Enlarge / Measuring Beaufort Sea methane aboard the R/V Ukpik. (credit: John Kessler Lab)
The Earth responds to climate change in interesting ways, sometimes producing what we call “feedbacks,” which can either amplify global warming or dampen it. Some of the feedbacks that can amplify warming have behavior that is hard to predict in the near future and leaves scenarios that are potentially worse than expected hanging over our heads. One of those is the release of greenhouse gas from thawing permafrost—and regions of shallow seafloor that were frozen land thousands of years ago when sea level was much lower.
The most dangerous-sounding issue involves methane hydrate, an ice-like substance full of methane that is present in some ocean sediments. Its sudden release is a suspect in some major extinction events. But how much we should worry about destabilizing methane hydrates or thawing permafrost is not perfectly clear.
A group of researchers led by Kathryn Sparrow headed to the Beaufort Sea in the Canadian Arctic to bring an improved measurement technique to bear on an important question: how much of the methane in the sea floor is ending up in our atmosphere?

]]>A federal court has granted a request from environmental groups that would require the Environmental Protection Agency (EPA) to start enforcing methane pollution rules that were drafted under former President Barack Obama.
In an order issued Monday, a majority of the full US Court of Appeals for the District of Columbia Circuit directed the clerk to issue the mandate that reinstates a rule made under Obama, to limit the emissions of the greenhouse gas methane from new oil and gas drilling, according to copies obtained by Inside EPA Climate.
Only two judges on the 11-judge panel objected to the mandate and said they “would not issue the mandate forthwith,” according to the order.
The rules, which were written by the EPA in 2016, set standards for the oil and natural gas drilling industry in order to prevent 180,000 tons of methane a year from escaping into the atmosphere while boosting federal revenue up to $ 13 million a year from fines.
Under Administrator Scott Pruitt, the EPA proposed a stay of oil and gas standards for three months “while the agency reconsiders them.” After the initial stay, the agency’s plan is to to delay the rules for two more years.
Earlier in July, a three-judge panel ruled the EPA would be allowed to reconsider the rules that limited methane and smog-forming pollutants emitted by oil and gas wells, but could not delay the date they were scheduled to begin. The court allowed the agency to continue its suspension for two weeks, which ended Friday.
After the court issued the ruling, the EPA said that it was “considering its options in light of the court’s opinion.”
While industry groups and conservative states asked the court to rehear the case, the EPA did not file an appeal of the original ruling.
On Monday, a coalition of environmentalists, led by the Environmental Defense Fund, filed a petition with the court, asking them to issue the mandate.
“Every day that the stay remains in place, petitioners’ members and similarly situated Americans are exposed to excessive amounts of air pollution from more than 11,000 oil and gas wells — pollution that compliance with the rule would reduce or avoid,” the coalition wrote in the petition.

The Trump administration suffered a legal blow on Monday when the US Court of Appeals for the District of Columbia ruled (PDF) that the Environmental Protection Agency (EPA) must enforce methane emissions rules that were finalized by the Obama administration in mid-2016.
The rules established performance standards for new drilling operations, and they required many oil and gas companies to conduct an initial survey of methane leaks by June 3, 2017. Changing finalized rules is often a lengthy and painstaking process, and Trump’s EPA Administrator Scott Pruitt announced his intention to start the reconsideration process for the rules in April. Pruitt, who sued the EPA as attorney general of Oklahoma over these rules, also announced a stay on the EPA’s enforcement of certain parts of the rules that could have lasted up to two years. Specifically, Pruitt said the EPA would not, for the time being, enforce four items specified in the rules, including regulation of low-production wells and the requirement that a professional engineer certify well vent system designs.
Environmental groups—including the Environmental Defense Fund, Natural Resources Defense Council, Environmental Integrity Project, Earthworks, the Clean Air Council, and the Sierra Club—challenged the EPA’s stay in court, however. The EPA argued that the stay was reasonable because the previous administration hadn’t given all stakeholders due opportunity to comment on certain parts of the rules’ final wording.
]]>The Environmental Protection Agency’s 90-day suspension of new emission standards on oil and gas wells has been struck down by a US appeals court. EPA Administrator Scott Pruitt has long sought a repeal of the Obama-era rules.
A three-judge panel of the US Court of Appeals for the District of Columbia Circuit ruled 2-1 that the EPA would be allowed to reconsider a 2016 ruling that limited methane and smog-forming pollutants emitted by oil and gas wells, but could not delay the date it begins.
Two judges concluded, “the administration record thus makes clear that industry groups had ample opportunity to comment on all four issues on which EPA granted reconsideration, and indeed, that in several instances the agency incorporated those comments directly into the final rule.”

