“We have agreed to take efforts aimed at convening the first session of the Syrian constitution committee early next year. These steps will lead to the launch of a viable and lasting Syrian-owned, Syrian-led, UN-facilitated political process,” Russian Foreign Minister Sergey Lavrov said in a statement following the meeting hosted by UN Special Envoy for Syria Staffan de Mistura.

Sochi or Vienna: Which peace plan offers best solution for Syria?
The agreement, which could pave the way for political reconciliation in the war-ravaged country, was struck between Lavrov, Turkish Foreign Minister Mevlut Cavusoglu, and Iranian Foreign Minister Javad Zarif.
The creation of the 150-member body was first envisaged during a UN-backed summit in Sochi last January, which reinvigorated the stale Geneva peace process. However, efforts had been without a major breakthrough due the parties’ inability to agree on the composition of the committee.

The body will consist of 50 representatives from the Syrian government, 50 representatives from the opposition, and the remaining 50 are intended to be “independent” delegates of civil society chosen by the UN.
The latter has become a bone of contention, with Damascus reportedly opposing some of the candidates.
The list has not been finalized as of yet, but the trio of Russia, Turkey and Iran is nearing a mutually acceptable solution, Cavusoglu said after the meeting.
“As guarantor states, we are working together with the UN on this issue. We are gradually moving towards the finish line,” he said.
Cavusoglu stated earlier that Turkey will work with Syrian President Bashar Assad if he remains in power after “very credible, transparent, democratic and fair” elections are carried out, which is the ultimate goal of the constitutional committee.
It was hoped that the committee would convene before Mistura, who is stepping down in December, leaves his post. Speaking after the meeting, the outgoing special envoy wasn’t overly optimistic, however, saying that “there is an extra mile to go” before having a balanced and credible body tasked with drafting a constitution.
Meanwhile, the US – which has so far been wary of the possibility of intra-Syrian reconciliation – seems to be taking a less hawkish approach, with its special representative in Syria, James Jeffrey, recently saying that it doesn’t want to topple Assad anymore.
“We want to see a regime that is fundamentally different. It’s not regime change – we’re not trying to get rid of Assad,” Jeffrey said at the Atlantic Council meeting on Monday.
This doesn’t mean that the US has actually abandoned its plans to dislodge the Syrian president, however, according to Joshua Landis, director of the Center for Middle East Studies at the University of Oklahoma. Instead, it would merely prefer to do so without spilling blood.
“The Americans are counting on this committee’s constitution change and [the] election overseen by the UN, which will change the regime peacefully and bring about a peaceful settlement in America’s favor,” he argued.
Landis predicted that since this is “unlikely to happen,” the US will maintain a presence in Syria until it occurs.
“That could mean that America is an open-ended force in Syria,” he said.

Boris Johnson launched a fresh attack on Theresa May’s Brexit strategy, saying that she “wrapped a suicide vest around the British constitution” and handing the detonator to the EU.
The former foreign secretary’s comments, which were published in the Mail on Sunday, specifically criticised May’s so-called Chequers proposal, which was agreed earlier this year.See the rest of the story at Business Insider

Ramaphosa, who vowed to return the lands owned by the white farmers since the 1600s to the country’s black population after he assumed office in February this year, said on Tuesday that the ANC would introduce a constitutional amendment in parliament.
“The ANC will through the parliamentary process finalize the proposed amendment to the constitution that outlines more clearly the conditions under which expropriation of land without compensation can be effected,” Ramaphosa, a prominent trade union leader and a close associate of Nelson Mandela, said in a televised address on Tuesday.
The millionaire ex-businessman argued that “it has become pertinently clear that our people want the constitution to be more explicit” about the proposal, which is viewed by the South African white minority as forceful expulsion that can incite violence against farmers.
There have been growing fears that the planned expropriation will deal a blow to commercial farming in the country and might put it on the verge of a food production crisis, like the one that struck Zimbabwe when it unleashed a similar crackdown on white farmers in 1999-2000.
Promoting his plan to boost land redistribution in March, Ramaphosa sought to assure white citizens, who constitute roughly nine percent of the total population, that the government would handle the controversial matter through “dialog, discussion, engagement, until we find good solutions that take our country forward.”
“There is no reason for anyone of us to panic and start beating war drums,” he said at the time, noting that nothing should prevent farming activities from continuing as normal.
However, many of the Boers, descendants of Dutch settlers in South Africa, do not take the government’s promises at face value, instead seeking asylum abroad from what they say is a surge in violence and government-fueled hostility against them.
Last month, a call from Australian Home Affairs Minister Peter Dutton to provide emergency visas for South Africa’s white farmers, who are reportedly facing persecution at home, sparked a diplomatic scandal, with the head of the South African opposition labeling Australia “a racist country” for granting refuge to white farmers both in the Mandela era and now.
Boers have also appealed to Russia, seeking to resettle farmers who no longer feel at home in South Africa. A delegation consisting of some 30 South African farming families arrived in Russia’s farm belt Stavropol Region last month, asking the local authorities to consider resettling up to 15,000 Boers.
Moving “is a matter of life and death” for them the head of the delegation told the media.
The region’s Deputy Commissioner for Human Rights Vladimir Poluboyarenko told RT earlier there is a plan in place to resettle up to 50 Boer families and potentially some 500, who would arrive to Stavropol with their own cattle.

