In an interview to CNN’s Christiane Amanpour on Tuesday, former Democratic presidential nominee rejected parallels between allegations of sexual misconduct against her husband and the ones that have been leveled against President Donald Trump and marred the confirmation process of Justice Brett Kavanaugh to the Supreme Court.
There is a very significant difference. That is the intense, long-lasting, partisan investigation that was conducted in the 90s.
The former Secretary of State added that “if the Republicans, starting with President Trump on down want a comparison, they should welcome such an investigation themselves.”
Kavanaugh, who was sworn in on Monday after weeks of bitter partisan bickering, has faced allegations of sexual misconduct from several women, including claims he took part in gang-rape parties and was involved in sexual assault during his high-school years. The most prominent accuser, Dr. Christine Blasey Ford, testified before the Senate Judiciary Committee. Following her testimony and that of Kavanaugh, which both held Americans glued to their television screens for hours, the White House ordered a new FBI probe into Kavanaugh, who had previously undergone six background investigations as part of the George W. Bush Administration and as a judge on the DC Circuit Court of Appeals.
Clinton’s words did not go down well with Juanita Broaddrick, one of Bill Clinton’s most famous accusers. In 1999, she alleged in an interview with Dateline NBC that Clinton raped her in 1978 when he was serving as the attorney general of Arkansas. The ex-President himself has never addressed the allegations, referring them to his legal representative. His lawyer, David Kendall, denied the allegations at the time. Broaddrick’s story has resurfaced during the 2016 presidential election campaign and in light of the growing popularity of the #MeToo movement, encouraging victims of sexual assault, including historic, to come out.
As tensions around Kavanaugh’s confirmation were gaining momentum, Broaddrick demanded an FBI investigation into her own allegations against Clinton, accusing Democrats, adamant about a thorough FBI probe into Kavanaugh, of opportunism and “double standards.”
“It’s not politically advantageous for them to circle around me and support me,” she told Fox News in September.
Responding to Clinton’s fresh interview, Broaddrick did not mince words, calling her a “lying hypocrite.”
“My case was never litigated,” he wrote on Twitter, reiterating her call for investigation into the allegations.

Broaddrick has launched a Change.org petition, asking for a criminal investigation into “Bill Clinton’s sex crimes.” The petition has so far garnered 76,000 signatures out of the 100,000 required for it to earn a White House response.
Hillary Clinton has found herself in hot water in the past for standing by her top staffer Burns Strider on the 2008 presidential campaign, accused of harassing a younger woman who was his subordinate. The New York Times reported that Clinton refused to fire the staffer even after the allegations reached her.

She also drew widespread criticism when she claimed that her loss had contributed to the rise of “Me Too” movement, saying that “although it was a wave that was building,” her election debacle “probably accelerated that wave” in April.
The Clinton’s record as a paragon of women’s rights has also been repeatedly tested by her close ties to disgraced Hollywood producer Henry Weinstein. The Hollywood mogul donated to Clinton’s campaign and even hosted several fundraisers for her.

Court documents reportedly seen by the New York Times outline allegations by Jimmy Bennet, actor and rock musician, who says Argento sexually assaulted him when he was 17 and she was 39. The age of consent in California, where the alleged assault took place, is 18.
The events took place in 2013, but the pay-off was only demanded by Bennett and paid by Argento in recent months, as the scandal around Harvey Weinstein and the #MeToo movement gained momentum. Bennett is now 22 and Argento is 42. As part of the deal, Bennett handed over to Argento the rights to a photograph of the two of them in bed.
In mail exchanges between lawyers and clients the $ 380,000 of apparent hush money is reportedly described as “help” for Bennett, who claims to have been struggling with work and mental health after Argento’s alleged assault, his income dropping from $ 2.7mn in the five years before his encounter with Argento, to $ 60,000 a year afterwards. None of the involved individuals have provided any comment on the matter.
Asia Argento along with a dozen other women kicked off the avalanche of sexual assault allegations that has been hitting powerful men in the US movie industry and beyond. In October 2017 they accused Hollywood producer Harvey Weinstein of sexual misconduct, which precipitated his rapid downfall and became the staple of the #MeToo movement, where women come out with their stories of sexual assault, often at the hands of similarly powerful men. Weinstein himself has been embroiled in criminal cases ever since, and his career rapidly disintegrated.

Banfield asked if the accuser’s so-called “bad date” was what “victimized” her “to the point of seeking a public conviction.”
“But what you have done, in my opinion, is appalling,” Banfield said. “You have chiseled away at a movement that I, along with all of my sisters in the workplace, have been dreaming of for decades, a movement that has finally changed an oversexed professional environment that I, too, have struggled through at times over the last 30 years.”
The anchor said she’s been a victim of sexual misconduct herself, before launching into a statement addressed directly to the anonymous accuser, whose choice to remain anonymous Banfield noted protected her from experiencing a “career hit” like Ansari.
“You had an unpleasant date. And you did not leave. That is on you. And all the gains that have been achieved on your behalf and mine are now being compromised by the allegations that you threw out there — and I’m going to call reckless and hollow.”

