After several tumultuous weeks of uncertainty, Judge Brett Kavanaugh has been confirmed to the Supreme Court on Saturday.
The Senate voted 50-48 on Saturday to confirm Kavanaugh, after several days of speculation over how key senators viewed as “swing votes” would decide. Republican Sen. Susan Collins of Maine and Democratic Sen. Joe Manchin of West Virginia were pivotal in confirming Kavanaugh, voting “yes,” while Republican Sen. Lisa Murkowski opposed his confirmation.
But the multiple sexual misconduct allegations lodged against Kavanaugh in recent weeks still hangs over Saturday’s news, prompting furious backlash from the protesters who for weeks lobbied Collins, Manchin, and other senators to vote against Kavanaugh’s confirmation.
Christine Blasey Ford, 51, accused a teenaged Kavanaugh of forcing himself on her at a high school party in the early 1980s. Deborah Ramirez, a former Yale University classmate of Kavanaugh’s, said Kavanaugh exposed himself to her without her consent at a dorm-room party during his freshman 1983-84 school year.
Kavanaugh categorically denied Ford and Ramirez’s accounts in separate statements before delivering a fiery testimony to the Senate Judiciary Committee. An additional FBI background check into the allegations concluded less than a week later with no corroboration for the accounts.
Kavanaugh was born and bred in the Washington, DC area and has a long history in conservative circles. Top Democratic Sen. Dick Durbin once called Kavanaugh the “Forrest Gump of Republican politics,” because he was present for so many key moments in modern political history.
As the final vote for Kavanaugh’s confirmation approaches, here’s a look at how the born-and-bred conservative rose to become the court’s most pivotal nomination in decades:

William Clegg, QC, a leading defence lawyer who has worked on high profile cases for half a century and whose clients have included Prince Andrew, said the profession is under attack from cutbacks and revealed he worried about the fairness of trials in the future.
He said morale in the judiciary was at “an all-time low”, with staff shortages, broken facilities and “a general feeling of squalor”.
Speaking from his chambers, 2 Bedford Row in central London, Mr Clegg said barristers now had to have a private income to be able to operate, which he claims sets back diversity by up to 40 years. Mr Clegg, whose clients have included Barry George and Colin Stagg, paints a worrying picture in his book, Under The Wig, published this week.
He said: “At the moment the profession is in crisis and the court system is in crisis.
“It is unbelievable that if you go to a busy crown court in London you will find lavatories that don’t work, lifts that are broken, carpets that are threadbare, roofs that leak and a general feeling of squalor that is difficult to believe when you are in one of the biggest economies in the world.
“Incredibly, if you go to the Third World and a court there, you find they are often in pristine condition – spotless and there is a great pride in the fact that they are able to keep their courts in an immaculate state. There is none of that in this country.” He said government cuts were to blame, explaining: “The profession has been attacked on all fronts by the Government.
“There is no department which has lost more money by way of a percentage of its turnover than the Lord Chancellor’s Department and the Ministry of Justice. They have been hit the hardest of any departments. As a result morale in the judiciary is at an all-time low.
“There are staff cuts, the effect of which means courts cannot sit because there is nobody to open them.
“I have been in court where we are due to start a trial at 10 o’clock but not been able to start it until 10.30 because there is no usher and no clerk to open the door and let me in because one clerk is having to do two or three courts at the same time. And one usher is having to do two courts.” He said the situation is so bad everyone has become “completely depressed” by the way the court system operates.
Mr Clegg added: “The barristers, the practitioners, have had their fees savaged to a fraction of what they were.
“When I defended Barry George [for the murder of Jill Dando] I was paid approximately half as much Michael Mansfield QC was for defending him in his first trial. If I were to defend him today I would be paid half as much again.
“Barristers are undervalued by the Government and it’s getting to the stage now where despite great strides the profession has made to increase diversity in the profession, the fees are so low that unless you have a private income you can’t afford to be a barrister doing publicly funded work.
“It is setting back diversity 30 or 40 years. You either have to have a private income, family money, or you have to subsidise the publicly funded work with private work. In a chambers like this one a lot of our turnover is from private paying individuals – most of it, in fact. Some will take out a second mortgage to pay for their defence. Some will be covered by insurance, the directors of companies. Sometimes a trade union will pay, sometimes a local authority will pay.
“The fees are set at the market rate and they subsidise the people who work here who just do publicly funded work.
“We couldn’t run this building just on publicly funded work. We would be bankrupt in no time.
“You couldn’t afford to pay the staff, the accountants, the reception, the rent or anything.”
He has some 70 barristers in his “set” with a large part of the work they do funded privately. However, chambers which focus purely on publicly funded work are going out of business. He said: “They can’t afford to operate.
“What’s happening is they are merging to try to reduce overheads. They are trying to cut staff to compress themselves into smaller buildings.”