A little-known article in the Italian constitution makes it virtually impossible for Italy to leave the euro or the European Union in the near future, even if the country ends up being ruled by a eurosceptic coalition in the coming months.
Article 75 of the Italian constitution could play a key role in defusing the developing crisis in Italian politics, a crisis which many fear could culminate in Italy pulling out of the euro.See the rest of the story at Business Insider

YANGON (Reuters) – Myanmar’s civilian president called in an Independence Day speech on Thursday for reform of a military-drafted constitution and for justice for all recognized minorities under a federal system, but made no mention of the treatment of its Rohingya Muslim people.
Amending the charter to remove a dominant political role for the military has been one of the most contentious issues facing Myanmar as it emerges from nearly half a century of strict army rule.
The debate over constitutional reform, however, has been muted since the assassination in January last year of a lawyer advising government leader Aung San Suu Kyi’s ruling party on the issue.
“As we build the Democratic Federal Republic, in accordance with the results of the political dialogues, we all need to work collectively for creating a suitable constitution,” President Htin Kyaw said in his speech marking the 70th anniversary of Myanmar’s independence from Britain.
Htin Kyaw’s post is largely ceremonial but he is a close ally of Suu Kyi. He did not elaborate on what he meant by suitable or spell out why he was suggesting the 2008 constitution drawn up by the military was unsuitable.
The constitution bars Suu Kyi from becoming president because it rules out candidates with a foreign spouse or child. Suu Kyi’s late husband was British as are her two sons.
It also reserves for the military one quarter of the seats in parliament and several major cabinet posts, including defense, interior and border affairs, giving it an effective veto over constitutional change and control of security affairs.
Myanmar began emerging from 49 years of military rule in 2011. Suu Kyi’s party swept a 2015 election and formed a government but concern is growing that the reform program is stalling or even sliding back.
This has been compounded by attacks on press freedom, including the detention of several journalists over the past year. On Dec. 12, the authorities arrested two Reuters reporters who had covered the army crackdown that has led to the mass flight of Rohingya residents of Rakhine State across the border into Bangladesh.
Htin Kyaw called for respect for human rights but he did not refer to the crisis over the exodus of 655,000 Rohingya people, nor to the international condemnation it has generated.
“We are working for the emergence of a democratic state based on the principles of freedom for all ethnic national races, justice, equality and right of self-determination,” he said.
“National race” is a term used by Myanmar referring to what it categorizes as indigenous ethnic groups. The Rohingya, who have traditionally lived in Rakhine, have been denied inclusion as authorities regard them as illegal immigrants who have crossed over from Bangladesh.
Thomson Reuters
The Rohingya crisis erupted in late August after Rohingya insurgent attacks on security posts in Rakhine triggered a fierce military response that the United Nations denounced as ethnic cleansing.
Myanmar denies ethnic cleansing saying its security forces have mounted legitimate clearance operations.
Htin Kyaw called for an end to conflict with insurgents from various ethnic minorities who have been battling for autonomy for decades.
Clashes have flared in recent weeks between the army and guerrillas in Kachin and Shan states in the north.
Myanmar’s minorities have long demanded self-determination under a federal system. The army has traditionally seen itself as the only institution preventing the country’s disintegration and has favored a unitary state.
Amending the constitution would not be easy.
Changes require a 76 percent majority vote in a parliament dominated by military members and their allies.
The killing of lawyer and constitutional expert Ko Ni last year has not been fully explained even though the gunman was caught at the scene.
Many activists believe Ko Ni, who was Muslim, was targeted for his efforts to reduce the military’s political role.

