One year after a white-supremacist rally turned violent, ultimately killing Heather Heyer, a Charlottesville local, people gathered to memorialize the one-year anniversary.

Last year, a gathering of white nationalists at the Unite the Right rally clashed with counter-protesters. This year, locals and demonstrators came together to honor Heyer, stand in solidarity against racism, and protest the way police and officials handled last year’s deadly events.

Here’s how Saturday unfolded:

Notably absent from the city was any sign of the white-supremacist organizations that drew thousands of counter-protestors last year.

Virginia Gov. Ralph Northam declared a state of emergency in Charlottesville ahead of the one-year anniversary, anticipating a repeat of the violence between white supremacists from the Unite the Right rally and counter-protestors, some of whom were members of the left-wing group Antifa.

Some local residents remarked that the heavy police presence this year was too little too late.

The US President has spoken out against racism and violence ahead of a fresh Unite the Right rally on Sunday, and has trumpeted his own achievements that he says have benefitted African-Americans and Hispanics.

“The riots in Charlottesville a year ago resulted in senseless death and division. We must come together as a nation. I condemn all types of racism and acts of violence. Peace to ALL Americans!” Donald Trump tweeted on Saturday afternoon.

The statement Trump made one year ago, in which he blamed “hatred, bigotry, and violence on many sides” in the aftermath of the clashes between white nationalists and counter-protesters, was one of the most controversial moments of his presidency. While he gathered some support from his base, who believed that Antifa helped ignite the combustible atmosphere, Trump was widely condemned even by members of his own party, who pointed to the death of Heather Heyer, who was killed when a Unite the Right demonstrator plowed his car into a crowd of counter-protesters.

Saturday’s tweet took a more diplomatic, positive and inclusive tone but, notably, did not contradict anything the US president said a year ago, something ignored in most media outlets, which commended his conciliatory tone, but noted by his political opponents.

Trump also painted himself as an ally of minorities in a follow-up missive.

“I am proud to have fought for and secured the LOWEST African American and Hispanic unemployment rates in history. Now I’m pushing for prison reform to give people who have paid their debt to society a second chance. I will never stop fighting for ALL Americans!” he tweeted, once again presenting himself as a unifier.

The president’s diplomatic skills are sure to be tested on Sunday, when Unite the Right, a broad group uniting white supremacists, Confederate sympathizers, and more mainstream conservatives, gather for a second rally.

Charlottesville rejected Unite the Right’s request to stage the repeat rally, so the march has been relocated to Washington, DC, where police have promised a heavy presence that will separate the demonstrators from the likely much-larger counter-protester gathering. Meanwhile, Charlottesville itself held a commemorative demonstration, organized by progressives, on Saturday.

Charlottesville Charges https://briefnews.eu/charlottesville-charges/ https://briefnews.eu/charlottesville-charges/#respond Fri, 15 Dec 2017 05:21:51 +0000 http://briefnews.eu/charlottesville-charges/

The charge against the man accused of driving his car into a crowd of people protesting a group of white supremacist gathering in Charlottesville, Virginia — killing a woman — was upgraded Thursday to first-degree murder.

James Alex Fields Jr., an apparent neo-Nazi, is charged with driving his Dodge Charger into the counter-protesters on Aug. 12, killing 32-year-old Heather Heyer and injuring 35 other people.

Fields was arrested after fleeing the scene and has been in jail ever since.

The 20-year-old had traveled from Maumee, Ohio to Charlottesville to attend the rally. Fields, who has a documented history of attending white supremacist rallies and posting neo-Nazi slogans to his Facebook page, was initially charged with second-degree murder, but on Thursday, Judge Robert Downer upgraded that to first-degree murder and confirmed nine other charges.

First-degree murder requires proof that the crime was premeditated, which can be just moments before the incident takes place. Second-degree murder requires malice in intent, but does not involve premeditation or planning.

Fields was in cuffs and said nothing during the preliminary court hearing, according to CBS 19. Heyer’s mother, Susan Bro, was also in the courtroom, as were many victims.

