  • A judge refused to delay the upcoming trial of Oath Keepers founder Stewart Rhodes.

  • Mehta also declined to allow Rhodes to fire his lawyers, creating a potentially awkward arrangement.

From the outset of a court hearing Wednesday, Judge Amit Mehta made himself clear: He was not amused with Oath Keepers founder Stewart Rhodes' request to fire his defense team and delay his upcoming trial on charges related to the January 6, 2021 attack on the Capitol.

In a nearly 15-minute diatribe, Mehta denounced Rhodes over "incorrect and, frankly, bewildering" claims the far-right group's former leader made a day earlier in a request to replace his defense lawyers and push back his trial — currently set to start on September 26 — by three months. Mehta, an Obama appointee confirmed in 2014, flatly rejected those requests following an extended rebuke of Rhodes' suggestion that he could not receive a fair trial.

"The very first allegation is that somehow Mr. Rhodes is not receiving a fair trial, and that is unequivocally false," Mehta said.

Mehta convened the hearing a day after Rhodes, in a 20-page court filing a day earlier, asked to replace his Dallas-based defense team with a new lawyer, Ed Tarpley. Rhodes is set to stand trial alongside four other members of the Oath Keepers accused of plotting to storm the Capitol on January 6, 2021, and disrupt the certification of the 2020 election results.

Rhodes cited a "breakdown" in communication with the attorneys who have represented him since his January incident on a seditious conspiracy charge and other allegations tied to the Capitol attack. Through Tarpley, Rhodes argued he has still yet to receive most of the discovery — or relevant evidence — from the Justice Department.

But Mehta said that, until Tuesday's filing, he had not heard a "peep" from Rhodes about any "disenchantment" with his defense team. The judge said Rhodes' defense lawyers for the past nine months, James Lee Bright and Phillip Linder, have displayed not only competence but also leadership in helping other Oath Keepers and their lawyers ahead of the trial, which is expected to last several weeks.

"Not once has he complained one iota about his lawyers," Mehta said.

"Mr. Linder and Mr. Bright are going to be at that table representing Mr. Rhodes at trial in three weeks," he added. "Period. Full stop. End of story."

Mehta suggested that Rhodes would have more easily communicated with lawyers based in the Washington, DC, area, where he has been detained since January but instead hired the Texas-based duo of Bright and Linder.

"That was his choice," Mehta said.

Mehta similarly dismissed Rhodes' claims that he lacked access to crucial evidence in his case. Rhodes, he said, has received "every dispensation," including biweekly sessions in which he is allowed to review evidence at the courthouse for hours.

"No other defendant is getting that kind of accommodation. No one," Mehta said, adding that federal prosecutors have "bent over backwards, as far as I'm concerned," to provide Rhodes with discovery to which he's entitled.

Mehta's ruling thrust Linder and Bright into the awkward position of continuing to represent Rhodes after he, with Tarpley, publicly criticized their work in a court filing. Bright appeared particularly concerned about the future of the engagement, saying the Tuesday filing suggested a "lack of trust."

"Perhaps it is a broken relationship, your honor," Bright said.

"I truly wish him the best," he added. "I've given seven months of my life to Mr. Rhodes. I've missed sporting events. I've missed time with my family for a man I don't know. I'm prepared to come to DC for six weeks away from my children."

At one point, Bright said he didn't want to work alongside Tarpley. But Mehta said he would allow Tarpley to take part in the case so long as Rhodes and the other lawyers agreed.

"We can make room," Mehta said. "We have enough tables."

Mehta said he would not allow Rhodes to wreak "havoc" in the case or his calendar as he and other judges in Washington, DC, confront a flood of prosecutions stemming from the Capitol attack. If he granted a delay, Mehta said, his schedule would not open for Rhodes' trial until next summer.

"January 6 has created a massive traffic jam of cases," Mehta said. "That is just the reality of it."

Wade’s rivals must press their cases with elite displays over the three Shield rounds before the Brisbane Ashes opener from November 23.

Redbacks opening pair Jake Weatherald (30) and John Dalton (21) delivered an unbroken 53-run stand that reduced the first innings deficit to 97 at dinner. The young duo were rewarded for positive stroke play but Weatherald was dropped on 19 by Steve Smith at second slip off Pat Cummins.

Lehmann was in Adelaide to handle the Ashes auditions and monitor the progress of gun speedsters Mitch Starc and Cummins. It was Trent Copeland who stole the limelight with 6-24 on day one. Redbacks linchpin Chadd Sayers’ 4-64 reinforced his standing as the paceman most deserving of a baggy green outside of the Test XI on day two.

Having removed Test skipper Steve Smith (3) and Kurtis Patterson (14) on Friday, Sheffield Shield player of 2016-17 Sayers returned to clean up Starc (23) and Cummins (9).

The Blues folded for 242 with Daniel Hughes (57) justifying his controversial inclusion ahead of Steve Waugh Medallist Ed Cowan while Test star David Warner top scored with 83.

Redacks skipper Travis Head continued his habit of breaking partnerships with innocuous deliveries to prevent a Hughes ton. Hughes followed a delivery from part-time spinner Head down leg-side and flicked uppishly to Callum Ferguson, diving full stretch to intercept at mid-wicket.

Head, coveting a Test debut at No.6 was after significant runs in SA’s second dig after making 8 on Friday. Hilton Cartwright (61) and Shaun Marsh (63) made half-centuries in Western Australia’a first innings against Tasmania. Current Test No.6, Victoria’s Glenn Maxwell, missed out against Queensland at the Gabba with scores of 7 and 20.

With the rise of NPR’s popular Serial podcast, HBO’s riveting limited series The Jinx, and Netflix’s wildly addictive Making a Murderer over the span of a couple of years, the true crime genre had never been hotter. It’s cooled down a bit since 2015, but it seems like the public will always be intrigued by a murder mystery, and if a story is framed in the right way, it can still become an outright sensation.

That’s clearly what Netflix is hoping for with The Keepers, the streaming service’s new seven-part docuseries about the unsolved murder of a Baltimore nun and the potential cover-up that’s been going on for nearly fifty years.

I know there’s still an audience out there for true crime shows like this, but does anyone else feel that the genre is beginning to fall in a bit of a rut? All of these series are starting to look the same to me, and it’s only in extraordinarily rare cases like The Jinx where there’s actually a satisfying conclusion at the end of the tunnel.

Still, I’ll admit that The Keepers looks fascinating; its allegations of corruption and a cover-up that may have lasted almost half a century help it stand out from its contemporaries. And corruption within the Catholic church is likely something that’s still relatively fresh on the minds of many cinephiles in the wake of Spotlight’s Best Picture win not too long ago.

Netflix seems to be leaning into the true crime genre pretty hard with this, Casting JonBenet, and an impending second season of Making a Murder on the way. Since they don’t release viewer numbers, we won’t know exactly how many people tune in to those shows, but Netflix wouldn’t be continuing to churn them out if the company’s algorithm didn’t indicate a significant portion of its audience would be curious enough to check it out. Through interviews with dozens of friends, relatives, journalists, government officials and Baltimore citizens determined to uncover the truth, White pieces together a story that goes beyond the death of a beloved Catholic schoolteacher to encompass clergy abuse, repressed memories and government and religious institutions that he says “at best, dropped the ball over the last 45 years – and, at worst, covered it up.”
