The music we played and the music we listened to often exploded from a 1-2-3-4 drum-stick click into two-to-three minute paeans to all kinds of Reagan-era anomie. We wore boots, were tattooed, would fight at the drop of a hat (win or lose) and in general earned the sobriquet: punks. In short, no one could tell us shit. About music and just about anything else.
Until: “Hands UP! Who wants to die?!?!”
It came from the speakers we had mounted on the floor and it sounded like it came from hell, the screamed imprecation, followed by a twisted military drum beat and the rest of the “song.”
“Who the hell is this?”
Who the hell it was, was The Birthday Party, via a cassette our drummer’s sister had sent him from Germany. The record, Mutiny/The Bad Seed, was a compilation and it was one of their last ones. The Australian band formed in 1976 as The Boys Next Door had become The Birthday Party and by 1983 they were dead. Their lead singer, Nick Cave, moved on to Nick Cave and The Bad Seeds and a career that now has branched out into movies, books and even more music.
But there was something else not spoken and something only shared between singers/frontmen … I’m going to kill you out there.
You see, Cave was one of Kerouac’s fabulous roman candles and his incandescence, while not always on, was way more on than off, and when my musical tastes moved beyond hardcore he was there. So much so that our next band, Oxbow, named our fourth record, An Evil Heat, from the same song, “Sonny’s Burning,” that asked us the ever-trenchant query, “Who wants to die?!?!”
With half a dozen friends in common, Cave and I had never met until an email. The sender? Barry Adamson, sometime bass player for The Bad Seeds, former bass player for Magazine and David Lynch soundtrack god. The message? A feeler to see if I’d be interested in playing with him and Cave at the 2007 London Jazz Festival at the Royal Albert Hall. All expenses paid. Plus a fee.
In a burst of near-cartoon dust I answered “yes” by showing up almost before the ink dried on the contract. The show would feature almost a full orchestra, tons of great players and two other singers other than me and Cave. His song? “Next,” a Scott Walker cover of a Jacques Brel tune. My song? “Romeo Is Bleeding,” a Tom Waits killer.
It was the mad genius of Adamson, himself a lodestar of heavy who’s had my ear for decades, that envisioned this playing out like an old-style revue. While he task mastered the band into shape, I loitered at the hotel in full reflection of how strange it all was. And then the call and off to the Hall.

This was the first time I met Adamson, even if I had been seeing him on stage for years, and in the green room, we chatted easily. Cave would be here soon, he said, but first I’d do a run-through of my song. He headed off to the stage, and as I stood by the buffet table Cave came in. Shorter than I had imagined after years of seeing him on the stage while I stood on the floor, we shook hands and I babbled about how excited I was. Cave was friendly enough in sort of a diplomatic way, despite me doing my Dennis Hopper to his Dean Stockwell (A Blue Velvet reference, thank you).
He went and picked his way through the tune, a high piece of drama concerning being forced into an Army whorehouse. I watched from the wings and felt it in my chest. I felt his rendition of the song and something else: a desire to show him … well, something. So when Adamson called me up, I was primed. Rather than imitate Waits’ jazzbo stylings, I decided to make the song — a tribute to a cholo, chopped and channeled by a kind of toxic masculinity — a serious cry for divine intervention.
And I did it like I was going to die if I didn’t do it.
Getting back to the wings afterward I could see that Cave stuck around, watching. He nodded and shook my hand again and told me what I knew, “very nice.” But there was something else not spoken and something only shared between singers/frontmen, even if only in my mind: I’m going to kill you out there. It was a friendly competition, but we’d never have been here without it. In other words, we live for shit like this.
That night, sold out and filled to the rafters, Cave came out and just DESTROYED the world with his version. People were standing and screaming. I was standing and screaming. A bit later I followed and did my best to both call and raise. No idea if I succeeded, but I was happy enough to have pulled it off.
Back in the green room again, standing around feeling somewhat accomplished, we started to talk. I told him his take was phenomenal but then an idea shoulders its way to my mouth: “Wouldn’t it have been cool to actually do it in the original French? Fuck. That would have been cool too!”
Cave silently eyed me, followed by a sharp nasal exhalation, and an almost imperceptible shake of the head. I could see I’d offended him somehow, but before I could fix it, he spun on his heels and was gone, to never be seen again by me from anything other than a seat, or floor space, in the audience.
Which is really too bad. We made beautiful music together.

