Sears, which invented the strategy of selling everything anyone with a mailing address long before Amazon, has been mortally wounded by its spiritual successor. After nearly a decade of struggle, the US retailer announced that it has filed for bankruptcy. It entered voluntary Chapter 11 proceedings and plans to close as many as 150 stores in an effort to slash debt and make it through the holidays. Since 2013, Sears has shuttered over 1,000 stores and lost around $ 5.8 billion.

Sears is perhaps best known for distributing catalogs and selling products across America using the US Postal Service. Founded in 1892, it was a US retail juggernaut until the 1990s, when it started facing stiff competition from Walmart, Target and other more agile competitors. In 2004, the company was acquired by hedge fund manager Edward Lampert and merged with K-Mart.

Under Lampert, the company saw a $ 1.5 billion profit in 2015, but it’s been downhill ever since. While losing the retail battle with Walmart, Home Depot and others, it was flanked on another side by Amazon’s rapidly growing e-commerce business. The great recession of 2008 set off a sharp decline that never really stopped, described by one bankruptcy expert as “the slowest-moving train wreck.”

While we have made progress, the plan has yet to deliver the results we have desired, and addressing the company’s immediate liquidity needs has impacted our efforts to become a profitable and more competitive retailer.

In 2008, the company employed 302,000 people, but that figure has fallen to just 68,000, according to the New York Times. It’s last profitable year was 2010, and Lampert has since stripped off and sold much of its land holdings and iconic brands like Craftsman. He recently proposed selling off another $ 3.25 billion in real estate and assets, including Sears Home Services and the flagship Kenmore brand.

“The Chapter 11 process will give [Sears] the flexibility to strengthen its balance sheet … continue right-sizing its operating model, and return to profitability,” Lampert said in a statement. However, turning Sears around, even in a much smaller form, will be a huge challenge. Toys “R” Us, another retail institution that recently failed, tried to reorganize but eventually shut down and laid off all its employees.

Sears downfall could bring a lot of pain. Over 100,000 employees still receive pensions, though regulators might force the company to protect those. Still, there are bound to be more layoffs, and stores that close will leave shopping malls across America without major tenants. It’s also one of the most prominent symbols yet of the death of old-school retail in the US.

  • Applebee’s parent company, Dine Brands, and its second-largest franchisee, RMH Holdings, are battling in court, with Dine Brands attempting to take control of dozens of the franchisee’s restaurants. 
  • RMH controls more than 140 Applebee’s locations and filed for bankruptcy in May, blaming Dine Brands’ “ill-advised and value-destroying” decisions for struggling sales and millions of wasted dollars.
  • The franchisee filed for bankruptcy at 3:30 a.m. on May 8, just hours after Dine Brands’ CEO issued an ultimatum: send $ 12 million in unpaid royalties by the end of the day, or lose your restaurants.
  • Dine Brands claims that RMH owes the company more than $ 23 million in unpaid and lost future royalties and other fees. 

There’s a battle raging within Applebee’s. 

On one side is the chain’s parent company, Dine Brands. On the other is Applebee’s second-largest franchisee, RMH Holdings, which filed for bankruptcy earlier this year — at 3:30 a.m. on Tuesday, May 8, to be exact.

Home retail chain Brookstone has filed for bankruptcy for the second time since 2014 after more than four decades of business. Barring 35 airport locations, all of its US outlets will be shut down.

For many, Brookstone’s exit from the shopping scene may be as bittersweet as when The Sharper Image closed its doors in 2008, or SkyMall’s demise seven years later. Its quirky assemblage of non-essentials — 3D printing pens, Parrot AR Drones and gigantic Dance Dance Revolution remote controls — offered customers a welcome escape from the throes of everyday life, and a chance to buy obscure gifts.

In their heyday, Brookstone’s all-in-one geek boutiques were able to drive significant foot traffic. But intense competition from rivals — often selling cheaper products with the added convenience of online purchases — may have torpedoed any chance of a proper revival. Brookstone CFO Greg Tribou said recent technology shifts in e-commerce triggered data loss which had a “severely damaging” impact upon digital sales.

