  • Deposit box holders whose property was seized by the FBI in a March 2021 raid are suing the bureau.
  • The agency raided US Private Vaults and seized the contents of 1,400 safety deposit boxes.
  • A lawyer involved in the class-action said the FBI raid was the "largest armed robbery in US history."

A lawsuit filed after FBI agents raided a Beverly Hills vault company, seizing more than $ 86 million in cash as well as jewelry and gold from 1,400 safety deposit boxes, claims owners' items have still not been returned and that agents misled a judge to get the warrant.

Agents raided a branch of US Private Vaults in Beverly Hills in March 2021 and seized assets from boxes held by hundreds of people who were not suspected in any crimes, state court papers reported by the Los Angeles Times.

The FBI and the US attorney's office in Los Angeles obtained search and seizure warrants against US Private Vaults by concealing critical details from the judge who approved them, according to the lawsuit.

Robert Frommer, a lawyer with the Institute for Justice which brought the lawsuit, said in the court papers: "The government did not know what was in those boxes, who owned them, or what, if anything, those people had done."

After the raid many box-holders asked the FBI for their property back, Frommer told Insider.

"We brought suit on behalf of seven clients, but we were representing a class of at least 400 people. What we've been trying to show for the past several months is that the government's actions violated the search and seizure protections of the US constitution in the Fourth Amendment," he said.

"The scope of what the FBI did is unprecedented," Frommer added. "This was the largest armed robbery in United States history, and it was committed by the FBI."

After a two-year investigation that began in 2019, leaders of the FBI's Los Angeles office believed boxes at US Private Vaults were being used by criminals to store illicit proceeds. 

The FBI requested and obtained warrants to seize US Private Vaults' business property. However, a senior FBI agent recently testified that the warrant omitted a key part of the bureau's plan – to permanently seize everything in every box that contained at least $ 5,000 in cash or goods, the LA Times reported.

Frommer said in an Institute for Justice press release last month: "The FBI lied about its intentions in claiming to only be interested in the property of the business, and not the box holders. Ultimately, the lure of civil forfeiture turned these federal cops into robbers."

Laura Eimiller, an FBI spokeswoman, told the LA Times the warrants were lawfully executed "based on allegations of widespread criminal wrongdoing. At no time was a magistrate misled as to the probable cause used to obtain the warrants."

US Private Vaults has pleaded guilty to conspiracy to launder drug money, and the investigation was continuing, Eimiller added.

The FBI and Department of Justice did not immediately respond to Insider's requests for comment.

Frommer wants the government to destroy any information or records obtained from customers' boxes in what he said was a violation of the Fourth Amendment.

The Fourth Amendment protects against "unreasonable searches and seizures." It requires the government to get a warrant by showing probable cause explaining why a location needs to be searched and describing specifically what it is seizing.

The plaintiffs in the lawsuit have asked for the FBI raid to be deemed unconstitutional by a district judge, the LA Times reported. Doing so could force the return of assets worth millions of dollars to box holders.

A pair of lawsuits filed in Dallas County District Court late last year came to light on Friday, each revolving around an apparently nasty dispute between the former general counsel of Gearbox Studios (makers of the Borderlands and Aliens: Colonial Marines game series) and its CEO, Randy Pitchford.

A November filing by Gearbox, uncovered by Kotaku’s Jason Schreier, alleged that the company’s former general counsel, Wade Callender, “exploit[ed] Gearbox’s generosity and trust for his own personal gain.” Callender’s own counter-suit, filed in the same court one month later, went quite a bit further. Callender’s suit alleges that Pitchford “breached his fiduciary duties by exploiting Gearbox employees and property to fund Pitchford’s private cravings,” and one portion of the suit makes two sensational accusations about Pitchford’s behavior: that he accidentally left a selection of “underage” pornography on a USB stick at a restaurant, and that he used his company’s money to host parties where “adult men have reportedly exposed themselves to minors, to the amusement of Pitchford.”

The allegations about a USB stick places its discovery at a 2014 Medieval Times Dinner and Tournament location in Dallas, down the road from Gearbox’s Plano, TX, headquarters. As Callender alleges in the December suit, someone from the restaurant perused the USB stick’s contents upon their discovery and then contacted the game studio so that its employees could recover it. “Pitchford declared that the thumb drive was his and requested its prompt return,” Callender’s suit states.

Cook County, Illinois, has joined the parade of lawsuits filed against Facebook in the wake of the ongoing Cambridge Analytica scandal—the county is believed to be the first public entity to sue the social media giant and its former London-based business partner.

The case, which was filed in the Circuit Court of Cook County on Friday, March 23, lays out similar allegations to the six other cases currently pending in federal court. Cook County argues that Facebook, Cambridge Analytica, and the SCL Group, its corporate parent, violated users’ privacy en masse when they violated Illinois laws against fraud.

Just over a week ago, The New York Times and The Observer, a British newspaper, broke the story that the British data analytics contractor, which worked with Donald Trump’s presidential campaign, retained private data from 50 million Facebook users despite claiming to have deleted it. Facebook executives including CEO Mark Zuckerberg have called Cambridge Analytica’s actions a “breach of trust.”

In the wake of the ongoing Cambridge Analytica debacle, Facebook has now been sued in federal court in San Francisco and San Jose. These new cases claim violations of federal securities laws, unfair competition, and negligence, among other allegations.

The pair of cases stem from recent revelations that Cambridge Analytica, a British data firm that contracted with the Donald Trump presidential campaign, retained private data from 50 million Facebook users despite claiming to have deleted it. New reporting on Cambridge Analytica has spurred massive public outcry from users and politicians with CEO Mark Zuckerberg calling it a “breach of trust.”

These two cases, which were filed on March 20, could be just the first among what could be a coming wave of similar lawsuits.

When Apple unveiled its 2015 MacBook, reviewers quickly discovered its keys were flatter than ever, with single-digit millimeters of travel between their pressed and unpressed states. At first, we heralded this as a miraculous accomplishment in ever-thinner laptop computing, which carried over virtually unchanged into the next years’ models. But all was not well. The complex ‘butterfly’ switches that enabled the incredibly-slight travel distance had kept dirt out — until it got in and had nowhere to go, mucking up keys and effectively disabling keyboards, according to some reports. It seems Apple filed a patent for a contaminant-proof keyboard back in 2016 to solve the issue.

According to the documentation published, the patent was filed on September 8th, 2016 — months after reviews for the second-generation MacBook had come out. The one page made public doesn’t tell us much about the new design, or the solutions Apple envisioned to deal with the contaminant problem. But it does suggest the company took this issue seriously enough to start workshopping — and filing patents for — a fix. It’s definitely possible that this exact design doesn’t make it to the market, but it implies a solution is coming to future machines.

In its annual SEC filing, Intel has revealed that it’s facing 32 lawsuits over the Spectre and Meltdown attacks on its processors. While the Spectre problem is a near-universal issue faced by modern processors, the Meltdown attack is specific to processors from Intel and Apple, along with certain ARM designs that are coming to market shortly.

Per Intel’s filing, 30 of the cases are customer class-action suits from users claiming to be harmed by the flaws. While Meltdown has effective workarounds, they come with some performance cost. Workarounds for Spectre are more difficult and similarly can harm system performance.

The other two cases are securities class actions that claim that Intel made misleading public statements during the six-month period after the company was notified of the problems but before the attacks were made public.
