Internet giants like Google might breathe a little easier in Europe… at least, for now. The EU has called off January 21st negotiations for a final vote on the controversial Copyright Directive after 11 countries, including Germany, Italy and the Netherlands, said they wouldn’t support the latest version of the proposal. European Parliament Member Julia Reda noted that most of these countries (Croatia and Portugal are exceptions) have previously argued that the disputed Articles 11 and 13 of the directive didn’t do enough to protect users’ rights, and this may have played at least some part in their opposition.

Critics have regularly described Article 11 as a “link tax,” since it gave companies the right to charge sites like Google for merely including content with links, even if it’s just a brief snippet to show the user what they’re seeing. Article 13, meanwhile, has raised concerns that internet companies would be virtually required to implement copyright filters and wouldn’t have enough protections for fair use rights.

This doesn’t mean that the Copyright Directive is gone, or that Articles 11 and 13 will go away. However, it may need a significant overhaul if it’s going to come to a vote. That, in turn, could delay any implementation. European elections are scheduled for May, just two months after the originally planned March vote on the Directive — there isn’t much room to breathe if there’s a significant setback.

AT&T is terminating the broadband service of more than a dozen customers who were accused multiple times of copyright infringement, according to a report by Axios today.

“It’s the first time AT&T has discontinued customer service over piracy allegations since having shaped its own piracy policies last year, which is significant given it just became one of America’s major media companies [with the purchase of Time Warner],” Axios wrote.

Axios’ report is based partly on anonymous sources, but AT&T also confirmed the news in official statements to Axios and Ars. The allegedly pirating customers will receive their disconnection notices within a week or so; each one already “received at least nine separate notifications with allegations of copyright infringement from content owners,” Axios wrote.

Tom Edwards, a Colorado-based potter who designed a “farting unicorn” mug that Tesla CEO Elon Musk became enamored with, announced last Friday that the two sides had reached an “agreement” over the use of the image. No terms were disclosed.

“It’s clear there were some misunderstandings that led to this escalating, but I’m just glad that everything has been cleared up,” Edwards wrote. “I’ve always been a Tesla fan, and I’m looking forward to getting back to making pots and selling them in my online store.“

The image, which Edwards created in 2010, was first noticed by Musk in February 2017, when the entrepreneur called it “maybe my favorite mug ever.”

(credit: Furie v. Infowars)

Matt Furie, the creator of the Pepe the Frog cartoon character, has now sued Infowars, alleging that a poster for sale on the conspiracy-minded website infringes his copyright.

The poster contains the frog’s likeness alongside President Donald Trump and other conservative political allies, including Infowars’ founder, Alex Jones.

The lawsuit, which was filed Monday in federal court in Los Angeles, claims that Infowars and its parent company, Free Speech Systems LLC, are in violation of Furie’s copyright for Pepe.

How a fight over Star Wars download codes could reshape copyright law https://briefnews.eu/how-a-fight-over-star-wars-download-codes-could-reshape-copyright-law/ https://briefnews.eu/how-a-fight-over-star-wars-download-codes-could-reshape-copyright-law/#respond Fri, 23 Feb 2018 15:36:01 +0000 http://briefnews.eu/how-a-fight-over-star-wars-download-codes-could-reshape-copyright-law/

We’re as stunned as you are, Rey. (credit: Lucasfilm)

A federal judge in California has rejected Disney’s effort to stop Redbox from reselling download codes of popular Disney titles like Frozen, Beauty and the Beast, and the latest Star Wars movies.

Judge Dean Pregerson’s Tuesday ruling invoked the little-used doctrine of copyright misuse, which holds that a copyright holder loses the right to enforce a copyright if the copyright is being abused. Pregerson faulted Disney for tying digital download codes to physical ownership of discs, a practice that he argued ran afoul of copyright’s first sale doctrine, which guarantees customers the right to resell used DVDs.

If the ruling were upheld on appeal, it would have sweeping implications. It could potentially force Hollywood studios to stop bundling digital download codes with physical DVDs and force video game companies to rethink their own practices.

