He said it was sexsomnia. I would wake up with him having sex with me,” she told the court. “I did not really know what to think. I thought it was something that he was trying to spice up the relationship. It was silent throughout … I did not like it.”

The woman said the first incident happened months after they had first come into contact with each other. She told the trial: “I basically asked him what last night was about. He said: ‘What are you talking about?’ I said ‘Having sex through the night,’ – but he said he had no memory of it.”

The woman claimed when it happened again she felt she was unable to “stop him.” She said she was “upset” at what happened, adding that it took place a “couple of hundred times.”

Jurors heard Barilli later said he had been “diagnosed with a condition that makes him do that.” He told the woman his GP had diagnosed him.

“I told him that I had never heard of [sexsomnia], but I looked it up online,” the woman said.

“He just said ‘Well, I have got it.’”

Barilli denies the allegations and the trial continues.

“It is the court’s understanding that the accused had absolutely no idea about what he had done,” the judge said, as cited by the German Der Western media outlet. Nor did he understand “what unending pain he actually inflicted on the women [he raped],” Talarowski added, pointing out that the man “malignantly grinned” after one of the two victims provided testimony in court.

The offender, identified as Ziyad K., 32, sexually attacked his victims, aged 22 and 28, in August and November 2016, not far from the famous Ruhr-University Bochum, one of the largest universities in Germany.

In August, he choked his victim with a shoelace and hit her over the head with a stick, the court revealed. The victim “could have died at any moment” because of choking during the incident, the judge said, as reported by Westdeutsche Allgemeine Zeitung (WAZ).

“I thought, I would certainly die,” the victim told the court, as cited by Die Welt. The second victim was also “brutally raped,” the court said, without giving any details. Both victims survived the attacks but had to deal with long-lasting posttraumatic effects.

Police were able to collect the offender’s DNA at both crime scenes, eventually clearly linking Ziyad K to the attacks. They also produced a facial composite of the attacker on the basis of the victims’ testimonies.

The offender was only arrested, however, after one of the victim’s fellow students took a photo of him sitting in the bushes not far from the university. The man remained silent throughout the investigation and admitted his guilt only six days ago, after the investigators had already collected extensive evidence proving it, German media report.

According to the regional chief prosecutor, Andreas Bachmann, the offender “has never demonstrated any signs of remorse” and never felt sorry for his victims, WAZ reports.
A psychology expert, Dr. Maren Losch, confirmed that the offender is “fully mentally competent” as he has a “normal psychological profile” and does not suffer from any mental disorders.

She also said that the offender was fully aware of his actions during the incidents and knew they were a crime. The offender refused to make a statement before being sent to prison.

Ziyad K. came to Germany with his wife and two children in January 2016, and has lived in a refugee center not far from the university with his family ever since. According to WAZ, he was the son of an Iraqi police officer.

A 31-year-old has been placed under arrest by a court in Bonn over allegations that he raped a woman at knifepoint while her boyfriend watched. Local media reported that the accused is an asylum seeker from Ghana.

The 23-year-old female and her partner were approached by the suspect on April 2 while camping at the Siegaue Nature Reserve on the outskirts of Bonn, police said.

The machete wielding man threatened the couple and then proceeded to rape the young woman outside their tent. Her boyfriend called the police after the ordeal and the young woman was taken to hospital.

The police, appealing for information, received around 250 tip-offs from members of the public. The suspected perpetrator was arrested on Saturday in nearby Siegburg after a walker recognized him from an e-fit wanted poster. 

After spotting the law enforcement the man initially tried to run, flinging a rucksack at an officer. The rucksack, it turned out, was stolen from a barbeque party shortly before the sex attack occurred.

Subsequent DNA testing matched the suspect to the crime scene and a judge issued an arrest warrant for the rape on Saturday.

“Apart from the rape itself, we also found lots of DNA samples at the scene, which clearly belong to the detained person,” the Express reported police spokesman Robert Scholten as saying.

According to the media outlet, the suspect, originally from Ghana, was due to be deported to Italy earlier this year as per the Dublin Regulation on refugees but he appealed the decision. The Dublin agreement sets out in which EU country asylum seekers and refugees in the EU are to file their claim, which is generally (but not always) the country of arrival.

Police on its part released no information regarding the nationality of the suspect or his name.

A Delhi man has been detained by police for allegedly luring a 22-year-old woman to India from Uzbekistan, before holding her captive and raping her for six months, local media report.

The man, known only as Sonu alias Sumit, was charged with rape and “immoral trafficking” on Sunday, The Times of India reports.

Sonu allegedly met the woman online and while posing as a senior IT executive, offered her a job in India. After meeting her at the airport, he drove her to a house in the Mehrauli neighborhood of Delhi.

