Snohomish County Judge Linda Krese was “surprised” and “outraged” by the deficiency in Washington’s state law which only allowed her to sentence Brian Varela to 34 months in prison – the maximum judgment for an individual with no prior criminal record.
Varela pleaded guilty to second-degree manslaughter, third-degree rape, and unlawful disposal of remains of Alyssa Noceda last February. According to case documents, the 20-year-old, who was known to use and sell drugs, invited the teenage victim to a house party where he offered her narcotics.
After Noceda snorted a “large line of Percs” [painkillers], he offered her a “dab” of liquid marijuana, at which point the 18-year-old collapsed unconscious. But instead of calling for help or administering aid, Varela raped the high school student.
He then took selfies with his victim and sent them to his friends, and went on playing video games until passing out.
When he woke up the next morning, Noceda was dead. As if nothing had happened, Varela got dressed and went to work, where he bragged about the ordeal to a coworker, who notified the police. When authorities arrived at Varela’s mobile home they discovered the body with her legs broken to fit in a crate. Authorities also discovered that Varela tried to use Noceda’s finger to gain access to her phone to post messages that would give the impression that she had run away from home.
‘I’m going to ruin his life lol’: Teen ‘rapist’ latest victim of police disclosure failings
“It’s a joke,” the victim’s mother Gina Pierson, told a local news outlet after the judgment on Thursday, noting that she intends to fight the verdict and demand a life sentence for the killer. “Usually people who do stuff like this don’t get away with a slap on the wrist.”
“You might as well let him walk free with that kind of time,” Noceda’s aunt, Rachelle Palmer added.

As more actors denounce director Woody Allen, Alec Baldwin is publicly standing with him.
Dylan Farrow, Allen’s adopted daughter, has long accused Allen of sexually abusing her when she was seven years old. And since the #MeToo movement has come to prominence in Hollywood, many actors have either said they would never work with Allen again, or in some cases, donated their salaries from his movies to charity.
But not Alec Baldwin.
Baldwin, who has starred in several of Allen’s films including “To Rome with Love” and “Blue Jasmine,” posted a series of tweets on Sunday in support of Allen. In the tweets, Baldwin compared Dylan to Mayella Ewell, a character in the classic novel “To Kill a Mockingbird” who lies about being raped.

1 of the most effective things Dylan Farrow has in her arsenal is the “persistence of emotion.” Like Mayella in TKAM, her tears/exhortations r meant 2 shame u in2 belief in her story.
But I need more than that before I destroy some1, regardless of their fame.
I need a lot more.

To say that @RealDylanFarrow is telling the truth is to say that @MosesFarrow is lying.

If my defense of Woody Allen offends you, it’s real simple.
Unfollow.
Condemn.
Move on.
Allen has always denied the allegations from Dylan Farrow. Allen and Dylan’s brother Moses — whom Baldwin mentions in one of the tweets — say that Dylan’s mother, Mia Farrow, brainwashed her into telling this story to get revenge on Allen for cheating on her with their other adopted daughter, Soon-Yi. Allen had an affair with Soon-Yi and has been married to her for 20 years.

Mujahid Arshid, 33, a builder, allegedly abducted his niece Celine Dookhran, 20, a Barclays worker, and another young woman, 21, who cannot be named for legal reasons. He is then said to have taken them to a disused six-bedroom house he was working on in Kingston, south London in July last year.
The second victim managed to survive by fooling her attacker into believing they could be together. The woman then called her mother and police raided the property. It was then that officers found the remains of Dookhran dumped in a freezer.
Once Arshid was arrested at the Holiday Inn Folkestone, police went through his laptops and found pictures of his victims. His internet history included searches including “chest freezers for sale,” “at what temperature does the human body freeze,” and “can a person freeze to death,” jurors heard.
Arshid, said to be “sexually fixated” on the girls, was also found to have searched for strong painkillers, sulfuric acid, and googled “acid bath murderer.”
Jurors were told the defendant also looked into “human cremation” and “butchering the human carcass.”
According to Prosecutor Crispin Aylett QC, Arshid had searched for information on serial killer John George Haigh, who was hanged in 1949 for murdering six people and disposing of their remains in a number of ways, including by dissolving them in baths filled with acid.
The serial killer, who Aylett said was known in “infamy” for the acid baths, inspired Arshid to set up a new email address at the domain iNeedAnAcidBathSpace.com.

