Two documents reveal the rules the FBI would have to follow in obtaining warrants to spy on reporters under the Foreign Intelligence Surveillance Act  (FISA), implicitly confirming the existence of such cases. The documents were obtained as part of a Freedom of Information Act (FOIA) lawsuit by Freedom of the Press Foundation and the Knight First Amendment Institute at Columbia University.

A March 19, 2015 memo by then-Attorney General Eric Holder specifies that the FBI needs to refer surveillance applications against “known media entities” and “known members of the media” to the AG himself, his deputy or, in certain cases, the assistant attorney general of the National Security Division of the DOJ, for review.

This means that Holder and his successor Loretta Lynch, former DAG Sally Yates, and former AAG John P. Carlin all had knowledge of any FISA warrants taken out against members of the media under the Obama administration. The individuals with that authority in the current administration are AG Jeff Sessions, Deputy AG Rod Rosenstein, and AAG John C. Demers.

Freedom of the Press Foundation and the Knight First Amendment Institute have reacted to the revelation by asking if the current government is spying on journalists. The Obama administration has been accused of spying on reporters in the past, though not of using FISA warrants to do so.

While the mainstream media may have reasons for concern, given that relations between them and President Donald Trump can be charitably described as hostile, the rules laid out in the memos suggest it is highly likely that both the Trump and the Obama administration snooped on journalists they considered “foreign agents” – and anyone they might have been in contact with.

“You can safely assume that pretty-much any RT reporter can easily be under surveillance under these guidelines,” investigative journalist Max Blumenthal told RT.

“I always assume I’m under surveillance when I’m abroad,” Blumenthal said, but the newly revealed FBI rules “provide the basis for government officials, including the president, to obtain private communications of reporters operating domestically.”

The FISA court cannot be counted on to curb government spying, Blumenthal added, noting that it is a “rubber-stamp” institution that approves something like 98 percent of applications. The DOJ could easily get a warrant to spy on RT journalists solely on the basis of the network’s status under the Foreign Agents Registration Act (FARA). RT and Sputnik were the only foreign media outlets the DOJ demanded register under FARA until Tuesday, when it was reported that similar request was made of the China Global Television Network (CTNG) and the news agency Xinhua.

In the most infamous recent case, the court authorized –and extended three times– a surveillance application against Trump campaign adviser Carter Page and everyone he was in contact with, based on the “dodgy Steele Dossier,” Blumenthal said.

The FISA application against Page was the subject of the ‘Nunes memo,’ made public in February. In the document, chairman of the House Intelligence Committee Devin Nunes (R-California) accused the Obama DOJ and FBI of abusing the FISA process by misleading the court about the origin and authorship of the dossier – compiled by former British spy Christopher Steele and funded by the Hillary Clinton campaign through the Washington, DC firm Fusion GPS.

On Monday, Trump ordered the declassification of previously redacted portions of the FISA application against Page dated July 2017, as well as a number of other FBI and DOJ documents. The release of those documents is still pending.

Top DOJ watchdog to investigate FBI over FISA abuses https://briefnews.eu/top-doj-watchdog-to-investigate-fbi-over-fisa-abuses/ https://briefnews.eu/top-doj-watchdog-to-investigate-fbi-over-fisa-abuses/#respond Wed, 28 Mar 2018 23:07:17 +0000 http://briefnews.eu/top-doj-watchdog-to-investigate-fbi-over-fisa-abuses/ The Department of Justice inspector general has announced it will investigate the FBI over the use of a FISA court order to spy on a Trump campaign adviser, after the House Republican memo claimed the process was abused.

The review will determine whether the FBI followed proper procedure when it obtained a Foreign Intelligence Surveillance Act (FISA) warrant “relating to a certain US person,” DOJ Inspector General Michael Horowitz said in a statement on Wednesday.

The OIG will also “review information that was known to the DOJ and the FBI… from or about an alleged FBI confidential source” and review the DOJ and FBI’s “relationship and communications with the alleged source as they relate to the FISC applications.”

Horowitz’s review was prompted by the memo published last month by Republicans on the House Intelligence Committee, which revealed that the warrant to spy on Trump campaign adviser Carter Page was based on the infamous dossier authored by British spy Christopher Steele and paid for by Hillary Clinton’s campaign.