And I know about justice from decades defending evil killers
WILLIAM CLEGG described Rachel Nickell’s killer Robert Napper as “one of the most deranged men I have ever had the misfortune to have to represent”.
Mr Clegg defended Colin Stagg – the man wrongly accused of murdering Rachel – before representing Napper for two unconnected murders some years later. Napper was charged with the killings of Samantha Bissett, 27, and her daughter Jazmine, four, at their home near Plumstead Common, east London, in 1993.
Similar methods had been used against Rachel Nickell, 23, who was stabbed to death in front of her two-year-old son Alex on Wimbledon Common in July 1992. Mr Clegg represented Mr Stagg, who was cleared when the case was dropped after a bungled police investigation.
He then defended Napper for the Bissett killings – and realised he was the likely killer of Rachel. Napper was finally to plead guilty 13 years later.
Mr Clegg said: “Rachel Nickell’s murder, in the presence of her young son, had shocked the nation.
“But Colin Stagg had no evidence against him in the ordinary sense of the word.
“He had been a frequent walker on the common with his dog but that was about it.”
A police sting against Mr Stagg was “clear entrapment”, Mr Clegg said, and the case was dropped at the start of a planned trial. But Mr Clegg said: “The result of that was the real perpetrator was allowed to carry on offending for the best part of another year.
During that time several women were attacked and raped. “
The remarkable coincidence was that after the acquittal of Colin Stagg I was instructed to defend Robert Napper for the murder of Samantha Bissett and her child. “There were obvious similarities between the crimes. In each case a mother was killed in the presence of a young child by a stranger, itself a rare event statistically.
“In both cases the murders took place on, or next to, commonland which was another coincidence.
“Both women victims were young. Both children were young as well. “When I read the papers I remember saying to myself: ‘I bet he’s the person who killed Rachel Nickell’.” Mr Clegg didn’t raise his suspicions with police because Napper was his client, but his hunch proved to be correct because many years later the developments in DNA analysis proved that Napper’s DNA was indeed on Rachel’s body and he pleaded guilty to her killing.
“It is a strange irony. I’ve never known it happen to any other barrister – ever.”

In 2015, a group of children filed a climate change lawsuit against the US government on the grounds that “through the government’s affirmative actions that cause climate change, it has violated the youngest generation’s constitutional rights to life, liberty, and property.” The case, often referred to as the Juliana case, is scheduled for trial in October this year.
Will this strategy work? Litigation involving climate change and environmental regulations has had mixed success over the years, but there are some common trends that could be informative. A paper published in Nature Climate Change this week combs through hundreds of lawsuits to tease out what kinds of strategies have been tried out, and what’s been successful. The paper found that pro-regulation lawsuits often have a hard time proving injury but still have a decent track record on cases involving renewable energy.
Sabrina McCormick, a sociologist at George Washington University, is interested in the social dimensions that shape climate change. She and her colleagues created a database of all 838 climate change lawsuits in the US between 1990 and 2016, classifying each case by factors like the kind of plaintiff and the outcome of the case.

