A court has seized the Dutch assets of Russian energy major Gazprom to pay $ 2.56 billion in compensation to Naftogaz, the Ukrainian company has said.

In February, the Stockholm arbitration court demanded that the Russian company pay for a shortfall in the delivery of gas to Ukraine. Gazprom said that the decision created an imbalance in favor of Kiev. The Russian firm appealed the verdict, and notified Naftogaz that it had launched a procedure for the termination of gas-delivery contracts.

“Naftogaz will use all legitimate measures and tools available to us to enforce the decision and fully recover the amount awarded from Gazprom,” Naftogaz CEO Andrey Kobolyev said in a statement released on Tuesday.

Gazprom has said that there will be no resources for transit through Ukraine in previous volumes, as Russia’s gas production recourse base is shifting northwards. The gas giant’s CEO, Aleksey Miller, was quoted as saying on Tuesday that transit for Ukraine in amount of 10-15 bcm annually may be preserved, but Kiev must justify its economic expediency. German Chancellor Angela Merkel promised to consider the impact of a new Russian-German gas pipeline on Ukraine as plans progress. Merkel said she listened carefully to Ukrainian President Petro Poroshenko’s concerns over the Nord Stream 2 at a meeting in Berlin on Tuesday. She said Ukraine must retain a role in gas transit, adding that a Nord Stream 2 project “without having clarity about how things continue with the Ukrainian transit role is not possible,” AP reported.

“The main provisions of the contract were recognized as valid” by the Arbitration Institute of the Stockholm Chamber of Commerce, Gazprom Deputy Chairman Alexander Medvedev told the Rossiya 24 channel, adding that Gazprom believes that its “lawsuit was satisfied in the key contractual terms.” Ukrainian President Petro Poroshenko’s claim that Naftogaz had won the case is “at least, strange and makes one wonder if he was correctly informed on results of this arbitration,” Medvedev said.

The Swedish arbitration body ruled on the three-year dispute between Gazprom and Naftogaz Friday, both entities acknowledged. The policy of the Institute prevents it from even acknowledging that it’s mediating the case, which makes it impossible to obtain its own account of the final ruling. As a result, both energy companies have opposing takes on the outcome, both claiming victory in the case.

Medvedev said in line with the decision, Naftogaz immediately has to pay slightly over $ 2 billion, with a $ 600,000 fine added for every day of non-payment. With the Ukrainian enterprise having already paid their Russian partners $ 3.1 billion, the “total payment in this dispute amounted to $ 5.1 billion to be received by Gazprom,” he added.

Gazprom is “waiting for the contract to be fulfilled,” Medvedev said. “So far, we have received neither the money nor the fines for the delay. The penalty is growing. It has reached $ 1.8 million over the course of the last three days” since Friday’s decision, he said. Medvedev also pointed out that Ukraine has the right to purchase 5 billion cubic meters of gas if payment is made.

Ukraine’s claims that the Swedish arbitration body annulled the ‘take-or-pay’ provision were also misguided, Medvedev said. “This isn’t the case. Regarding the two remaining years, the amount of ‘take-or-pay’ was established at the level of 80 percent from 5 billion cubic meters of the annual volume. This is also a very important decision by the arbitration,” he said. ‘Take or pay’ means the client has to pay for a certain amount of gas agreed upon even if they don’t use all that is supplied to them, ensuring the contractual obligations are observed.

The ‘take-or-pay’ rule wasn’t implemented in full because the arbitration “apparently took into account… That the full application of ‘take-or-pay’ was impossible for either Naftogaz or for Ukraine as a whole” Medvedev said. “If it was fully implemented, this would lead to bankruptcy of not only Naftogaz, but of the entire Ukrainian economy,” he explained.
“One shouldn’t forget that the Ukrainian side’s demands for a compensation of its so-called overpayment of $ 14 billion were completely denied,” Gazprom’s deputy chairman manager said. He clarified that Ukraine tried to retroactively decrease the price of Russian gas, claiming it had paid too much for the resource over the past few years.

Naftogaz also hailed the ruling as a major win, estimating its positive effects at $ 75 billion. This sum included every penny the Ukrainian company would’ve had to pay Gazprom. It claimed further that the arbitration sanctioned the re-export of gas while voiding the linking of gas prices to oil products.

President Poroshenko described the results of the Stockholm arbitration as a “huge contribution into the energy security of our state.” He congratulated “the legal team of Naftogaz, the government, all the people of Ukraine on learning to defend its interests using European courts.”

