Top Myanmar military leaders should be prosecuted for genocide against Rohingya Muslims, investigators working for the UN’s top human rights body said on Monday. The call, accompanying a first report by the investigators, amounts to some of the strongest language yet from UN officials. They have denounced alleged human rights violations in Myanmar since a crackdown began last August. The three-member “fact-finding mission” working under a mandate from the UN-backed Human Rights Council assembled hundreds of accounts by expatriate Rohingya, satellite footage and other information, AP said. The UN-backed Human Rights Council created the mission six months before a rebel attack on security posts set off the crackdown that drove hundreds of thousands of Rohingya fleeing to neighboring Bangladesh.

White Helmets must be tracked down & prosecuted for ‘war crimes’ – Syria’s Grand Mufti https://briefnews.eu/white-helmets-must-be-tracked-down-prosecuted-for-war-crimes-syrias-grand-mufti/ https://briefnews.eu/white-helmets-must-be-tracked-down-prosecuted-for-war-crimes-syrias-grand-mufti/#respond Mon, 23 Jul 2018 17:23:54 +0000 http://briefnews.eu/white-helmets-must-be-tracked-down-prosecuted-for-war-crimes-syrias-grand-mufti/ Russia and Syria must hunt down and prosecute members of the White Helmets for “war crimes,” Syria’s Grand Mufti has said shortly after Israel “evacuated” a large number of the group’s members at the request of the US and Canada.

“These people are not refugees. They are war criminals. I’d like to ask the governments of our two countries [Syria and Russia] to pursue the members of the White Helmets group. To find them anywhere they might be,” Grand Mufti Ahmad Badreddin Hassoun said on Monday. Hassoun was meeting families of five Russian servicemen, who were killed while fighting terrorists in Syria. The relatives of the fallen soldiers were invited to visit Syria by President Bashar Assad.

Hassoun branded the White Helmets group “terrorists” and squarely blamed them for the use of chemical weapons against civilians. While the White Helmets advertise themselves as a humanitarian group and Syria’s “civil defense” they operate exclusively in militant controlled areas. The group, praised in the West as “rescuers” has been repeatedly accused of closely cooperating with terrorists and staging chemical attacks to frame Syria’s government.

On Sunday, the Israeli military said it evacuated a number of the group’s members and their families from Syria to Jordan at the request of the US, Canada and some European countries. The initial plan involved the evacuation of 800 people, yet only 422 made it to Jordan, according to the country’s authorities.

Tel Aviv’s move was condemned by Syria’s government, which said that the “criminal operation” to rescue the White Helmets is further proof of Israel’s support towards terrorists. It has long accused Tel Aviv of tending to injured Syrian militants, distributing “humanitarian aid” to militant-controlled areas and repeatedly attacking Syria’s government troops over alleged Iranian military buildup.

The evacuated members of the White Helmets are expected to be resettled in Canada, Germany and some other countries. Such destinations have clearly shown who the true masters of the group are, Hassoun said.

“We’d like to ask why they are not fleeing to Syria, why they don’t want to return to the Syrian society? There’s only one answer – they are the force, which the West counted on to destroy the Syrian society,” he stressed.

I’m A Celebrity 2017: Former star reveals contestants could be PROSECUTED if they do this https://briefnews.eu/im-a-celebrity-2017-former-star-reveals-contestants-could-be-prosecuted-if-they-do-this/ https://briefnews.eu/im-a-celebrity-2017-former-star-reveals-contestants-could-be-prosecuted-if-they-do-this/#respond Thu, 16 Nov 2017 17:26:51 +0000 http://briefnews.eu/im-a-celebrity-2017-former-star-reveals-contestants-could-be-prosecuted-if-they-do-this/

And ahead of their entrance into the camp, they will be issued with a number of rules to adhere to.

Former contestant Michael Buerk, who appeared on the series in 2014, spilled all restrictions put in place after he left the jungle.

In a piece written for the Radio Times, he revealed the kind of behaviour that is banned for being “inappropriate”.

The list included: “Bullying, non-consensual touching, masturbation, homophobic language or attitudes and category A swear words (f-word and c-word).”

Michael dished: “It was all rather odd because it was made clear that there was no problem with nudity, sexual behaviour that is reciprocated, and rudeness.”

But he insisted that there was one rule this year’s contestants should be very careful of.

“The one thing they were adamant about was harming the wildlife: ‘You could be prosecuted’,” he wrote in his piece.

It comes after it was revealed by medic Bob.

He told Woman’s Own that they are necessary to prevent exposing the public to any unsightly wounds the stars may get.

That may also be the reason behind the matching red shorts and trousers that the celebrities are often seen wearing.

starts Sunday on at 9pm.