During the court hearing, videos of Fields’ Charger driving into the crowd and the chase afterward were shown, CBS 19 reported. In one video, people could be seen flying into the air after being hit.

A detective was asked by Field’s attorney, Denise Lunsford, to recall that the suspect cried and sobbed when he learned someone had died in the accident. She also noted that Field asked that any ambulance that would be called for him be sent instead to aid the victims of the collision, CBS 19 reported.

The case is scheduled to go to a grand jury on Dec. 18.

(Reuters) – A white nationalist accused of killing a 32-year old woman when he plowed his car into a crowd of counter protesters in Charlottesville, Virginia, in August, was charged with first-degree murder on Thursday, local media reported.

James Fields Jr., 20, appeared at Charlottesville District Court for a preliminary hearing, during which a previous charge of second degree murder was changed to first degree murder, local TV station WSET and others reported from the court.

Fields would face up to life in prison if convicted of first degree murder, while second degree murder carries a penalty of five to 40 years in prison, according to the Virginia penal code.

Court officials and the local district attorney were not immediately available for comment.

Ohio-native Fields is suspected of killing Heather Heyer and injuring 19 people.

The incident took place amid clashes between hundreds of white supremacists and counter-protesters. After hours of clashes, a sedan driving at high speed plowed into the crowd before reversing along the same street.

Charlottesville is home to the University of Virginia’s flagship campus.

Virginia Governor Terry McAuliffe blamed neo-Nazis for sparking the unrest in the town, where rival groups fought pitched battles using rocks and pepper spray after far-right protesters converged to demonstrate against a plan to remove a statue of a Confederate war hero.

After the rally, Republican President Donald Trump inflamed tensions by saying there were “very fine people” on both sides, drawing condemnation from some Republican leaders and praise from white supremacists.

The city of Charlottesville has denied permits for white nationalist and left-wing groups seeking to commemorate the Unite the Right rally in which white nationalists faced off with counter-protesters before a fatal vehicle attack.

In an email obtained by the Daily Progress, city spokeswoman Miriam Dickler said the authorities are refusing five different applications for events in and around Emancipation Park, where counter-protesters confronted white nationalists on August 12.

The letter, signed by City Manager Maurice Jones, says the applications for permits on the weekend of August 11 and 12, 2018, are being denied on the grounds of protecting public safety. “The proposed demonstration or special event presents a danger to public safety and it cannot be accommodated within a reasonable allocation of city funds and/or police resources,” the notices read.

White nationalist Jason Kessler, who submitted the first of the five applications on November 27, said he plans to sue the city “early next year” and proceed with the rally even if he fails to obtain permits.

“Communist government of Charlottesville denies permits for multiple right-wing rallies including the Unite the Right Anniversary Rally. BUT WE WON’T BE STOPPED,” Kessler wrote on Twitter.

Charlottesville authorities also denied permits to demonstrate in Emancipation Park to Walter Heinecke, a professor at the University of Virginia, and Bob Fenwick, a member of the Charlottesville City Council – both of whom oppose Kessler’s white nationalist agenda. Heinecke and Brian Lambert, an ally of Kessler, submitted applications for rallies in nearby Justice and McGuffey parks. Those were denied too.

Last August, white nationalists flocked to Charlottesville under the banner of “Unite the Right” to protest the city’s planned removal of a statue of Confederate General Robert E. Lee from Emancipation Park. Hundreds of counter-protesters came to challenge them. At the August 12 rally, police largely looked on as physical altercations took place in the park and adjacent streets. Police then declared an unlawful assembly and forced the two sides back together, resulting in more violence.

As the crowds dispersed, counter-protesters celebrated in the streets. White nationalist James Fields then drove his vehicle into a crowd of people, killing 32-year-old Heather Heyer and injuring 19 others.

The night before, white nationalists conducted a torch-lit marched through the University of Virginia campus and chanted “Jew will not replace us” and the Nazi slogan “Blood and soil.”

A third-party review released earlier this month found that police and government officials failed to ensure public safety and protect free speech. “The city was unable to protect the right of free expression and facilitate the permit holder’s offensive speech,” said the report.