Police also found a bank payment to co-accused Vincent Tappu, an employee of Arshid, who allegedly helped him to abduct the girls. The pair are jointly charged with the kidnap of Dookhran and the second woman, conspiracy to falsely imprison both women, and possessing a firearm with intent – a taser.
Dookhran’s family wept at the Old Bailey as a police interview with the witness was played. She told how they were abducted by Dookhran’s uncle and a taser-wielding accomplice, and bundled into the back of his pick-up truck.
In the police interview, she described hearing screams and thuds as Arshid allegedly killed Dookhran after molesting both women. When he turned on her, the witness allegedly told him: “No, no, no, we need to talk.”
She said, according to the Daily Mail: “I started fighting, I grabbed him, kneed him down below. He did not flinch at all. I grabbed his face. I grabbed the knife. He started to slit me everywhere. I got my neck slit, my wrists.
“He said ‘Now you’ve got 10 minutes to live and your body will shut down.’ I was trying to play dead. He molested Celine’s body while she was dead and then he molested me thinking I was dead. He’s such a psycho.
“I sat up and he said ‘How have you got so much energy?’ I was covered in blood from head to toe. I was swimming in it. I started saying things he wanted to hear: ‘I love you, we can run away together, we can be happy together, we can have a family.’
“He said ‘I’m not good enough for you, look what I have done,’” she recalled.
Arshid, of no fixed address, and Tappu, 28, of Acton, west London, deny kidnap, false imprisonment and possession of a firearm with intent.
Arshid has also pleaded not guilty to murder, attempted murder, rape of both women, and the previous sexual assault and assault by penetration of the surviving woman when she was about 13.

A woman who told her husband she believed she had been sexually assaulted during a night out later discovered he was her attacker, a court heard. After collecting his wife, who had been found slumped on a bench, he took her home and raped her.
The woman had gone out alone and become intoxicated after an argument with her husband, 35, who cannot be named for legal reasons. The next morning, the victim suspected she had been sexually assaulted so confided in her husband, who told her to call the police, Reading Crown Court heard.
Detectives later arrested the man after DNA showed he was the attacker. He had claimed the couple last had consensual intercourse a week earlier, but evidence proved otherwise.
The man began his seven-year jail sentence last week after being convicted of rape by a majority verdict. He was also ordered to sign the Sex Offenders’ Register and made the subject of a restraining order, banning him from contacting his wife other than through solicitors.
The court had earlier heard the pair had an argument on the way to a friend’s barbecue and the woman had spent the night drinking in a bar before she was found in a drunken stupor, the Sun reports. The judge said CCTV footage shows she went to a bar and drank a “considerable amount of alcohol” before leaving “completely intoxicated” at about 1am.
The judge explained that the victim’s husband had spent the evening at the barbecue with their son, but at 2am a member of the public called him to say his wife was draped over a bench close to a major road. The judge said: “In your evidence to the court and in your interview with police, you said she was very drunk, barely coherent and had trouble talking. You drove her home and the inevitable conclusion of the jury was you then raped her while she was unable to consent, as a result of the alcohol she had consumed.”

The victim said she felt she had been betrayed by the one person in the world she trusted the most, in a statement read by the judge. “She described the total and utter shock upon finding out the person responsible was you, her husband,” the judge said. “Your marriage has broken down as a result and she had to move out of the home you shared together.”

