A lawsuit filed after FBI agents raided a Beverly Hills vault company, seizing more than $ 86 million in cash as well as jewelry and gold from 1,400 safety deposit boxes, claims owners' items have still not been returned and that agents misled a judge to get the warrant.
Agents raided a branch of US Private Vaults in Beverly Hills in March 2021 and seized assets from boxes held by hundreds of people who were not suspected in any crimes, state court papers reported by the Los Angeles Times.
The FBI and the US attorney's office in Los Angeles obtained search and seizure warrants against US Private Vaults by concealing critical details from the judge who approved them, according to the lawsuit.
Robert Frommer, a lawyer with the Institute for Justice which brought the lawsuit, said in the court papers: "The government did not know what was in those boxes, who owned them, or what, if anything, those people had done."
After the raid many box-holders asked the FBI for their property back, Frommer told Insider.
"We brought suit on behalf of seven clients, but we were representing a class of at least 400 people. What we've been trying to show for the past several months is that the government's actions violated the search and seizure protections of the US constitution in the Fourth Amendment," he said.
"The scope of what the FBI did is unprecedented," Frommer added. "This was the largest armed robbery in United States history, and it was committed by the FBI."
After a two-year investigation that began in 2019, leaders of the FBI's Los Angeles office believed boxes at US Private Vaults were being used by criminals to store illicit proceeds.
The FBI requested and obtained warrants to seize US Private Vaults' business property. However, a senior FBI agent recently testified that the warrant omitted a key part of the bureau's plan – to permanently seize everything in every box that contained at least $ 5,000 in cash or goods, the LA Times reported.
Frommer said in an Institute for Justice press release last month: "The FBI lied about its intentions in claiming to only be interested in the property of the business, and not the box holders. Ultimately, the lure of civil forfeiture turned these federal cops into robbers."
Laura Eimiller, an FBI spokeswoman, told the LA Times the warrants were lawfully executed "based on allegations of widespread criminal wrongdoing. At no time was a magistrate misled as to the probable cause used to obtain the warrants."
US Private Vaults has pleaded guilty to conspiracy to launder drug money, and the investigation was continuing, Eimiller added.
The FBI and Department of Justice did not immediately respond to Insider's requests for comment.
Frommer wants the government to destroy any information or records obtained from customers' boxes in what he said was a violation of the Fourth Amendment.
The Fourth Amendment protects against "unreasonable searches and seizures." It requires the government to get a warrant by showing probable cause explaining why a location needs to be searched and describing specifically what it is seizing.
The plaintiffs in the lawsuit have asked for the FBI raid to be deemed unconstitutional by a district judge, the LA Times reported. Doing so could force the return of assets worth millions of dollars to box holders.

Booking a holiday is a wonderful feeling, especially in the midst of winter when temperatures are below freezing.
However, expensive deposits and booking fees mean that those on a tight budget often miss out on pre-booking deals.
Thomas Cook has announced that they have the solution.
For the first time ever, the holiday provider and launched a zero deposit option for those on a budget to spread the cost of a trip.
The new plan will allow holidaymakers to plan ahead without any upfront costs, offering customers a “buy now, pay later payment plan.”
The plan will launch online and across its high street shops on the 1 March 2018.
Those looking to book their dream holiday will then be able to pay in monthly installments.
Holidays have to be booked at least 14 weeks before departure and the scheme is only available on a direct-debit payment method.
Welcomed as the first of its kind amongst tour operators, the new payment plan coincides with the release of their 2019 summer holiday programme.
From 1 March 2018, customers will be able to book a holiday departing from 1 November 2018 to 31 October 2019 on the plan.
Although there is a variety of holidays available on the scheme, the offer will only apply to selected Thomas Cook, Airtours and Manos package holidays.
It is also required that final payments need to be made six weeks before departure.
For a seven-night all-inclusive holiday to Kos for two people departing in May 2019, prices start from £1482 – that’s just £114 a month.
The managing director of Thomas Cook UK, Chris Mottershead said: “We’re always looking for ways to make it easier for our customers to enjoy their well-earned breakaway.
“Our new zero deposit buy now pay later offer means that they can get the holiday in the diary now, and then spread the cost over the coming months.
Our existing direct debit payment plan is very popular with families and we expect this new offer to appeal to them too.”
Airbnb has announced that it will now let guests pay a deposit at the time of booking, marking a notable shift from the current state-of-play that requires you to pay the full amount up front.
The new “pay less up front” option has been in testing prior to launch, and Airbnb said that around 40 percent of guests chose to delay full payment when presented with the opportunity. According to the company, guests can choose to pay a 50 percent deposit “in most cases” in advance, with the remainder payable shortly before the check-in date.

