Blue-chip companies weasel out of charity lobbying disclosures https://briefnews.eu/blue-chip-companies-weasel-out-of-charity-lobbying-disclosures/ https://briefnews.eu/blue-chip-companies-weasel-out-of-charity-lobbying-disclosures/#respond Mon, 05 Mar 2018 22:03:23 +0000 http://briefnews.eu/blue-chip-companies-weasel-out-of-charity-lobbying-disclosures/ More than 20 major companies have failed to disclose money they paid to nonprofit groups linked to government officials, according to a new report. The disclosures are required by law, but loopholes can be used to avoid them.

The findings, which come from a new analysis conducted by the Center for Public Integrity, a nonprofit investigative news organisation, show how blue-chip companies are sponsoring charity fundraising events and contributing to charity funds without disclosing them.

In 2017, the nonprofit Wyoming Congressional Awards Council hosted its annual golf fundraiser, with its website listing 23 major corporations as sponsors, including UPS, Chevron, ExxonMobil, Shell and Novartis.

The Council has links to three members of Congress: Senators John Barrasso (R-Wyoming), Mike Enzi (R-Wyoming) and Rep. Liz Cheney (R-Wyoming), the daughter of former Vice President Dick Cheney. They are all listed as honorary chairpersons.

Out of the sponsors listed on the website, 16 lobby the federal government and are therefore required to file disclosure reports, which include ‘honorary contributions.’ By law, corporations and organizations that lobby the federal government must disclose certain charitable contributions to nonprofits.

However, only two of the 16 organizations actually included information about the Wyoming event on their disclosures.

The report exposes the loopholes contained in federal disclosure laws, and how the lobbying contribution requirements are not being enforced. It reveals that charitable organisations are providing a conduit for the lobbying money of big companies.

Meanwhile, Merck & Company, the Pharmaceutical Research and Manufacturers of America and Visa, all made major donations to the charitable Orrin G. Hatch Foundation, which has strong ties to the foundation’s namesake, the sitting Senator Orrin G. Hatch (R-Utah).

These companies attended a soiree at a luxury mountain resort in Utah hosted by Hatch himself, in which top donors at the dinner reportedly gave $ 100,000 or more, according to the Center for Public Integrity.

These same companies spent the best part of 2017 trying to influence tax legislation, which Hatch, as chairman of the US Senate Finance Committee, played a crucial role in shaping.

Major pharmaceutical firm Merck’s 2017 disclosures did not initially include a $ 20,000 contribution to the Orrin G. Hatch Foundation, although it subsequently amended this.

“We are amending our lobby disclosures to reflect those charitable donations as well, and our compliance department is working to add procedures to ensure that all donations in the future are noted on all applicable disclosures,” John Cummins, a spokesman for Merck & Company, told the Center for Public Integrity.

Moreover, the analysis indicated that the number of lobbyists disclosing their ‘honorary contributions’ has dramatically decreased over the past year. Only 308 filings disclosed honorary contributions in 2017, the lowest number since the legal requirement came into force in 2008.

In 2007, Congress passed the Honest Leadership and Open Government Act, which demanded new disclosure and ethics requirements from lobbyists and lawmakers. It was passed in response to corruption scandals associated with Jack Abramoff. The former Republican political lobbyist was convicted of fraud, conspiracy and tax evasion in 2006, after funneling Indian casino proceeds into multiple schemes to influence US lawmakers. The scandal is considered the most significant congressional corruption in generations, with 22 others also convicted of corruption or bribery or receiving bribes.

SEC guidelines push for clearer data breach disclosures https://briefnews.eu/sec-guidelines-push-for-clearer-data-breach-disclosures/ https://briefnews.eu/sec-guidelines-push-for-clearer-data-breach-disclosures/#respond Thu, 22 Feb 2018 07:41:50 +0000 http://briefnews.eu/sec-guidelines-push-for-clearer-data-breach-disclosures/

American companies haven’t always been forthright about disclosing data breaches in a responsible way, and regulators want to encourage better behavior. The Securities and Exchange Commission has issued “interpretive guidance” that it hopes will both promote clearer disclosures and fewer ethical conflicts. The guidance asks companies to share more information about cyberattacks and other risks, and warns executives against trading securities before they’ve publicly shared the details of a breach — they shouldn’t dump shares knowing a hack will tank the company’s stock price.

