DC District Judge John Bates on Friday upheld his earlier ruling from April 24, that found the White House’s decision to scrap the policy, which has shielded about 800,000 migrants from deportation since it was adopted in 2012, was “arbitrary and capricious.”

“The Court therefore reaffirms its conclusion that DACA’s rescission was unlawful and must be set aside,” he wrote in a 25-page opinion on Friday.

The court argued that the memorandum issued by Homeland Secretary Kirstjen Nielsen in June, that was supposed to offer a legally sound explanation for the government’s action, failed “to elaborate meaningfully on the agency’s primary rationale for its decision: the judgment that the policy was unlawful and unconstitutional.”

Bates contended that although the memo provides several new reasons for the court to review its decision, the majority of them “simply repackage legal arguments previously made.” The only one “bona fide (albeit logically dubious) reason” offered by Nielsen was not enough to sway the court’s opinion, Bates wrote, since it was “articulated nowhere in DHS’s prior explanation for its decision” and hence cannot come into play now.

Calling the renewed justification provided by the department “a hodgepodge of illogical or post hoc policy assertions” that “simply will not do,” the court at the same time stressed its ruling does not mean that the DHS is not entitled to rescind the program in principal, but that it “must give a rational explanation” if it wants to do so.

Bates, who in April gave the government a 90-day window so that DHS could come up with what the court will perceive as an adequate rationale to shut down DACA, on Friday provided the Trump administration with only 20 days to decide if it will appeal the ruling and seek a temporary stay in execution.

The decision is an important landmark in the litigation over DACA’s validity, that saw the Trump administration being challenged by multiple lawsuits across the country. Should the ruling come into force, The White House will have to restart the DACA program in full.

In his April ruling Bates wrote that if the DHS fails to issue a memo that would prove that the program was unlawful and unconstitutional, as insisted by the government, “the Rescission Memo will be vacated in its entirety, and the original DACA program will be restored in full.”

Since US President Donald Trump rescinded the Obama-era program on September 5, the White House has been embroiled in numerous legal battles. While the administration has won some, with Trump praising Judge Roger W. Titus of Maryland, who ruled in March that the President was within his authority to rescind the executive order issued by his predecessor, it has suffered more losses so far.

A California court in January ordered to partially restart the program, while a New York judge in February issued an injunction ordering the government to maintain DACA, although that will not require DHS to accept new applications. Several government appeals are still pending in US courts.

Bates’ ruling was applauded by The National Association for the Advancement of Colored People (NAACP), a plaintiff in the case, which called it a “huge victory.”

“This represents a powerful victory against attempts to dehumanize immigrants who are law-abiding and productive residents of the United States and who were long ago brought to this country as children through no fault of their own,” NAACP President and CEO Derrick Johnson said.

Donald Trump has said there will be no deal to give legal status to migrants who came to the US as minors. In a series of tweets on Sunday, he also told Republicans to take the “nuclear option” and eliminate the Senate filibuster.

The US president began his tirade by claiming that catch-and-release laws are hindering efforts at border protection. Trump then attacked Mexico, saying the country was doing “very little, if not nothing” to stop migrants from other Central American countries from crossing its southern border on their way to the US. As punishment for their perceived inaction, Trump threatened to dismantle the North American Free Trade Agreement (NAFTA).

The billionaire property tycoon later claimed that “big flows” of people were trying to cross the border in time to take advantage of the Deferred Action for Childhood Arrivals (DACA) deal, a long-delayed piece of legislation designed to protect illegal immigrants who entered the country as children. “They want in on the act,” he wrote.

Catch and release was the system that allowed people who were caught for entering the country illegally to go free while they awaited a hearing by an immigration judge. The policy ended under President George W. Bush in 2006 and was replaced by a policy in which illegal immigrants were either detained or returned to their own countries.

Current Senate rules mandate that 60 senators – a near-two-thirds majority of the 100-member house – must agree in order to move forward to a vote on legislation. Trump has long called for an end to these rules, saying that he would like to see a simple 51-vote majority system.

