Romania is voting this weekend on whether to define marriage as a union between a man and a woman. Currently, the law defines marriage as a union of “spouses.” The conservative EU nation decriminalized homosexuality in 2001, but it neither allows same-sex marriage, nor recognizes same-sex unions sealed abroad. In order to be valid, the two-day vote needs a turnout of 30 percent. The referendum was approved after calls from the Coalition for the Family, a group of conservative and religious NGOs, which has long campaigned to replace the word ‘spouse’ in the constitution. The leader of Romania’s ruling Social Democrat Party, Liviu Dragnea, said that many fear “what has happened in other countries, such as legalizing marriage between a man and an animal, could happen here.” Opponents of the referendum are urging the public to boycott the vote, warning that a ‘yes’ vote would further infringe on the rights of minorities.
The lifting of the ban on Nazi symbols, if used in a “socially adequate” way, was announced by a German industry group on Thursday. The Entertainment Software Self-Regulation Body (USK), which is responsible for issuing age ratings for video games, said they will ensure the policy shift doesn’t promote Nazism.
Only those titles that clearly disapprove of Nazi ideology may be allowed to use such unconstitutional symbols, on a case-by-case basis, to better reflect that.
For instance, in the German versions of the famous Wolfenstein series, images of Adolf Hitler had to be altered to remove his mustache and the swastikas replaced with a triangular symbol. The gaming community have been strong advocates for video games to be treated like films.
“Through the change in the interpretation of the law, games that critically look at current affairs can for the first time be given a USK age rating,” said USK Managing Director Elisabeth Secker.
“This has long been the case for films and with regards to the freedom of the arts, this is now rightly also the case with computer and video games.”
The game classification body, which reviews all titles sold in Germany, emphasized that they will continue to act responsibly and scrutinize future video games individually to determine if they qualify for an exemption.

The top French constitutional authority has for the second time this year scrapped proposed legislation to criminalize visiting terrorist websites, ruling in favor of civil liberties over increased security from terrorism.
The bill proposes to sentence anyone who visits jihadist websites “without any legitimate reason” to “two years of imprisonment and a €30,000 fine.”
On Friday, the French Constitutional Council, the highest constitutional authority in France, rejected the proposed legislation, considering it “neither adequate, not proportional.” The bill violates freedom of expression and communication, the council said in a statement.
The legislation was previously rejected by the Constitutional Council in February, which prompted lawmakers to introduce changes, clarifying surfing restrictions. The latest version of the bill allows someone to visit a terrorist website if the visitor can prove it was for “public information or scientific research.” The bill was again rejected by the Constitutional Council, however.
The new legislation prompted fears it would severely limit civil liberties. Human Rights Watch, which has been vocally opposing the legislation since it was first introduced, hailed the ruling as a “welcome respite from France’s rush to adopt restrictive counterterrorism measures at the cost of rights and freedoms.” According to the rights group, the amendments introduced to the bill were purely cosmetic and did not change its nature.
The looming threat of terrorist attacks make it worth sacrificing certain liberties for the sake of safety, the bill’s proponents argue.
In December 2016, before the original bill’s defeat, a 32-year-old Frenchman was sentenced to two years in jail and a fine after police discovered during a raid that he was regularly browsing pro-Islamic State (IS, formerly ISIS/ISIL) websites. The investigation then found that the suspect was using an IS flag as a cover photo on his PC and downloaded IS propaganda images, including execution videos, on his phone. Despite accounts by family members that the man had shown the signs of radicalization, his lawyer successfully appealed to the Constitutional Court, which scrapped the law in February. However, the man remained in jail as he was sentenced for other offenses.
France has witnessed some of the deadliest terrorist attacks in Europe in recent years. More than 200 people have been killed since early 2015 by assailants who have pledged allegiance to, or been inspired by, Islamic State. In a series of coordinated attacks in Paris on November 13, 2015 alone, 130 people were killed by IS terrorists. On Bastille Day in July 2016, a truck was driven into crowds of people celebrating in Nice, killing 86 and injuring over 450.