Whether or not this makes a difference is another story. Although Democrats at the SEC supported the guidance, they argued that the real solution would be tougher rules requiring better disclosures and improved security standards. The guidance may formalize SEC interpretations that haven’t always been made public, but it doesn’t change those laws to keep pace with modern cybercrime. It’s not uncommon for companies to downplay or cover up incidents, but they won’t necessarily face serious repercussions for their actions.

If nothing else, though, this is a shot across the bow. It’s a reminder that companies shouldn’t sit on news of a breach, jeopardizing the data of their customers for the sake of profit. If companies honor the guidelines (and that’s a big “if,”) you may understand the true severity of a breach and have a better chance at mitigating the damage.

Apple’s battery fiasco continues to grow as the US government gets involved. According to a Bloomberg report, the Department of Justice and the Securities and Exchange Commission are investigating if Apple violated securities laws with its disclosures surrounding a software update that intentionally slowed down the performance of older iPhones. The DOJ and SEC have requested more information from Apple on the subject.

No other details have been reported since the investigation is still new. It’s possible that the government is looking into Apple violating the securities laws that require publicly traded companies to disclose accurate financial information, including risk factors associated with investing in the company. The DOJ and SEC may consider the update that included the slow-down practices a risk factor that could affect the company’s stock and one that wasn’t properly disclosed to investors. As of writing this article, Apple’s stock fell 1.02 percent to $ 166.21 per share.

But this new investigation doesn’t signal definite wrongdoing by Apple—just an investigation by the government to see whether or not wrongdoing occurred. It’s also unclear which securities laws the DOJ and SEC are referencing—and since the probe is private, it’s hard to anticipate when more information about the investigation will be made public.

Hidden fees that show up on broadband bills after customers sign up for service have long been a source of frustration for Internet users.

Because advertised prices often don’t reflect the full cost of service, the Federal Communications Commission in 2015 forced ISPs to be more transparent with customers about hidden fees and the consequences of exceeding data caps. The new requirements were part of the net neutrality rules—and are therefore going to be eliminated when the FCC votes to repeal the rules next week.

While FCC Chairman Ajit Pai is proposing to keep some of the commission’s existing disclosure rules and to impose some new disclosure requirements, ISPs won’t have to tell consumers exactly what everything will cost when they sign up for service.

WikiLeaks disclosures on Iraq, Afghanistan did not damage US – report https://briefnews.eu/wikileaks-disclosures-on-iraq-afghanistan-did-not-damage-us-report/ https://briefnews.eu/wikileaks-disclosures-on-iraq-afghanistan-did-not-damage-us-report/#respond Wed, 21 Jun 2017 12:50:00 +0000 http://briefnews.eu/wikileaks-disclosures-on-iraq-afghanistan-did-not-damage-us-report/ Leaked US military files provided to WikiLeaks by Chelsea Manning did not significantly harm national security, according to a recently released Department of Defense secret report published by BuzzFeed.

The whistleblowing website WikiLeaks, providing access to classified intelligence, military and diplomatic documents, has been making headlines since its creation. The US government was hunting and prosecuting whistleblowers, saying the leaks pose a huge threat to national security. But it turns out that the leaked data, specifically on wars in Iraq and Afghanistan, was not so sensitive, a secret 107-page document obtained by the BuzzFeed News revealed.

A task force of more than 20 US agencies, including NSA, CIA and FBI, carried out a “line-by-line review” of more than 740,000 records of “known or believed compromised” WikiLeaks data available as for 2011. The document was provided to BuzzFeed under a Freedom of Information Act, in response to a request filed in 2015. However, it was not fully disclosed, with only 35 pages available.