Study blames police for ‘disastrous results’ in Charlottesville violence https://briefnews.eu/study-blames-police-for-disastrous-results-in-charlottesville-violence/ https://briefnews.eu/study-blames-police-for-disastrous-results-in-charlottesville-violence/#respond Fri, 01 Dec 2017 23:01:22 +0000 http://briefnews.eu/study-blames-police-for-disastrous-results-in-charlottesville-violence/ Police and government officials failed to ensure public safety and protect free speech during a white nationalist rally in Charlottesville, Virginia in August, an independent review concluded. An anti-fascist protester was killed after the rally.

“The city was unable to protect the right of free expression and facilitate the permit holder’s offensive speech,” said the report, published Friday. Commissioned by Charlottesville officials following criticism of authorities’ handling of the events, it was conducted by Hunton and Williams law firm and led by former US attorney Timothy Heaphy.

Sparked by the city’s plan to remove a statue of Confederate General Robert E. Lee from Emancipation Park, white nationalists flocked from around the country to protest the decision under the banner “Unite the Right.” Hundreds of anti-fascist counter protesters came to Charlottesville to challenge them. At the August 12 rally, police stood idly by as physical altercations took place in the park and adjacent streets. Police then declared an unlawful assembly and forced the two sides back together, resulting in more violence.

While clashes were at their peak, Charlottesville Police Department (CPD) “commanders pulled officers back to a protected area of the park, where they remained for over an hour,” the report says. “Because of their misalignment and lack of accessible protective gear, officers failed to intervene in physical altercations that took place in areas adjacent to Emancipation Park.”

“Despite clear evidence of violence, police consistently failed to intervene, de-escalate, or otherwise respond,” the report said. “These shortcomings contributed to a chaotic series of events that led to violence and death.”

As the crowds dispersed, counter protesters celebrated in the streets. White nationalist James Fields then drove his vehicle into a crowd of counter protesters, killing 32-year-old Heather Heyer and injuring 19 others.

The report faulted the CPD, Virginia State Police, and local and state officials. Prior to the rally, city officials attempted to move the rally from Emancipation Park, where a federal judge allowed the white nationalist to assemble. This further compounded the efforts of law enforcement officials, whose planning is described in the report as “inadequate and disconnected.”

City and state police did not coordinate their efforts, the report said, adding that police were not adequately trained.

“This represents a failure of one of the government’s core functions – the protection of fundamental rights,” the report said. “Law enforcement also failed to maintain order and protect citizens from harm, injury, and death.”

Police and emergency responders should follow nationally recognized procedures for responding to large protests and enforce separation of conflicting groups, the report recommended. Lawmakers at the city and state level should “explicitly codify the prohibition of certain objects” – referring to the bats, weapons and shields protesters brought. Finally, the reports recommends police and local officials should work to “restore confidence in the government” through community engagement.

Charlottesville authorities declined to respond to the study, Reuters reported. The city council is scheduled to hold a public hearing on the review on Monday, according the The Daily Progress.

Charlottesville is suing to keep out militias and armed white nationalists https://briefnews.eu/charlottesville-is-suing-to-keep-out-militias-and-armed-white-nationalists/ https://briefnews.eu/charlottesville-is-suing-to-keep-out-militias-and-armed-white-nationalists/#respond Sat, 14 Oct 2017 00:21:09 +0000 http://briefnews.eu/charlottesville-is-suing-to-keep-out-militias-and-armed-white-nationalists/ FILE PHOTO: A photograph of Charlottesville victim Heather Heyer is seen amongst flowers left at the scene of the car attack on a group of counter-protesters that took her life during the Thomson Reuters

Americans were shocked by more than the hate speech at a Unite the Right demonstration in the university town of Charlottesville, Virginia, this August.

Also unsettling for many was the sight of the fatigue-wearing men carrying AR-15 rifles who descended on the city to form protective perimeters around the white nationalists for the stated purpose of protecting the protesters’ free speech.

Governor Terry McAuliffe later claimed that police held back from intervening in the clashes that ensued, and left one dead, for fear of sparking a confrontation with the militias.

