A lawyer for a former high-ranking gymnastics coach says a former trainee levelled allegations of sexual assault against the man because she was psychologically scarred after failing to make it to the Olympics.

Dave Brubaker, who was the director of the women’s national gymnastics team, has pleaded not guilty to one count of sexual assault and one count of sexual exploitation.

The complainant, whose name is protected by a publication ban, has said Brubaker would pick her up from school and take her to his house, where he would occasionally spoon her in bed and tickle her belly before driving her to practice.

Ex-coach defends massage techniques:

CBC Sports' Jamie Strashin has the latest from Sarnia on the sexual assault case against former Canadian gymnastics coach Dave Brubaker. 1:21

Defence lawyer Patrick Ducharme argued that wasn't possible because Brubaker's wife was nearly always home at the same time, and suggested the gymnast felt betrayed that Brubaker took other trainees to the Olympics but not her.

Prosecutor David Rows argued the woman was forthright and honest in her testimony.

Justice Deborah Austin is expected to deliver her decision in the case on Feb. 13.

Coach accused of sexual assault testifies he kissed young gymnast on lips regularly https://briefnews.eu/coach-accused-of-sexual-assault-testifies-he-kissed-young-gymnast-on-lips-regularly/ https://briefnews.eu/coach-accused-of-sexual-assault-testifies-he-kissed-young-gymnast-on-lips-regularly/#respond Thu, 13 Dec 2018 22:42:28 +0000 http://briefnews.eu/coach-accused-of-sexual-assault-testifies-he-kissed-young-gymnast-on-lips-regularly/

A former high-ranking gymnastics coach testified at his sexual assault trial Thursday that he never took naps with the gymnast levelling accusations against him nor did he spoon her in bed, though he acknowledged he kissed her on the lips every time he saw her.

Dave Brubaker, who used to be the director of the women's national gymnastics team, has pleaded not guilty to one count of sexual assault and one count of invitation to sexual touching at his judge-alone trial in Sarnia, Ont. The charges relate to alleged incidents between 2000 and 2007.

The gymnast, who is now in her 30s, has testified that Brubaker would kiss her on the lips to say hello and goodbye starting when she was 12 years old. She said he initiated the ritual after a trip to Europe and kissed others on the cheek but kissed her on the lips.

The woman also testified that Brubaker would pick her up from school and take her to his house, where he would occasionally spoon her in bed and tickle her belly before driving her to practice.

In court Thursday, Brubaker acknowledged that the gymnast would come over to his house between school and practice, but he said they did not take naps together.

"It never happened," he said.

He also said that while he did kiss her regularly on the lips, he did not compel her to.

"I think it was just out of habit … that she started to kiss me," he said, insisting that the kisses were innocent.

The woman has also told the trial that Brubaker occasionally touched her inappropriately during sports massages — an allegation Brubaker firmly denied.

He said he would palpate the area where her upper thigh met her pubic area, as well as the area around her breast to get at pectoral muscles, but maintained that it was all to improve her performance in the sport.

Sports massages crucial to success: expert

An expert witness who testified earlier Thursday said sports massages such as the ones administered by Brubaker were crucial to success in gymnastics.

"It's required," said Ronald Weese, a sports physiologist with a specialization in training gymnastics coaches. "You can't get [to an elite level] from here without an emphasis on the small, finer details."

Weese said the muscles in those parts of the body are extremely important for gymnasts, who use them while doing the splits or to lift themselves up. He also said it's possible for an inexperienced sports therapist to touch the wrong part of the body in these massages.

"I'm sure slips occur all the time, but the more expert you are about it the less they occur," he said.

I'm sure slips occur all the time, but the more expert you are about it the less they occur.–  Ronald Weese, sports physiologist

When questioned by Crown attorney David Rows, Weese said it would be unusual for a coach to lie behind an athlete and rub her belly.

The trial has heard that in a videotaped interview with police, Brubaker apologized for "crossing the line" with the complainant, although he said he never had any sexual intent with her.

