Texas Attorney General Ken Paxton fled his home when faced with a subpoena following a lawsuit by abortion rights groups, according to an affidavit by the man trying to serve it. 

According to the affidavit, first obtained by the Texas Tribune, Paxton escaped in a truck driven by his wife, Texas state Sen. Angela Paxton after the process server, Ernesto Martin Herrera, arrived at his home.

The subpoena required Paxton to give evidence Tuesday in a lawsuit filed by several abortion rights groups, who are seeking protections against legal threats made against them for helping women travel to other states to get abortions.

Texas has enacted tough new restrictions on abortion following the Supreme Court's decision to overturn the Roe v. Wade ruling earlier this year. 

In his affidavit, Herrera said he parked outside Paxton's address on Monday and saw a man he recognized as Paxton. He approached the front door and saw him turn around and walk away when he saw Herrera.

The door was answered by Sen. Paxton, who said her husband was on the phone and in a "hurry to leave."

Herrera said he had already spotted Paxton inside the house, so he went and waited for an hour.

He then saw Paxton emerging from a garage, but when Herrera called out Paxton's name, he "RAN back inside the house," Herrera said in the affidavit.

Shortly after, Sen. Paxton emerged from the property, got into a black truck parked in front of the house, and opened the passenger side back door, at which point "Mr. Paxton ran from the door inside the garage towards the rear door behind the driver side," said Herrera.

The process server added: "I approached the truck, and loudly called him by his name and stated that I had court documents for him. Mr. Paxton ignored me and kept heading for the truck."

Herrera said he left the subpoena documents by the truck, but the Paxtons sped away "leaving the documents on the ground."

Responding on Twitter to media reports about the incident, Paxton, who is is up for re-election in November's mid-terms, said he fled because he feared for his family over a "stranger lingering outside my home."

 

He said: "The media wants to drum up another controversy involving my work as Attorney General, so they're attacking me for having the audacity to avoid a stranger lingering outside my home and showing concern about the safety and well-being of my family."

Rep. Alexandria Ocasio-Cortez's probing questions at a congressional hearing more than three years ago bore legal fruit this week when New York Attorney General Leticia James announced a $ 250 million civil lawsuit against former President Donald Trump — and credited the Democratic lawmaker with sparking the investigation.

The New York attorney general's office announced Wednesday that it had asked federal prosecutors to investigate Trump's business practice regarding possible federal crimes.

The request comes on the heels of James filing a sprawling lawsuit against Trump, his three eldest children, and the Trump Organization, accusing the former president of inflating his net worth and claiming that his business artificially inflated or deflated asset values for tax purposes.

The announcement is the culmination of James' three-year probe into Trump and his New York business empire. But the story of Trump's most recent legal malady begins at a February 2019 congressional hearing — where a then-freshman lawmaker went toe-to-toe with a convicted criminal.

Just one month into her newfound role as a congresswoman, Ocasio-Cortez stole the show at a House Oversight and Reform Committee hearing where Michael Cohen, Trump's former lawyer and fixer, testified publicly against his one-time boss.

Ocasio-Cortez, who sent shockwaves through Washington, DC, the year prior after she unseated a longtime lawmaker in New York's Democratic primary, earned praise for her questions and follow-ups which prompted Cohen to make some enlightening revelations. 

The New York congresswoman probed Cohen about whether Trump had ever provided inflated assets to an insurance company.

Cohen, who was sentenced in 2018 to three years in prison after pleading guilty to charges in two separate investigations, confirmed that the then-president had offered up fraudulent asset information. Cohen also said several Trump Organization executives, including Allen Weisselberg, Ron Lieberman, and Matthew Calamari, were aware of such practices. 

"And where would the committee find more information on this?" Ocasio-Cortez asked. "Do you think we need to review his financial statements and his tax returns in order to compare them?"

"Yes, and you'd find it at the Trump Org," Cohen replied.

 

The New York attorney general this week credited the 2019 exchange with prompting the probe.

"I will remind everyone that this investigation only started after Michael Cohen, the former lawyer, his former lawyer, testified before Congress and shed light on this misconduct," James said.

