The defendant, Dr. Jumana Nagarwala, isn’t entirely off the hook – she still faces 20 years in prison for conspiracy to travel with intent to engage in illicit sexual conduct, and four co-defendants remain charged with conspiracy to obstruct an official proceeding.

The “conspiracy” at the center of the case involved up to 100 young girls from multiple states, according to prosecutors, though the charges brought against Nagarwala only reference nine. An Indian Muslim from the Dawoodi Bohra sect, Nagarwala was charged in April 2017 with performing female genital mutilation on the girls at a clinic in Livonia, Michigan, the first person to be prosecuted under the 1996 anti-FGM law.

Along with clinic owner Dr. Fakhruddin Attar, she was also charged with conspiring to transport a minor with intent to engage in criminal sexual activity, which carries a life sentence, but Friedman dropped those charges in January. Attar’s wife, Farida, was charged with helping to arrange the procedure and later saddled with an additional charge of drugging one of the girls.

Nagarwala remains free on $ 4.5 million bond – believed to be the largest unsecured bond in Detroit history – but is under house arrest, strapped with an ankle monitor. Prosecutors worried her wealth and ties to India and Africa made her a flight risk, pointing out she had attempted to board a flight to Kenya before her arrest, and the judge opted to freeze her and her husband’s retirement accounts and assets when she was released from jail to await trial.

The four other defendants allegedly brought their daughters from Illinois and Minnesota as well as other parts of Michigan to be circumcised by Nagarwala over the course of 12 years. FGM is internationally condemned as a violation of human rights, though it is practiced by some members of the Dawoodi Bohra.

The prosecution alleges that Nagarwala performed FGM on two 7-year-old girls from Minnesota last February 2017 in Livonia, Michigan. Eight people have been charged in relation to the case, one of which is Dr Fakhruddin Attar, who allegedly allowed Nagarwala to perform the procedure in his clinic.

Nagarwala’s defense attorneys argued the government was using the definition of ‘criminal sexual conduct’ under state law and ‘sexual act’ from another federal statute to characterize FGM as a ‘criminal sexual activity.’

Judge Friedman agreed with the defense that the alleged conduct does not qualify as sexual activity because the doctors did not touch the girls’ genitalia for sexual gratification or to abuse, humiliate or degrade the victims.

“We’re thrilled for our clients that the law was followed,” Attar’s lawyer Mary Chartier told Detroit News on Sunday. “This is going to be a long fight, but we’re confident they’ll be vindicated.”

The other defendants include four mothers accused of subjecting their daughters to the procedure, and Dr Attar’s wife, who is accused of holding the girls’ hands during the procedures and lying to investigators.

The group is accused of conspiracy to carry out FGM on the girls as part of a religious procedure practiced by an Indian Muslim sect, the Dawoodi Bohra. Prosecutors in the case say the girls were cut, while the defense argues the procedure performed on them was benign and not FGM.

One girl told the FBI that Nagarwala “pinched the place [where] she goes pee,” according to a court filing. Medical examinations meanwhile found the girls’ genitals did appear to have been altered, with some scar tissue and healing lacerations.

Nagarwala is suspected of using Attar’s clinic to carry out the procedure for more than a decade. The government estimates the doctor performed as many as 100 FGM procedures throughout her career and allege that she tried to cover up her crimes by telling her religious community to “deny everything.”

Both Nagarwala and Attar face up to 20 years in prison if convicted of the other remaining charges.

Germany experienced a sharp increase in the number of women who have been subjected to genital mutilation, which is illegal in the country, an advocacy group has said. There are now more than 58,000 women affected by FGM, 10,000 more than the year before.

The estimate was published Tuesday by the women’s rights organization, Terre des Femmes, who said the increase was largely due to the influx of migrants from countries where female genital mutilation (FGM) is practiced.

“Due to the arrival of migrants from countries such as Eritrea, Somalia and Iraq, we have recorded a huge increase in the number of affected women and threatened girls,” said spokeswoman Charlotte Weil to DPA Tuesday, as cited by The Local.