Judge Janice Brown wrote a dissenting opinion in the case.
Pruitt, the new head of the EPA, had been looking to extend a suspension on these activities for two years.
There will be a separate administration public hearing on the same extension next Monday, according to the Washington Post.
“The court’s ruling is yet another reminder, now in the context of environmental protection, that the federal judiciary remains a significant obstacle to the president’s desire to order immediate change,” Richard Lazarus, environmental-law professor at Harvard Law School, said in an email as reported by the Post.
Lazarus continued, “the DC Circuit’s ruling today makes clear that neither the president nor his EPA administrator, Scott Pruitt, can by fiat unilaterally and instantaneously repeal or otherwise stay the effectiveness of the environmental protection rules put into place during the Obama administration.”
Former President Barack Obama had put in place a rule in 2016 that was connected to a regulatory strategy which sought to reduce methane emissions.
At the time, Pruitt was the Attorney General of Oklahoma and he and others sued the EPA to overturn the legislation.
Pruitt has also begun to move on suspending or revoking many other measures which were implemented during the Obama years. This includes a two-year delay on a certain regulations aimed at minimizing chemical accidents.

It’s not that hard to understand the changes that have controlled the levels of carbon dioxide in the atmosphere during past climate changes. But methane (a potent greenhouse gas itself) does some mysterious things. A lot of it is secreted away in seafloor mud in the form of an odd substance called “methane hydrate”—methane gas in molecular cages of water ice that only survive at low temperature and high pressure.
The thawing of these methane hydrates would release the gas into the ocean and atmosphere. For several rapid climate change events in Earth’s history, this has been proposed as a possible source for sudden increase in greenhouse gasses.
Many questions remain unanswered about methane hydrates, including a rather big one: could our current climate change thaw some hydrates, contributing to further warming in the near future? After all, there are places where plumes of methane bubbles can be seen rising from the seafloor today. Some of those plumes have been active for thousands of years, and (counterintuitively) they might even have the net effect of removing greenhouse gases. But other areas have inspired concern about the risk of accelerated warming.

Methane as a greenhouse gas isn’t all that eco-friendly when used for power, but scientists might have a way to keep the damage to a minimum. Penn State researchers have crafted microbial fuel cells that can convert methane into electricity right at the well, without leaking loads of gas into the atmosphere by sending it through pipes. The team created a cocktail of bacteria (including a synthetic microbe you can’t normally grow) that produces the necessary materials to grab and transport electrons from the methane. Not only is this a relatively clean process, the bacteria can run on waste products — it might clean up the site as it generates power.
This definitely isn’t ready for prime time. The current project only produces a thousandth of the electricity that you’d get from a methanol fuel cell. And of course, cleaning up methane power is really a stopgap solution on the way to wider use of renewable energy. But it’s a start — until it’s realistic to ditch methane, anything that curbs its harmful emissions should be helpful.

