Lawyers representing Dominion Voting Systems is now asking producers for Tucker Carlson to sit for depositions in their sprawling $ 1.6 billion election defamation lawsuit against Fox News.
According to a series of filings this week, Dominion has asked Justin Wells, Eldad Yaron, Alex Pfieffer, producers for Tucker Carlson, as well as John Fawcett, a former associate producer for former Fox host Lou Dobbs to sit for depositions by the end of September.
On March 26, 2021, Dominion filed a defamation lawsuit against Fox News seeking $ 1.6 billion in damages, claiming that the network gave prominence to the election-fraud claims as a tactic to revive viewership as ratings dropped after President Donald Trump's loss.
Dominion manufactures and sells electronic voting hardware, software, and voting machines, and was repeatedly targeted with conspiracies in the wake of the 2020 election.
And in the company's lawsuit, Dominion claimed that Fox News "sold a false story of election fraud in order to serve its own commercial purposes, severely injuring Dominion in the process."
Two months later, Fox News filed to dismiss the motion, and by December 2021, a judge had rejected Fox's motion.
"We are confident we will prevail as freedom of the press is foundational to our democracy and must be protected, in addition to the damages claims being outrageous, unsupported and not rooted in sound financial analysis, serving as nothing more than a flagrant attempt to deter our journalists from doing their jobs," a spokesperson for Fox News told Insider in a statement.
Attorneys for Fox News did not immediately return Insider's request for comment.
The case is set to go to trial in April 2023, and the voting company will aim to use key testimonies from the producers to build its case.
In June, Delaware Superior Court Judge Eric M. Davis ruled that Dominion's lawsuit could move forward including claims against Fox Corporation, Fox News's parent company run by Rupert and Lachlan Murdoch.
Davis argued that Fox News's parent company Fox Corporation could also be found to be liable for pushing and directing the campaign of election lies, particularly after Fox News called Arizona for Joe Biden and as the network sought to regain lost viewers from right-wing channels like Newsmax and One America News Network.
In February 2021, another voting systems company, Smartmatic, filed a defamation lawsuit against Fox News, Sidney Powell, Rudy Giuliani, and current and former hosts, which is moving forward in New York.

It didn’t take long for Tucker Carlson to go after Kamala Harris: The Fox News host repeatedly mispronounced the Democratic VP candidate’s name on Tuesday’s show, and later shrugged it off when a guest tried to point out his mistake.
Carlson referred to Harris — who was chosen to be Democratic presidential candidate Joe Biden’s running mate earlier on Tuesday — as “Ka-MAL-a,” emphasizing the second syllable, when it’s pronounced “KAM-a-la,” with the emphasis on the first syllable. Carlson’s guest, Democratic political consultant Richard Goodstein, interrupted to tell Carlson how her name is pronounced, and Carlson responded with a scoff: “OK… so what?”
“I think out of respect for someone who’s going to be on the national ticket, pronouncing her name right is kind of a bare minimum,” Goodstein replied, and Carlson laughed: “So I’m disrespecting her by mispronouncing her intentionally? So it begins. You’re not allowed to criticize Ka-MAL-a Harris, or KAM-a-la… Look, I unintentionally mispronounced her name, but I love the idea that she’s immune from criticism. So let me restate my question, because on this show, nobody in power is immune from criticism.” (For the record, Carlson did continue to mispronounce Harris’ name later in the show.)

Tucker Carlson on Monday night shared his thoughts on the resignation of Blake Neff, his Fox News program’s top writer, who was revealed to have penned racist and sexist messages using a pseudonym.
“What Blake wrote anonymously was wrong,” Carlson said towards the end of the hour on Monday. “We don’t endorse those words. They have no connection to the show.” He acknowledged that Blake “fell short” of the standards of human decency, “and he has paid a heavy price for that.”
Carlson then directed his ire to the “ghouls now beating their chest in triumph.” To those celebrating Neff’s exit, Carlson said, “righteousness also has its costs. When we pose as blameless in order to hurt other people, we are committing the gravest sin of all.”
He then announced that he will be going on a pre-planned vacation. Watch the embattled anchor’s full address below:
A Fox News rep told CNN Business that Neff resigned on July 10 from Tucker Carlson Tonight, after an investigation revealed that Neff had been posting on AutoAdmit, a message board notorious for vulgar and offensive content. As “CharlesXII,” Neff made a series of brazenly racist comments, including a June 5 post that read: “Black doods staying inside playing Call of Duty is probably one of the biggest factors keeping crime down.” He also wrote that he “wouldn’t get LASIK from an Asian for free” and commented that “given how tired black people always claim to be, maybe the real crisis is their lack of sleep.”
Previously a reporter at conservative outlet The Daily Caller, Neff worked for Fox News for four years and was considered Carlson’s top writer. (As Neff once told a Dartmouth alumni magazine, “anything [Carlson is] reading off the teleprompter, the first draft was written by me.”)
Fox News CEO Suzanne Scott and president/executive editor Jay Wallace confirmed in a statement that Neff “made horrendous and deeply offensive racist, sexist and homophobic comments,” adding: “We want to make abundantly clear that FOX News Media strongly condemns this horrific racist, misogynistic and homophobic behavior…. [A]ctions such as his cannot and will not be tolerated at any time in any part of our workforce”
Carlson himself attracted controversy in March 2019, when comments he made years prior on the Bubba the Love Sponge shock jock radio program resurfaced. There, Carlson described women as “very primitive,” called Martha Stewart’s daughter Alexis “c–ty,” and dubbed Britney Spears and Paris Hilton “the biggest white whores in America.” He also said on the call-in program that “Iraq is a crappy place filled with… semi-literate primitive monkeys.”
Carlson did not apologize for those years-old comments but instead dismissed the hubbub as “liberal hypocrisy,” asserting that he and Fox News “will never bow to the mob, ever, no matter what.” And despite all that and more since, Tucker Carlson Tonight is the top-rated program on all of cable news, averaging a record 4.3 million total viewers last quarter.