Why Wasn't He Prosecuted? https://briefnews.eu/why-wasnt-he-prosecuted/ https://briefnews.eu/why-wasnt-he-prosecuted/#respond Wed, 11 Oct 2017 22:33:09 +0000 http://briefnews.eu/why-wasnt-he-prosecuted/

Manhattan District Attorney Cy Vance Jr. on Wednesday defended his office’s decision not to prosecute Harvey Weinstein for sexual assault after the film mogul groped a woman in New York in 2015. Vance denied it had anything to do with campaign contributions from Weinstein’s lawyer.

“Our sex crimes prosecutors made a determination that this was not going to be a provable case so the decision was made not to go forward,” said Vance, after a panel on the changing role of the prosecutor at New York’s John Jay College of Criminal Justice.

“If we had a case we felt we could prosecute…we would have. We take on many, many, many difficult sex crime prosecutions with individuals irrespective of background or their money,” said Vance.

Last week, the New York Times revealed that Weinstein had paid settlements to at least eight women, often actors and former assistants, after unwanted physical contact and sexual harassment.

On Tuesday, the New Yorker published allegations of rape and harassment of multiple women by Weinstein, including the audio recorded by Ambra Battilana Gutierrez, in collaboration with the New York Police Department, where Weinstein acknowledged that he had groped Battilana Gutierrez the day before.

Despite the audio recording, the DA’s office declined to pursue the case.

“We have probably the best sex crime prosecutor’s office in the country… Our best lawyers looked at the matter. I, like they, were very distributed but the contents of the tape, it’s obviously sickening. But at the end of the day we operate in a courtroom of law, not the court of public opinion,” Vance told the group of gathered journalists on Wednesday.

The International Business Times reported last week that Vance had received $ 10,000 in campaign contributions from Weinstein’s lawyer David Boies after the decision, and more than $ 50,000 since 2005.

Vance denied that the monetary contributions informed the office’s choice not to pursue the film producer.

“No contribution ever, in my seven years of being district attorney, has ever had any impact on my decision making in a case,” said Vance.

He repeatedly noted that it was “legal” for district attorneys to receive contributions from defense law firms while running for election, but hinted that he may change his position on accepting those contributions in the future.

“Obviously [it] calls for an opportunity like this for me to rethink with my assistants how we wish to handle this now going forward,” he said.

On Tuesday, the DA’s office released a statement arguing that the NYPD had failed to get the evidence required to pursue a prosecution:

After the complaint was made in 2015, the NYPD – without our knowledge or input – arranged a controlled call and meeting between the complainant and Mr. Weinstein. The seasoned prosecutors in our Sex Crimes Unit were not afforded the opportunity before the meeting to counsel investigators on what was necessary to capture in order to prove a misdemeanor sex crime. While the recording is horrifying to listen to, what emerged from the audio was insufficient to prove a crime under New York law, which requires prosecutors to establish criminal intent. Subsequent investigative steps undertaken in order to establish intent were not successful. This, coupled with other proof issues, meant that there was no choice but to conclude the investigation without criminal charges.

The NYPD responded arguing that they had provided adequate evidence, in a statement from DCPI:

The case was carried out by experienced detectives and supervisors from NYPD’s Special Victims Unit. The detectives used well established investigative techniques. The recorded conversation with the subject corroborates the acts that were the basis for the victim’s complaint to the police a day earlier. This follow-up recorded conversation was just one aspect of the case against the subject. This evidence, along with other statements and timeline information was presented to the office of the Manhattan District Attorney.

On Wednesday Vance said he accepts “criticism” for his decision but stands by it.

“Obviously he [Weinstein] has some serious issues, and the tape is terrible. But I, as district attorney, have to be guided by the evidence and the elements of the crime and my experts in the office and if I stopped being guided by any of those things and start being guided by outside influences, whether it’s money or public opinion, then I’m not doing the right job,” he said.

If the US could have prosecuted Assange, it would have already done so https://briefnews.eu/if-the-us-could-have-prosecuted-assange-it-would-have-already-done-so/ https://briefnews.eu/if-the-us-could-have-prosecuted-assange-it-would-have-already-done-so/#respond Sat, 22 Apr 2017 10:34:41 +0000 http://briefnews.eu/if-the-us-could-have-prosecuted-assange-it-would-have-already-done-so/ Julian AssangeCarl Court/Getty Images

While the Obama administration prosecuted more leakers of classified information than all previous administrations combined, there was one target they could never quite figure out how to go after without getting ensnared in the First Amendment rights of journalists.

From his perch at the Ecuadorean Embassy, the journalist-cum-transparency activist Julian Assange could expose the U.S. government’s mostly closely held secrets — and American prosecutors could do nothing about it.

But now the Trump administration is considering throwing out its predecessor’s conclusion that a prosecution of Assange could open the door to legal attacks on mainstream journalism. According to the Washington Post, the U.S. Justice Department is planning to charge Assange. U.S. Attorney General Jeff Sessions called his arrest “priority.”

