More than 35 minutes of Spyro Reignited Trilogy cut scenes, none of which can be enjoyed by deaf or hard-of-hearing gamers (or those with the TV on mute).

Last week’s release of the Spyro Reignited Trilogy disappointed many, including deaf and hard-of-hearing gamers, by not including subtitles in the games’ many spoken cut scenes. Now, Activision’s justification for that decision is angering many for seeming insensitivity to the needs of the community.

An Activision spokesperson gave the following statement to British site GamePitt when asked about the issue (the company was not immediately available to respond to a request for comment from Ars Technica):

When Toys For Bob set out to make an awesome game collection, there were certain decisions that needed to be made throughout the process. The team remained committed to keep the integrity and legacy of Spyro that fans remembered intact. The game was built from the ground up using a new engine for the team (Unreal 4) and was localized in languages that had not previously been attempted by the studio. While there’s no industry standard for subtitles, the studio and Activision care about the fans’ experience especially with respect to accessibility for people with different abilities, and will evaluate going forward.

As GameCritics’ Brad Gallaway phrased it on Twitter, many are taking the statement as Activision “basically saying ‘we evaluated whether it was worth the cost and effort to keep Deaf and HH players happy, and we decided that it wasn’t.'”

Two documents reveal the rules the FBI would have to follow in obtaining warrants to spy on reporters under the Foreign Intelligence Surveillance Act  (FISA), implicitly confirming the existence of such cases. The documents were obtained as part of a Freedom of Information Act (FOIA) lawsuit by Freedom of the Press Foundation and the Knight First Amendment Institute at Columbia University.

A March 19, 2015 memo by then-Attorney General Eric Holder specifies that the FBI needs to refer surveillance applications against “known media entities” and “known members of the media” to the AG himself, his deputy or, in certain cases, the assistant attorney general of the National Security Division of the DOJ, for review.

This means that Holder and his successor Loretta Lynch, former DAG Sally Yates, and former AAG John P. Carlin all had knowledge of any FISA warrants taken out against members of the media under the Obama administration. The individuals with that authority in the current administration are AG Jeff Sessions, Deputy AG Rod Rosenstein, and AAG John C. Demers.

Freedom of the Press Foundation and the Knight First Amendment Institute have reacted to the revelation by asking if the current government is spying on journalists. The Obama administration has been accused of spying on reporters in the past, though not of using FISA warrants to do so.

While the mainstream media may have reasons for concern, given that relations between them and President Donald Trump can be charitably described as hostile, the rules laid out in the memos suggest it is highly likely that both the Trump and the Obama administration snooped on journalists they considered “foreign agents” – and anyone they might have been in contact with.

“You can safely assume that pretty-much any RT reporter can easily be under surveillance under these guidelines,” investigative journalist Max Blumenthal told RT.

“I always assume I’m under surveillance when I’m abroad,” Blumenthal said, but the newly revealed FBI rules “provide the basis for government officials, including the president, to obtain private communications of reporters operating domestically.”

The FISA court cannot be counted on to curb government spying, Blumenthal added, noting that it is a “rubber-stamp” institution that approves something like 98 percent of applications. The DOJ could easily get a warrant to spy on RT journalists solely on the basis of the network’s status under the Foreign Agents Registration Act (FARA). RT and Sputnik were the only foreign media outlets the DOJ demanded register under FARA until Tuesday, when it was reported that similar request was made of the China Global Television Network (CTNG) and the news agency Xinhua.

In the most infamous recent case, the court authorized –and extended three times– a surveillance application against Trump campaign adviser Carter Page and everyone he was in contact with, based on the “dodgy Steele Dossier,” Blumenthal said.

The FISA application against Page was the subject of the ‘Nunes memo,’ made public in February. In the document, chairman of the House Intelligence Committee Devin Nunes (R-California) accused the Obama DOJ and FBI of abusing the FISA process by misleading the court about the origin and authorship of the dossier – compiled by former British spy Christopher Steele and funded by the Hillary Clinton campaign through the Washington, DC firm Fusion GPS.

On Monday, Trump ordered the declassification of previously redacted portions of the FISA application against Page dated July 2017, as well as a number of other FBI and DOJ documents. The release of those documents is still pending.