In his predictably unhinged rally in Arizona on Tuesday night, Donald Trump opted to go for the season-ending, ratings-boosting cliffhanger when he declined to pardon former Maricopa County Sheriff Joe Arpaio for his federal criminal contempt of court conviction.
Demonstrating his natural nose for high drama, Trump teased a future pardon, promising the roaring crowd that he would take care of former Sheriff Joe. “Was Sheriff Joe convicted for doing his job?” President Trump asked as the crowd cheered.
“I’ll make a prediction, I think he’s going to be just fine.” He then added, “I won’t do it tonight because I don’t want to cause any controversy.” (According to a CNN report on Wednesday, the White House has already prepared the paperwork.) But the will-he-won’t-he arc hardly quells the staggering reality that with or without a presidential pardon, Trump has cast Arpaio as an unfortunate victim of judicial overreach. Just like Donald Trump.
None of this is new or revelatory. The president told Fox News on Aug. 14 that he was “seriously considering” pardoning for Arpaio, describing him as a “great American patriot, and I hate to see what has happened to him.” Much has already been said about Arpaio’s decades-long career of racist, abusive, and sadistic treatment of Latinos in Maricopa County, and there can be no doubt that Trump’s promises of pardoning the well-documented monstrous racism and cruelty is another deliberate piece of signaling about the centrality of bias and racism in Donald Trump’s presidency.
Trump and Arpaio were proud co-conspirators in the claim that President Obama was not an American citizen. After Trump began teasing the pardon earlier this month, the American Civil Liberties Union tweeted, “Make no mistake, if Trump pardons Arpaio, this would be an official presidential endorsement of racism.”

There’s more. Arpaio is also a soulmate for this president in his inexcusable failure to investigate hundreds of reported sex crimes and child molestations, which in his view, were less serious offenses than the crime of driving while Mexican. But one other aspect of the Arpaio controversy has shimmied under the radar. Arpaio’s career and conviction stand as yet one more example of his complete disregard of judicial orders and binding court authority. That makes him another Donald Trump. Make no mistake about it: The fact that Arpaio is quite literally convicted of being in criminal contempt of the courts is a big selling point for a president who has evinced nothing but contempt for the judicial branch since before he took office.
Arpaio isn’t just your garden-variety racist. He is a criminal racist who ignores judges for sport. Arpaio was convicted by a federal judge last month for defying a different federal judge’s order that he stop racially profiling Latinos for traffic stops and detention. This contempt goes back a decade. In 2007, a civil class action was filed and a federal investigation and lawsuit followed.
In 2011, then-Sheriff Arpaio was enjoined by U.S. District Judge G. Murray Snow from detaining people he deemed illegal immigrants, on suspicion of nothing beyond race. Nevertheless he persisted. Last year, the Justice Department decided to pursue a criminal contempt-of-court case against him, alleging that he and his deputies continued their racial-profiling practices for almost two years after being ordered to desist. And all the while, Arpaio was fundraising and boasting that no judge could constrain him.
In July, following a bench trial, U.S. District Judge Susan R. Bolton finally held him in criminal contempt for refusing to abide by the earlier ruling. Bolton wrote that Arpaio had shown a “flagrant disregard” for the court’s order and that this rejection of judicial authority was unacceptable. “Not only did Defendant abdicate responsibility,” she wrote, “he announced to the world and to his subordinates that he was going to continue business as usual no matter who said otherwise.” Arpaio has yet to be sentenced—that happens in October. He could serve up to six months in jail.
Indeed, if any American has out-Trumped Donald Trump in embodying the firm belief that no court may stop him, perhaps it is former Sheriff Joe. At his federal trial, prosecutors played video of Arpaio telling TV pundits that he would continue to jail people he considered “illegals,” as well as a video of Arpaio telling a Mexican detainee through a translator: “Nobody is higher than me. I am the elected official, elected by the people. I don’t serve any governor or any president.” It’s no wonder Arpaio is the president’s spirit animal.

Arpaio even wrote the playbook for Trump on discrediting judges based on race. As the Associated Press reports, “Arpaio was accused of launching an investigation into the federal judge who ruled against him in the racial-profiling case. Before that, he questioned the impartiality of a judge initially on the case because her twin sister leads a prominent advocacy group for Latinos.” Opposing lawyers noted that Arpaio had forwarded an email to staff members in which he referred to then–U.S. District Judge Mary Murguia as a “token Hispanic female judge.”
Trump’s contempt for and loathing of the judicial branch is almost as flamboyant as Arpaio’s—although perhaps he’s just had slightly less practice. At the very least, it seems to elicit quicker public pushback: Racist contempt for the judiciary seemed to backfire during the campaign when he went after the judge who was presiding over the Trump University lawsuit by deriding him as biased. But what was deemed disqualifying in the campaign is now just Monday chatter, and Trump’s contempt for judges went on to reach full flower when he began to threaten federal jurists throughout the sanctuary city and travel ban litigation.
He has since dismissed federal judges who disagree with him as “so-called judges.” He has threatened to break up a federal appeals court. He has, in tweets and at rallies, threatened individual jurists to the point that they needed increased security. That anyone devoted to principle of judicial independence isn’t horrified at the prospect of an Arpaio pardon is the real mystery here. This is condoning racism yes, but it’s also undermining judicial processes, findings, and orders.
Probably nobody cares. That a man who has made a career of deriding and ignoring judicial rulings will likely be pardoned by a man who has built a presidency on deriding and ignoring judicial rulings is hardly shocking anymore. Judges will take note, and perhaps that’s the best anyone can hope for. But if the real moral of the story in Arizona is that two men who lost popular elections are also permanently above the rule of law, you may want to carbon date the end of checks and balances to right here.