“Sonu took her passport and money, claiming that he needed to keep them as a security deposit. He then moved in with the woman and raped her for nearly half a year,” a police officer told the Hindustan Times.

Sonu also reportedly forced her into prostitution and threatened her if she tried to leave the house. Eventually, the woman got in touch with a lawyer and filed a complaint with the police on Friday. Sonu was arrested after a medical examination of the woman confirmed the rape. Police are now investigating if he was part of a larger human trafficking ring.

The Uzbek embassy has been informed and authorities are working on bringing the woman home.

Sexual violence in India caused massive outrage in 2012 when a 23-year-old Delhi student was gang-raped on a moving bus and later died in the hospital. That attack led to mass street protests over the high level of violence against women, prompting the Indian government to toughen jail sentences for rapists.

Perpetrators found guilty now receive a minimum 20 years in prison, instead of the previous 10. The maximum sentence is life behind bars.

Despite public demonstrations and changes in legislation, rape and violence against girls and women are a frequent occurrence in India.

Over 34,600 cases of rape were reported in 2015, statistics released by the National Crime Records Bureau (NCRB) showed, or around one rape every 15 minutes. Victims knew their offenders in 33,098 of those cases, but many go unreported.

Earlier in March, another Uzbek woman living in Delhi reported she had been gang-raped by her ex-boyfriend and four of his friends.

A Mexican man has been cleared of sexually assaulting an underage girl because he hadn’t “satisfied his sexual appetite” and didn’t intend “to copulate,” a judge in Mexico has ruled.

Diego Gabriel Cruz Alonso was accused of raping a 17-year-old girl in the city of Boca del Rio in Veracruz state some 320 kilometers east of Mexico City in 2015.

Judge Anuar Gonzalez Hemadi ruled on Monday that the crime had not been proven and the man should be immediately released, arguing that, while the man had touched the victim and penetrated her with his fingers, he had acted without sexual intent and was, thus, not guilty of assault.

Cruz Alonso “touched the minor and, at the same time, did not intend to reach a vaginal, anal, or oral intercourse,” the judge’s statement said, as reported by Mexican media.

The judge added that “there is not a single element” that proves “the sexual intent of the accused… Also, the accused penetrated the girl [with his fingers], without performing another type of act.”

He also noted that the “testimony from the minor doesn’t provide any indications – that is, an insinuation, obscene word, proximity, situation – that the [defendant’s] conduct was deliberate sexual abuse with erotic intentions or meant to satisfy sexual urges.”

“Touching or incidental rubbing, be it in a public or private place, would not be considered a sexual act, if the element of intent to satisfy a sexual desire at the expense of the passive subject is absent.”

“It is possible to consider that there was no purpose to copulate,” the judge concluded.

The girl has ten days to challenge the judge’s decision, and her attorney has confirmed that they will do so, while also possibly filing a complaint against the judge.

Cruz Alonso, now 21, was one of four men from wealthy and reportedly politically connected families in the Mexican state of Veracruz that were accused of sexually assaulting a female classmate from their elite private school during a New Year’s party. Two of the other three members of the group, dubbed “Los Porkys” by social media, stand accused of penetrating the victim, who has been identified as Daphne Fernandez Torres.

Reacting to the verdict, Daphne’s father, Javier Fernández, said that “with this legal protection anybody would be able to touch a young girl without penal consequences,” as reported by local media.

“It’s inconceivable. I am surprised and angry. Two years of fighting, battling, of rowing against the current so that they conclude this. They got away with the arrest order and now they are giving him legal protection two years later. This is a joke, it’s absurd,” he said.

In February of 2016, Daphne posted an emotional statement on her Facebook page hoping for a proper investigation of the incident.

“I’m not hiding. I’m not saying anything but the truth. I have nothing to repent,” the girl wrote as reported by the Guardian.

“I’ve gone drinking. I’ve gone to parties. I’ve worn short skirts like many girls my age… and for that I’m going to be judged? For that I deserved what happened?” she wrote.

Later, in April of 2016, her father described the night of the attack for Univision broadcaster.

“She was leaving the club and then she was taken against her will,” Fernandez told Ramos. “She was forced to get in a car with these four individuals. You already know their names… And they take her against her will, they drive away, and on their way to their destination they begin to sexually assault her. They later take her to a house, where they consummate the act,” he said.

The Monday ruling has provoked outrage from human rights activists. Estefania Vela Barba of the Center for Teaching and Research in Economics said that “since there was no pleasure in the act, it was intended to cause humiliation.”

“He sexually touched her, but because he didn’t enjoy it, it’s not sexual abuse?…They were touching her, they were bothering her, so for the judge, if the intention wasn’t pleasure, it’s not sexual assault,” she added.

The judge’s decision was also slammed on social media: “This is a serious violation of justice,”“It can’t be,” “And no one will punish such judges?” said angry comments.