The memo, signed by committee chair Devin Nunes (R-California), said that the Steele dossier “formed an essential part” of the warrant obtained by the FBI from the Foreign Intelligence Surveillance Court, which was extended three times. Former FBI Director James Comey signed three of the FISA applications, while former deputy director Andrew McCabe’s signature was on at least one.

A key claim in the Nunes memo was that the FBI and DOJ did not properly disclose to the FISA court that the Steele dossier was a partisan product funded by the Clinton campaign.

The dossier contains unverified claims that Russia has compromising information on President Donald Trump, which Moscow might use to blackmail him.

Horowitz’s move was met by protests from the Democrats. The ranking member of the House Judiciary Committee, Rep. Jerrold Nadler (D-New York) condemned the IG’s decision to investigate what he described as “a conspiracy theory as fact-free, openly political, and thoroughly debunked as the President’s so-called ‘FISA abuse,’” in a statement on Wednesday.

Horowitz’s latest announcement comes amid his ongoing investigation into the FBI and Justice Department’s handling of the investigation into Hillary Clinton’s use of a private email server while she was serving as Secretary of State.

The DOJ watchdog is investigating why former FBI Deputy Director Andrew McCabe took three weeks to act on a request to examine Clinton’s emails, which were discovered during the 2016 US presidential election. That report is expected to be released in the coming weeks.

GOP  demand #ReleaseTheMemo on ‘shocking’ FISA abuses (after supporting surveillance law)   https://briefnews.eu/gop-demand-releasethememo-on-shocking-fisa-abuses-after-supporting-surveillance-law/ https://briefnews.eu/gop-demand-releasethememo-on-shocking-fisa-abuses-after-supporting-surveillance-law/#respond Fri, 19 Jan 2018 19:48:00 +0000 http://briefnews.eu/gop-demand-releasethememo-on-shocking-fisa-abuses-after-supporting-surveillance-law/

Republican lawmakers demand the public release of a classified memo detailing Foreign Intelligence Surveillance Act abuses under the Obama administration. The move comes as lawmakers reauthorized government surveillance powers.

The House Intelligence Committee passed the motion introduced by Rep. Peter King (R-New York) Thursday. The measure was voted on along party lines, with all Democrats voting against the motion to make the classified report available to all House members.

“I viewed the classified report from House Intel relating to the FBI, FISA abuses, the infamous Russian dossier, and so-called ‘Russian collusion.’ What I saw is absolutely shocking. This report needs to be released –– now. Americans deserve the truth. #ReleaseTheMemo,” Rep. Mark Meadows of North Carolina said Thursday night about the 4-page memo, reported New York Daily News.

Congressman Meadows was joined by other lawmakers who saw the memo, and who are pressing for its public release. The hashtag #ReleaseTheMemo has gone viral on social media.

Intercept journalist Glen Greenwald weighed in to tell conservatives they were falling for a fraud.

Florida Republican Congressman Matt Gaetz believed people could lose their jobs after the memo is released.

“I believe the consequence of its release will be major changes in people currently working at the FBI and the Department of Justice,” said Gaetz, as quoted by Fox News.

Weighing in was lone Democrat Representative Adam Schiff (California), the ranking member on the House Intelligence Committee, called the report “a profoundly misleading set of talking points drafted by Republican staff attacking the FBI and its handling of the investigation.”

“Rife with factual inaccuracies and referencing highly classified materials that most Republican Intelligence Committee members were forced to acknowledge they had never read, this is meant only to give Republican House members a distorted view of the FBI,” Schiff said, according to The Hill.“This may help carry White House water, but it is a deep disservice to our law enforcement professionals.”

House Oversight Committee member, Rep. Steve King (R-Iowa) told Fox News it should be released because it doesn’t reveal sources or methods and that it shows “how this whole collision thing was going on during the campaign.”

Florida Republican Rep. Ron Desantis called the memo “deeply troubling” in interviews on Fox News.

The House vote came the same day the Senate voted 65-34 to reauthorize a FISA provision that allows US spy agencies to conduct surveillance on foreign targets abroad for six years. The bill, already passed by the House, is now heading to the White House where President Donald Trump has said he will sign it into law.

An irony not lost on whistleblower and former NSA intelligence analyst, Edward Snowden

“If this memo had been known prior to the vote, FISA reauth would have failed. These abuses must be made public, and @realDonaldTrump should send the bill back with a veto,” Snowden said in a tweet Friday.