Trump responded to the New York AG's suit in a statement on Truth Social, accusing James of being a "failed AG" with a "lack of talent." A lawyer for Trump also released a statement, saying James' office is focused neither on "the facts nor the law" and is instead interested in advancing her "political agenda."

State prosecutors in the case are aiming to permanently ban the Trump family from doing business in New York after James said Wednesday that her office believes there is enough evidence in the civil suit to show that Trump and his organization violated federal criminal law.

It's the most recent legal trouble for Trump, who faces a slew of increasing legal troubles, including an FBI probe into how he handled classified materials.

A former US Attorney said the thought of former President Donald Trump being re-elected "frightens me." 

Trump has teased a 2024 run but appears to be holding his announcement until after the midterms in November. Meanwhile, he continues to repeat disproven claims that the 2020 election was stolen.

On NBC's "Meet the Press" on Sunday, former US Attorney for the Southern District of New York Geoffrey Berman said Trump's potential second term would be "dangerous."

"I shudder to think about it. The prospect of a second Trump administration frightens me," Berman said. "All of the dangerous and outrageous things he did as president will be repeated if there's a second administration, except this time, he's going to be more successful in doing that."

Berman added: "And remember, when he was president, he always knew he had to stand for reelection. If there's a second administration, he'll be free of those concerns."

 

After his Mar-A-Lago property was raided for a slew of confidential documents, Trump said on Truth Social that the raid was "one of the most egregious assaults on democracy in the history of our Country," according to The New York Times. At a rally in Youngstown, Ohio this weekend, Trump decried the "unprecedented weaponization of the Justice Department and the FBI," NBC reported. 

Berman – who volunteered for the Trump campaign in 2016, per NBC – expressed frustration about Trump's criticisms of the Justice Department.

"Trump is trying to portray himself somehow as the victim of a politicized Department of Justice," Berman said. "It was under Trump and under Barr that the politicization of the Department of Justice actually occurred. There's no evidence supporting that he was victimized." 

Berman added that it's unlikely that the raid will lead to any indictments of Trump before the midterms. 

"I don't think anything dramatic should be expected prior to the election," Berman said.

Former President Donald Trump lashed out at his one-time ally Bill Barr on Friday after the former attorney general defended the Justice Department's raid on Mar-a-Lago.

"Bill Barr had 'no guts,' and got 'no glory.' He was a weak and pathetic RINO, who was so afraid of being Impeached that he became a captive to the Radical Left Democrats," Trump wrote in a post on his social media site, Truth Social, referring to Barr as a "Republican In Name Only."

"Barr never fought the way he should have for Election Integrity, and so much else. He started off OK as A.G., but faded fast – Didn't have courage or stamina. People like that will never Make America Great Again!" Trump continued. 

In a second post, he also criticized Barr's handling of the Russia probe and the "Laptop from Hell," presumably a reference to Hunter Biden's laptop.

Barr was largely considered a staunch ally of Trump while serving as his attorney general from February 2019 to December 2020. Their relationship changed when Barr came forward to say the Justice Department had found no evidence of widespread voter fraud that would have impacted the election results, directly defying Trump's insistence that the election had been stolen from him. He departed the administration one month before the end of Trump's term.

In an interview with Fox News on Friday, Barr dismissed arguments that the Justice Department's decision to raid Mar-a-Lago was an overstep.

"I personally think, for them to have taken things to the current point, they probably have pretty good evidence, but that's speculation," Barr said.

He also dismissed Trump's defense that he had declassified all the documents that were being held at his Florida club and residence.

"I, frankly, am skeptical of this claim that, 'I declassified everything,' because, frankly, I think it is highly improbable," Barr said. "And, second, if in fact he sort of stood over scores of boxes, not really knowing what was in them, and then said, 'I hereby declassify everything in here' — that would be such an abuse and such recklessness that it's almost worse than taking the documents."

In another interview with The New York Times, Barr also called Trump's request to have a special master, or a court-appointed outsider, to review the documents a "crock of shit."

During the Mar-a-Lago raid on August 8, the FBI seized highly classified documents, according to court records. The Justice Department is investigating potential violations of laws pertaining to the handling of government documents.

It’s all for the 47-year-old attorney who channels their frustration against elitism and the perceived establishment, cultural sands that shift like the mulch beneath their standing ovation.