That video was allowed into evidence on Thursday. Its admissibility had been called into question when court heard that the police officer interviewing Brubaker was related to the complainant by marriage.

"It is clear this personal involvement could have an impact on the way the officer conducted the interview," Justice Deborah Austin said, adding that it wasn't clear how Brubaker's responses would have changed had he known about the relationship.

Austin said she would exercise a degree of caution in weighing the video as evidence.

The inspiring athlete and YouTube star who won a bronze gold medal at the Rio Olympics is bringing his expert fitness moves into homes across the UK.

He has created a new 21-day exercise programme in collaboration with Herbalife Nutrition, suitable for anyone of any fitness level and only takes a maximum 15-20 minutes a day.

Burpees, squats, high knee running and handstand practice are just some of the gymnastics style exercises expected to feature in the program that’s pipped to seriously challenge the bodies of those that partake. And it comes with advice on mindset too – something which has got Wilson through some tough times in his young sporting career.

Wilson, 22, from Leeds suffered an injury to his ankle ligament during a training session in January 2017 which saw him bowing out of the sport for a frustrating nine months following surgery.

Physio, family support and determination got him back on track and three gold medals at the Commonwealth Games in April earlier this year proved he’s very much back on top of his game.

“Working your way back from injuries is never easy”, says Wilson. “But I always say that those setbacks make you stronger and that has definitely been the case with me. In some ways, I’m grateful for the injuries I have had because they have developed me as a person and athlete.”

Wilson, who trains for three to five hours a day confesses to being “obsessed with being the best” and when he’s not training, he can be found filming gymnastics stunts for his YouTube followers including back flipping into a pair of shorts.

The athlete was selected by Herbalife Nutrition to develop the challenge featuring the moves he relies on to maintain his Olympic physique.

Commenting on what followers can expect he said: “The 21-Day Challenge is aimed at getting people moving and into good habits – anyone of any ability can take part.”

“Gymnastics uses all the body’s muscles so the exercises involved improve your all-round strength and fitness. It’s about encouraging people to step out of their comfort zone and give them a fresh perspective on fitness.”

Olympic gymnast champ Kyle Shewfelt says Canada must strengthen its own abuse policies https://briefnews.eu/olympic-gymnast-champ-kyle-shewfelt-says-canada-must-strengthen-its-own-abuse-policies/ https://briefnews.eu/olympic-gymnast-champ-kyle-shewfelt-says-canada-must-strengthen-its-own-abuse-policies/#respond Fri, 26 Jan 2018 14:01:16 +0000 http://briefnews.eu/olympic-gymnast-champ-kyle-shewfelt-says-canada-must-strengthen-its-own-abuse-policies/

Canadian gymnast Kyle Shewfelt says policies dealing with abuse in sports need to be strengthened to help prevent further incidents of sexual assault and other crimes against young athletes.

The Olympic champion said Thursday that it was good that the Larry Nassar case in the United States has raised awareness about abuse but it needs to be followed up with strong measures from authorities in all sports, not just gymnastics.

Nassar, a sports doctor who admitted to molesting some of the U.S.’s top gymnasts over many years, was sentenced Wednesday to 40 to 175 years in prison for sexual assault and other charges in a Michigan court.

“We need stronger policies in place so Larry Nassar can’t get away with what he got away with for 20 years,” said Shewfelt. “The conversation has started, but much more needs to be done.

“The deviants are always going to have a plan. Let’s have zero tolerance. Let’s have black and white policies.”

Shewfelt, who now runs his own gymnastics club, said that if authorities in the U.S. had listened to the first athlete to complain about Nassar years ago, he would not have been able to continue his abuse. When action was finally taken, more than 150 women made statements against him.

Shewfelt said he was heartened by the fact that athletes now appear more prepared to speak out when faced with abuse than in the past.

“At least it’s something that a lot of people in Canada and around the world are talking about,” said Shewfelt. “As horrible as it is.”

Allegations in Canada

While the Nassar trial has taken centre stage in recent days, gymnastics’ governing body in Canada has also been dealing with sexual assault allegations.