FISA court finds NSA violated search restrictions, spied on Americans https://briefnews.eu/fisa-court-finds-nsa-violated-search-restrictions-spied-on-americans/ https://briefnews.eu/fisa-court-finds-nsa-violated-search-restrictions-spied-on-americans/#respond Thu, 25 May 2017 01:19:55 +0000 http://briefnews.eu/fisa-court-finds-nsa-violated-search-restrictions-spied-on-americans/ Intelligence agencies under former President Barack Obama routinely violated privacy rights, conducted illegal searches and gathered information on US citizens, according to a FISA court that called their conduct “a very serious Fourth Amendment issue.”

Earlier this month, the Director of National Intelligence released a court order from the Foreign Intelligence Surveillance Court that found illegal searches of American citizens conducted by the National Security Agency (NSA) may have violated privacy rights. The court order came from a hearing on October 26, just before former President Barack Obama left office.

Under section 702 of the Foreign Intelligence Surveillance Act (FISA), the intelligence community is authorized to target the communications of non-citizens located outside the US for foreign intelligence purposes. However, the agency is supposed to be kept in check by multiple layers of oversight.

In 2011, the court placed further restricted on the NSA by instating minimization procedures that prohibit the agency from targeting American citizens in their searches.

The recent court order revealed that NSA analysts had been conducting searches of American citizens that violate the minimization procedures “with much greater frequency than had previously been disclosed to the Court.”

In their 2016 hearing, the court said the NSA’s violations amounted to “a very serious Fourth Amendment issue.”

The court found “significant” changes in the way the NSA intercepted communications, especially pertaining to their “upstream collection” – data the agency gathers from internet traffic as it flows through major telecommunications hubs. The NSA searches that traffic for “selectors,” such as a specific email addresses or keywords.

Along with other data, the NSA also gathered so-called “Multiple Communication Transactions” (MCT), which consists of several communications bundled together. MCTs were at the heart of the NSA’s illegal collection from 2008 to 2011.

The MCTs began to collect communications that were to, from or even contained a reference to a selector, known as “about” information.

“As a result, upstream collection could acquire an entire MCT for which the active user was a non-target and that mostly pertained to non-targets, merely because a single discrete communication within the MCT was from or contained a reference to a tasked selector,” the court said.

Senator Rand Paul (R-Kentucky) told Fox News that the NSA’s searches of “about” information are really a “backdoor way to sort of get at Americans’ privacy without using a warrant.”

Just after the court order was released, the NSA issued a statement that claimed the agency would stop collecting communications that contained references to a foreign intelligence selector.

“NSA will no longer collect certain internet communications that merely mention a foreign intelligence target,” the agency said in a statement. “Instead, NSA will limit such collection to internet communications that are sent directly to or from a foreign target.

The NSA also promised it would “delete the vast majority of its upstream internet data to further protect the privacy of US person communications.”

Microsoft says U.S. more than doubled its FISA requests https://briefnews.eu/microsoft-says-u-s-more-than-doubled-its-fisa-requests/ https://briefnews.eu/microsoft-says-u-s-more-than-doubled-its-fisa-requests/#respond Fri, 14 Apr 2017 03:37:44 +0000 http://briefnews.eu/microsoft-says-u-s-more-than-doubled-its-fisa-requests/

(Reuters) – Microsoft said on Thursday it had received at least a thousand surveillance requests from the U.S. government that sought user content for foreign intelligence purposes during the first half of 2016.

The amount, shared in Microsoft’s biannual transparency report, was more than double what the company said it received under the Foreign Intelligence Surveillance Act (FISA) during the preceding six-month interval, and was the highest the company has listed since 2011, when it began tracking such government surveillance orders.

The scope of spying authority granted to U.S. intelligence agencies under FISA has come under renewed scrutiny in recent weeks, sparked in part by evolving, unsubstantiated assertions from President Donald Trump and other Republicans that the Obama White House improperly spied on Trump and his associates.

Microsoft said it received between 1,000 and 1,499 FISA orders for user content between January and June of 2016, compared to between 0 and 499 during both January-June 2015 as well as the second half of 2015.

The number of user accounts impacted by FISA orders fell during the same period, however, from between 17,500 and 17,999 to between 12,000 and 12,499, according to the report.

The U.S. government only allows companies to report the volume of FISA requests in wide bands rather than specific numbers.