It is by far the most exuberant reaction to a Senate candidate at the Neshoba County Fair, aka Republican Woodstock. And on this humid day, it is the riotous center of America’s White Christian male aggrievement politics. Their hero, Chris McDaniel, is mounting a campaign that looks less like a candidacy than a crusade. A fight for the soul of the country, sure, but also revenge for an election four years ago he and his supporters thought they had won. He isn’t just taking on the Democrats, but also his fellow Republicans, and even Donald Trump, who’s backing his GOP rival. Surrounded on all sides, McDaniel speaks of decision points and fallen glory, of standing up despite stacked odds and, inevitably, of martyrdom.

Lest you think it’s confined to Mississippi, understand this is the same persecution complex that fuels White nationalists from Portland, Oregon, to Charlottesville, Virginia. It’s four straight years of rising hate crimes in America’s biggest cities, the largest spike coming in San Jose, California, a region that’s also home to a simmering Silicon Valley backlash against the #MeToo movement. It’s fellow U.S. Senate candidate Corey Stewart railing against torn-down Confederate monuments in Virginia, and Fox News host Laura Ingraham decrying a loss of national identity fed by demographic changes “foisted upon” the American people as if non-White citizens were interlopers.

They’re losing — running third in a three-person race, according to the polls. But with McDaniel’s war on liberalism and what he sees as a tepid conservatism, winning isn’t entirely the point. “Now is our time of choosing. Will you be fighters or cowards?” McDaniel asks the crowd. “Many years from now, let them speak of us, of these brave few who stood one last time.”

Militaristic fervor, veneration of the past, forceful fear of an impending future: They are all traits of the politics of modern populism, one that in Mississippi mixes Christian faith with a nostalgic White manifest destiny.

Let’s step back to the two conversion moments in McDaniel’s life. The first was in 1980, when a teenage McDaniel watched a presidential hopeful named Ronald Reagan at the same Neshoba County stage — next to McDaniel’s father, in fact — give a controversial embrace of “states’ rights.” The speech was attacked as a coded appeal to racism, and it was the genesis of the younger McDaniel’s embrace of outsiderism.

The second took place far from any cameras, on the side of a lonesome two-lane Mississippi highway in July 1998, after his father, Carlos, was in a devastating car accident with a tractor-trailer while driving in front of Chris. “I was with him when he died,” McDaniel says, the sound of grinding metal and gruesome groans seared into his mind forever.

Up until that point, McDaniel, 28 years old and only days from his wedding, had lived a life in his father’s image. The younger Reaganite grew up in “The Free State of Jones,” so called because the Mississippi county opposed the Confederacy during the Civil War. He was a 3-point marksman point guard who played basketball at Jones County Junior College, where his father was a well-liked health instructor for more than three decades. He attended William Carey University and the University of Mississippi School of Law, clerked with a U.S. District Court judge and was on his way to becoming a partner at a law firm in his hometown of Laurel, where he still lives today with his wife and three kids. But the accident that summer night shook him, taking away the most important influence of his life. “I was mad at God. I was mad at myself,” the lifelong Southern Baptist says.

As Reagan’s speech had confirmed his political belief, the accident solidified a spiritual second chapter — one in which he resolved to live fearlessly. “I had to come out of that. And when I did, I felt liberated,” he says. He became a conservative radio talk show host in Hattiesburg in 2004, a platform that propelled him in 2007 to a state Senate seat, from which he led bills to curb illegal immigration and allow student-led school prayers. His sway was evident when then-Lt. Gov. Phil Bryant asked the freshman senator to stop a troublesome redistricting bill in its tracks — and McDaniel succeeded. He was named the 2010 Citizen of the Year by the Laurel Leader-Call and a “Rising Star” in the Republican Party by The Clarion-Ledger in Jackson.

Then he had the audacity to challenge seven-term incumbent U.S. Sen. Thad Cochran. While before he was seen as “an articulate spokesman for conservatism,” the establishment turned on McDaniel, says Ryan S. Walters, who wrote a book about the election titled Remember Mississippi. “All of a sudden, he was [portrayed as] a radical, a fanatic, a bomb-thrower,” says Walters, who is now a policy writer for the McDaniel campaign.