The Brookstone and Sharper Image aren’t isolated cases in America’s dead mall saga, either. Just this year, we’ve seen Toys ‘R’ Us and Claire’s declare bankruptcy. Bloomberg denies e-commerce companies like Amazon are solely responsible for the retail retreat, pointing out younger crowds prefer experiences and services over material possessions. Brookstone — which now faces a $ 500 million debt — revealed supply chain issues and management turnover also contributed to its closure.

Brookstone’s CEO Piau Phang Foo said it was a ‘difficult’ decision to shut down mall stores, but is still keen to continue operations “with a smaller physical footprint”. So Brookstone hasn’t been completely extinguished from the retail map — you’ll just need to seek out its novelty products online from now on.

Cambridge Analytica LLC, the American arm of the London-based data analytics firm of the same name, filed for bankruptcy in federal court in New York on Friday.

The company submitted a voluntary formal petition for Chapter 7 bankruptcy—liquidation. That document reveals the company has between $ 1 and $ 10 million in debt with very little assets. On May 2, SCL Elections Ltd. and its other British affiliates filed similar “insolvency” documents with UK authorities.

It was revealed last month that a 2014 survey app created at the behest of Cambridge Analytica required Facebook login credentials and provided the survey creator access to their friends’ public profile data. In the end, this system captured data from 87 million Facebook users. This data trove wound up in the hands of Cambridge Analytica, the British data analytics firm, which worked with clients like the Donald Trump presidential campaign.

Other than the Fender Stratocaster, there are few electric guitars more steeped in blues and rock history than the Les Paul. It has famously been played by Eric Clapton, Jimmy Page, and Pete Townshend, among many others. It might seem like cause for alarm, then, that that guitar’s 116-year-old manufacturer, Gibson Guitar Corp., is filing for bankruptcy protection because its additive attempts to make waves in the consumer electronics business have landed it in as much as $ 500 million in debt.

Fortunately, there looks to be a viable path to survival for the Nashville-based company. That path involves liquidating the consumer electronics business, which is the work of a soon-to-be-defunct division called Gibson Innovation. The division’s products have included headphones, speakers, and other audio equipment. If the company’s plan is successful, Les Pauls and other guitars—along with the company’s other professional studio audio equipment products and instruments, like Epiphone guitars and Baldwin pianos—could continue to be sold to future generations of musicians.

Despite Gibson’s historic role in the music industry, chief executive Henry Juszkiewicz (who joined the company to save it from another bankruptcy scare in 1986) sought to turn the company into a “music lifestyle brand” in response to slowing guitar sales, according to a report in The New York Times. That’s where the Innovation division and the tech products came into play. Juszkiewicz also began pushing new technologies like self-tuning guitars which didn’t appeal to musicians who play in styles that are all about tradition. Ultimately, those bets have not paid off.

March was the worst month for the company in seven years, as Tesla’s shares plunged 22 percent in 31 days.

It is unclear whether Musk’s jokes spooked off investors, or if they are just worried about Tesla’s poor performance last month – but the company’s shares dropped over $ 6 (or 2.5 percent) in pre-trading to $ 259.5 per share.

Last week, Moody’s Investors Service downgraded Tesla stock over concerns about Model S production. Tesla also recalled 123,000 Model S vehicles due to problems with the power-steering component, saying it saw “excessive corrosion” in the power-steering bolts of the affected cars.

To add to the company’s problems, Tesla admitted that the car involved in a fatal crash in California last week was operating on Autopilot mode. The company claims the driver’s hands were not detected on the wheel for six seconds prior to the collision, despite warnings from the system. Tesla and Uber are major rivals in the development of driverless cars.

Despite the recent drawbacks, Tesla’s market capitalization is still $ 45 billion, higher than traditional automakers. Investors are beginning to question whether a company that hasn’t managed to turn a profit in its 15 years of existence is overpriced.