FISA orders, which are approved by judges who sit on the Foreign Intelligence Surveillance Court, are tightly guarded national security secrets. Even the existence of a specific FISA order is rarely disclosed publicly.

The Washington Post reported on Tuesday that the FBI obtained a FISA order to monitor the communications of former Trump advisor Carter Page as part of an investigation into possible links between Russia and Trump’s presidential campaign.

Parts of FISA will expire at the end of the year, unless U.S. lawmakers vote to reauthorize it. Privacy advocates in Congress have been working to attach new transparency and oversight reforms to any FISA legislation, and to limit government searches of American data that is incidentally collected during foreign surveillance operations.

Microsoft also for the first time published a national security letter, a type of warrantless surveillance order used by the FBI.

Other technology companies, including Twitter and Yahoo, have also disclosed national security letters in recent months under a transparency measure of the USA Freedom Act that was enacted into law by the U.S. Congress in 2015.

The FBI reportedly obtained a FISA warrant to surveil a former Trump adviser https://briefnews.eu/the-fbi-reportedly-obtained-a-fisa-warrant-to-surveil-a-former-trump-adviser/ https://briefnews.eu/the-fbi-reportedly-obtained-a-fisa-warrant-to-surveil-a-former-trump-adviser/#respond Tue, 11 Apr 2017 23:53:29 +0000 http://briefnews.eu/the-fbi-reportedly-obtained-a-fisa-warrant-to-surveil-a-former-trump-adviser/ carter pageAP

The FBI obtained a FISA warrant last summer to monitor the communications of Carter Page, who was an early foreign-policy adviser to Donald Trump’s presidential campaign, The Washington Post reported on Tuesday.

The energy-consultant-turned-foreign-policy adviser was named in an unverified dossier about President Donald Trump’s ties to Russia as a liaison between the Trump campaign and Russian officials. His trips to Moscow and contact with at least one Russian official last year are now reportedly under FBI investigation.

Page has called accusations that he served as a liaison an “illegal” form of “retribution” for a speech he gave in July at the New Economic School in Moscow in which he slammed the US for its “hypocritical focus on ideas such as democratization, inequality, corruption, and regime change.”

Page did not immediately respond to Business Insider’s request for comment. But he told The Washington Post on Tuesday that the existence of the FISA “confirms all of my suspicions about unjustified, politically motivated government surveillance…I have nothing to hide.”

Law-enforcement and intelligence agencies wishing to monitor signal intelligence they deem relevant to an investigation — in this case, suspected Russian interference in the 2016 election — must obtain what is known as a FISA warrant from the Foreign Intelligence Surveillance Court.

The government’s application for the FISA warrant targeting Page, The Post reported, has been renewed more than once, and “included a lengthy declaration that laid out investigators’ basis for believing that Page was an agent of the Russian government and knowingly engaged in clandestine intelligence activities on behalf of Moscow.”

There were contacts Page had with Russian intelligence officials that he did not disclose, according to The Post, and unanswered questions about a court case involving a Russian spy who tried to recruit him in 2013.

BuzzFeed News obtained the court filing for the case, which included a transcript of a conversation between Victor Podobnyy, the person accused of spying, and Igor Sporyshev, another Russian operative, about trying to recruit someone identified as “Male-1.”

Page confirmed to BuzzFeed that he was “Male-1.” But he said in a statement later that his personal identity was made “easily identifiable” in the court documents because the US government wanted to punish him for his “public positions of dissent.”

Page found himself at the center of a Russia-related firestorm in late February after USA Today reported that he met Russia’s ambassador to the US, Sergey Kislyak, during an event at the Republican National Convention. At least two other Trump associates, former adviser J.D. Gordon and then-Sen. Jeff Sessions, now the US attorney general, also spoke with Kislyak at the convention.

The White House has distanced itself from Page, insisting that he was an “informal” adviser to the campaign who left in early September. Page had no badge, an administration official told Business Insider last month, and never signed a non-disclosure agreement — two requirements of anyone working with the campaign in an official capacity. He also wasn’t on the campaign’s payroll, the official said, and did not have a campaign email account.

The Senate Intelligence Committee, which is investigating Russia’s interference in the 2016 election, has asked Page to preserve all information related to contacts with Russians during the campaign. He volunteered to be interviewed by the committee last month.