‘Dreamers’ protest outside Schumer’s home & office over DACA https://briefnews.eu/dreamers-protest-outside-schumers-home-office-over-daca/ https://briefnews.eu/dreamers-protest-outside-schumers-home-office-over-daca/#respond Wed, 24 Jan 2018 04:14:39 +0000 http://briefnews.eu/dreamers-protest-outside-schumers-home-office-over-daca/

Immigration activists gathered outside Senate Minority Leader Chuck Schumer’s (D-New York) home and office to protest his deal with Republicans to end the federal government shutdown without protections for so-called “dreamers.”

On Tuesday night, dozens of protesters met under the arch at Grand Army Plaza in Prospect Park before marching over to Schumer’s Prospect Park West home with signs that read “Pass a Clean Dream Act Now” and “No! Not One More Deportation!”

The marchers banged on drums and chanted in an attempt to keep the senator awake.

“If Chuck won’t let us dream, we won’t let him sleep,” they chanted repeatedly.

One activist, who claimed the protest had only been planned 25 hours prior, said they chose to protest in front of Schumer’s house because he “always notices when people protest in front of his apartment building.”

Varying reports said there were anywhere from 75 to more than a 100 protesters at the event.

The protest was organized by Indivisible, a left-wing advocacy group, along with several other groups in New York. The organizers called on Schumer to secure a long-term agreement for the legal status of immigrants brought to the country as children after he voted on a bill to end the government shutdown without any protections.

“Our community is outraged by the Senate vote to pass a temporary budget deal with no solution for Dreamers,” the organizers wrote. “Dreamers are tired of empty promises and need a legislative solution NOW!”

The protesters targeted Schumer for the deal and carried signs that said he was the “worst negotiator in Washington and Brooklyn,” along with the hashtag #SchumerSellout.

On Monday, Democrats made a deal with Republicans to fund the government through to February 8. However, many liberals were upset that the deal did not include amnesty for migrants brought into the US illegally as children.

Organizers of the protest wrote a blog Monday, describing their frustration with Schumer over a deal they said was “unacceptable.”

“In abdicating their responsibility to oversee an executive branch that is advancing white supremacy, Republican leadership should not be trusted, but forcefully opposed,” the group wrote.

The group added that if the Democrats are not able to secure protections for Deferred Action for Childhood Arrivals Act (DACA) recipients by February 8, they will “hold him accountable.”

A large group of protesters also took over Schumer’s office on Tuesday, chainting “fight back” in the halls.

Other protesters gathered at the offices of Senators Dean Heller (R-Nevada), Mark Warner (D-Virginia), Marco Rubio (R-Florida), Martin Heinrich (D-New Mexico), and others who voted on the spending bill that did not include protections for Dreamers.

According to a press release from one of the groups that organized the protests, at least six protesters were arrested for civil disobedience at Schumer’s office.

DACA provides protection from deportation to some 700,000 immigrants who were brought into the US illegally as children. In September, Attorney General Jeff Sessions announced the decision to rescind the program President Barack Obama issued via executive action in 2012.

Congress was given six months to pass a law that would regulate the status of so-called ‘Dreamers.’ That program is set to expire March 5.

DACA To SCOTUS ⚖️ https://briefnews.eu/daca-to-scotus-%e2%9a%96%ef%b8%8f/ https://briefnews.eu/daca-to-scotus-%e2%9a%96%ef%b8%8f/#respond Tue, 16 Jan 2018 22:12:02 +0000 http://briefnews.eu/daca-to-scotus-%e2%9a%96%ef%b8%8f/

The US Department of Justice announced Tuesday that it will take the unusual step of immediately petitioning the US Supreme Court to challenge a judge’s order that partially revived the Deferred Action for Childhood Arrival program.