In December, Gymnastics Canada suspended Edmonton-based coach Michel Arsenault after CBC’s French-language network reported he sexually abused at least three gymnasts in Quebec when they were minors in the 1980s and early ’90s. Less than two weeks later, the organization placed Sarnia, Ont., coach Dave Brubaker on leave after learning he was facing multiple sex-related charges. Police haven’t released any details in that case and a publication ban has been imposed.

Shewfelt, 35, owns Kyle Shewfelt Gymnastics in Calgary. His staff held a meeting recently to discuss the Nassar case, go over the club policies and underline the need to protect young gymnasts.

Rule of Two

He said strict rules are in place at his club on interactions between coaches and athletes. They include the Coaching Association of Canada’s Rule Of Two, which says a young athlete should never be left alone with a coach or other staff member, which is a deterrent to predatory behaviour.

“If I have a coach who is not following these policies, I do have to let them go,” he said.

Shewfelt said it is next to impossible to entirely eliminate sexual predators, calling them “master manipulators,” but strong policies can greatly reduce their number.

The Calgary native was Canada’s first Olympic gold medallist in gymnastics at the 2004 Games in Athens, winning the floor exercises, and remains deeply involved in the sport as a coach and a broadcaster. He said his sport and others could emerge stronger in the wake of the Nassar case.

“There are thousands of coaches who are doing the right thing,” he said. “We need to look at what they’re doing.”

US Olympic champion gymnast paid ‘hush money’ in Nassar sex abuse scandal https://briefnews.eu/us-olympic-champion-gymnast-paid-hush-money-in-nassar-sex-abuse-scandal/ https://briefnews.eu/us-olympic-champion-gymnast-paid-hush-money-in-nassar-sex-abuse-scandal/#respond Thu, 21 Dec 2017 13:31:30 +0000 http://briefnews.eu/us-olympic-champion-gymnast-paid-hush-money-in-nassar-sex-abuse-scandal/ US Olympic gold medalist McKayla Maroney has filed a lawsuit against USA Gymnastics alleging that she was paid to keep quiet about sexual abuse suffered at the hands of the team’s disgraced former doctor Larry Nassar.

Maroney spoke of ‘systematic sexual abuse’ by Nassar, who worked for nearly 30 years as the team doctor, under the pretext of medical treatment. Earlier this month, Nassar was sentenced to 60 years in prison after pleading guilty to three federal child pornography charges, and will be sentenced in a separate sexual abuse case on January 18.

The Wall Street Journal reported that Maroney’s lawsuit alleges that the Olympic champion signed a confidential $ 1.25 million settlement agreement with USA Gymnastics in December 2016, after Nassar was arrested in Michigan on the child pornography charges.

The agreement included a non-disclosure clause relating to Maroney’s allegations of abuse by Nassar. Maroney’s attorney, John Manly, who filed a lawsuit on behalf of the gymnast on Wednesday, said the London 2012 gold medalist willingly signed the agreement, but did so under psychological trauma brought on by the news that dozens of other women had been victims of Nassar.

“I want people to understand that this kid had no choice. She couldn’t function. She couldn’t work,” Manly told ESPN. “Confidentiality agreements in child sex abuse cases are unlawful in the state of California and have been for years. We’re basically saying USAG and its lawyers violated the law by asking McKayla to agree to it and that she should be free to talk about her abuse to whomever she wants, whenever she wants.”

The 22-year-old Maroney, who is now retired from gymnastics, broke the agreement in October after posting an emotional statement on her Twitter page, in which she detailed Nassar’s seven-year-long sexual abuse, beginning when she was just 13 and continuing to her retirement from competition in 2016.

“I was molested by Dr Larry Nassar, the team doctor for the US Women’s National Gymnastics Team, and Olympic Team,” she said in the statement. “Dr Nassar told me that I was receiving medically necessary treatment that he had been performing on patients for over 30 years.

“It seemed whenever and wherever this man could find the chance, I was ‘treated,’” Maroney wrote. “It happened in London before my team and I won the gold medal, and it happened before I won my silver” she added.

