The Austrian law banning full-face veils has claimed an unusual victim: a man impersonating the iconic St Nicholas for a children’s party, whose red frock and frothy fake beard the police deemed the equivalent of a burqa.

The man, identified only as Hans M in media reports, was stopped by several officers as he was driving to a Viennese school party dressed as St Nicholas, the Christian saint who inspired Santa Claus.

“Don’t you know about the full-face ban?” a policeman asked the 35-year-old St Nicholas, according to the Heute newspaper. Hans’ arguments that he was late for the show and children were waiting did not help. The officers demanded he take off his fake white beard and red frock, and proceeded to search his car for at least 15 minutes. “They even checked my spare glasses,” the man said.

Finally, the police stopped the search and allowed Hans to leave. “You’ll hear from us,” were the last words from the officers, recalls Hans who, fearing the consequences, hired a lawyer.

Hans’ lawyer, Erich Gemeiner, confirmed the incident to RT. “My client works as a Santa Claus every year. He has a lot of [shows] in kindergartens and schools and that’s why he was in a hurry [that day],” he said.

Gemeiner believes that the case is merely a provocation, as Hans didn’t fully cover his face and the police had no reason to take off even the frock.

“It wasn’t a normal traffic check, the police were driving next to him,” Gemeiner said.

The officers stopped him just because he was dressed as Santa Claus, Gemeiner added. “I think the scene was just to annoy him and to hold him as long as possible so that he would never be in time [for the show].”

Austria’s controversial ban on the wearing of full-face veils in public places came into effect in October this year. Those found in breach of the “Anti-Face Veiling Act” will be subject to fines of €150. The law does exempt people who cover their faces for medical or safety reasons, including hazardous weather conditions such as smog. Participants of street carnivals and other “artistic, cultural or traditional events” are also exempt, along with athletes requiring face-covering gear. Apparently, the St Nicholas incident was not considered an “artistic” or “cultural” event by the police officers.

Hans is not the first victim of the newly-adopted legislation. In October, police flocked to a Lego store in Vienna, responding to a report of a violation of the law forbidding full-face veils. The officers responded to the call, only to find out that the apparent “criminal” was a woman dressed in a Lego Red Ninja costume. She was not issued with a fine, though: police said they established she concealed her face as part of her “professional occupation.”

The ban’s advocates say the garments prevent students from communicating with each other.

The bill, put forward Monday, would cover both private and public institutions, including kindergartens, schools, colleges and universities. It would apply to students and staff alike.

“We do not want clothes covering the face in nurseries, schools and universities,” said Education Minister Torbjorn Roe Isaksen, who introduced the bill along with Immigration Minister Per Sandberg. The ban will also affect newly arrived immigrants taking part in language courses and educational programs for refugees.

“Garments cover the face prevent communication, which is key for pupils and students in their learning,” Isaksen said in a statement, adding that Norway is “an open society where everyone should be able to see each other’s face.”

“Face-covering garments such as the niqab or burqa do not belong in Norwegian schools. The ability to communicate is a basic value,” said the minister of immigration, who is from the Progress Party, known for its anti-immigration policies.

The ban implies only those garments which cover the face, such as Muslim full-face veils called niqab, balaclavas or face masks. It won’t apply to hijabs or any other headscarves that leave the face exposed, the government says, adding that exceptions will be made for those wearing face-covering items for educational, health, climatic or safety reasons.

With the ban already being implemented by several schools in Oslo, Østfold and Akershus, the government says it now wants the regulations to be nationwide.
The draft bill has been sent to the institutions that. would be affected, inviting their comments before September 20.

“We have every reason to believe this will be approved by parliament,” Torbjoern Roe Isaksen told Reuters.

However, the proposal has already been denounced by the country’s student association, with its leader saying: “If a single piece of clothing is not an obstacle to teaching, there is no basis to prohibit it.”

Marianne K. Andenæs from the Norwegian Student Organization says that right to education must be applied to everyone, including those whose personal choices are difficult for politicians to understand.

With France becoming the first European nation to introduce restrictions on wearing full-face coverings in public in 2011, other countries across Europe such as Belgium, the Netherlands, Bulgaria and German state of Bavaria picked up the policy. Earlier this month, Austria adopted a law that will fine women wearing Islamic veils, burqas and niqabs, starting from October.

Under the new measures, migrants must also perform unpaid public work or face losing benefits or other consequences. The requirement is meant to better prepare refugees for the Austrian labor market, according to Bild.

The measure received the go-ahead from both ruling parties, the Social Democratic Party (the SPÖ) and center-right Austrian People’s Party (the ÖVP), Austria’s news outlet oe24.at reported. 

Opposition parties have criticized the move, however, saying it is doubtful that banning full-face veils will contribute to integration.

Attacks on migrant facilities doubled in Austria in 2016 compared to the previous year. The acts committed by the perpetrators ranged from hurling Molotov cocktails at buildings to slashing gas pipes, officials said last month.

Austria has received more than 130,000 asylum claims from applicants from the Middle East and North Africa since the summer of 2015. The country of some 8.7 million people has taken in more refugees per capita than any other country in Europe, apart from Sweden.

Under an EU refugee resettlement and relocation program agreed on in 2015, Austria has to accept 460 asylum-seekers from Italy and about 1,400 refugees from Greece. However, Austria took in around 90,000 refugees in 2015 (more than one percent of its population), and was granted a temporary exemption.

As part of a campaign to speed up the repatriation of around 50,000 asylum seekers, Vienna promised in March to double the amount of money paid to migrants who voluntarily return home. Austrian Interior Minister Wolfgang Sobotka said the plan primarily targets “those who are not likely to be granted the right to long-term residence.”

Traditional Islamic head and face coverings have long been controversial in Europe, where they are often seen as incompatible with secular values. France became the first European country to impose a ban on full-face coverings in 2011. Belgium followed suit shortly thereafter.

Late last month, German MPs approved a partial ban on full-face veils, saying it’s the country’s duty to present itself “in an ideologically and religiously neutral manner.” The ban applies to public servants, including elected officials, military personnel, and staff working in the judiciary.

“[The ban] obliges officials and soldiers not to hide their faces while performing their duties or during direct fulfillment of their tasks,” a statement on the Bundestag’s website said.

The legislation does contain some exceptions, however. For example, military personnel and public servants may wear full-face veils to protect themselves from infections. Police officers can also cover their faces in order to conceal their identity.