Now, after torch-carrying racists marched once more in Charlottesville earlier this month and the well-known white nationalist Richard Spencer vowed more demonstrations there, the city is asking courts to stop the groups from coming back.

A lawsuit filed today argues that gun-toting militias, organized hate groups sporting weapons, and the leftist self-defense organizations who squared off against both all constituted paramilitary organizations, which are banned by the state. It cites three different laws — one in the Virginia state Constitution, along with two parts of the state criminal code — that specifically bar unregulated militia activity.

In addition to those state laws, the city is invoking Supreme Court precedent, including a 1982 case pitting a group of Vietnamese fisherman against members of the Ku Klux Klan in Texas, whose members had terrified the immigrants. In that ruling, the high court held that “the proliferation of private military organizations threatens to result in lawlessness and destructive chaos.”

Through the suit, Charlottesville asks the court to prevent the return of the militias and hate groups. “Without such relief,” the plaintiffs claim, “Charlottesville will be forced to relive the frightful spectacle of August 12: an invasion of roving paramilitary bands and unaccountable vigilante peacekeepers.”

The plaintiffs, which also include various Charlottesville businesses, allege that the behavior of the militias and hate groups was not speech protected by the First Amendment or self defense protected by the Second Amendment, but rather an attempt to intimidate and violently harass others:

“These vigilante militia members (Militia Defendants) carried assault rifles as they patrolled the sidewalks in combat boots, military-grade body armor, and, in most cases, camouflage uniforms. They were equipped to inflict massive harm upon a moment’s notice from their commanders. Whatever their stated intentions, these groups terrified local residents and caused attendees to mistake them for authorized military personnel. In reality, they answered to no governmental authority, and their activity draws no support from the Second Amendment, which protects an individual right to self-defense and extols the virtues of a ‘well regulated Militia,’ while creating no right to form unregulated private armies or private peacekeeping forces.”

The suit may be the first of its kind in decades. Mark Pitcavage, an expert on extremism with the Anti-Defamation League, wrote on Twitter, it was “to my knowledge the first use of such a lawsuit since the early 1980s.”

In addition to the complaints against self-designated militias like the Three Percenters, the suit alleges that the white-nationalist groups at the center of the August 12 rally also acted not as lawful demonstrators, but as private military organizations, clad in uniforms of polos and khakis and equipped with shields and melee weapons.

The city’s argument zeros in on the white nationalists’ extensive preparations for combat:

“Several white-nationalist organizations came to Charlottesville to fight. Applying techniques developed well in advance, affiliated bands of alt-right warriors used clubs, flagpoles, and shields to batter their ideological opponents. Sporting matching uniforms and weaponry — and with command structures to coordinate their actions—they functioned as paramilitary units. These paramilitary organizations and their leaders (the Alt-Right Defendants) wielded their weapons on August 12 not “as individuals” exercising their Second Amendment rights to self defense, but “as members of a fighting force.”

If successful, the suit could provide a model for other cities beyond Virginia wishing to keep protests free of guns. Before the August rally, a state pre-emption law that prevents localities from making their own gun regulations blocked Charlottesville from prohibiting firearms at the event. As The Trace reported in August, Virginia is one of 36 states where laws require cities to allow guns in some form at protests.

But 28 additional states also, like Virginia, have another set of laws allowing governments to regulate unauthorized military groups, according to an analysis by attorneys at Everytown for Gun Safety, a donor to The Trace.

That means that even though cities in many states may not be able to implement blanket bans on gun-carrying protesters, they may be able to take action against the organized, heavily armed groups whose presence may chill the speech of counter protesters, terrorize bystanders, and inhibit law enforcement’s ability to keep confrontations from spiraling out of control.

Pitcavage noted that it is hard to judge the strength of all the suit’s allegations. Militias have kept to themselves for the last several decades, and have rarely ventured into crowded towns and cities. Until the Trump era, cities now contending with white nationalists and armed extremists had little need to enforce the laws that Charlottesville’s suit will test.