Following Maroney’s revelation, two more gymnasts from the Team USA 2012 gold-winning squad, Aly Raisman and Gabby Douglas, admitted that they also suffered sexual abuse by Nassar, who faces lawsuits from more than 100 women.

It remains unknown whether USA Gymnastics made offers of similar agreements to other alleged victims. The lawsuit filed by Maroney names the United States Olympic Committee (USOC), USA Gymnastics, Nassar and his employer, and Michigan State, as defendants.

In a statement released on Wednesday, USA Gymnastics denied allegations that the confidential agreement with Maroney was initiated by the organization, adding that it was the gymnast’s attorney at the time, Gloria Allred, who “approached USA Gymnastics, requesting that the organization participate in a confidential mediation process.”

Olympic champion gymnast Simone Biles makes Houston Texans cheerleading debut https://briefnews.eu/olympic-champion-gymnast-simone-biles-makes-houston-texans-cheerleading-debut/ https://briefnews.eu/olympic-champion-gymnast-simone-biles-makes-houston-texans-cheerleading-debut/#respond Mon, 11 Dec 2017 17:46:41 +0000 http://briefnews.eu/olympic-champion-gymnast-simone-biles-makes-houston-texans-cheerleading-debut/

US Olympic champion gymnast Simone Biles has made her debut as a National Football League (NFL) cheerleader, turning out to cheer on her hometown team the Houston Texans during Sunday’s game against the San Francisco 49ers.

Team USA’s most decorated gymnast was invited by the Texans to perform as the first-ever honorary member of the cheerleading squad after Biles expressed her wish to become an NFL cheerleader on her Twitter account.

The 20-year-old Houston native was formally introduced to the squad on Friday, when her fellow cheerleaders gave her a pair of their famous red boots, which she donned for the occasion.

Biles attended two practice sessions with the cheerleading team before showing off her skills on the field at NRG Stadium. She said that her fellow Texans cheerleaders had helped her get ready for her first appearance.

“They’ve been so helpful in and out of practice, sending me videos and all that and even just today, they’re like, ‘Let’s go over this,’” Biles said. “So, they’re so helpful in telling me how the crowd’s going to react and how loud it’s going to be so to not pay attention because you can get distracted.”

The four-time Olympic gold medalist and multiple world champion said she enjoyed the experience of waving the red pom-poms on the sideline. “I had such an amazing experience cheering at the Texans Game. Definitely a memory to last forever!” Biles wrote on her Instagram page.

The gymnast, who has recently resumed her full-time training after a year layoff, is eyeing a return to world-class competition next year.

At the 2016 Olympic Games in Rio de Janeiro, the tumbling powerhouse, who has been unofficially crowned “the Michael Phelps of gymnastics”, completed her Olympic run with five medals.

Olympic gymnast Gabby Douglas shares abuse allegations after being accused of ‘victim shaming’ her teammates https://briefnews.eu/olympic-gymnast-gabby-douglas-shares-abuse-allegations-after-being-accused-of-victim-shaming-her-teammates/ https://briefnews.eu/olympic-gymnast-gabby-douglas-shares-abuse-allegations-after-being-accused-of-victim-shaming-her-teammates/#respond Wed, 22 Nov 2017 09:19:10 +0000 http://briefnews.eu/olympic-gymnast-gabby-douglas-shares-abuse-allegations-after-being-accused-of-victim-shaming-her-teammates/ gabby douglasLaurence Griffiths/Getty Images

  • On Tuesday, Olympic gymnast Gabby Douglas accused former team doctor Larry Nassar of sexual abuse.
  • The two-time gold medalist wrote in an Instagram post that she didn’t share her stories sooner because she was “conditioned to stay silent.”
  • Douglas’ allegations come several days after she was accused of victim-shaming her former teammates Aly Raisman, who has also accused Nassar of alleged abuse.

Over the weekend, Gabby Douglas tweeted a message that appeared to criticize her former teammate Aly Raisman. The two-time gold medalist was dragged through the mud on Twitter, with many accusing her of victim-shaming Raisman and others who’ve come forward with abuse allegations against former team doctor, Larry Nassar. Now, Douglas has not only released an apology, but alleged that Nassar abused her as well.