Enlarge / Under the Federal Circuit appeals court, patent law swung from software patent skepticism in the 1970s to extreme permissiveness in the 1990s, then started to swing back toward skepticism with stricter Supreme Court oversight. (credit: Federal Circuit Historical Society / Aurich Lawson)
Forty years ago this week, in the case of Parker v. Flook, the US Supreme Court came close to banning software patents. “The court said, ‘Well, software is just math; you can’t patent math,'” said Stanford legal scholar Mark Lemley. As a result, “It was close to impossible in the 1970s to get software patents.”
If the courts had faithfully applied the principles behind the Flook ruling over the last 40 years, there would be far fewer software patents on the books today. But that’s not how things turned out. By 2000, other US courts had dismantled meaningful limits on patenting software—a situation exemplified by Amazon’s infamous 1999 patent on the concept of shopping with one click. Software patents proliferated, and patent trolls became a serious problem.
But the pendulum eventually swung the other way. A landmark 2014 Supreme Court decision called CLS Bank v. Alice—which also marks its anniversary this week—set off an earthquake in the software patent world. In the first three years after Alice, the Federal Circuit Court, which hears all patent law appeals, rejected 92.3 percent of the patents challenged under the Alice precedent.

BRUSSELS (Reuters) – EU Brexit negotiator Michel Barnier warned Britain on Saturday that failing to agree a deal on the governance of a withdrawal treaty which preserves the primacy of the EU court would mean no treaty and no transition period.
Barnier also described British delays in spelling out what kind of trade relationship London wants as “a game of hide and seek” in remarks prepared for delivery to a gathering in Portugal of jurists specialized in EU law.See the rest of the story at Business Insider

EXCLUSIVE:
Silicon Valley is home to an abundance of VC firms, all of them competing to get in on the next big deal. But VCs also exist (and succeed) outside of the Bay Area. While Washington, D.C. may not be an obvious location to establish a venture capital firm, Lavrock Ventures set its sights on the political capital. The firm announced today that it has closed its first fund at $ 25 million to invest in early-stage startups at the intersection of enterprise software, cybersecurity, and national security.
Founded in late 2016 by managing partner Jim Hunt and general partners Daniel Hanks and Steve Smoot, Lavrock Ventures has already made a handful of investments out of its first fund.
One of its portfolio companies is New York-based Graphika, which is reportedly being used by large social networks to tease out the extent of foreign influence operations and propaganda. This is obviously extremely timely, especially in light of the backlash Facebook is facing over its role in 2016’s presidential election.
The VC firm also invested in Annapolis, Maryland-based Sixgen, a cybersecurity company that provides a variety of products and services to clients in both the private and public sectors.
While Lavrock Ventures closed its first fund at $ 25 million, it expects to invest more than $ 50 million — something it can do through special sidecar vehicles.
“We will have the ability to ‘punch above our weight’ and write larger checks when situations warrant,” said Lavrock Ventures general partner Daniel Hanks, in an interview with VentureBeat. “Similar to other firms raising ‘opportunity funds’ or ‘growth funds’, our LP (limited partner) base has expressed a strong interest in additional direct allocations where/when available. But we did not raise a specific fund for this purpose. We get the flexibility, and our investors can scale up with conviction on specific deals, without worrying about additional capital being tied up.”
The arrangement gives LPs a way to test the waters without having to commit too much capital in this first fund. If things go well and they see potentially lucrative deals along the way, they can then choose to inject more capital without dealing with the complex fee structures of a fund.
Hanks says the firm is looking to invest between $ 1 million and $ 3 million in what he calls “East Coast series A” rounds, which he characterizes as usually between $ 3 million and $ 7 million.
While D.C. may be known as a political hub, it is also home to a healthy entrepreneurial ecosystem. The National Venture Capital Association (NVCA) is headquartered there. Steve Case’s VC firm, Revolution, is based in D.C., and so is In-q-Tel, a nonprofit strategic investor that accelerates the development and delivery of advanced technologies to the Central Intelligence Agency (CIA) and the broader U.S. Intelligence Community (IC).
But the duality between tech and politics isn’t always harmonious, it seems.
“The D.C. area definitely has a strong tech scene, but it seems to find itself in a perpetual identity crisis about what it wants to be,” said Hanks. “First and foremost, the region has the highest density of cyber talent in the country, if not the world, when taking into account the multiple three-letter agencies, the large government contractors, and the innumerable young companies. Every six months or so, there is some quixotic initiative to brand the region and manufacture an identity, and D.C., Maryland, and Virginia cannot ever seem to play well together.”
While cybersecurity is D.C.’s strongest asset, technologically speaking, the capital could grow into a larger tech hub. Jeff Bezos already has a strong foothold in the city through his acquisition of the Washington Post. And with rumors that Amazon’s HQ2 could be coming to town, a new flock of startups may soon be moving in.