Embedding a tweet could violate copyright https://briefnews.eu/embedding-a-tweet-could-violate-copyright/ https://briefnews.eu/embedding-a-tweet-could-violate-copyright/#respond Fri, 16 Feb 2018 11:07:57 +0000 http://briefnews.eu/embedding-a-tweet-could-violate-copyright/

If you’ve ever embedded a tweet on your blog, that could be a copyright violation, according to a New York federal court ruling. Numerous sites, including Time, Yahoo (which is part of Oath, Engadget’s parent company), Vox and Breitbart published stories with an embedded tweet containing an image of NFL star Tom Brady. The tweet was posted by another party, but the photographer who took the photo accused the news sites of copyright infringement for embedding it. The judge agreed, saying their actions “violated plaintiff’s exclusive display right.”

Open internet advocate group Electronic Frontier Foundation (EFF) wrote that that effectively upends ten years of precedent from a 2007 Ninth Circuit ruling called “Perfect 10 v. Amazon.” In that case, the court ruled that the hosting entity is liable for copyrights, not the company or individual who embeds or links it. That’s because anyone links to the content might not know that it’s infringing, and can’t even be certain what the server will provide. You might embed one Facebook image, for instance, and then the user who is hosting it could edit the post and change it.

Don’t sue me, EFF

The judge apparently rejected the Ninth Circuit’s so-called server test, in part by describing embedding — something that’s easy to do on a modern CMS — as a highly technical process only done by “coders.” That means that publishers, rather than hosts, can be held liable.

“[When the] defendants caused the embedded Tweets to appear on their websites, their actions violated plaintiff’s exclusive display right,” ruled Judge Katherine Forrest. “The fact that the image was hosted on a server owned and operated by an unrelated third party (Twitter) does not shield them from this result.”

EFF notes that the ruling could apply to any inline embedded content, and not just tweets. As such, it could cause chaos, as the 2007 ruling “has been a foundation of the modern internet,” EFF’s Daniel Nazer wrote. There may be an appeal, however, which could see the ruling overturned. The EFF, for one hopes that the new judgement doesn’t stand. “If it did, it would threaten the ubiquitous practice of in-line linking that benefits millions of Internet users every day,” wrote Nazer.

Google will make copyright credits more apparent in image searches https://briefnews.eu/google-will-make-copyright-credits-more-apparent-in-image-searches/ https://briefnews.eu/google-will-make-copyright-credits-more-apparent-in-image-searches/#respond Fri, 09 Feb 2018 23:57:20 +0000 http://briefnews.eu/google-will-make-copyright-credits-more-apparent-in-image-searches/

Google has reached a deal to end Getty Images’ European complaint over photo copyrights, and it’s quite likely that you’ll notice the effects. A new agreement between the two will see Google obtain a “multi-year” license for Getty’s photos in its products in exchange for reforming its approach to copyright in image search. Google will do more to highlight copyright attribution for the photos you find, so you’ll know whether or not you’d need to pay for a picture. It will also pull “view image” links for pictures to reduce the number of direct downloads.

In the European Commission complaint, Getty had accused Google of effectively being a one-stop piracy shop: you could easily download and view copyrighted photos without visiting the host site or understanding the legality of a download. Google has long had an option to filter photos by licensing rights, but that only helps if you already intend to honor image permissions. The changes likely won’t stop those determined to grab every image they want, but they may prevent ‘casual’ downloads from people who may only have a loose understanding of copyright.

The cost of the deal isn’t known. It’s no surprise that a deal exists at all, mind you. Google already has its plate full with EU matters, including a shopping-related antitrust fine and tax disputes. The Getty deal gets the copyright complaint out of the way and prevents it from complicating an already complicated situation.

On January 1, 2019, every book, film, and song published in 1923 will fall out of copyright protection—something that hasn’t happened in 40 years. At least, that’s what will happen if Congress doesn’t retrospectively change copyright law to prevent it—as Congress has done two previous times.

Until the 1970s, copyright terms only lasted for 56 years. But Congress retroactively extended the term of older works to 75 years in 1976. Then on October 27, 1998—just weeks before works from 1923 were scheduled to fall into the public domain—President Bill Clinton signed legislation retroactively extending the term of older works to 95 years, locking up works published in 1923 or later for another 20 years.

Will Congress do the same thing again this year? To find out, we talked to groups on both sides of the nation’s copyright debate—to digital rights advocates at the Electronic Frontier Foundation and Public Knowledge, and to industry groups like the Motion Picture Association of America and the Recording Industry Association of America. To our surprise, there seemed to be universal agreement that another copyright extension was unlikely to be on the agenda this year.