The sudden vilification of Assange and WikiLeaks, which candidate Donald Trump cheered endlessly during his presidential campaign for its role in disseminating harmful information about his rival, represents an abrupt change of stance. CIA chief Mike Pompeo just slammed WikiLeaks as a “hostile intelligence service” — the site had released details of CIA hacking tools — which marked a sharp departure from the previous summer, when Pompeo tweeted out WikiLeaks’ publication of hacked DNC emails.

And the change of heart comes as FBI and congressional investigators continue to zero in on the Trump campaign’s possible coordination with WikiLeaks and Russian intelligence to hack political rivals and publish harmful information ahead of the election.

In an email to Foreign Policy, Assange lawyer Barry Pollack said Pompeo’s attack on his client demonstrates that there has “never been a time in our history when independent reporters disseminating truthful information has been more important.”

“My hope is that the Department of Justice will come to the conclusion that no one should be the subject of a criminal investigation for their role in publishing accurate information,” Pollack said. “Such investigations chill free speech and deprive the public of its right to truthful information.”

Ultimately, the administration’s efforts to bring charges against Assange might carry a bigger symbolic and political punch than legal impact. Given the Ecuadorean government’s unchanging support for sheltering Assange in its London embassy — thus preventing extradition to the United States — it’s not clear that presenting formal charges would actually bring him any closer to a U.S. courtroom.

Nonetheless, the Trump administration appears poised to go further than the Obama administration ever would, since it was fearful of opening a legal can of worms that could undermine press freedoms on the United States.

“Bringing charges under the Obama administration wasn’t a problem of a lack of will,” said a former Justice Department official familiar with the case.

Following the public disclosure of a huge trove of U.S. diplomatic cables and military reports in 2010 — at the time considered to be the largest breach of classified information in American history — senior officials across the U.S. government wanted to bring charges against Assange, the former official said.

But the Justice Department could find no way to structure the case to ensure that it would survive a free speech challenge. “DOJ would have brought this case a long time ago if they thought they could win,” the former official said.

How to charge Assange presents some thorny legal questions. Assange describes himself as a journalist, and case law and the U.S. Constitution provides strong protections for outlets that publish classified but sensitive information deemed to be in the public interest. A successful prosecution of Assange, legal scholars argue, could make reporters at mainstream media outlets liable for publishing government secrets, and could set a legal precedent that would seriously undermine the media’s ability to hold government officials to account.

Obama administration lawyers grappled with this problem and could never find a way around the numerous First Amendment questions in prosecuting Assange.

“The problem with the investigation was finding a case that you could bring against Julian Assange that wouldn’t also apply to reporters from every major U.S. media outlet,” the former official said.

That could be just what recommends the move to Trump administration officials. As a candidate, he suggested using the power of the presidency to go after media outlets, and talked of strengthening federal libel laws (there are none) to make it easier to go after adversarial journalists.

Still, slapping Assange with criminal charges would represent a breathtaking about face for President Donald Trump. As a candidate, Trump declared, “I love WikiLeaks” for the role it played in undermining the campaign of his opponent. Trump famously called on Russia to hack into the email account of former Secretary of State Hillary Clinton, and he cited WikiLeaks scores of times at rallies during the final month of his campaign.

According to U.S. intelligence officials, Russian operatives passed documents stolen from computers of the Democratic Party to WikiLeaks, which published them online, exposing and exacerbating serious divisions within the party.

FBI and congressional investigators are currently examining whether Trump lieutenants coordinated with Russian intelligence the publication of documents damaging to Clinton. That sprawling inquiry has burdened the early months of the Trump administration.

Julian AssangeREUTERS/Anthony Devlin/Pool (The Trump administration’s legal strategy against Assange remains shrouded in mystery. Prosecutors may use communications between Assange and Chelsea Manning, the Army intelligence analyst who passed a huge archive of classified military documents to WikiLeaks in 2010, to argue that the transparency activist incited the soldier to break the law.

In 2011, American prosecutors presented chat logs purportedly documenting conversations between Assange and Manning in which the two men discussed how to crack a password to a an Army database. Assange told Manning that he had tools for doing so, which may serve as the basis of a conspiracy charge against Assange.

Whether American prosecutors possess evidence that Assange provided such help remains unknown.

Regardless, legal experts argue that even if Assange provided such help, his actions could still be defended under journalists’ First Amendment rights. Journalists routinely advise government officials how to pass them information without getting caught by their superiors or investigators.

Days before she was set to go to trial over $ 12 worth of ceviche sold on Facebook, Mariza Ruelas struck a deal with the San Joaquin County district attorney.

On Friday, prosecutors in the central California county agreed to drop various misdemeanor criminal charges, including operating a food facility without a permit, if Ruelas did 80 hours of community service within a year. She also agreed to not sell or trade food online unless she has the proper permits.

When Ars asked her how she felt on Friday afternoon, Mariza Ruelas said by phone: “Relieved, you know? It’s just like, ugh, finally it’s over.”