An appeal would normally go to a federal circuit court — in this case, the US Court of Appeals for the 9th Circuit — before either side attempted to take it to the Supreme Court. But Attorney General Jeff Sessions said in a statement that the government would petition the high court now, in addition to appealing to the 9th Circuit, in the hopes of getting a faster resolution.

“We are now taking the rare step of requesting direct review on the merits of this injunction by the Supreme Court so that this issue may be resolved quickly and fairly for all the parties involved,” Sessions said.

The DACA program provided temporary protection against deportation for undocumented immigrants brought to the United States as children. Nearly 800,000 people had received benefits through the program before the Trump administration announced in September that it would end it.

A federal district judge in San Francisco issued an order on Jan. 9 that partially revived DACA while legal challenges against the decision to end it went forward. US District Judge William Alsup ruled that the Trump administration must resume accepting renewal applications from people who had already been enrolled in the program. The judge found that groups and individuals challenging President Donald Trump’s decision to end DACA were likely to succeed in their claim that the move was “arbitrary and capricious.”

Alsup did not order the administration to accept new applications.

Following Alsup’s ruling, the US Department of Homeland Security announced that it would follow the order and accept renewal applications, including from past recipients whose deferred action status had expired after the administration stopped accepting renewals last year. The administration announced on Sept. 5 that it would wind down the program — no new applications would be accepted, and renewals would only be accepted through Oct. 5 from recipients whose benefits were set to expire by March 5, 2018.

The Justice Department’s appeal comes as Democrats, Republicans, and the White House have been attempting to negotiate a deal that would address the status of undocumented immigrants who were eligible for protection against deportation under the DACA program. But those efforts were derailed after Trump knocked down a bipartisan agreement and reports came out that Trump had referred to certain countries as “shithole” places during an Oval Office meeting with lawmakers about immigration.

Republicans and Democrats have also disagreed about the timing of a deal — a government shutdown is looming if lawmakers fail to approve a spending measure by the end of the week — and the scope. Trump on Jan. 14 tweeted that DACA “is probably dead,” accusing Democrats of trying to stop US military spending.

Mark Rosenbaum, one of the lawyers representing individual DACA recipients that filed one of the lawsuits against the Trump administration, told BuzzFeed News that the Justice Department’s decision to challenge Alsup’s order is “deeply disappointing.” That DOJ would attempt to go directly to the Supreme Court was “more evidence that the usual rules by which a democracy functions aren’t being followed here,” he said.

“DACA recipients don’t represent any threat to the national security or the well-being of this country. The authority for that is the United States government, who has thoroughly vetted each and every one of these recipients,” said Rosenbaum, director of legal advocacy group Public Counsel, which is representing DACA recipients with the law firm Gibson, Dunn & Crutcher. He said that DACA recipients were unfairly being used as a “bargaining chip” in the political negotiations over immigration.

  • The federal government is now accepting applications to renew permits under the Deferred Action for Childhood Arrivals.
  • The Trump administration had begun phasing out the program in September and intended to terminate it on March 5.
  • A federal judge in California on Tuesday ordered the Trump administration to continue processing DACA renewal applications.

Citing a recent court order, the Trump administration on Saturday resumed processing young unauthorized immigrants’ applications to renew their protections under the Deferred Action for Childhood Arrivals program.

“Until further notice, and unless otherwise provided in this guidance, the DACA policy will be operated on the terms in place before it was rescinded on Sept. 5, 2017,” the United States Citizenship and Immigration Services agency announced on its website.

USCIS said young immigrants who have previously received DACA, and whose protections expired after the Trump administration announced the program’s termination, may file renewal applications.

The agency added that no new DACA applications will be accepted from immigrants who had not previously been protected under the program.

The Trump administration had said in September it would phase out DACA by March 5, giving Congress six months to enact a legislative solution that permanently resolved the fate of young immigrants who have lived in the US illegally since childhood.

The Trump administration also allowed DACA recipients with near-term expiry dates to renew their two-year protections one last time, so long as they submitted their applications before an October 5, 2017 deadline.