Kodi add-on fans could have seen a huge piracy precedent set, with a judge recently siding with major Hollywood players Netflix and Amazon in court.
The Kodi surge continues without any sign of stopping, as users continue to ditch paid TV services for the online player.
Research has suggested Kodi – which offers access to thousands of channels – is being used in more than five million UK homes.
Kodi software is not illegal, but developers can produce third-party add-ons that provide free access to pirated and illegal content.
These apps allow users to stream premium content, like paid-for sports and movie channels for free.
The illegal add-ons are being targeted by ISPs, government agencies, broadcasters and rights holders.
And now one Kodi Box distributor has been dealt a heavy blow in a court case set in motion by major Hollywood players.
TickBox TV is a popular streaming set-top box, powered by the Kodi media player.
According to Hollywood studios, the Georgia-based company includes instructions for a number of Kodi add-ons that enable users to stream paid-for content for free.
Much of this paid-for content is generated by the likes of Disney, 20th Century Fox, Paramount Pictures, Warner Bros, Amazon, Netflix – which are all part of the Alliance for Creativity and Entertainment.
The ACE last year filed a lawsuit against TickBox, claiming these set-top boxes are nothing more than piracy tools, allowing buyers to stream copyright-infringing content.
And now a US judge has ordered TickBox to keep add-ons out of their set top boxes in a huge victory for Netflix Amazon and co.
In their preliminary injunction this week, US District Court Judge Michael Fitzgerald largely sided with movie companies, TorrentFreak reported.
The ACE had claimed TickBox promoted its service for piracy purposes, and Fitzergerald said there was enough evidence to make this likely.
As such, the judge said there is sufficient reason to believe TickBox can be held liable for inducing copyright infringement.
TickBox had said they had simply offered a computer that users can configure the way they want to.
But the US judge said TickBox went further, as it directed users to install certain ‘themes’.
These themes feature several add-ons that link to infringing content.
In their findings, judge Fitzergerald wrote: “Thus, the fact that the Device is just a ‘computer’ that can be used for infringing and noninfringing purposes does not insulate TickBox from liability if [..] the Device is actually used for infringing purposes and TickBox encourages such use.”
The preliminary injunction compels TickBox to ensure set-top boxes should no longer have links to themes or add-ons that the ACE has flagged up as copyright infringing.
TickBox said their business could be shutdown by a broad injunction, but the court argued against this as customers can still use the devices for legitimate purposes.
The court added if customers are no longer interested then it suggests piracy was the main draw of the devices.
The preliminary injunction is not final, and it remains to be seen how TickBox can remove add-ons from devices that already have been sold.
The Court has told both TickBox and the ACE to reach an agreement on outstanding issues which can be included in an updated injunction.
The ACE has also filed a similar lawsuit against Dragon Box, a set-top box that makes use of Kodi add-ons.
The complaint alleges Dragon Box advertised the product as a way for users to avoid paying for authorised subscription services.
It quotes marketing material that encourages users to “Get rid of your premium channels … [and] Stop paying for Netflix and Hulu.”
The set top box costs around £255 and is in over a quarter million homes in the US.