A small group of white nationalists led by Richard Spencer marched through the University of Virginia campus in Charlottesville on Saturday evening, local media outlets reported.

The group, carrying the same tiki torches they held in the now-infamous August rally, chanted “you will not replace us” and “we will be back” in front of the Robert E. Lee statue that the city plans to remove.

The rally lasted just 20 minutes, CBS affiliate WTVR reported.

“It was a planned flash mob,” Spencer told The Washington Post, calling the event a “great success” and adding that the rally had been planned for a long time. “We wanted to prove that we came in peace in May, we came in peace in August, and we come again in peace.”

He continued: “Our identity matters. We are not going to stand by and allow people to tear down these symbols of our history and our people — and we’re going to do this again.”

The rally comes nearly two months after the “Unite the Right” rally, which drew scores of white nationalists, white supremacists, and neo-Nazis, as well as counter-protesters. The event turned deadly when a driver plowed into a crowd of pedestrians, killing 32-year-old Heather Heyer.

Paul GosarVice News

A Republican congressman from Arizona suggested that a white supremacist rally in Charlottesville, Virginia in August was organized by an “Obama sympathizer” and backed by financier George Soros in an interview that aired Thursday evening.

Rep. Paul Gosar told Vice News that the Antifa group — short for anti-fascist — was responsible for the outbreak of violence in Charlottesville.

“Because let’s look at the person that actually started the rally,” Gosar said. “It’s come to our attention that this is a person from Occupy Wall Street that was an Obama sympathizer.”

Jason Kessler, the leader of “Unite the Right,” the group that organized the rally, admitted he did vote for President Barack Obama and had attended an Occupy Wall Street rally, though his views have since become more extremist and racist. The Southern Poverty Law Center outlined Kessler’s rightward shift, which began in 2013 after he was angered when a PR executive was publicly excoriated and fired over a racist tweet.

The rally in Charlottesville, which left a 32-year old woman dead and multiple injured, broke out after white nationalists held a torchlight vigil to protest the removal of a statue of Confederate Gen. Robert E. Lee from a park in the town, and were met by a large group of counterprotestors.

Gosar further suggested that George Soros, a billionaire Democratic donor, had provided financial backing to the Charlottesville rally organizers as some sort of subversive attempt to discredit the white nationalist groups. This theory has been widely debunked.

“You know, you know George Soros is one of those people that actually helps back these individuals. Who is he? I think he’s from Hungary. I think he was Jewish. And I think he turned in his own people to the Nazis,” Gosar said.

“Better be careful where we go with those,” he added.

Soros, who is Jewish and was only 13 years old when Nazi Germany occupied Hungary, has frequently been cast as a scapegoat by conspiracy-minded public figures on the right, including Alex Jones of Infowars.

Congress has passed a joint resolution “condemning the violence and domestic terrorist attack” in Charlottesville, Virginia, in early August, and urging President Donald Trump and his administration to combat white supremacist groups.

The bill now heads to Trump’s desk to sign, after it passed the House unanimously on Tuesday evening. The Senate also passed the resolution unanimously on Monday night.

The resolution, which rejects “White nationalists, White supremacists, the Ku Klux Klan, neo-Nazis, and other hate groups,” urges Trump and his cabinet “to use all available resources to address the threats posed by those groups.” It also calls on the president and his administration to “speak out against hate groups that espouse racism, extremism, xenophobia, anti-Semitism, and White supremacy.” Trump has received widespread criticism for his failure to fully denounce the groups following the deadly clashes in Charlottesville.

Additionally, the bill urges Attorney General Jeff Sessions to work with the Department of Homeland Security to investigate hate crimes and “improve” reporting.

The resolution specifically expresses support for the two state police officers who died in a helicopter crash while responding to the violence, and offers “deepest condolences to the families and friends of those individuals who were killed and deepest sympathies and support to those individuals who were injured by the violence.” In addition to the police officers, the resolution specifically recognizes 32-year-old Heather Heyer, who was killed when a car rammed into a group of people protesting racism at the rally.

Sen. Mark Warner, who represents Virginia, urged Trump to sign the resolution after it passed the House Tuesday night.