As of September 2017, there were roughly 690,000 young immigrants protected by DACA, but thousands have already begun losing their protections in recent months. An estimated 22,000 eligible DACA recipients either did not or could not apply for renewal before the deadline, and roughly 1,900 of those who attempted renewal saw their applications lost or delayed in the mail and subsequently rejected.

But a federal judge in California on Tuesday issued a preliminary injunction blocking the Trump administration from ending the program, and ordering the government to resume processing DACA renewal applications.

DACA was first implemented by the Obama administration in 2012, and offered the immigrants temporary work authorization and protection from deportation.

The Trump administration’s termination of the program launched lawmakers into a frenzy in recent weeks as the March deadline draws near. Democrats vowed to pass a legislative fix by the January 19 budget deadline, but negotiations devolved recently after President Donald Trump and some Republicans demanded certain hardliner immigration reforms in exchange for codifying DACA protections.

Talks took a further turn for the worse on Thursday after Trump reportedly referred to Haiti and African nations as “shithole countries” during an immigration-related meeting with lawmakers, and asked why the US had to accept immigrants from those places.

  • A judge blocked President Donald Trump’s administration from ending the Deferred Action for Childhood Arrivals program, a program that shielded children brought to the United States illegally by their parents.
  • The ruling came as Trump and U.S. congressional leaders negotiated broad immigration reforms.

SAN FRANCISCO/WASHINGTON (Reuters) – A U.S. judge blocked President Donald Trump’s administration on Tuesday from ending a program that shielded from deportation children brought to the United States illegally by their parents.

Trump decided in September to rescind the Deferred Action for Childhood Arrivals program, or DACA. U.S. District Judge William Alsup ruled in San Francisco on Tuesday the program must remain in place while litigation over Trump’s decision unfolds.

The ruling came as Trump and U.S. congressional leaders negotiated broad immigration reforms.

Alsup’s decision follows on from stands taken by other U.S. judges to rein in Trump’s immigration policies, striking down moves against sanctuary cities and limiting the scope of a ban against travel from some Muslim-majority counties.

The DACA program has provided protection from deportation and the right to work legally to nearly 800,000 young people since it was authorized by President Barack Obama in 2012.

Several states, organizations and individuals have filed lawsuits seeking to protect DACA recipients, who are known as Dreamers.

Alsup said in his ruling the federal government did not have to process new applications from people who had never before received protection under the program. However, he ordered the government to process renewal applications people who had previously been covered.

“DACA gave them a more tolerable set of choices, including joining the mainstream workforce,” Alsup wrote. “Now, absent an injunction, they will slide back to the pre-DACA era and associated hardship.”

A Department of Homeland Security spokesman declined to comment, and representatives for the White House and the Department of Justice could not be reached immediately for comment.

Trump ran on a hardline immigration platform during the 2016 presidential election, promising to end DACA and strengthen border protections to increase jobs for U.S. workers.

A judge has granted a pretrial injunction, blocking the Trump administration’s rollback of protections for illegal immigrants who arrived in the US as children, according to Reuters.

The order does not, however, prevent the Trump administration from refusing to process any new applicants or the discontinuation of the advance parole feature.

“Nothing in this order prohibits the agency from proceeding to remove any individual, including any DACA enrollee, who it determines poses a risk to national security or public safety, or otherwise deserves, in its judgment, to be removed,” the ruling read.

The plaintiffs in the case against the US Department of Homeland Security were the Regents of the University of California and its president, former Homeland Security Secretary Janet Napolitano.

Trump is asking Congress for nearly $ 18 billion to pay for the construction of more than 700 miles of his border wall expansion project, according to a report by the the Wall Street Journal Friday.

If the funding is approved, the border wall would increase from around 654 miles to nearly 1,000 miles, covering roughly half the length of the entire US-Mexico border.