A number of genetic testing companies, including 23andMe and Ancestry, have signed onto a set of guidelines that aim to address consumer privacy concerns, the Washington Post reports. The privacy best practices, drafted alongside the Future of Privacy Forum, state that companies should acquire “separate express consent” from customers before handing over their individual-level information — like genetic data and personal information — to certain third parties. It also says companies should disclose how many requests for information they receive from law enforcement. MyHeritage, Habit and Helix have agreed to the voluntary guidelines as well.

The move comes as recent events have put genetic testing companies in the spotlight, and specifically their policies on sharing customers’ data. In April, California officials announced the arrest of Joseph James DeAngelo, a man suspected to be the elusive Golden State Killer. Law enforcement were pointed to DeAngelo after running a DNA profile obtained from a crime scene sample through the open-source ancestry site GEDMatch. Since then, reports have documented how GEDMatch has been used to solve a handful of other cases.

In those cases, the police weren’t required to first obtain a warrant, and GEDMatch’s privacy policy now expressly states that law enforcement can access the site’s data in order to solve murder and sexual assault cases. But that sort of access has stirred a lot of privacy concerns, and other genetic sites, like 23andMe and Ancestry, have been clear that they don’t give law enforcement access to their databases without a court order. “I don’t think the average consumer has wrapped their head around the range of issues they should think about when they make a decision to share [DNA] data,” Future of Privacy Forum CEO Jules Polonetsky told the Washington Post.

Per the best practices guidelines, companies will “attempt to notify consumers on the occurrence of personal information releases to law enforcement requests” unless they’re legally required to keep it under wraps, by a gag order, for example. As for yearly law enforcement request disclosures, Ancestry and 23andMe already provide that information. Ancestry reported 34 valid requests in 2017 — all of which concerned credit card misuse and identity theft — and provided information in response to 31 of them. 23andMe says it has only received five such requests throughout its history, none of which were fulfilled.

The guidelines don’t require companies to obtain separate consent when sharing anonymized user data with other parties. An example of such a use would be 23andMe’s deal with GlaxoSmithKline, through which the genetic testing company will provide data to aid in the development of new drugs. In those cases, a company would need to have obtained prior consent to use their data for research, and 23andMe estimates around 80 percent of its customers have agreed to that type of participation.

These guidelines are all voluntary and some think more stringent, legally binding rules should be implemented throughout the growing industry. But an FTC spokesperson told the Washington Post that if companies don’t keep their promises, whether that be those made through its own privacy policies or via best practice agreements, “they could be subject to FTC law enforcement action.​​​​​”

Steam, the long-running PC games marketplace operated by Valve Software, has consistently run into issues with approved and restricted content, and arguments about those guidelines have heated up in recent weeks. After Valve removed various “ero” games and then approved the sexualized, violence-against-women simulator Agony, users began asking what was up with Steam’s content guidelines.

A lengthy blog post by Valve’s Erik Johnson, titled “Who gets to be on the Steam store?,” saw the company frankly admit that its own staff has struggled with the same question until reaching a new conclusion.

“We’ve decided that the right approach is to allow everything onto the Steam Store, except for things that we decide are illegal or straight-up trolling,” Johnson wrote. “Taking this approach allows us to focus less on trying to police what should be on Steam and more on building those tools to give people control over what kinds of content they see.”

American companies haven’t always been forthright about disclosing data breaches in a responsible way, and regulators want to encourage better behavior. The Securities and Exchange Commission has issued “interpretive guidance” that it hopes will both promote clearer disclosures and fewer ethical conflicts. The guidance asks companies to share more information about cyberattacks and other risks, and warns executives against trading securities before they’ve publicly shared the details of a breach — they shouldn’t dump shares knowing a hack will tank the company’s stock price.

Whether or not this makes a difference is another story. Although Democrats at the SEC supported the guidance, they argued that the real solution would be tougher rules requiring better disclosures and improved security standards. The guidance may formalize SEC interpretations that haven’t always been made public, but it doesn’t change those laws to keep pace with modern cybercrime. It’s not uncommon for companies to downplay or cover up incidents, but they won’t necessarily face serious repercussions for their actions.

If nothing else, though, this is a shot across the bow. It’s a reminder that companies shouldn’t sit on news of a breach, jeopardizing the data of their customers for the sake of profit. If companies honor the guidelines (and that’s a big “if,”) you may understand the true severity of a breach and have a better chance at mitigating the damage.