Furthermore, there is currently more than 13,000 girls in Germany who are at risk of being forced into the procedure by their families, a 4,000 increase over last year, the group said.

“We don’t know of any cases where a girl was mutilated in Germany. It either takes place on a holiday back in their homeland, or during a visit to a practitioner in a city such as Paris or Amsterdam,” Weil added.

FGM is illegal in Germany, but is tolerated in many African countries as well as some in Asia. More than 200 million women worldwide are affected by female genital mutilation, according to Unicef.

While culturally entrenched in some countries, FGM is widely criticized by many health professionals and rights groups. The procedure may cause health problems depending on how exactly it is performed and has no health benefits.

Weil advised teachers to pay attention to young girls in their classes, especially if they share plans to go home for a “big festival.”

Some 280,000 migrants fled to Germany from their war torn and conflict ridden countries in 2016 – a decline on the 890,000 that arrived the previous year, according to Reuters.

Shaker Elsayed, the imam of Dar Al-Hijrah Islamic Center in Falls Church, Virginia, gave a lecture on child rearing and family life in May, describing female genital mutilation (FGM) as the “honorable thing to do” for young girls, because it prevents “hyper-sexuality.” 

“You see in societies where circumcision of girls is completely prohibited, hyper-sexuality takes over the entire society, and a woman is not satisfied with one person, or two, or three,” Elsayed said.

The video of the lecture, which was posted on the Islamic center’s YouTube page, quickly went viral and was later removed from the page after many called for Elsayed’s dismissal.

On Monday, the Board of Directors at Dar al-Hijrah issued a statement denouncing Elsayed’s views on FGM, which they said are “prohibited in Islam as well as the laws of the land.”

“We at Dar Al-Hijrah, DO NOT condone, promote, or support any practice of FGM,” the board said in a statement. “The reference to ‘Hyper-sexuality’ is offensive and it is unequivocally rejected. The Board of Directors is particularly disturbed by such comments.” 

The board also called on Muslim scholars to join the fight against FGM and “condemn silence in the face of these harmful practices.”

The statement also included a retraction from Elsayed, who apologized for his statements on “hyper-sexuality.”

“FGM is very harmful to women’s health, and anything in Islam that is harmful is in fact prohibited,” Elsayed said in a statement. “I admit that I should have avoided it. I hereby take it back. And I do apologize to all those who are offended by it.”

In his lecture, Elsayed described the process, where a gynecologist cuts “only the tip of the sexual sensitive part in the girl so that she is not hyper sexually active.” He warned his listeners about unqualified gynecologists who “cut more than needed.”

“They end up damaging the sexual sensuality of the woman, when she becomes an adult, and she becomes cool or cold in the sexual relationship. And this is haram. This is prohibited,” Elsayed said.

In his apology, Elsayed reiterated that he warned about the potential harms and told his listeners that they should talk to their obstetrician-gynecologist (OBGYN) about the procedure.

FGM has been illegal in the US for anyone under 18 since 1996.

The World Health Organization (WHO) has branded the practice as a human rights violation and says it offers “no health benefits, and it harms girls and women in many ways.”

The organization says FGM can cause “severe bleeding and problems urinating, and later cysts, infections, as well as complications in childbirth and increased risk of newborn deaths.” The list of consequences from the procedure include painful urination, menstrual problems, human immunodeficiency virus (HIV) and even death.

WHO estimates that more than 200 million women alive today have undergone the procedure.

Dar Al-Hijrah has been labeled “the 9/11 mosque” by critics. Nidal Malik Hasan, the shooter at Fort Hood in 2009, attended the mosque in 2001 at the same time 9/11 hijackers Nawaf al-Hazmi and Hani Hanjour were regulars when Anwar al-Awlaki – who later joined Al-Qaeda – was an imam there, according to the Associated Press.

The mosque’s phone number was also found in the Hamburg, Germany, apartment of Ramzi bin al-Shibh, a planner of the 9/11 attacks, according to the congressional joint-inquiry into the 9/11 attacks.

Anwar al-Awlaki, a former imam at the Virginia mosque, left the country after the 9/11 attacks to become an Al-Qaeda leader.