The plan, which was laid out in a document from the US Customs and Border Protection agency at the Department of Homeland Security and described to the Wall Street Journal by two sources, also calls for an additional $ 15 billion to pay for “critical physical border security requirements.”

The other requests include $ 1 billion to construct a road, $ 8.5 billion to deploy 5,000 new Border Patrol agents and $ 5.7 billion to construct towers and pay for surveillance equipment, unmanned aerial vehicles and other technology.

In total, Trump’s vision for the wall would cost taxpayers $ 33 billion over the next 10 years, according to the report.

During the 2016 presidential campaign, Trump said he would construct a “big, beautiful wall” along the southern border and promised that Mexico would pay for it.

Later, Trump tweeted that Mexico would pay for the wall “in some form” and “at a later date.”

While in office, Trump has insisted that any deal to make the Deferred Action for Childhood Arrivals (DACA) program permanent must also include funding for the border wall.

However, Senate negotiators were waiting for Trump to release details of his immigration reform plan, which they were promised in mid-December.

“I think as soon as the president will tell us ‘OK, this is something I could support’ then I think that gives us, I think, a lot of room to go talk to Democrats and say ‘OK, this what our parameters are,’” Senator John Cornyn (R-Texas) said, according to The Hill.

On Thursday, a group of Republican Senators met with Trump at the White House to discuss DACA, the Obama-era program protecting some 800,000 immigrants from deportation who were underage when they arrived in the country illegally.

At the meeting, Trump said he was optimistic he could get Democrats on board with his proposal.

“We need the wall, we need all of those things, and frankly, I think a lot of Democrats agree with us when they see what’s happening, when they see the kind of problems we’re having at the border, they really understand it,” Trump said, according to CNN.

However, when House Minority Leader Nancy Pelosi (D-California) saw the document obtained by the Wall Street Journal, she called it “alarming” and urged all Democrats to “speak out.”

Pelosi took to Twitter Friday, to list all the other things that could be done with the proposed border wall funding, including, providing job training for workers, treating people addicted to opioids, and helping Puerto Rico and the Virgin Island rebuild in the wake of recent hurricanes

“All of these and more would do a far better job of improving the everyday lives of American families than your ineffective & immoral wall,” Pelosi tweeted.

Republican Senators James Lankford (Oklahoma) and Thom Tillis (North Carolina) also said that negotiations have been faltering.

“Over the course of the last several weeks, we have negotiated in good faith with Senate Democrats on a DACA agreement,” Lankford and Tillis said in a joint statement. “Unfortunately, our discussions on border security and enforcement with Democrats are much further apart, and that is key to getting a bipartisan deal on DACA. Until that happens, we cannot accomplish the solutions our country needs and many families deserve.”

Even before releasing their joint statement, Tillis and Lankford stopped attending the meetings, according to Politico.

The remaining senators who attend the meetings are Dick Durbin (D-Illinois), Jeff Flake (R-Arizona), Lindsey Graham (R-South Carolina), and Michael Bennet (D-Colorado), and Cory Gardner (R- Colorado)

Durbin confirmed the Trump administration’s $ 18 billion proposal on Twitter after Thursday’s meeting, calling it “outrageous.”

“President Trump has said he may need a good government shutdown to get his wall. With this demand, he seems to be heading in that direction,” Durbin tweeted.

Trump is planning to hold another meeting with a bipartisan group of lawmakers next week to continue the negotiations.

In order to have any chance of passing an immigration bill, Republicans would need 60 votes, meaning at least some Democrats would need to support their bill.

“It does no good to just have a partisan bill,” Flake said, according to CNN. “The only thing that’s going to work is a bipartisan bill. It’s got to have 60 votes.”

  • White House chief of staff John Kelly met with top senators on Tuesday to discuss policy changes they want included in a potential fix next month for recipients of the Deferred Action for Childhood Arrivals program.
  • The Trump administration likely wants changes to border security included in any DACA deal.
  • Lawmakers from both parties say it’s unlikely that they’ll reach a legislative solution this year, and are working to bring a bill to the Senate floor for a vote in January.