In October this year, the French parliament approved a new controversial anti-terrorism law which made permanent parts of the two-year state of emergency enacted after the 2015 attacks. That bill caused a severe backlash over its potential to limit civil liberties. French Interior Minister Gerard Collomb justified it by warning that “nobody is safe” and France “is still in a state of war.”

Kuwait’s controversial mandatory DNA collection law has been overturned by the country’s Constitutional Court in a Thursday ruling.
“Forcing civilians who have not been accused of violating the law to take and save their DNA in a database violates basic human rights and privacy,” the court ruled, according to a translation provided to Ars.
“The law violates Articles 30 and 31 of Kuwait’s constitution as well as Article 17 of the International Convention of Civil and Political Rights, which Kuwait has agreed to.”

The US Supreme Court on Monday declared as unconstitutional a 2008 North Carolina law barring registered sex offenders from accessing commercial social media sites where minors may become members or create personal pages or profiles.
The justices ruled that the law, used to prosecute more than 1,000 registered sex offenders, was a breach of the First Amendment because “cyberspace” amounted to the “modern public square.” The court said the North Carolina law, which bars sex offenders from sites like Facebook and Twitter, “enacts a prohibition unprecedented in the scope of First Amendment speech it burdens.”
Justice Anthony Kennedy, writing (PDF) for the majority, added that the law was too broad.
]]>President Donald Trump fired FBI Director James Comey on Tuesday after he testified before Congress on the investigation into alleged Russian meddling in the 2016 presidential election.
NSA whistleblower Edward Snowden tweeted in reaction, that despite Comey having “sought for years to jail me,” he opposed the firing and condemned it as “political interference in the Bureau’s work.”
This FBI Director has sought for years to jail me on account of my political activities. If I can oppose his firing, so can you. https://t.co/zUp5kquy8q

Rep. Elijah Cummings (D-Maryland), Ranking Member of the House Committee on Oversight and Government Reform, called for “immediate emergency hearings” to hear testimony from Attorney General Sessions and Comey.
“The White House was already covering up for Michael Flynn by refusing to provide a single document to Congress, and now the President fired the one independent person who was doing the most to investigate President Trump and his campaign over allegations of coordination with Russia,” Cummings said in a statement released by the House Oversight Committee.
Senate Minority Leader Chuck Schumer (D-New York) said Trump called him to tell him about the firing before it was announced, to which Schumer said he was making “a big mistake.”
Later, Schumer called the decision “part of a deeply troubling pattern from the Trump administration.”
“They fired Sally Yates. They fired Frank Carrara. And now they fire Director Comey, the very man leading the investigation. This does not seem to be a coincidence,” Schumer said, adding that anyone who is appointed to lead the investigation “will be concerned that he or she will meet the same fate as Director Comey if they run afoul of the administration,” according to a transcript from C-Span.
If we don’t get a special prosecutor, every American will rightfully suspect that the decision to fire #Comey was part of a cover-up.
— Chuck Schumer (@SenSchumer) May 9, 2017
The top Democrat on the House Intelligence Committee, Rep. Adam Schiff (D-California), said the firing “raises profound questions about whether the White House is brazenly interfering in a criminal matter.”

Rep. Eric Swalwell (D-California) said the firing of Comey “should send a chill down the spine of every American,” and that Trump’s action was “an abuse of power, and shows a consciousness of guilt.”
“The American people deserve to know what happened, and Trump’s ‘Tuesday Afternoon Massacre’ won’t interfere,” Swalwell added.
The “Tuesday Afternoon Massacre” is a reference to President Richard Nixon’s “Saturday Night Massacre” in which he fired two prosecutors investigating the Watergate scandal.
Senator Ron Wyden (D-Oregon) called Trump’s decision “outrageous” and called on Comey to immediately testify on the status of the investigation before he was fired.
“There can be no question that a fully independent special counsel must be appointed to lead this investigation,” Wyden said in a statement. “At this point, no one in Trump’s chain of command can be trusted to carry out an impartial investigation.”
Senator Elizabeth Warren (D-Massachusetts) questioned the reason the administration gave for their decision, saying “does anyone seriously believe that Donald Trump fired the top person investigating Trump’s ties to Russia because he was unfair to Hillary Clinton? Give me a break.”