Fox News Channel’s Tucker Carlson is choosing to forego “the usual contrition” after audio surfaced of him making offensive remarks during a radio call-ins from years ago.
During call-ins to the Bubble the Love Sponge shock jock radio program, which took place between 2006 and 2011 and were brought to light on Sunday by Media Matters — an organization that “pushes back on right-wing misinformation, hypocrisy and smears” — Carlson refers to Martha Stewart’s daughter, Alexis Stewart, as “c–ty”; calls Arianna Huffington a “pig”; and labels Britney Spears and Paris Hilton “the biggest white whores in America.”
Carlson also says that women are “extremely primitive” and enjoy being told to “be quiet and kind of do what you’re told.”
He also minimizes the crimes of then-Most Wanted fugitive Warren Jeffs, who arranged illegal marriages between his adult male followers in the FLDS Church and underage girls in Utah. “[A]rranging a marriage between a 16-year-old and a 27-year-old is not the same as pulling a stranger off the street and raping her,” he says on the tape. “That’s bullsh–t.”
Hours after the audio surfaced, Carlson said on Twitter that he would forego the apology that public figures confronted with past indiscretions typically offer up. Instead, he invited anyone who disagrees with his views as expressed these days on TV to come challenge him on Tucker Carlson Tonight.

Whereas liberal claims of Trump’s incompetence and lack of understanding are nearly inescapable in much of the media, the Fox News star’s recent comments came as a surprise to many, given his network’s overwhelming support for the president. Despite his own conservative convictions and previous support, Tucker did not pull any punches when asked about Trump by an interviewer from Switzerland’s Die Weltwoche.
When asked if Trump had met his campaign promises, Tucker responded with a resounding no:
His chief promises were that he would build the wall, de-fund planned parenthood, and repeal Obamacare, and he hasn’t done any of those things.
Trump has no fundamental understanding of how “the system” works, Carlson argued: “He knows very little about the legislative process, hasn’t learned anything, hasn’t surrounded himself with people that can get it done.”
Carlson was surprisingly unreserved on the topic given that his recent book “Ship of Fools”, mostly avoids criticizing the president directly, focusing its attacks on Trump’s liberal critics.
Tucker addressed a question about Trump’s “populism” in a way surprisingly reminiscent of the anti-Trump forces his book criticizes, describing the anti-elite political phenomena as what happens “when your leaders fail” opening the door for politicians like Trump to take power. The problem, in Carlson’s perspective, is not that America has a ‘ruling class’ (of which Carlson himself never shys from claiming membership) but the fact that this class has been disconnected from the interests and perspectives of ordinary people; Trump is merely a “symptom” of this broader issue.
Carlson expressed skepticism regarding the prospect of a revolution in the United States, joking that “Testosterone levels are so low and marijuana use is so high” that Americans are as incapable as Trump in effecting major change. Carlson instead was hopeful about the prospect of the “slow self-segregation” of states and races polarized in contemporary America.
While Tucker was certainly more pointed with his words about Trump that usual, this is not the first time the Fox star has criticized the president: he described Trump’s attack on Jeff Sessions after his recusal a “useless self-destructive act”. His book also suggests that Trump’s election had much more to do with middle-class rage than the president himself.
Not all of Carlson’s comments about the President were totally negative, however. He did say that Trump had played an important role in creating a nation conversation about “what actually matters”, such as the United States’ critical immigration problems, and why NATO still exists 27 years after the end of the Soviet Union.