White House officials reportedly met with top senators on Tuesday to hammer out details to be included in a long-anticipated legislative solution for young unauthorized immigrants protected by the Deferred Action for Childhood Arrivals program.

White House chief of staff John Kelly told senators the Trump administration is drawing up a list of asks to present to lawmakers as early as the next few days, Politico reported on Wednesday. Changes to border security are expected to be among the administration’s top priorities.

News of the meeting comes amid reports that Democrats are backing away from their vow to force a vote on a DACA solution this year by threatening a government shutdown.

But the urgency of a legislative fix is growing as Congress approaches the March 5 deadline that the Trump administration set when it first announced it would end DACA.

The Trump administration began phasing out the program in September. Former President Barack Obama enacted the program to offer certain young immigrants who have lived in the US illegally since childhood temporary work authorization and protection from deportation.

At the time of Trump’s announcement, DACA protected roughly 690,000 young immigrants, who are often known as “Dreamers.” Although the deadline is still months away, some DACA recipients have already lost their protection.

‘I’m sorry that it’s taken this long’

daca dreamer protestReuters/Mike BlakeSen. Dick Durbin, an Illinois Democrat who has pushed various legislative solutions for Dreamers for more than a decade, told Politico that he now expects a bipartisan package with a DACA fix to be introduced by mid-January. He expressed regret that Congress has not yet resolved the issue.

“The closer we get [to the deadline], the more nervous I get, not to mention the way these young people feel,” he said. “I’m sorry that it’s taken this long.”

Though a handful of Democratic senators — including Durbin — have vowed to withhold their support for spending legislation this month if it doesn’t include a DACA fix, other Democrats who face re-election in conservative states have said they’re unwilling to risk a government shutdown.

“We’ve got to get it done, but I’m not drawing a line in the sand that it has to be this week versus two weeks from now,” Sen. Claire McCaskill of Missouri told The Washington Post.

Sen. Jeff Flake, an Arizona Republican, attended the meeting with Kelly and tweeted Wednesday that a bipartisan DACA bill will reach the Senate floor in January.

But it’s unclear whether a bill will actually materialize. Other Republicans have expressed reluctance to act on legislation in the near future.

Senate Majority Leader Mitch McConnell has said repeatedly in recent weeks he doesn’t view the issue as urgent, since the deadline is still months away. Senate Majority Whip John Cornyn even suggested to Reuters on Monday that “the president could extend the deadline if he chose to do so” if Congress fails to enact a solution by March 5.

Thousands of protesters gathered at the Capitol Building in Washington, DC to protest the Trump administration’s decision to ditch programs protecting immigrants. Over two hundred people were arrested, including two members of Congress.

Organized by The New York Immigrant Coalition and CASA Virginia, protesters called for Congress to vote to protect the Deferred Action for Childhood Arrivals Act (DACA) and the Temporary Protected Status (TPS) program.

Approximately two hundred protesters were arrested after blocking the entrance to the Capitol Building. Among them were Representatives Luis Gutierrez (D-Illinois) and Judy Chu (D-California).

Police set up tables to process the arrested protesters on the spot.

Protesters chanted the Spanish phrase “Si se puede” meaning ‘Yes we can’ and waved signs in support of the immigration programs.

“We are more than papers!” one sign read.

DACA provides protection from deportation to some 700,000 immigrants who were brought into the US illegally as children. In September, Attorney General Jeff Sessions announced the decision to rescind the program President Barack Obama issued via executive action in 2012.

Congress was given six months to pass a law that would regulate the status of so-called ‘Dreamers.’ That deadline is now just 50 days away.

The TPS program granted temporary visas that allow immigrants to live and work in the US and not be forced to return to their home countries. 321,220 immigrants from ten different countries in Central America and Africa are in the US under the TPS program, according to the Journal on Migration and Human Security. Many fled natural disasters and violence resulting from US-backed regime change wars.