It’s time for Congress to get their heads out of the sand. @realDonaldTrump cannot pick the person to continue this critical investigation.
— Elizabeth Warren (@SenWarren) May 9, 2017
Senator Bernie Sanders said the firing “raises serious questions about what his administration is hiding.” He also called for an independent investigation, saying “it’s clear that whomever President Trump handpicks to lead the FBI will not be able to objectively carry out the Russian investigation.”
Rep. Keith Ellison (D-Minnesota) said that, with the firing, “We are witnessing a Constitutional crisis unfold before our very eyes.”
Many on the left questioned why Trump decided to fire Comey now, just after he gave testimony on the Russian investigation.
Now it’s even more important that an independent special counsel is appointed to investigate the Russian interference in our elections. pic.twitter.com/WcoxtbfSyW

.@POTUS It’s now clearer than ever that we need an independent investigation into Trump’s ties to Russia.
— Sen. Al Franken (@SenFranken) May 9, 2017
Sad for the country that any decision DOJ and FBI make now will be shrouded in suspicion. It’s a hammer blow to the integrity of our system.
— David Axelrod (@davidaxelrod) May 9, 2017
As a former prosecutor, I find Trump’s firing of Comey SCREAMS consciousness of guilt and a cover up. We need a special prosecutor NOW. https://t.co/c2dV8MsLJT

Many on the right were happy with Trump’s decision, saying it will restore confidence and questioning Democrats who criticized Comey for reopening the investigation into former Secretary Hillary Clinton days before the 2016 election.
Judicial Watch, a conservative watchdog group, called the sacking “an important move to restore public confidence in the fair administration of justice at the Federal level,” adding that Trump “took the right step in cleaning house at the FBI.”
Comey Fired!!! Finally.
— Sean Hannity (@seanhannity) May 9, 2017
Given the recent controversies surrounding the Director, I believe a fresh start will serve the FBI and the nation well.
— Lindsey Graham (@LindseyGrahamSC) May 9, 2017
Media is melting down like a snowball in hell-are these the same media folks who called for Comey’s head when they thought he hurt Hillary?
— Gov. Mike Huckabee (@GovMikeHuckabee) May 10, 2017
Seriously, you mind-numbed, moonbat addled Democrats, how long will Trump be “under investigation” for Russia? Forever?
— Bill Mitchell (@mitchellvii) May 10, 2017
Many on the right, however, voiced concerns about the future of the investigation.
Senate Intelligence Committee Chairman Richard Burr (R-North Carolina) said he was “troubled by the timing and reasoning of Director Comey’s termination.”
While Senator John McCain (R-Arizona) said that he was “disappointed” in Trump’s decision to fire Comey, adding that it “only confirms the need and the urgency of such a committee.”
Rep. Justin Amash (R-Michigan), a ranking member of the conservative House Freedom Caucus, said that he is “reviewing legislation to establish an independent commission on Russia.”
My staff and I are reviewing legislation to establish an independent commission on Russia. The second paragraph of this letter is bizarre. https://t.co/wXeDtVIQiP

Edward Peruta is a litigious Vietnam veteran who spends part of each year living out of a trailer home in San Diego.
Neil Gorsuch is a conservative Coloradan with impeccable Ivy League judicial credentials.
Peruta’s legal challenge to San Diego County’s concealed carry permitting system has been winding its way through the federal court system since 2009.
Gorsuch was sworn in as the newest associate justice of the Supreme Court just four days ago.
On Thursday, their fortunes will meet when Gorsuch joins his first-ever Supreme Court conference to discuss whether the bench should hear Peruta v. California, which asks whether the Second Amendment protects a right to carry guns in public spaces. It could be the most consequential gun case since the Court confirmed the individual right to bear arms in District of Columbia v. Heller nearly a decade ago.
The majority opinion in that case was written by Antonin Scalia, Gorsuch’s predecessor and a staunch originalist (meaning he believed that the intent of the Constitution has not changed), but it left unresolved a handful of major questions about the Second Amendment. Peruta seeks to answer one of them. Here’s everything you need to know about the case.
