Just a day after an appeals court cleared the Justice Department to review classified records seized from Mar-a-Lago, the decision proved a setback not only for former President Donald Trump but also for one of his most prominent allies.
In Minnesota, a federal judge on Thursday rejected MyPillow CEO Mike Lindell's request for the return of his cellphone, which federal agents seized last week in the drive-through line of a fast-food restaurant. The ruling from Judge Eric Tostrud came only two days after Lindell filed a lawsuit demanding that the Justice Department return his cellphone and refrain from accessing data on the device.
Ruling against Lindell, Tostrud did not have to look far to find legal precedent backing up his conclusion that the phone should remain in the Justice Department's hands. A Trump appointee confirmed in 2018, Tostrud cited the recent decision from the US Court of Appeals for the 11th Circuit that allowed the Justice Department to resume its review of about 100 classified records seized from the former president's South Florida home and private club.
In that decision, three-judge panel of the 11th Circuit overruled a lower court order barring the Justice Department from reviewing the classified materials. The 11th Circuit panel fully embraced the Justice Department's argument that a further delay in its review of the classified records could cause "irreparable harm" to the government and public.
"It is self-evident that the public has a strong interest in ensuring that the storage of the classified records did not result in 'exceptionally grave damage to the national security,'" the 11th Circuit judges wrote.
"Ascertaining that," they added, "necessarily involves reviewing the documents, determining who had access to them and when, and deciding which (if any) sources or methods are compromised."
The 11th Circuit panel included two Trump appointees — Judges Andrew Brasher and Britt Grant — along with Judge Robin Rosenbaum, an Obama appointee. In addition to sympathizing with the Justice Department's national security concerns, the panel appeared at a loss for why Trump needed access to the classified records seized from his South Florida estate.
"For our part, we cannot discern why Plaintiff would have an individual interest in or need for any of the one-hundred documents with classification markings," the judges wrote.
Rarely does an appeals court decision so rapidly grow legs that it is cited in a separate case within 24 hours. But Tostrud found use for it as he presides over just one of the lawsuits Trump and his allies have filed seeking to limit the Justice Department's access to evidence.
Last week, Lindell said that FBI agents swarmed his car while he was in the drive-through line at a Hardee's and presented him with a warrant for his phone. In interviews and on his online television show, Lindell said the agents asked about his ties to Tina Peters, a county clerk in Colorado who is facing state charges related to an alleged effort to obtain data from voting machines produced by Dominion Voting Systems. Peters is accused of engineering a scheme she believed would prove a long-debunked conspiracy theory that Dominion's machines were used to steal the 2020 election from Trump.
The seizure of Lindell's phone signaled interest at the federal level in the accusations against Peters. In Lindell, the search warrant targeted one of the highest-profile promoters of pro-Trump disinformation about the 2020 election.
Lindell's lawsuit followed a similar move by John Eastman, a conservative lawyer who helped advise Trump on how to overturn the 2020 election results. Eastman filed a lawsuit for the return of his cellphone after FBI agents seized it in a restaurant parking lot in New Mexico. A federal judge rejected his bid for the immediate return of his phone, and the Justice Department later obtained another search warrant to review the contents of the device.

]]>In finance news, Citi has scored a much-needed legal victory over its embarrassing "fat-finger" mistake. The bank persuaded a federal appeals court to force Revlon creditors to give Citi back $ 504 million.
In August 2020, Citi accidentally sent Revlon lenders — including Brigade Capital Management, Symphony Asset Management, and HPS Investment Partners — more than $ 900 million.
It was the ultimate blunder on Wall Street. And while Citi managed to recover nearly half the amount, the accidental payment shone a light on Citi's internal processing systems for transactions, and fostered debate over whether processes like repayments could be automated to mitigate human error.
Chief Executive Jane Fraser called it a "massive unforced error." And internally, Citi bankers did have a laugh about it.
"The first reaction in investment banking was a combination of 'what a f'ing joke' and 'there goes our bonus,'" one senior banker told me.
Thursday's decision is the ideal tonic for Citi in an otherwise turbulent investment-banking environment.
Oh and ICYMI — Revlon filed for bankruptcy in June.
And don't forget, it's time for the Banker of the Week!