Following the comprehensive analysis, the report concludes that WikiLeaks disclosures on operation in Afghanistan has no “significant strategic impact,” while it is still potentially damaging for “intelligence sources, informants, and the Afghan population” as well as for the US and NATO “collection methods and capabilities.”

The leaks on the war in Iraq “have no direct personal impact on current and former senior US leadership Iraq,” as the reports references to it are not damaging in any way, according to the Information Review Task Force (IRTF) assessments.

The review also has chapters on leaked Guantanamo records, as well as separate parts on Baghdad and Gerani airstrikes, carried out by the US Air Force during the wars in Iraq and Afghanistan correspondingly. The attacks received worldwide coverage and condemnation following the WikiLeaks posting the video of the airstrikes. However, the provided pages of the document do not include any assessment whether those leaked videos were harmful.

US Army private and whistleblower Chelsea Manning provided 700,000 military documents on Iraq and Afghanistan to WikiLeaks in 2010. For leaking classified information Manning was sentenced to 35 years in prison in 2013. She had served seven years behind bars before being pardoned by then-President Barack Obama and released in May.

The IRTF report also mentions another whistleblower and WikiLeaks co-founder, Julian Assange, saying “with moderate confidence” that his “insurance file” does not have anything “beyond that which the IRTF has already reviewed.” The task force related to Assange’s password-protected file, purportedly having additional leaks, in case anything happened to him.

Key Disclosures https://briefnews.eu/key-disclosures/ https://briefnews.eu/key-disclosures/#respond Sat, 01 Apr 2017 11:11:35 +0000 http://briefnews.eu/key-disclosures/

WASHINGTON — On Friday night, the White House began publicly releasing financial disclosure forms for senior officials in the Trump administration.

A handful of staff — like Jared Kushner, President Trump’s son-in-law and senior adviser, and Gary Cohn, the former Goldman Sachs president who is now the National Economic Council director — are very rich. Some — like White House senior strategist Steve Bannon — are merely wealthy. Others made incomes in the low six-figures before joining the White House.

Rather than posting the disclosure forms online, however, news outlets had to specify — one by one — which staffers’ forms they wanted to receive. The White House later began emailing them to requesting publications.

And so, as the night wore on, reporters — and the public — learned a little bit more about the team Trump has brought into the White House.

Bannon made more than $ 1,000,000 last year — with $ 191,000 coming from Breitbart and more than $ 490,000 coming from Bannon Strategic Advisors, Inc., but with significant amounts coming from several other enterprises. For example, Bannon received $ 100,000 from Citizens United Production IV, LLC, for “director fees.” He made more than $ 125,000 in “consulting fees” from Cambridge Analytica LLC, and more than $ 160,000 came from Glittering Steel, a production company that the Daily Beast previously connected to Bannon.

Ivanka Trump’s business trust alone is worth more than $ 50 million, the 54-page disclosure form filed by Jared Kushner revealed.

Kellyanne Conway, one of the president’s most recognizable advisers, made more than $ 800,000 from her polling and consulting firm, inc./Woman Trend, according to her disclosures.

President Trump’s social media adviser, Dan Scavino, made $ 300,000 over the past year before joining the White House — through his work on the Trump campaign and transition and other political consulting work.

KT McFarland, the deputy national security adviser who had previously been a Fox News analyst, made a little more than $ 60,000 from the cable news station — but more than double that from paid speeches (which came in about $ 10,000 a speech, on average) and a $ 42,500 book advance.

STEVE BANNON

White House Chief Strategist Steve Bannon’s financial disclosure report shows he earned between $ 1.3 and $ 2.3 million last year, according to the New York Times. Much of that money came from companies backed by Republican mega-donors Robert and Rebekah Mercer.

Bannon disclosed $ 191,000 in consulting fees from Breitbart News Network, where he previously worked as executive chairman before joining the Trump campaign. He also disclosed $ 125,333 in consulting fees from Cambridge Analytica, a political consulting firm that specializes in predicting the political leaning of voters through “psychographic” profiles based on details of their consumer habits, social media, and other traits.