Broadly, it’s about whether the Second Amendment protects the right of a citizen to carry a firearm in public for self defense. More specifically, it’s about the “good cause” requirement many California counties — including San Diego — impose on residents applying for a license to carry a concealed weapon.
How strict the “good cause” standard is varies by jurisdiction, but it means that gun permit applicants must have what the sheriff’s department deems to be a convincing reason to need to carry a gun. If a sheriff finds an applicant doesn’t clear that bar, they can’t legally carry a concealed gun in public, which is what happened to Peruta.
Yes, in District of Columbia v. Heller, the Supreme Court held that the Second Amendment provides an individual right to protect oneself with a firearm. But the facts of that case were about having a firearm in the home: The Washington, D.C., gun ordinance underlying that 2008 case banned some types of guns and required firearms kept in personal residences to be disassembled and unloaded.
And residences were the explicit focus of the majority decision in Heller, in which Scalia argued that the Second Amendment “surely elevates above all other interests the right of law-abiding, responsible citizens to use arms in defense of hearth and home.”
REUTERS/White House/Pete Souza/Handout
Heller seems to leave room for that, especially when it comes to concealed weapons. Here’s the relevant section from the decision:
Like most rights, the right secured by the Second Amendment is not unlimited … For example, the majority of the 19th-century courts to consider the question held that prohibitions on carrying concealed weapons were lawful under the Second Amendment or state analogues … Although we do not undertake an exhaustive historical analysis today of the full scope of the Second Amendment, nothing in our opinion should be taken to cast doubt on … laws forbidding the carrying of firearms in sensitive places.
Well, for starters, the court only grants cert (that is, agrees to hear arguments and rule on a case) to a tiny fraction of the petitions it receives. And in the years since Heller, it’s likely that the justices haven’t felt like they’ve seen a good case on this particular question of carrying guns in public. If the justices decide that Peruta is not the suit to determine if the right to carry a gun extends outside the home, there’s at least one other upcoming case on the issue — Matthew Grace and Pink Pistols v. District of Columbia — that the court could agree to hear.
Chip Somodevilla/Getty Images“As a matter of basic arithmetic, yes,” says Joseph Blocher, a law professor at Duke University who part of Washington, D.C.’s legal team in the Heller case. “It’s easier to get four votes when you’ve got nine justices.” But Blocher also notes that even with Scalia’s former seat now filled, petitioners in gun cases face another obstacle to getting their cases heard. “Replacing him with Gorsuch doesn’t really up the odds that much. Besides Scalia, [Clarence] Thomas and [Samuel] Alito are the only ones who have supported a cert grant since Heller.”
In order for Peruta to be granted cert, Gorsuch, Thomas, and Alito would need a fourth justice — most likely Anthony Kennedy or Chief Justice John Roberts — to also agree that the case should go forward for a full hearing.
We put this one to Dave Kopel, a leading pro-gun legal scholar.
Heller describes in detail what the words in the Second Amendment mean. What are “arms?” What is “keep?” What is “bear?” Some people have said “bear” is a technical term that only means carrying arms while serving in the militia. Heller says no, “bear” means to carry arms in general.
In addition, Kopel argues, when the court used Heller to lay out how guns can be regulated, it was de facto emphasizing that the right to bear arms extends to carrying them in public.
They say it’s okay to ban guns for convicted felons and the mentally ill. That’s an exception that tells you there’s a right, in general, to keep and bear arms. The fact that you need to name the exception tells you what the rule is. Likewise, Heller says conditions and qualifications on the commercial sale of guns are okay. That tells you that selling guns, in general, is a constitutional right. The other exception they state is that it’s okay to ban the carrying of guns in “sensitive places” such as “schools and government buildings.” Well, again, that tells you there’s a right to carry guns in general, but you can make certain limits in spaces that are sensitive. If there wasn’t a right to carry outside your home, you wouldn’t need exceptions.
Maybe — but Blocher notes that originalist interpretations of the Second Amendment can also cut either way. Scalia’s famous Heller opinion certainly used an originalist argument — but so did the dissenting justices who argued that the right to bear arms did not extend outside the “militia” context described in the Bill of Rights.