One of the rich ironies in President Trump’s obsession with the “fake media” is that the real masters of “fake news” are the Russians he seems so reluctant to offend. Let’s hope someone is pointing this out to him as he prepares to meet with President Vladimir Putin tomorrow. If Trump raves to Putin about all his troubles with “fake media,” Putin, who long ago turned Russia’s media into his personal tool, will be smiling broadly to himself and thinking: “At last, a president who understands.”
Putin is heir to a 100-year-old tradition of pushing fake news as a matter of official Russian policy. It goes back at least as far as the Bolshevik Revolution of 1917. In the aftermath, Lenin and his revolutionaries felt embattled. Most of the world treated the Soviets as pariahs because of the revolutionary ideology they were preaching. To push back, the Russians developed tools for spreading propaganda — fake news — pumping false reports out through the front groups and communist parties they were setting up around the world. World War II and the Cold War gave them new opportunities, especially because their West European communist parties had played important roles in the anti-fascist resistance and thus became more credible vehicles for spreading Russian propaganda after 1945.
Trump should be pushing government agencies to uncover Russian fake news. And he should be looking to the U.S. media as an ally to help bring it to light.
But it was really during the Cold War when Russia turned fake news into a high art. There are numerous examples of Moscow faking things like U.S. embassy cables, and letters from White House officials, including President Ronald Reagan and Zbigniew Brzezinski. Russians circulated forged documents through their propaganda organs, presenting a challenge to Americans, who had to identify and debunk them. To anyone who understands this history and knows what Putin has done with today’s Russian media and with online fake news, it is downright laughable to put the U.S. media in the same category, as Trump does almost every day.
Skip to our recent election. With decades of practice and turbocharged by cybertools and social media, Russia played us like a violin. They issued faked messages from Google to carry out phishing attacks on a variety of U.S. government and political officials. As King’s College professor Thomas Rid pointed out in congressional testimony, American journalists were often unwitting victims of Russian fake news, not the creators that Trump accuses them of being.
Moreover, Russia used automated Twitter accounts to spread false news during the campaign. In fact, a study by Oxford University claims that if questionable WikiLeaks material and Russian-origin stories are folded in, more than 45 percent of election-related news accounts amounted to propaganda.
Rather than battling the U.S. media, Trump should be pushing government agencies such as Homeland Security, the FBI, the U.S. Information Agency, the Department of State and the CIA to uncover Russian fake news and throw a spotlight on it. And he should be looking to the U.S. media as an ally to help bring it to light. An excellent recent study by The Washington Post documented ways in which the Europeans, who have dealt with Russian intrusions for decades, are taking such steps, working hard to make the problem visible so citizens will not be deceived.
The U.S. media is far from perfect, but Trump’s attacks on journalism are among the most reckless things he is doing. Fair enough to dispute media accounts — every administration has, to varying degree — but he should do it on the basis of specific substantive points, not the sort of name-calling that defines autocratic views of the press throughout modern history. Add to this the sheer hypocrisy of his charges: Trump’s long campaign to prove Obama was not born in the U.S. was laughably fake, and during the campaign his seizing on a fake news story about Sen. Ted Cruz’s father being involved in JFK’s assassination shows Trump loves fake news when it works for him.
So unless Trump’s attacks on the media are just a tactic, as some supporters suggest, the danger is that he and Putin could turn out to be soul mates in their disdain for an unfettered press. Public statements on Russian hacking by Putin and Trump put them almost on the same page. Putin denies any role, saying that if it occurred, it could have been “patriotic” individuals moved to defend Russian interests (similar to his eventually retracted denial of Russian official involvement in the Crimea takeover). Trump has been equivocal about the Russian role — late last month, he was still calling it a “big Dem hoax.”
So this meeting will pose the ultimate test for Trump’s views on the Russia issue. If he comes away still expressing doubts or ambiguity about Russia’s role in our election, Putin — an old KGB officer — will have had his way. If on the other hand, Trump finds a way to acknowledge Russia’s role, he will begin to thin the mysterious cloud that still hangs over his presidency.