1. Citi has won its appeal over its Revlon loan blunder, helping it to recover about $ 500 million.
The US Court of Appeals for the 2nd Circuit in Manhattan said the lenders were not entitled to the repayment and had been told that the wiring was a human error.
A trio of judges overturned US District Judge Jesse Furman's decision, which allowed the lenders to keep the $ 504 million, ruling that the lenders should not have been expected to know the transfer was a mistake.
Citi argued that the lenders should have been skeptical of receiving such a payment because there was no notice that Revlon's term loan was being paid off. That loan was scheduled to mature in 2023.
Citi was Revlon's agent bank, meaning that it would act as a conduit between lenders that participated in the loan and Revlon as the borrower.
In sending such a large amount, Citi's lawyers argued that those receiving it should have known it was an error. Or at least had the wherewithal to ask why such a sum of money was sent their way well ahead of the loan maturing.
The lenders, however, argued that Judge Furman's decision should stand because those who receive money from reputable third parties like Citi should not question if the payments are legitimate.
For those of you who like to mine through court documents, here is the ruling from the appellate panel.

A Florida state appellate court has made two recent pro-privacy rulings that take into account a landmark Supreme Court case from earlier this year.
In Florida v. Sylvestre, the District Court of Appeal of the State of Florida, Fourth District, affirmed a lower court’s granting of a motion to suppress evidence. In doing so, the court found that the warrantless use of a stingray is unconstitutional.
In the second case, Ferrari v. Florida, the Fourth District reversed a lower court ruling that denied the suppression of cell-site location information (CSLI). This data was specifically at issue in the June 2018 Supreme Court decision, Carpenter v. United States.

The US Department of Justice will appeal the court ruling that allowed AT&T to purchase Time Warner Inc.
AT&T completed the merger after getting a favorable ruling from a judge at the US District Court for the District of Columbia last month. The Trump administration’s Justice Department did not seek a stay of the ruling, so AT&T was able to take ownership of Time Warner. But the DOJ is appealing the judge’s ruling to the United States Court of Appeals for the District of Columbia Circuit, the DOJ said in a court filing today.
A court could theoretically force AT&T and Time Warner to reverse the merger. AT&T said it would maintain some separation between its old and new business units in a post-verdict letter to the DOJ. That separation might make undoing the merger logistically easier if the DOJ wins its appeal.

Lawyers representing the Massachusetts man who for years has made a highly-controversial claim that he invented email have filed their appeal in an ongoing lawsuit brought against the tech news site, Techdirt.
The appeal to the 1st US Circuit Court of Appeals comes more than a year after a federal judge dismissed the libel lawsuit brought by Shiva Ayyadurai, an entrepreneur who is now also running as a longshot candidate for the United States Senate.
In the lower court ruling, US District Judge F. Dennis Saylor found that because it is impossible to define precisely and specifically what email is, Ayyadurai’s “claim is incapable of being proved true or false.”

Charter Communications is appealing a court ruling that said the ISP must face a lawsuit alleging the company falsely promised fast Internet speeds that Charter knew it could not deliver.
Charter claims that federal regulations, including the recent repeal of net neutrality rules, preempts the lawsuit filed by New York Attorney General Eric Schneiderman against Charter and its Time Warner Cable (TWC) subsidiary in February 2017.
The New York Supreme Court rejected Charter’s motion to dismiss the case on February 16, but Charter is appealing the decision in a state appellate court. (Despite its name, the New York Supreme Court is not the state’s highest court.)

An appeals court has ruled that Twitter is not liable for the deaths of two American military contractors who were killed in Jordan in 2015.
In a Wednesday decision, the 9th US Circuit Court of Appeals agreed with a lower court’s ruling in 2016 for dismissal of the case, Fields v. Twitter.
As Ars reported, the plaintiffs claimed that Twitter violated the Anti-Terrorism Act by providing Twitter accounts to the terrorist group. The plaintiffs, who represent the estate of the two deceased men, did not allege that any specific tweets instigated the terrorist to kill the US contractors, and they did not allege that ISIS recruited or trained the terrorist over Twitter. However, they did claim that Twitter provided “material support” for terrorism by allowing ISIS and its sympathizers on the social media network.