With nearly $ 5 billion in equity investment, Airbnb has emerged as the poster child for the home-sharing economy, an industry that has disrupted the traditional holiday letting market. Rivals in the space include OneFineStay, which was bought out by hotel giant AccorHotels or $ 170 million, while HomeAway and HouseTrip were snapped up by Expedia and TripAdvisor respectively.
Airbnb, for its part, is expected to go public in the next couple of years, and in the meantime it’s pushing to make its platform more appealing to guests. Back in November, the company announced it would make it easier for groups split the cost of their stay, while it acquired Accomable to improve accessibility for disabled travelers.
Adopting a deposit-based approach fits into the broader picture here, as it allows guests to pay in two installments. It could also go some way toward helping hosts secure more bookings, given that would-be guests may be more inclined to make a booking if the up-front payment is lower. Airbnb also said the new payment option “encourages” bookings even further ahead of time.
“We’ve found that Pay Less Up Front encourages bookings further in advance,” it said in a statement. “Compared with ordinary bookings, the Pay Less Up Front payment option led to bookings with nearly double the lead time, helping hosts to secure and manage bookings more easily.”
The “pay less up front” option is arriving globally from today across all Airbnb platforms. The only real caveats to qualifying for the option is that the stay must be booked at least 14 days in advance, while the overall value must be more than $ 250.

Serena Williams may be one of the highest-paid athletes, according to Forbes — and the only woman to crack the top 100 — but she says she’s never been motivated by the money.
“I’ve actually never played for money — I just thought you would go out there and hold a trophy,” Williams said on “Kneading Dough,” the personal-finance video series produced by LeBron James’ media company, Uninterrupted.
“Not once did I think about a check,” Williams told sports business manager Maverick Carter.
“I just played for the love of the sport,” said Williams, who has won 23 Grand Slam events, one fewer than the world-record holder Margaret Court. It comes as no surprise then that when Williams received her first million-dollar check she kept it safely in the bank.
“I never touched [the money] — just put it in the bank,” she said. “And I remember I went through the drive-thru to deposit my check, and then they were like, ‘I think you need to come in for this,’ and so I ended up going inside … ‘Just put it in my account!'”
The 35-year-old, whose career prize money tops $ 84 million, credits her parents with teaching her about the value of money at a young age.
“I never ever ever felt broke,” she told Carter in the video. “Looking back, I’m like, wow, we lived in a two-bedroom house with seven people … I don’t know how my parents were able to make me feel that way, but they did, and that was something really special. So I never felt when I came into money that I needed to go buy this [or that] because I never wanted it, so it was a great way [to grow up].”
Williams also said her father and longtime coach was “always hands-on” but never demanded a fee or a cut of her earnings, and he told her it was up to her to decide how she would spend her money.
“Since I was a teenager I’ve made every financial decision in my life, and I’ve had to learn how to make good ones and how to make bad ones, and it helps you make better ones,” she said.
Kneading Dough is produced by JP Morgan Chase and Uninterrupted, a media company owned by LeBron James and Maverick Carter.

Monarch Holidays’ city breaks brochure is giving travellers a more affordable way to book their trip with a package holiday deposit scheme of just £59pp.
The travel provider is trying to break down the price of city breaks to encourage travellers to prebook their holiday without paying for it all in one payment.
Most package holidays require full payment of at least the flight, making it more expensive.
With the package deal offer, they can then pay the rest at a later date and spread out the cost of the trip.

AFL: Touk has re-signed with the Suns.

JACK Bowes assured himself of a start in the JLT Community series opener next week and placed a deposit on a senior debut in Round 1 with a standout performance in the Suns’ intra-club match on Saturday morning.
The No. 10 draft pick, the first player from either of Queensland’s two AFL academies to go in the top 10, played across half-back alongside skipper Steven May and Kade Kolodjashnij.
The match featured the first choice offence in yellow against the premier defence in white, with the midfielders split up.
Coach Rodney Eade confirmed Bowes would play against Brisbane at Broadbeach next week and hinted the Cairns product’s name was on the board for the premiership opening Q-Clash against the Lions on March 25.
“I thought he was very impressive today,’’ he said.
“He was very calm under pressure, he makes good decisions so he is progressing very well and has put himself in the frame for Round 1.’’
The highlight of the match for Suns fans was the successful return of former No. 1 draft pick and 2014 club champion David Swallow, who has managed just six games sin two years due to ongoing knee problems.
Stars Tom Lynch and Jack Martin, who finished first and third in last year’s club championships, were standouts while Touk Miller and Pearce Hanley were also prominent.
There were no major injuries. Trent McKenzie left the field with what appeared to be a calf injury, but was later diagnosed as a bakers cyst which will likely only sideline him for a week.
Top draft pick Ben Ainsworth had a bump on the hip and went off at halftime, as did Adelaide recruit Jarryd Lyons who had a minor Achilles tendon soreness.
Ex-Docker Michael Barlow was given leave to attend a wedding while Gary Ablett (shoulder), Michael Rischitelli (knee) Peter Wright (finger) Jarrod Harbrow (ankle) and Alex Sexton (wrist) did not play. All expected to be available at some point during the pre-season.