The lower court opinion affirming San Diego County’s decision to reject Peruta’s permit application was also heavily originalist. In that opinion, Judge William Fletcher of the Ninth Circuit Court of Appeals cited sources from the 13th century, the Revolutionary War, and Reconstruction to illustrate that the right to bear arms does not necessarily include the right to bear arms in public.
Like most states, each county sheriff’s office is responsible for issuing concealed weapons permits. California is a “may issue” state, which means that its sheriffs have broad discretion over who gets a permit.
In San Diego County, the sheriff may issue a permit if an applicant meets these criteria:
Thomson ReutersYou’re on to it: Indeed, the majority of states follow “shall issue” permitting schemes. That means if an applicant meets the criteria for a permit, the issuing authority must grant them a permit. Put simply, “shall issue” states remove discretion from law enforcement.
That San Diego County’s “good cause” requirements are too strict because they basically preclude the ability to carry a gun in public. The county’s specific provision defines “good cause” as “a set of circumstances that distinguish the applicant from the mainstream and causes him or her to be placed in harm’s way. Simply fearing for one’s personal safety alone is not considered good cause.”
States and municipalities that have “good cause” permitting requirements would have to make sure those stipulations aren’t too restrictive. A decision in favor of Peruta wouldn’t necessarily mean that states could no longer place any restrictions on concealed gun carry, however. “The question is not the absolute one of whether states are going to allow public carry,” Blocher said. Because, in practice, every state already does.
Because California doesn’t allow open carry. Peruta is saying he’s stuck between a rock (the good cause requirement) and a hard place (the ban on open carry).
He hasn’t said, but here’s a fair guess: He probably thinks he has a better shot at changing a rule in his county — the “good cause” restrictions — than he does changing a statewide law.
NOW WATCH: The disturbing reason some people turn red when they drink alcohol
]]>According to the changes adopted after the referendum in December 2015, Armenia’s current leader, president Serzh Sargsyan, will become the last president elected in a national vote.
After his term expires next year, a ceremonial head of state will be appointed by parliament and will only have representative authority.
Parliament itself is elected for a five-year term and will become the main authority in the republic.
Some 2,000 polling stations opened in Armenia on Sunday morning, with nearly 30,000 local and international monitors observing the voting process.
According to police data, 2.56 million people have been registered as eligible to vote, with no voter turn-out set by Armenian election law. About 900 Armenians living outside the country, including diplomats and the military, cast their online ballots last week, with their votes to be added to the count after the election ends at 4:00 pm GMT Sunday.
National minorities in Armenia, including Russians, Kurds, and Assyrians are taking part in the voting for the first time.
More than 28,000 monitors from almost 50 local NGOs, as well as nearly 650 international monitors including OSCE (Organization for Security and Cooperation in Europe) and European Parliament representatives are in the country.
A prominent US musician and political activist of Armenian descent, Serj Tankian of the System of a Down music band is among the independent international observers.
“It’s a pleasure and an honor to be here to partake in the parliamentary elections,” Tankian told the media in Yerevan, the Armenian capital. The musician had teamed up with a group of artists in Armenia to monitor the elections “because we were afraid of what might happen… after years of injustice and apathy,” he added.
“Whatever is the result of these elections, the important thing is that the organization of civil society, labor unions and the people’s power and strength will always be there no matter what,” Tankian said, calling on the people to go to polling stations and vote.
Over 1,200 local and 100 international journalists are covering the elections.
Five parties and four blocs with some 1,500 deputy candidates are contesting the poll. The electoral threshold for the parties is five percent of the votes, while blocs require at least seven percent to secure representation in the parliament.
No limit for parliament seats is set by Armenian law, which only states that the minimum of 101 deputies is required, with a stable parliamentary majority of 54 percent to be necessarily formed. If, following the elections, such majority is not formed, a second round will be held between the two parties which received most votes in the first round.
Among the political forces taking part in the elections are the Republican party led by the country’s current president Sargsyan, the ‘Tsarukyan’ bloc headed by one of Armenia’s leading businessmen Gagik Tsarukyan, and the ‘Kongress-ANK’ bloc with Armenia’s first president Levon Ter-Petrosyan as its leader.