Italian police rescued a woman who had been held in an underground cellar and repeatedly raped and tortured for 10 years. She gave birth to two children from her abuser, who chained her to a bed and even forced her son to attack her.
Police found the victim, along with her two children, a three-year-old girl and nine-year-old boy, near the town of Gizzeria, southern Italy, the authorities said in a statement on Wednesday.
The Romanian woman, whose name hasn’t been released, was 19 when she arrived in Italy to take care of an elderly lady, La Repubblica newspaper reported. However, when the lady died, her son began to abuse the Romanian care worker.
For 10 long years the victim was kept in several apartments before being moved to an underground cellar in a building near Gizzeria. Her bed was made of cardboard boxes and instead of a toilet she had a garbage bin. The dirty cellar was also reportedly infested with vermin. To prevent the woman from fleeing, the captor, a man in his 50s, secured the door with a large chain.
After years of abuse, the woman gave birth to two children. She apparently bore them in the cellar without any attendance from doctors. She also went without treatment for the injuries she suffered from almost daily violence, which reportedly involved beatings and lacerations caused by a fishing line. The children also reportedly watched the chilling abuse, and it is alleged that the attacker forced the woman’s young son to join in with torturing her.

The boy attended a school and on several occasions the captor took him on a ride in a car. It was those journeys which caught the attention of the local police. During a routine stop, officers noticed that the child appeared unwashed and demanded to speak to the boy’s mother. When police visited the man’s house, they discovered the cellar where the woman, now 29, was being held.
Footage released by police on social media shows the cellar interior where the victims were kept. Broken chairs, cardboard boxes and rubbish can be seen scattered around, while out-of-date packaged food and moldy loaves of bread are seen stacked in a metal barrel.
The man has been charged with “family mistreatment,” “slavery” and “sexual violence,” police said.

In a series of tweets directed at Amazon’s Jeff Bezos, Rose McGowan has accused the company of “funding rapist, alleged pedos and sexual harassers.” She wrote that she told the head of Amazon Studios, presumably Roy Price, that she told him “HW raped me.” She claims Price said “it hadn’t been proven.”
Representatives for Amazon Studios and Amazon did not immediately respond to requests for comment. Harvey Weinstein’s representative, Sallie Hofmeister, told BuzzFeed News “Any allegations of non-consensual sex are unequivocally denied by Mr. Weinstein.”
And Lisa Bloom, who until recently represented Price, told BuzzFeed News her “representation of Roy Price has concluded.” Bloom had also been advising Weinstein before she quit on Saturday.
In the New York Times story last week exposing Harvey Weinstein for alleged sexual harassment spanning decades, the Times also reported that McGowan had settled with Weinstein for $ 100,000 after an “after an episode in a hotel room during the Sundance Film Festival” when she was 23.
In Ronan Farrow’s New Yorker investigation of Weinstein, three women — two of whom were on the record, and one who was anonymous — alleged the studio mogul had raped them. Weinstein has consistently denied he has raped anyone.
McGowan has been on a tear on Twitter since the Times story posted, calling out Weinstein and those she perceives as having colluded with him. She has started a petition demanding that The Weinstein Company board be dissolved. “Every man there has the blood of sorrow on their hands,” she tweeted on Tuesday. She also called out Ben Affleck after he made his statement about Weinstein.
McGowan’s target on Thursday was Amazon Studios. Earlier this year, McGowan was writing a script for Amazon about her childhood growing up in the Children of God cult. Amazon Studios has made a number of television deals with The Weinstein Company, including the high-profile television series The Romanoffs by Matthew Weiner and David O. Russell’s untitled series, which McGowan called a “Weinstein bailout” on Twitter, and said she tried to nullify her script deal with the company when she learned of it, only to be told her show “was dead.” On Wednesday, a representative for Amazon said in a statement, “We are reviewing our options for the projects we have with The Weinstein Company.”
According a story by Kim Masters in August, Amazon investigated Price for making “unwanted sexual remarks to Isa Hackett,” a producer of The Man in the High Castle and the daughter of Philip K. Dick, upon whose novel the show is based. And in an interview with Hackett published Thursday, the producer told Masters she felt inspired by the Weinstein revelations to come forward.
Despite McGowan’s outspoken activism on Twitter — which even got her temporarily suspended from the service Wednesday night for including a screenshot that had a phone number in it — she has not explicitly named Weinstein as her rapist, and this, using his initials and association with The Weinstein Company, is the closest she’s come.
In Farrow’s the New Yorker story about Weinstein, he wrote that one actor had been interviewed on the record, but later had to withdraw: “The legal angle is coming at me and I have no recourse,” she told him. A HuffPost story Wednesday about why NBC News didn’t run Farrow’s story revealed that person was McGowan.
In a 2015 profile of McGowan, BuzzFeed News asked her about Weinstein after she revealed she had been raped, and had been “blacklisted” by someone powerful in the film industry. McGowan, without naming Weinstein, said: in response “There’s a lot of people that don’t deserve to be alive — put it that way. There’s a lot of people who also get the face and body they deserve.