Carlson’s show boasts some of the highest ratings on Fox, and pulls an average audience of nearly 3 million viewers, according to Forbes. He has often been criticized for his support of Trump and racial politics. His views on immigration even led to a siege on his house by an antifa mob last month.

Avenatti has posted a video clip of the incident on Twitter, saying he is investigating “an alleged assault on a gay latino immigrant committed by T.Carlson and/or member of his inner circle” at a Virginia County club in October.
The video starts with the heated argument between Carlson, his entourage and a man seated at the bar already in full swing. “You need to get the f*ck out of here,” Carlson can be heard saying repeatedly with the man responding: “I won’t do that. I’m not going to get out of here.” While Carlson’s companions seem agitated, the Fox host himself maintains relative composure throughout the video and is not seen physically assaulting the other man.
After a bit of tense verbal back-and-forth, one of Carlson’s support men grabs the alleged Latino immigrant, forcing him to stand up. As the situation escalates, calls can be heard in the background saying “there’s no need for violence” and “guys, stop”. The video, which is less than a minute long, cuts there.
There’s no hint in the clip as to what might have caused Carlson to confront the man in the first place. The video, boosted by Avenatti, has racked up over 25,000 views on YouTube in mere hours.
In a lengthy response reported by the Hill, Carlson insists that the verbal fight between him and the Latino man, identified by witnesses as Juan, started after the man called Carlson’s 19-year-old daughter derogatory names.
It’s not like Carlson didn’t want to get physical, he admitted, saying it took him “enormous self-control not to beat the man which a chair.”“But I restrained myself. I did not assault this man, and neither did my son,” he said.
In the end, the club investigated the incident and revoked the Latino man’s membership, Carlson says.
Avenatti, who made headlines representing porn actress Stormy Daniels in a case against US President Donald Trump, says that Carlson’s version is an “absolute lie.” In a tweet storm on Saturday evening, he doubled down on his allegations that Carlson had committed assault, claiming that Juan “never admitted” to calling Carlson’s daughter those names.
“You are the aggressor in the video as is your friend. The man at the bar sits there calmly. Numerous witnesses contradict your claim of innocence,” Avenatti tweeted. He cited two unnamed witnesses to corroborate his take on what happened in the bar that night.
2/3 – and battery (on video). You are the aggressor in the video as is your friend. The man at the bar sits there calmly. Numerous witnesses contradict your claim of innocence. Your daughter was drinking underage in a bar with your assistance and knowledge. You were intoxicated.

One of the witnesses claimed that Juan did not speak to either of Carlson’s children before the host’s son approached him allegedly screaming “That man called my sister a C*** and Wh***, she is only 19 years old!” Carlson junior, according to the witness, poured his glass of wine on the man’s head from behind. The man then responded in kind, throwing his own glass of wine at Carlson’s son, which he is remorseful for, the witness said.
These are from one of the eyewitness stmts that completely undercuts the lies Tucker Carlson is now telling in connection with his bigotry directed at Juan, a gay Latino immigrant. Tucker’s conduct is not only illegal, it is also disgraceful. pic.twitter.com/PqQINUUjVO

Another “witness” cited by Avenatti didn’t actually see what happened, but claimed to know Juan as a “pillar of the Charlottesville community, involved in many charities..including being on the board of the Women’s Initiative,” arguing it was completely out of character for him to lash out at a woman like that.
Other excerpts from yet another eyewitness stmt that also shows Tucker Carlson is lying about what happened. He should be immediately disciplined for his conduct. pic.twitter.com/tdF1QnRLPD

After the attorney Michael Avenatti said he was investigating a claim that the Fox News host Tucker Carlson “assaulted” a “gay Latino immigrant,” Carlson responded in a statement to Business Insider that he did not assault the man and that the individual called his 19-year-old daughter a “w—-.”
The incident in question occurred last month at a country club in Virginia. In a video Avenatti attached to his tweet announcing his investigation, Carlson appears to be telling another man to “get the f–k out of here” while others seem to be trying to get Carlson and others in the room to calm down.See the rest of the story at Business Insider