Based on opinion polls and expert opinions, the conservatives led by Sargsyan and who have been in power for almost 20 years, have been named as the odds-on favorite.
Their main rival is the ‘Tsarukyan’ bloc, the leader of which has promised to bring in investments of $ 15bn to Armenia, the current GDP of which is $ 10.4bn, RIA Novosti reported.
The Armenian national congress who have teamed up with the People’s party of Armenia in the ‘Kongress-ANK’ formation focused their campaign on ethnic and the territorial conflict with Azerbaijan in Nagorno-Karabakh, calling for a compromise to settle the decades-long standoff.
Another group participating in the elections – the ‘Oganyan-Raffi-Oskanyan’ coalition of Armenia’s former defense and foreign ministers – have already called on the people to take to the streets and protest the election results if found to be rigged, even before the voting started, RIA Novosti reported earlier this week.
To prevent any illegal voting, electronic equipment is used for the first time. In addition, live video broadcast from polling stations has been introduced, which can be viewed online.
Only heterosexual love is in the air in the Arkansas Senate this Valentine’s Day, as lawmakers convened a hearing to decide whether to ask the US Congress to amend the Constitution to define marriage as between one man and one woman.
The committee hearing considered Senate Joint Resolution 7. If passed by the Arkansas legislature, it would ask Congress “to call a convention for proposing an amendment… prohibiting the United States Constitution or the constitutions or laws of any state from defining or construing the definition of ‘marriage’ to mean anything other than the union of one man and one woman.”
State Senator Jason Rapert (R-Conway), an evangelical Christian who also serves as president of Holy Ghost Ministries, introduced the resolution on February 2. He also proposed another constitutional amendment defining life as beginning at conception.
Article V of the US Constitution outlines the steps for amending the country’s founding document. Such an amendment must be proposed by Congress with a two-thirds majority in both chambers or via a constitutional convention called for and ratified by two-thirds of state legislatures.
“The federal courts cannot stop 34 states from calling for the amendment. If 38 states ratify the amendment as proposed, marriage between one man and one woman shall be restored in America,” Rapert wrote on Facebook.
None of the Constitution’s 27 amendments were proposed by a constitutional convention.
Gay marriage has been the law of the land since June 2015, when the US Supreme Court ruled in Obergefell v. Hodges that the equal protection clause of the Fourteenth Amendment requires all states to license same-sex marriages. The 5-4 decision sounded the death knell for the Defense of Marriage Act, which was signed into law in 1996. It defined marriage as being between one man and one woman at a federal level.
“A court just out of the clear blue decided to carve this new right,” Rapert told KATV, after he filed the resolution. “I think the country now knows the silent majority is out there and they spoke during the 2016 election, and they’re going to speak again.”
As of May 2016, a record 61 percent of Americans believed that same-sex marriages should be recognized by law as valid, according to a Gallup poll.
“It is not bigoted to say that marriage is between a man and a woman,” Rapert said later in the interview.
While Republicans do have majorities in both the House of Representatives and the Senate, they do not have the two-thirds majorities in either to pass a constitutional amendment without help from Democrats, who support gay marriage. The GOP fully controls 25 state governments ‒ meaning the governorship and majorities in both legislative chambers ‒ and partial control of 20 more states.
Although President Donald Trump would not have any say in a potential constitutional amendment process, he has said that the issue of gay marriage is “settled.”
“These cases have gone to the Supreme Court. They’ve been settled. And I’m — I’m fine with that,” he told CBS News’ Lesley Stahl after he was elected.
However, Trump does not appear to hold the same view for abortion or a woman’s right to bodily autonomy; issues that the Supreme Court ruled on in 1973. In the same ‘60 Minutes’ interview, the president implied that he will push for an anti-abortion position by appointing “pro-life judges.” When faced with the direct question if some women won’t be able to have an abortion, he was evasive, saying that “it’s a long way to go” and “it’ll go back to the states.”
“A person begins to form from the moment of conception and should be afforded the full protection of any other person in our nation,” Rapert wrote in a Facebook post about the anti-abortion amendment. “I cannot sit by while millions of little humans are killed as if they are worthless – nearly 60 million since Roe V. Wade in 1973.”