Reports of methane bubbling up from the bottom of the East Siberian Sea may have induced some climate change anxiety. In recent years, plumes of methane bubbles rising up from what was once dry permafrost have been observed off the Siberian coast. But their context was unclear. Were they a brand-new greenhouse gas release driven by climate change or were the bubbles long-time fixtures?
Work off the coast of Svalbard provided a welcome bit of relief. Examination of similar bubble plumes off Svalbard showed that they had been present (at some rate of bubbling) for thousands of years. While estimates of the amount of methane coming out of the East Siberian Sea were surprisingly large, measurements near Svalbard showed that the methane from deeper seafloor seeps gets trapped in the water column and consumed by bacteria before it can reach the atmosphere. That helped put the Siberian activity in some global context.
A new study led by United States Geological Survey researcher John Pohlman delivers another Svalbard surprise. Pohlman’s team looked at the other side of the ledger: how much carbon is pulled out of the atmosphere by photosynthetic critters at these sites?

The US Senate declined to overturn an Obama-era rule that requires oil and gas companies to limit their methane emissions if they’re drilling on federal and tribal lands. The outcome of the 51-49 vote was surprising given that Congress has thus far opted 13 times to use the Congressional Review Act (CRA) to overturn recent rules made in the previous administration, according to the Washington Post.
Every democrat in the Senate voted against the motion to overturn the methane rule, including Heidi Heitkamp (D-N.D.) and Joe Manchin (D-W.Va.)—senators from fossil fuel-rich states who often vote in favor of those interests. John McCain (R-Ariz.), Susan Collins (R-Maine), and Lindsey Graham (R-S.C.) also joined the democrats.
The rule allows the Bureau of Land Management (BLM) to set standards to prevent methane leaks and excessive flaring (that is, burning off methane that escapes during drilling). BLM will also be allowed to inspect drilling operations for leaks of methane, a key component of natural gas. The rule was supposed to have two main benefits. From a climate change perspective, methane is one of the most potent greenhouse gases and is a major contributor to global warming, so preventing leaks will reduce those emissions. From a resource-use perspective, oil and gas companies must pay royalties on natural gas extracted from operations on federal and tribal lands, so the rule would reduce waste and ideally result in a better return on those royalties.

The House voted to roll back rules on methane flaring this week. (credit: WildEarth Guardians)
Last week was a busy one for people watching the federal government’s rules on energy and the environment. With the opening of a new administration, the Republican-dominated Congress has been quick to kill regulations from the previous administration and enact new ones of its own. Below we take a glance at some of the most noteworthy actions taken by the executive branch and Congress this week.
1. Rolling back the stream protection rule: Congress wasted no time wielding a previously little-used rule called the Congressional Review Act, which allows the legislative branch to repeal rules and regulations passed in recent months. According to the Federation of American Scientists (via Vox), the 115th Congress can now overturn rules submitted on or after June 13, 2016 in an expedited reversal process. The stream protection rule, finalized in late December, is among those rules that found itself on the chopping block. The rule required coal companies that had finished mining in an area to restore the the land to conditions that existed before the mining began, with an emphasis on streams and waterways. Opponents of the rule claimed that the 1997 Surface Mining Control and Reclamation Act, which only forbids “material damage to the environment to the extent that it is technologically and economically feasible,” is sufficient to protect the environment around coal mining operations and that the newer stream protection rule unduly burdens mining companies. Both the House and the Senate voted to roll back the stream protection rule this week. Now the resolution to undo it officially awaits the signature of President Trump.
2. The resource-extraction rule: This rule also saw the blunt end of the Congressional Review Act this week. The rule got its start in 2010 as the Cardin-Lugar Amendment, a bipartisan amendment to the Dodd-Frank Act requiring oil, gas, and mining companies to reveal what they paid to foreign governments. Those companies sued over the rule, and a federal judge tossed out the first version of it in 2013. The Obama Administration started the rule-making process again, but the Securities and Exchange Commission (SEC) only enacted it in June 2016, leaving it vulnerable to the Congressional Review Act today. Extraction companies said the rule put them at a competitive disadvantage, and Rex Tillerson, the former Exxon-Mobile CEO who was sworn in as Secretary of State this week, lobbied hard against the rule in 2010. This leads some to question whether Tillerson’s business connections in foreign countries jeopardizes his ability to work as Secretary of State. However, the resolution to remove this rule was approved by both the House and the Senate this week, so it also awaits Trump’s signature.