A federal judge in California has ruled in favor of the Electronic Frontier Foundation after the organization was recently sued over its “Stupid Patent of the Month” blog posts. As a result, the advocacy group is not required to remove a recent post simply because an Australian patent entity (often called “trolls”) doesn’t like it.
The case began back in April 2017 when EFF countersued an Australian company that it previously dubbed as a “classic patent troll” in a June 2016 blog post entitled: “Stupid Patent of the Month: Storage Cabinets on a Computer.”
In 2016, that company, Global Equity Management (SA) Pty. Ltd. (GEMSA), managed to get an Australian court to order EFF to remove its post—but EFF did not comply. In January 2017, Pasha Mehr, an attorney representing GEMSA, further demanded that the article be removed and that EFF pay $ 750,000. EFF still left the post up and then sued regarding the Australian court’s injunction.

China’s ruling Communist Party has formally enshrined President Xi Jinping’s political thoughts into its constitution, raising his status to the country’s most powerful leader in decades and putting him on par with party founder Mao Zedong. The party unanimously passed the amendment to include “Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era” as one of its guiding principles at the end of a week-long congress on Tuesday, while endorsing the leader for a second five-year term. The amended constitution means that any challenge to Xi, who took office in 2012, will now be seen as a threat to Communist Party rule. It also ensures that his trademark fight against corruption – which has ensnared more than 1.3 million officials – will continue.

BEIJING (Reuters) – China’s ruling Communist Party has agreed to amend the party constitution, expected to embed President Xi Jinping’s political thought, ahead of next week’s five-yearly party congress in which Xi will further tighten his grip on power.
The party’s Central Committee, the largest of its elite ruling bodies, on Saturday passed a previously announced proposal to amend the constitution which will now be put to the Congress for formal approval.
A lengthy communique released by the party via state media offered praise for the past five years under Xi’s leadership, especially success in the fight against corruption, but did not say what wording would be inserted into the party constitution.
A key measure of Xi’s power will be whether he manages to have his name “crowned” in the party constitution, elevating him to the level of previous leaders exemplified by Mao Zedong Thought and Deng Xiaoping Theory.
Xi’s more recent predecessors, Jiang Zemin and Hu Jintao, both had the party constitution amended to include their guiding thoughts, but without their names directly attached.
Jiang has his “Three Represents,” which embraced private entrepreneurs, written in, while Hu, Xi’s immediate predecessor, had his economic doctrine of “scientific development” included.
The party has been pushing Xi’s “Four Comprehensives,” which refer to China working “comprehensively” to build a moderately prosperous society and strengthen reforms, rule of law and party discipline, as well as the “Four Greats”, which focus on party building and national rejuvenation.
The four-day Central Committee plenary meeting also approved reports by the party’s corruption watchdog of investigations into several former senior officials who have been sacked or jailed for graft, including Sun Zhengcai, once a contender for top leadership who was expelled from the party last month.
Since assuming power five years ago, Xi has mounted a sweeping campaign against deep-rooted corruption, with more than one million people punished and dozens of senior officials jailed.
The party has vowed that the campaign, overseen by close Xi ally Wang Qishan, will never end.
The Congress will open on Wednesday with a speech by Xi, the party’s head, details of which are a closely guarded secret ahead of time but will focus more on ideology than concrete policies.
Last October, the party gave Xi the title of “core” leader, a significant strengthening of his position ahead of the Congress, at which a new Standing Committee, the pinnacle of power in China, will be constituted.