In person, McDaniel comes across as reasonable, passionate, doggedly insistent and likable. But his own words condemn him: A married man who talks of unflappable Christian principles, he joked on-air about wanting to learn only enough Spanish to ask for the bathroom and hit on women he called “mamacitas.” In 2014, BuzzFeed surfaced old recordings from McDaniel’s talk show, in which he also decried a “homosexual agenda,” said a female candidate for Alabama governor was using her “breasts” to run for office and proclaimed that “our culture” would be lost if immigration continued.

Despite those revelations, McDaniel managed to beat Cochran by half a percentage point in the first round of primary voting. And here is the beginning of his electoral aggrievement: Since neither candidate reached the 50 percent mark, Mississippi law requires a runoff — and Cochran prevailed, thanks in part to his courting crossover Democrats. McDaniel’s backers unsuccessfully challenged the result in court, accusing Team Cochran of voter fraud, as Democratic primary voters were not allowed to turn around and vote in the GOP runoff. His followers often bring up unsolicited the “stolen” election, rhetoric of a rigged system now commonplace on all sides of the political spectrum.

McDaniel says he learned “where the traps are” from that race. Fueling him now is a super PAC that didn’t exist last time around, also called Remember Mississippi, which had raised nearly $ 1.5 million as of June. Again he’s facing the establishment in Sen. Cindy Hyde-Smith, chosen by the governor to replace Cochran earlier this year after the ailing incumbent retired. The new twist is a credible Democrat in the race: former U.S. Secretary of Agriculture Mike Espy, who would be the state’s first African-American senator. All three will face off on Nov. 6 in a “jungle primary,” with another nationally dissected runoff likely three weeks later. Both Espy and Hyde-Smith declined to comment for this story, with Hyde-Smith declaring she would rather “stay on the high road.”

Trump, who rode a McDaniel-style attitude to the White House, endorsed Hyde-Smith with an August tweet. “I don’t think Trump is against the insurgency candidates. I think [Senate Majority Leader] Mitch McConnell forces him to play the political game. We’re trying to make it possible one day so that he never has to play games with those people again,” McDaniel says. While political gurus believe Hyde-Smith is the much safer bet to beat Espy, the excitement around McDaniel could prove powerful when antiestablishment candidates on all sides of the political spectrum are thriving. An NBC News poll released last week found the trio tightly bunched: Espy at 25 percent, Hyde-Smith at 24 percent and McDaniel at 19 percent.

McDaniel’s campaign stances mimic libertarian-leaning Republicans like Ted Cruz and Rand Paul, often centered on cutting government spending. He generally opposes tariffs but defends a brewing trade war with China and others as Trump using “an ace in the hole” to force a long-term change with short-term tactics. Outside of a small-government philosophy, his focus is mostly cultural. He makes it a point to support the current Mississippi state flag, which his base sees as honoring Southern heritage and which others call racist for its use of the Confederate battle emblem. In August, he started a Twitter debate over whether Gen. Robert E. Lee was misunderstood, arguing incorrectly that Lee was against both secession and slavery — a whitewashing of Civil War history common among Confederate romanticizers.

His most consistent trait is playing the underdog even as the GOP controls most statehouses and every branch of federal government. “That’s my point: Republicans control those seats. Conservatives do not,” he argues. “We have a numerical advantage from a Republican standpoint, but our philosophy has been watered-down now, to the point where we are now a party of pastels.”

And then there’s his faith. Although Christianity remains the dominant force in religion and politics — 70 percent of Americans identify as Christian, while 91 percent of Congress does — many evangelical conservatives feel as if they have lost the war for America’s soul. Pastors warn of a culture becoming increasingly accepting of abortion rights and gay rights. Three-quarters of White evangelicals feel like things have gotten worse since 1950, according to Public Religion Research Institute (PRRI) surveys, while a similar number feel that America will be worse off if projections hold and White people become a minority this century.

“There is real evidence White evangelicals are losing,” says Robert P. Jones, the CEO of PRRI, shifting them from “values” voters to “nostalgia” voters. “They are really animated by trying to turn the clock back to a time where their values on things were more widely shared in the country.”