In an Instagram post shared Tuesday, Douglas apologized for her Tweet and shared her story of alleged abuse at the hands of Nassar. She explained that the day before she sent her tweet, she was at an event with girls who look up to her as a role model. Douglas wrote:

I didn’t view my comments as victim shaming because I know that no matter what you wear, it NEVER gives anyone the right to harass or abuse you. It would be like saying that because of the leotards we wore, it was our fault that we were abused by Larry Nassar. I didn’t publicly share my experiences as well as many other things because for years we were conditioned to stay silent and honestly some things were extremely painful. I wholeheartedly support my teammates for coming forward with what happened to them.

Douglas’ post makes her the third member of the 2012 “Fierce Five” gymnastics team to come forward with allegations against Nassar. McKayla Maroney came forward in early October as part of the #MeToo social media campaign. Raisman made allegations against Nassar earlier this month. Nassar is currently facing criminal charges that he molested other gymnasts, along with counts of possessing child pornography. He has denied the charges.

Though Maroney has been silent since coming forward, even deleting her social media accounts, Raisman has continued to criticize both Nassar and USA Gymnastics, which she says went to great lengths to protect the doctor over young female members of the team.

“I kept reaching out saying I wanted to meet with [the private investigator] again, because I had time to process it, I realized it was really bad,” Raisman said in an interview with “Today.” “I was basically told to keep it quiet, and that they were handling it.”

Raisman has been equally vocal on Twitter, writing on Saturday that she would not “put up with any woman or girl being shamed for wanting to wear a skirt, dress, etc.”

“STOP VICTIM SHAMING,” Raisman wrote. “It is because of you that so many survivors live in fear.”

Douglas responded in a now deleted tweet that said, “It is our responsibility as women to dress modestly and be classy. Dressing in a provocative/sexual way entices the wrong crowd.”

Many took Douglas’ message as a form of victim-shaming and a slap in the face to her former teammate, including Simone Biles, who competed with both women on the 2016 Olympic women’s gymnastics team.

“Shocks me that I’m seeing this but it doesn’t surprise me,” Biles wrote. “Honestly seeing this brings me to tears bc as your teammate I expected more from you & to support her.”

You can read Douglas’ full Instagram post below:

First, I want to reiterate my apology for responding the way that I did to a comment that one of my teammates posted. I know some of you may take what I’m about to say as insincere, but I still want to provide context.

The day before I commented, I was at an event where hundreds of children and young adults came to spend an evening with me. It’s very humbling when many people look up to you as an example. I take my job as a role model very seriously and I always want to do my best to represent all the best qualities that a role model should embody. I admit there are times that I fall short.

I understand that many of you didn’t know what I was dealing with, but it is important to me that you at least know this. I do not advocate victim shaming /blaming in any way, shape, or form! I will also never support attacking or bullying anyone on social media or anywhere else.

Please forgive me for not being more responsible with how I handled the situation. To every other individual that commented to or about me hatefully, I apologize that I let you down too. I will never stop promoting unity, positivity, strength, being courageous, and doing good instead of evil. I have learned from this and I’m determined to be even better

All my love,

Gabby

Gymnast slams ‘abused teammate’ https://briefnews.eu/gymnast-slams-abused-teammate/ https://briefnews.eu/gymnast-slams-abused-teammate/#respond Sat, 18 Nov 2017 14:48:12 +0000 http://briefnews.eu/gymnast-slams-abused-teammate/ GYMNASTICS star Gabby Douglas slammed fellow Olympian Aly Raisman on Friday for dressing in a “provocative/sexual way” after Raisman accused her former gymnastics team doctor of sexual assault.

The New York Post reports that Douglas responded to a tweet from Raisman that detailed the victim shaming she has recently received after launching the allegations because she had once done a “sexy photoshoot.”