Two advocacy groups filed the lawsuit on Wednesday in US District Court in Washington, DC, according to Reuters.
The suit was filed against President Trump, Defense Secretary Jim Mattis and other top officials, on behalf of the five, who said the ban violated the rights of service members’ due process and equal protection under the Fifth Amendment, and asks the court to declare Trump’s directive unconstitutional and to issue injunctions to stop its implementation.
In a Twitter post on July 26, Trump said the US government “will not accept or allow transgender individuals to serve in any capacity” in the military, a reversal of Pentagon policy that the lawsuit said was made without consulting senior military commanders.
….Transgender individuals to serve in any capacity in the U.S. Military. Our military must be focused on decisive and overwhelming…..
— Donald J. Trump (@realDonaldTrump) July 26, 2017
The plaintiffs are all listed as Jane Does to protect their identities. Three are soldiers in the Army, one is in the Air Force, and one is serving on active duty in the Coast Guard.
Among the plaintiffs, Jane Doe 1 submitted her prospective resignation rather than been involuntarily terminated as transgender. Jane Doe 2 was concerned the ban may result in early termination of her contract with the military. Jane Doe 3 expected to deploy to Iraq son and had intended to extend her contract. Jane Doe 4 received medical treatment for her gender transition and hoped to reach her 20-year service benchmark and Jane Doe 5’s livelihood depends on the military.
Trump’s announcement cited healthcare costs and unit disruption as the rationale for banning transgender service members. Critics said the ban appealed to Trump’s religious, conservative base.
The complaint argues Trump’s ban contradicted findings in a Rand Corporation study commissioned by the Pentagon that found allowing “transgender people to serve would cost little and have no significant impact on unit readiness.”
The Rand study suggests there are currently between 1,320 and 6,630 transgender people actively serving in the US military.
The ban also reverses Pentagon policy instituted in 2016 that allowed transgender people to serve openly in the military, stated the complaint.
The policy change led the plaintiffs, and others, to follow protocol and inform their chain of command that they were transgender and did so under the knowledge that the US promised “it would permit them to continue to serve their country openly,” for those who had built their lives around their military service.
“Execution of the President’s directive will result in an end to service by openly transgender service members and has already resulted in immediate, concrete injury to Plaintiffs by unsettling and destabilizing plaintiff’s reasonable expectation of continued service,” stated the complaint.
The Jane Does are being represented by attorney from GLBTQ Legal Advocates & Defenders and the National Center for Lesbian Rights.
The American Civil Liberties Union said it was preparing its own lawsuit.
“The ACLU send a letter to the White House [on Tuesday] formally informing them that we intend to sue and telling them to preserve all documents related to their planned ban on trans military members in preparation for our forthcoming lawsuit,” Ryan Karerat, communications strategist for the ACLU, according to the Huffington Post.
Joseph Dunford, the chairman of the Joint Chiefs of Staff, said in a memo a day after Trump’s tweets that there would be no change in policy until Mattis received an official order from the president.
That order has yet to be issued.
“In the meantime, we will continue to treat all of our personnel with respect,” Dunford said.

Venezuela is less than a week from the vote called by President Nicolas Maduro to elect for members of a constituent assembly that would start redrafting the country’s constitution — a move widely criticized as an attempt to expand government’s power while disempowering citizens.
Widespread public displeasure with Maduro’s effort has manifested itself in numerous street protests — continuing a period of protest that has gripped the country since April — and in an unofficial referendum organized on short notice by the opposition that drew more than 7 million of the country’s 19 million registered voters out to reject Maduro’s plan.
The Venezuelan president has said the vote will go ahead, however, and he has continued his campaign to support it. The latest part of that campaign appears to be a version of the Spanish-language pop song “Despacito” by Luis Fonsi and Daddy Yankee, which recently become the most streamed song of all time.
Maduro, who debuted the song over the weekend on his show, “Los Domingos con Maduro,” did not specify who made his version, referring only to “a group of creators.”
“We going to see if it also passes the test to become viral,” Maduro said before the music started.
“For the unity and peace of our country … the constituent [assembly] goes on,” begins the song, which you can see in the video below.

The government has indicated that the song was sent to the president by Ernesto Villegas, the minister of communication and information, according to El Nuevo Herald.
Panamanian composer Erika Ender, who coauthored the song, rejected its use by Maduro.
“To see that a song, on which I was coauthor, is used without permission in order publicize campaigns tied to a regime that is causing discontent and suffering in a country, far from making me happy, it angers me,” she wrote in an Instagram post. “I DO NOT APPROVE of its use.”
“At no time have I authorized the use of ‘Despacito’ or a lyric change to promote any political agenda, especially in the middle of the deplorable situation that Venezuela, a country that I love very much, is experiencing,” Fonsi said in a statement emailed to Business Insider on Monday evening. “My music is for everyone who wants to listen to it and enjoy it and is not intended to be used to manipulate the will of a country where the people are loudly begging for their freedom and a better future.”
Daddy Yankee also criticized both the unauthorized use of the song and the Venezuelan government’s action against citizens.

Despite a years-long political and economic deterioration and months of violence, Maduro has maintained about 20% support among Venezuelans, but his constituent assembly has been rejected by an overwhelming majority of the country and drawn international rebuke.
Most of the region voiced support for the July 16 referendum convened by the opposition against the assembly, and the EU and the US have suggested they could level sanctions on the Maduro government should the July 30 vote go ahead.
The opposition continues to call for protest, and it plans to mount a nationwide strike on Wednesday and Thursday this week, after a similar action last week. Ahead of the 48-hour strike, opposition leaders have encouraged Venezuelans to stock up on food and other goods — a call echoed by the US embassy in Venezuela.
Shortages have already left many stores and and shops in Venezuela empty or understocked, and Twitter users in Caracas reported that grocery-stores shelves around the city were bare, due to both the shortages and people shopping in preparation for the strike.