The legal battle between Gazprom and Naftogaz in the Arbitration Institute of the Stockholm Chamber of Commerce has been rumbling on since June 2014. Most of the Russian company’s claims against Naftogaz relate to fines for insufficient withdrawal of gas by the Ukrainian side in accordance with the ‘take-or-pay’ rule. Gazprom also demanded payment of the debt and fines for gas delivered to Ukraine between May and June 2014. Naftogaz, in its motion, pushed for a retroactive change in the price of gas, the reimbursement of overpayment for unreviewed prices, and a repeal of the ban on reselling Russian gas.

The Russian company is focused on geological exploration, production, transportation, storage, processing and sales of gas, gas condensate and oil, sales of gas as a vehicle fuel, as well as generation and marketing of heat and electric power.

Gazprom has the largest reserves of natural gas in the world and is among Russia’s top four oil producers.

ExxonMobil is now ranked only ninth. Among other big improvers, Germany’s E.ON climbed 112 places to 2nd place from 114th. India’s Reliance Industries went up to 3rd place from last year’s 8th.

The first five companies also include Korea Electric Power and Chinese CNPC. Russian oil company Lukoil is in sixth place.

The rating is formed on the basis of financial indicators of companies, including the value of assets, total revenues, net profit and others. All companies on the list have assets of more than $ 5.5 billion.

The world’s top ten largest companies earned $ 63.7 billion last year, 14 percent lower than the $ 74.3 billion posted the year before.

Coal companies saw a substantial decline in the rating, as more countries are striving to increase the use of renewable energy sources and cleaner fuels. However, China’s Shenhua Energy rose to 13th place from 25th, as the price of coal in China rose sharply following output cuts by Beijing.

In December, Kiev’s Economic Court upheld a decision by Ukraine’s Antimonopoly Committee to fine Gazprom $ 6.6 billion, including over $ 170 million in penalties. The fine was imposed for alleged abuse of monopoly power in the natural gas market in 2009-2015.

Miller refused to comment on the course of the litigation between Gazprom and Ukraine’s state energy company Naftogaz, as a final decision is still awaited.

Earlier this week, Naftogaz claimed the arbitration court in Stockholm had ruled in its favor in a dispute with Gazprom. The Russian company said the ruling was an interim stage in the court process.

In 2015, Gazprom took Naftogaz to court demanding the Ukrainian company pay penalties over the failure to fulfill the ‘take-or-pay’ terms of its contract. Gazprom said the deal obligates Kiev to buy a minimum quantity of gas annually or face a penalty.

As of the end of May, Gazprom’s claim totaled $ 47.1 billion, most of which – $ 34.5 billion – was for gas not delivered by the Russian company in 2012-2016.

Earlier this year, the head of business development of Naftogaz Yury Vitrenko admitted that losing the case in Stockholm court would lead to the Ukrainian company filing for bankruptcy.

Russian energy giant Gazprom has begun laying pipes for the Turkish Stream natural gas pipeline off the Russian Black Sea coast, Gazprom CEO Aleksey Miller said Sunday, days after the Sochi meeting between Turkish and Russian leaders.

“Today, we started the practical implementation of the TurkStream gas pipeline project: pipe-laying within the offshore section. The project has been implemented in strict compliance with the plan,” Miller said in a statement Sunday, adding that “by late 2019, our Turkish and European consumers will have a new, reliable source of Russian gas imports.”

Going into the details of the works that are currently under way off the Krasnodar Krai coastline, Miller said that that the inaugural construction works are being carried out by the Audacia multi-purpose pipe-laying vessel, owned by Allseas, the project’s main contractor. It is tasked with construction of both legs of the pipeline’s offshore stretch, measuring over 900 km.

The first of the legs, with a maximum capacity of 15.75 billion cubic meters, will deliver Russian natural gas directly to Turkey, while the second is envisioned to supply gas to European customers. 

The much-awaited announcement comes on the heels of a meeting between Russian President Vladimir Putin and his Turkish counterpart, Recep Tayyip Erdogan, in the Russian Black Sea resort city of Sochi on May 3.

The Turkish Stream project, which was signed into an agreement by Putin and Erdogan in Istanbul in October 2016, was one of the key points on the meeting’s agenda.

The following day, Miller told Putin that Gazprom had completed all preparatory work and was “ready to start the sea stretch of the Turkish Stream gas pipeline in a few days.”

The project, with an estimated total cost of €11.4 billion ($ 12.7 billion) was announced in December 2014, however, it was put on hold after the downing of a Russian Su-24 bomber by the Turkish Air Force in November 2015, which was followed by a sharp deterioration of relations, entailing travel restrictions, economic sanctions and the halt of joint infrastructure ventures.

However, since last August, when Turkey publicly apologized for bringing down the jet, many of the stalled projects, such as construction of Turkey’s first nuclear power plant and Turkish Stream project were put back on the table.

Pursuant to the October agreement, Russia is to construct and own the maritime section of both Turkish Stream legs, while Turkey would be in charge of construction of the land part of the branch supplying gas to its citizens.