Walking home at the end of July from a bus stop in Falun, he was suddenly attacked, threatened with a weapon and raped, Liljeglod disclosed on Facebook.
“On my way home I was attacked by an unknown man armed with a knife,” Liljeglod said. “I was brutally treated and also raped at knifepoint under the pretext that I was ‘Left-wing female genitalia’, that people like me ‘enjoy this’ and finally that I was a traitor.”
In an emotional and very personal revelation, the politician said he initially kept the attack private, only reporting it to police, but eventually turned it into a public discourse because the nature of the incident was politically motivated.
“The few words and sentences expressed by the man had a clear connection to me as politically active and therefore it affects us all,” Liljeglod wrote, adding that “what happened to me is an event in the crowd.”
Stressing that he does not seek “compassion or empathy,” the politician continued the rest of his narrative speaking about protecting the principles of democracy in Sweden.
“I stand here because, given my deeply rooted belief that democracy is an integral part of our society,” he wrote. “Nothing is more important than democracy, people die for the right to democracy every day – and the right we have inherited through our parents’ struggles, we have to continue fighting for.”
No one has yet been arrested for the attack on Liljeglod.
“We have secured some traces we have sent for analysis to the National Forensic Center,”said Police spokesman Stefan Dangardt. “If it turns out that the motive is his political allegiance then it is obviously a hate crime.”
“There are surveys that show that up to 30% of all politicians have been subjected to crime, but only 20% report it,” the spokesman pointed out.
According to a recent The Politicians Safety Survey (PTU), published by the Swedish National Council for Crime Prevention, some 6.3 percent of elected politicians who were polled admitted having suffered a hate crime in 2014.
The Left Party of Sweden (Vänsterpartiet) is a socialist and feminist political party that advocates environmentalism. Created 100 years ago, the party has never been part of the national government, only serving at local level.
In the wake of the refugee crisis in Europe, the party has been pushing to establish special employment assistance and improving the quality of language teaching for migrants.