Last year, Bannon was paid $ 167,500 in consulting and directing fees from Glittering Steel, a production company launched with Rebekah Mercer that financed “Clinton Cash,” a documentary film about corruption in the Clinton Foundation.

The film was based on the New York Times bestselling book of the same name written by Peter Schweizer, the senior editor-at-large at Breitbart.

The strategist also reported $ 61,539 in salary from the Government Accountability Institute (GAI), a conservative nonprofit organization. In total, Banon made at least $ 545,000 last year between those four entities, all of which are backed by the Mercer family.

The Mercer father-daughter duo originally supported Senator Ted Cruz (R-Texas) but switched when Trump won the nomination for the Republican party. Rebekah then became a member of the Trump transition team’s Executive Committee, where she voiced her opinion on nominees and helped mold the new administration.

In his disclosure, Bannon notes that he intends to sell his assets in Glittering Steel and Cambridge Analytica. His most valuable asset was Bannon Strategic Advisors Inc., which was valued between $ 5 million to $ 25 million, and he reported earnings of $ 493,836 from the entity. Bannon also reported as much as $ 2,250,000 across several bank accounts and $ 10.5 million in real estate.

JARED KUSHNER

Trump’s senior advisor and son-in-law Jared Kushner’s disclosure shows he and his wife Ivanka Trump have property and investment holdings worth as much as $ 741 million, according to the New York Times.

While the couple previously sold off many of their assets when they became White House employees, they are still holding on to many of their real estate holdings, including the Old Post Office that was converted into Trump Hotel in Washington DC.

Kushner’s disclosure says that Ivanka earned between $ 1 million and $ 5 million from the DC hotel between January 2016 and March 2017, valuing her stake between $ 5 million and $ 25 million.

The White House released a broad set of financial disclosures that showed the assets for as many as 180 senior officials on Friday evening.

The information outlines the sizable wealth of many members of the Trump administration which closes in on a cumulative $ 12 billion, according to a December Bloomberg report.

Officials including White House chief strategist Steve Bannon, and advisers Jared Kushner and Reince Priebus listed assets they held at the time they began working for the government, a little more than two months ago. Since then, staffers may have divested from some of those assets, resigned from prior jobs, or recused themselves from holdings that may potentially create conflicts of interest.

Here’s a look at what the Trump administration’s financial disclosures show, based on data gathered at the time they entered public service.

Steve Bannon, the White House chief strategist and perhaps its most controversial figure, appeared to be among the wealthiest in the Trump administration.

According to The New York Times, Bannon’s biggest asset is a private consulting business that received income from multiple investments valued between $ 5 million and $ 25 million.

Bannon’s disclosures also list:

  • Bank accounts valued up to $ 2.25 million
  • Rental properties valued at $ 10.5 million
  • $ 191,000 in consulting fees he earned from the Breitbart News Network

Reince Priebus, the White House’s chief of staff, reportedly earned $ 225,000 in salary and $ 100,000 in bonuses from the Republican National Committee in 2016.

On top of this salary, a significant portion of his earnings came about after a $ 450,000 equity buyout from his law firm.

Priebus’ disclosures also listed:

  • Assets between $ 604,000 and $ 1.16 million.
  • Two bank accounts worth between $ 300,000 and $ 600,000.
  • RNC payment for his rent in Washington amounting to a little over $ 57,000.

Jared Kushner, Trump’s innovations director and son-in-law, lists two main sources of income in his financial disclosure.

According to the documents, Kushner held:

  • Nearly $ 6 million in employment assets and income and retirement accounts
  • A long list of nationwide commercial real estate holdings, including in Chicago, New York, and New Jersey.
  • 13 US bank accounts, the most valuable of which totaling between $ 1 million and $ 5 million.

Kushner’s disclosure also notes that he revised his holdings four times within the last two weeks — the most recent change being made on Friday, ostensibly due to his expanding role in the White House.