“Just to be clear,” Raisman posted on Friday. “Just because a woman does a sexy photoshoot or wears a sexy outfit does not give a man the right to shame her or not believe her when she comes forward about sexual abuse.”

USA Gymnastics has been reeling since team doctor Larry Nassar was charged a year ago with sexual assault, prompting more than 130 gymnasts to come forward to accuse the doctor.

Raisman added her name to the list of victims this past Sunday night in an interview with 60 Minutes.

But Douglas — a teammate of Raisman on the 2012 “Fierce Five” and 2016 “Final Five” squads — took issue with Raisman’s anti-victim-blaming stance

“It is our responsibility as women to dress modestly and be classy,” Douglas wrote in a tweet that has since been deleted. “Dressing in a provocative/sexual way entices the wrong crowd.”

After Douglas’ misguided missive about dresses provocatively, teammate Simone Biles rushed to Raisman’s defence.

“Honestly seeing this brings me to tears bc as your teammate I expected more from you & to support her. I support you Aly & all the other women out there,” Biles wrote.

Biles hinted that Douglas hasn’t been a good teammate in the past, tweeting that the attack on Raisman, “shocks me that I’m seeing this but it doesn’t surprise me.”

Douglas later attempted to backtrack on her remarks.

“I didn’t correctly word my reply & I am deeply sorry for coming off like I don’t stand alongside my teammates,” she wrote on Twitter.

“Regardless of what you wear, abuse under any circumstance is never acceptable. I am WITH you. #metoo ”

Raisman and Biles are among the most decorated gymnasts in American history.

Biles won four gold medals at the 2016 games in Rio. Raisman has three golds, two silvers and a bronze from her two Olympic appearances.

Douglas has struck gold twice, once each in 2012 and 2016.

The 54-year-old Nassar remains in jail and is scheduled to appear in court on Wednesday — when he’s expected to plead guilty to charges, the Lansing Journal has reported.

Nassar faces life in prison on sex assault charges from Ingham and Eaton Counties. He’s already pleaded guilty to federal child porn charges.

Olympic gold medalist Aly Raisman is the second of the so-called ‘Fierce Five’ medal-winning squad to reveal that she was sexually abused by the USA Gymnastics team doctor.

Three-time gold medalist Raisman spoke out about the abuse in an interview with ‘60 Minutes’ which will air Sunday.

“I am angry. I’m really upset,” she told 60 Minutes. “I see these young girls that come up to me, and they ask for pictures or autographs, whatever it is… I just want to create change so that they never, ever have to go through this.”

The revelation comes in the wake of her 2012 London Olympics teammate McKayla Maroney’s admission that she suffered “systematic sexual abuse” at the hands of the doctor, Larry Nassar.

Maroney wrote on Twitter in October that she suffered years of sexual abuse that began when she was 13 and continued for seven years, until she retired last year.

Raisman, who was a member and medalist of the 2012 and 2016 US Olympic teams, said she was first treated by Nassar when she was 15.

“Why are we looking at why didn’t the girls speak up?” Raisman said. “Why not look at what about the culture? What did USA Gymnastics do, and Larry Nassar do, to manipulate these girls so much that they are so afraid to speak up?”

Nassar, who was a USA Gymnastics physician for 20 years, is currently in prison awaiting trial for possession of over 37,000 child pornography videos and images. He also faces over 100 lawsuits from women accusing him of sexual abuse.

More than 140 women have reported being sexually abused by Nassar, the Lansing State Journal reports. Nassar also worked at Michigan State University (MSU) for decades.

Last year, women began to come forward to report sexual abuse by Nassar after two women shared their story with the Indianapolis Star. He was fired from MSU soon after the story broke.

Sydney bronze medalist Jamie Dantzscher, was one of the two women to first accuse Nassar of abuse, which she said began when she was 12.

“In the last year, Aly has become an advocate for many issues, and sharing her personal experience of abuse takes great courage,” USA Gymnastics said in a statement to ‘60 Minutes.’ “We are appalled by the conduct of which Larry Nassar is accused, and we are very sorry that any athlete has been harmed during her or his gymnastics career.”