On Wednesday, the ECJ said that it had “dismissed in its entirety the actions brought by Slovakia and Hungary,” which aimed to have the quota system annulled.
The ruling follows an EU decision made in 2015 to rehouse some 160,000 refugees from Greece and Italy over a period of two years, only around 27,700 of whom have been settled so far. Hungary and Poland have refused to take part, while Slovakia has only taken in a small number from Greece. The low level of relocations, the ECJ noted, was partly due to “the lack of cooperation on the part of certain member states.”
“It is time to be united and show full solidarity. The door remains, it is still open, and we should convince all member states to fulfill their commitments,” EU Migration Commissioner Dimitris Avramopoulos said.
“But we should be clear that member states have to show solidarity now because it is now that some member states need help.
If the member states do not change their approach in the coming weeks, we should then consider [taking] the last step in the infringement procedure: to refer Poland, Hungary, and the Czech Republic to the European Court of Justice.”
Commenting on the ruling, Germany Foreign Minister Sigmar Gabriel said it was a positive step that fully adhered to European values and law. The decision is also likely to be welcomed by other countries such as Greece and Sweden, where the sheer volume of new arrivals threatens to overwhelm the system.
#ECJ confirms our view on the migration scheme. We expect all EU countries to respect and implement the ruling. @EPPGroup 1/3
— Manfred Weber (@ManfredWeber) September 6, 2017
However, Gabriel’s Hungarian counterpart, Peter Szijjarto, took the opposite view, declaring the ECJ’s ruling unacceptable.
“The Hungarian government considers today’s decision by the European court to be appalling and irresponsible,” Szijjarto said at a news conference. “This decision jeopardizes the security and future of all of Europe.”
“Politics has raped European law and values,” he added.
Human rights groups have criticized Hungary and Poland for their reluctance to take in any refugees. The government of Hungarian Prime Minister Viktor Orban has taken the stance that Hungary has the right to refuse entry to the primarily Muslim asylum seekers and refugees, claiming they threaten the country’s cultural identity. In September 2015, a razor-wire fence was constructed along the border with Serbia and Croatia, blocking migrants trying to reach the EU via the Balkans.
“The lesson of the verdict is that helping people fleeing war and terror is truly a common responsibility for Europe,” the Hungarian Helsinki Committee, which provides free legal assistance to asylum seekers, said in a statement quoted by AP. “Hungary needs to respect the decision of the EU court.”
Polish Prime Minister Beata Szydlo also rejected the ECJ’s ruling, saying that Poland will hold firm to its position on asylum seekers and refugees.
“I was convinced that such a decision would be made [by the court], but this absolutely does not change the stance of the Polish government with respect to migration policy,” Szydlo told reporters at a business conference.
Poland initially accepted a quota of several thousand refugees, but quickly changed its mind after the 2016 terrorist attacks in Brussels, citing security concerns.
But Slovakian Prime Minister Robert Fico said he accepted the court’s decision.
“We fully respect the verdict of the European Court of Justice,” Fico told reporters, but added that his government still views the system of quotas imposed by Brussels negatively.
“We will continue to work on having solidarity expressed in different ways other than forcing migrants [on Slovakia] from other countries that don’t want to be here anyway.”
Over the past few years Europe has been faced with millions of refugees and asylum seekers escaping war zones and hardship from across Africa and the Middle East. While the flow of Syrian refugees has slowed somewhat since a deal was signed with Turkey, the question remains of what to do with the ones that have already arrived.

Police have launched a double manhunt after a teenage girl was raped at a Birmingham railway station, only to be attacked a second time by a passing motorist she had flagged down for help.
The 15-year-old girl had walked with her friend to Witton railway station, near Aston Villa football ground, on Tuesday night. Police say she was approached by the first suspect, who led her away to an isolated part of the station where she was then raped.
The attack took place between 7pm on Tuesday and 2am on Wednesday.
After the first attack, the teen left the station and stopped a passing car to ask the driver for help. She was then raped again after getting into the second suspect’s vehicle.
Both suspects are described as Asian men in their early 20s.
The first has light skin, brown eyes, and a skinny build. He is about 6ft tall and was wearing a tracksuit and black trainers.
The second suspect is around 5ft 7in, of large build with a close-cropped beard. He was wearing a blue jumper and black jeans.
Detective Chief Inspector Tony Fitzpatrick, of British Transport Police, said: “This was a horrifying ordeal for this young girl and we have specially trained officers supporting her.
“It is now vitally important we investigate exactly what happened on Tuesday morning as well as identifying offenders for both of these awful incidents.
“My detectives are currently examining all available CCTV in an effort to identify the offenders and whilst these enquiries are made, we are keen to speak with any potential witnesses.
“Whilst this incident happened during the early morning and there may not have been many people around, I would be keen to speak with anyone who may have been in the area at the time.
“If you were passing by the station and saw two girls walking with an older man, then please get in touch immediately.
“Likewise, if you saw any suspicious vehicles close to Witton station close to 2am then please get in touch as soon as possible.
“Your information could prove vital in our enquiries to identify the perpetrators.”