“As a reality check, Tesla is worth twice as much as Ford [estimate of the enterprise value of both companies], yet Ford made six million cars last year at a $ 7.6 billion profit, while Tesla made 100,000 cars at a $ 2 billion loss,” Vilas Capital Management head John Thompson told Market Watch last week. According to him, Tesla is months away from collapse.

On Saturday, power corporation FirstEnergy placed its coal and nuclear generation units under chapter 11 bankruptcy. Although coal and nuclear plants across the country have struggled to compete with the low prices of natural gas, FirstEnergy’s filing is unique because it stands to take on a political dimension. Just two days before FirstEnergy’s bankruptcy filing, the company petitioned the Department of Energy (DOE) for an emergency bailout, citing concerns about reliability.

The petition could reinvigorate a debate started by Energy Secretary Rick Perry, who proposed a rule last year to change how coal and nuclear plants are compensated for their power. The rule was denied by the Federal Energy Regulatory Commission (FERC), which said that there was not enough evidence to justify changing how coal and nuclear are compensated.

FirstEnergy disparaged FERC’s decision in its Thursday petition (PDF), claiming that “as a result of FERC’s and the RTO’s [Regional Transmission Organization’s] failure to address this crisis, swift and decisive action is needed now to address this imminent loss of nuclear and coal-fired baseload generation and the threat to the electric grid that this loss poses” (emphasis FirstEnergy’s).

After a $ 500 million deal for an investor group to acquire the embattled film company fell through, The Weinstein Company has filed for bankruptcy.

In the process, The Weinstein Company is canceling its non-disclosure agreements. That means that many women seeking to come forward against disgraced former executive Harvey Weinstein now have freedom to speak.

According to Reuters, The Weinstein Company has officially filed for bankruptcy in a Delaware court.

The company reportedly listed $ 500 million to $ 1 billion in liabilities and $ 500 million to $ 1 billion in assets. The Weinstein Company says that it has already struck a deal with an affiliate of private equity firm Lantern Capital Partners to acquire its assets.

But most importantly, the company released all its employees from NDAs. When the revelations of sexual assault and misconduct about Harvey Weinstein surfaced in late 2017, it was reported that Weinstein used NDAs to silence his victims. Some of the 70 women who accused Weinstein of sexual misconduct, and in some cases rape, had broken their NDAs to go public against the former executive.

But in a gesture of goodwill toward the victims, The Weinstein Company has nullified all its NDAs. The company said in a statement:

“Since October, it has been reported that Harvey Weinstein used non-disclosure agreements as a secret weapon to silence his accusers. Effective immediately, those ‘agreements’ end.”

This Weinstein Company bankruptcy filing comes months after an initial deal was struck with an investor group led by former Obama-era Small Business Administrator Maria Conteras-Sweet to acquire its assets in a $ 500 million deal. But when the deal seemed like it had been finalized, the investor group suddenly pulled out after it “uncovered new information about previous undisclosed liabilities” with the Weinstein Company.

The negotiating process was marred with trouble throughout. Sales talks nearly collapsed in February, with the Weinstein Co. threatening to file for bankruptcy after Contreras-Sweet’s investor group refused to meet its terms. The New York attorney general’s office also sued the Weinstein Company and its co-founders Harvey Weinstein and his brother Bob Weinstein in February when Gen. Eric Schneiderman found issue with the proposed sale and the promised victims fund.

This bankruptcy filing brings an end to the saga that began with the October 2017 revelations of Weinstein’s history of sexual misconduct and harassment. More than 70 women accused Weinstein of sexual harassment, misconduct, and rape. Weinstein has denied the accusations. The executive was fired shortly after the accusations surfaced and an internal investigation was launched into the accusations. But the scandal would send the company into a death spiral, with filmmakers fleeing partnerships with the company and movies dropped from release. Revenue dried up, and the company was forced to put itself up for sale.

Now, The Weinstein Company said in a statement it entered into a “stalking horse” agreement with a Lantern Capital affiliate. Lantern would purchase substantially all of the assets of the company.