Lyz Lenz on Tucker Carlson.
Once upon a time, Tucker Carlson was considered one of the “intellectual conservatives” — a smart, thoughtful guy who leaned right but was nonetheless tight with his prose and sharp with his wit. Now he hosts what amounts to a White Power Variety Hour on Fox News. What happened? At the Columbia Journalism Review, Lyz Lenz tackles this question, with a cynical but straightforward approach that should serve as a guide to journalists reporting on these, ahem, “provocative” figures.
So is he a racist? “My god, I’m not a racist. I hate racism. Tell me how.”
He kept going, mimicking the debate he believes his accusers/liberals/me are having about him. “It’s like ‘Oh, creepy people like your show. Therefore, you shouldn’t have a show.’ What? How could you go along with that? I don’t understand. Like, that’s the lowest form…that’s so contemptible. And it’s, it’s amazing to me that that kind of goes on uniformly. Shut up. You’re a bad person. Go away. You’re fired now. What? Tell me what he did wrong. Speak slowly so that I can understand. What did he say that’s untrue? What did he say that’s not allowed? What’s the right position? Why don’t you explain it to me? Shut up, Nazi.”
His publicist calls after our interview to make sure I know that Carlson is not a racist.
Alison Willmore on John Krasinski.
In a masterful analysis of Krasinski’s metamorphosis from smirking Office nice guy to buffed-out, red state action star, Buzzfeed’s Willmore looks at how the actor (and sometimes director) works in, and promoted, his films 13 Hours and A Quiet Place and his new Amazon series Jack Ryan, and comes up with some fascinating conclusions.
Krasinski has sidestepped readings of A Quiet Place as a metaphor for the country’s political turmoil, telling the Hollywood Reporter, “That’s not what I was going for, but the best compliment you can get on any movie is that it starts a conversation.” When preparing for Jack Ryan, which starts with his character working as a mid-level CIA analyst, Krasinski shared some similar-sounding observations with Entertainment Weekly regarding getting to go to the actual agency: “I was blown away by a lot of things with the CIA — how incredibly diverse the place was and how apolitical. There was no politics being discussed, it was about objectives of protecting people and getting to the truth of the matter, which I thought was really interesting.” On one hand, you can’t blame the actor for wanting to avoid quotes that could possibly be lifted out, aggregated, and result in him dealing with a news cycle and the now-standard round of anger and apologies. On the other, presenting the CIA or a movie about Benghazi as somehow existing separately from politics is either a willfully oblivious or astonishingly convenient way to see the world.
Krasinski is too smart to believe that things are only political when actual politicians are invoked (which was one of the defenses of 13 Hours — that it couldn’t be political, because Hillary Clinton wasn’t mentioned by name). It’s more likely that he is simply opting out of engaging with the optics of the choices he’s making because he doesn’t feel he has to acknowledge them. It’s awfully advantageous to not see politics even when, say, starring in a story about one of the most divisive and politicized events in recent history. It’s a selective sight that allows him to be adjacent to potentially inflammatory choices while ankling any responsibility to address them himself.
Lara Zarum on The Deuce.
Flavorwire alum Zarum, one of the best damn TV writers in the game, was (much to this fan and friend’s chagrin) hit by the recent folding of The Village Voice. But on her way out the door, she filed this review of the new season of one of the finest shows on television.
Like GLOW — and Mad Men — The Deuce is a show about how things used to be, but it’s also, inadvertently, a show about how little things have changed. The number of women directors working in Hollywood today compared to men continues to be dismal; exploiting or harassing women at work continues to yield few consequences for men. (Including James Franco, an executive producer of The Deuce, whom five women accused of “inappropriate or sexually exploitative behavior,” as reported by the Los Angeles Times back in January.)
And, like those other series, The Deuce suggests that systemic barriers keeping women from achieving their full potential at work are relics of the past. The show’s writers are not totally blind to this irony; in one scene, at a porn awards ceremony in L.A., the camera catches a woman describing a film to her companion: “It’s a parody of Westworld, but instead of cowboys and Indians, it’s sex robots.” She’s referring to the 1973 movie Westworld, but this porn version suggests the series you can catch on Sunday nights on HBO.
Dave Eggers and Shawn Harris ask, “What Can A Citizen Do?”
And finally, a special Friday treat: a few images from What Can A Citizen Do?, a new picture book from Chronicle Books in which Eggers and Harris ask what citizenship – good citizenship – means to us all. Eggers was prompted to create the book, he tells Flavorwire, by the same things that have pushed so many of us into action over the past couple of years:
For some reason, in the fall of 2016, civics was on my mind. I don’t know why. But it occurred to me that fall and winter that as a nation we had largely forgotten what it meant to meaningfully participate in a democracy. Right or left, it was the same thing, really — different forms of apathy, rage, and self-interest. So one way I thought to address that would be to speak to the very young, kids under 10, who might appreciate a rhyming book that might insinuate radical ideas about society to them — ideas like notion that we’re better off when we work together with a shared vision than we are when we act from a place of fear, solipsism or entrenchment. That said, the book is really supposed to be kind of fun, too. There are ideas about community and democracy there, but there’s also a bear wearing a dress.
Here’s a quick peek at What Can A Citizen Do?, which hits bookshelves on Tuesday.