He’s far from the only one, but McDaniel has made an art form out of taking that feeling of spiritual persecution and converting it into a political force, sprinkling his county fair speech with biblical allusions. In the battle for spiritual and political piety, the actual result matters less than the decision to fight. US President Donald Trump has requested – and received – the resignation of Attorney General Jeff Sessions. The Department of Justice will be led by his chief of staff Matthew Whitaker until a permanent replacement is nominated.

“We thank Attorney General Jeff Sessions for his service, and wish him well!” Trump said on Twitter Wednesday afternoon, after announcing the appointment of Whitaker.

There is a potential problem with Whitaker’s appointment over the head of the current deputy AG Rod Rosenstein, who has been in charge of special counsel Robert Mueller’s investigation into allegations of Trump-Russia “collusion” during the 2016 presidential election. Rosenstein was confirmed to his post by the Senate.

Sessions, a senator from Alabama at the time, joined the Trump campaign early on and was considered a favorite to take over the Department of Justice in the new administration. He was immediately forced to recuse himself from any probes into “Russiagate,” due to his role in the campaign, however.

Since then, Trump has frequently clashed with Sessions over the DOJ’s handling of the Russia probe. The DOJ’s refusal to comply with congressional oversight requests to turn over documents related to the FBI’s spying on the Trump campaign also caused increasing frustration at the White House, prompting the president to declare at one point, “I have no attorney general!”

“I’m not happy at the border, I’m not happy with numerous things,” including the Russia probe, Trump told The Hill in September. “I’m very disappointed in Jeff. Very disappointed.”

Sessions has maintained his loyalty to Trump and the president’s law and order agenda, even in the resignation letter.

With Republicans picking up seats in the Senate in Tuesday’s midterm elections, despite losing a majority in the House of Representatives, Trump was widely expected to reshuffle his Cabinet in the near future, though the speed with which Sessions was ushered out was unexpected in Washington.

Attorney for the Western District of Pennsylvania, Scott Brady, said that he had launched a necessary legal procedure so the prosecutors are able to proceed with the maximum possible penalty in the case of Bowers, who has been charged with 29 criminal counts for the murder of 11 people at the Tree of Life synagogue in Pittsburgh on Saturday.

Brady is seeking authorization from Sessions to pursue with death penalty, AP reported.

Per US law, each federal death penalty case must be authorized by the AG upon consultation with local attorneys. 

Brady said that the investigation has been in full swing and multiple search warrants have been issued as law enforcers aim to unearth all circumstances behind the carnage.

Bowers is set to appear in court for the first time on Monday.

Bowers, 46, entered the synagogue armed with an AR-15 rifle and a Glock pistol during the Saturday service. Before going on the rampage, Bowers posted an anti-Semitic message on social network Gab, popular with right-wing activists, extremist and neo-fascists. Bowers’ feed on Gab was filled with anti-Semitic slurs, as well as insults directed US President Donald Trump, who he believed was surrounded by “too many” Jews. Bowers claimed that he did not vote for Trump.

The synagogue massacre as well as the failed mail bomb plot by Trump supporter Cesar Sayoc, who sent 14 explosive devices – none of which worked – to high-profile Democrats, have further polarized the already volatile pre-midterm environment in the US.

US Rep. Sheila Jackson Lee was caught on video slipping an envelope to Christine Blasey Ford’s attorney during hearings on accusations against the SCOTUS nominee Brett Kavanaugh, triggering a wave of speculation on its contents.

The envelope slip was very brief and quite secretive, yet it did not escape the cameras.

The mysterious transfer prompted speculations on what exactly was inside the envelope, with the leading – and obvious – theory it contained a wad of cash.

The manner in which the attorney handled the envelope, putting it straight into his pocket without even looking, prompted some questions as well.

Some people, however, assumed the package contained something more personal than a bunch of Federal Reserve notes.

Jackson Lee was quick to debunk the conspiracy theories, stating the envelope merely contained some ol’ boring legal papers.

“Simply, what was passed were unopened stationery notes to counsel for Dr. Ford from women who wanted to enter the hearing room but were not allowed to enter the hearing room,” the congresswoman’s press office has said.