In the wake of sexual assault allegations against Master of None star Aziz Ansari, HLN host Ashleigh Banfield had some brutally honest words for Ansari’s accuser on Monday.
President Donald Trump has amplified his support for Alabama US Senate candidate Roy Moore in a no-holds-barred rally speech in Florida. He also had choice words for Gloria Allred, who is representing several women accusing Moore of sexual assault.
During Friday night’s speech in Pensacola, Florida, just 25 miles from the border of Alabama, Trump urged people to vote for Republican candidate Moore, who is expected to win a close race with Democratic challenger Doug Jones in the upcoming special election Tuesday.
“Get out and vote for Roy Moore,” Trump said. “We can’t afford to have a liberal Democrat who is completely controlled by Nancy Pelosi and Chuck Schumer. We can’t do it.”

Trump went on to dub Jones “a little puppet” before turning attention to lawyer Gloria Allred and one of the nine women she represents, who accuse Moore of unwanted sexual advances or assault. One of those women, Beverly Young Nelson, came forward earlier Friday to admit that she added to a yearbook inscription from Moore in 1977, when she was a teen and he in his 30s. The admission led to Moore’s campaign discrediting all of her claims.
“So did you see what happened today, you know, the yearbook? Did you see that?” he said. “There was a little mistake made, she started writing things in the yearbook. Ah, what are we gonna do. Gloria Allred, anytime you see her, you know something’s going wrong.”
The Alabama Senate seat up for grabs was left open when Attorney General Jeff Sessions left the Senate to assume his new position earlier this year.

In the latest R. Kelly-related investigative report by BuzzFeed News, Jerhonda Pace, an alleged victim of the R&B singer, claims she received “cash settlements” from the singer in return for “signing nondisclosure agreements” crafted to cover up a sexual relationship she had with Kelly that turned abusive when she was 16 years old.
Pace, now 24, says she felt the need to violate her nondisclosure agreement to speak out against Kelly following a July report by BuzzFeed News that alleged that the singer was keeping women against their will in a “cult.”
“I didn’t have anybody to speak up on my behalf when I was going through what I was going through with him,” Pace told the outlet. “He’s brainwashed them really bad, and it kind of reminds me of Charles Manson.”
One of the women in Kelly’s alleged cult has since denied the previous report, saying that she is of age and in a relationship with the singer on her own free will. Kelly’s representatives have repeatedly denied all allegations.
According to the new report, Pace met R. Kelly outside of his 2008 child-pornography trial. As a 15-year-old fan of Kelly’s, she says she faked being 18 to sneak into the trial, and she even defended the singer to MTV News while standing outside of the courtroom. After R. Kelly was acquitted of all charges in the trial, Pace says that a friend of the singer’s invited her to a party at his home in Olympia Fields, Illinois. She then began an allegedly abusive relationship with Kelly as a 16-year old.
Pace alleges that the singer would film their sexual encounters and make her ask permission “to shower, eat, go to the bathroom, and leave the property” of his mansion. When she violated his “rules,” Pace says she was “mentally and physically abused,” according to BuzzFeed.
Pace left the relationship in 2010 after an alleged instance of abuse, and she contacted Susan E. Loggans, a Chicago lawyer. Pace claims the lawyer “negotiated a large settlement with Kelly” in return for her signing “a nondisclosure agreement and declining to pursue any charges or other claims against Kelly.”
Though her agreement included a “non-disparagement clause,” Pace is speaking out against Kelly for the first time, and she says she is now considering filing criminal charges against the singer.
Kelly’s camp has since refuted the claims with the following statement:
“The allegations against Mr. Kelly are false, and are being made by individuals known to be dishonest. It is clear these continuing stories are the result of the effort of those with personal agendas who are working in concert to interfere with and damage his career. Mr. Kelly again denies any and all wrong doing and is taking appropriate legal action to protect himself from ongoing defamation.”

Among the many surreal moments that made up Donald Trump’s 2016 presidential campaign, one of the most remarkable was the Facebook Live press conference he held before the second presidential debate to help deflect the impact of the now-infamous 2005 Access Hollywood tape. Sitting there with Trump in casual loungewear and a blingy hat, along with two other women who had accused Bill Clinton of sexual assault or harassment, was 49-year-old Arkansan Paula Jones, the woman who had sued a sitting president and likely changed — if you add up the George W. Bush voters who hoped to “restore honor and dignity” to the White House in 2000 — the course of American history. Believe it or not, Jones may not be done influencing history just yet.
Chances are, when President Trump — who once labeled Jones “a loser” in a 1998 NBC News interview — first resurrected her case to help bolster his candidacy, he never contemplated the role it could play in unraveling his presidency. Over two decades ago, Clinton attempted to delay a sexual harassment suit filed against him by Jones until after he left office. In it, she alleged that in 1991, the then Arkansas governor had exposed himself to her in a Little Rock hotel room while she was a 24-year-old state employee. The resulting case, Jones v. Clinton, went all the way to the Supreme Court, which held in a unanimous decision in 1997 that executive privilege did not protect a sitting president from lawsuits filed against him for private conduct.
One major weapon for attacking the policies of a sitting president is through litigating his private conduct.
You know the rest of the story: Clinton was forced to submit to hours of depositions, and the case led Jones’ lawyers to a White House intern named Monica Lewinsky. In addition to humbling one president, the case set a powerful precedent for presidents who misbehave in their private lives — one that could get a workout under Trump’s administration. Jones v. Clinton is “horrible news” for Donald Trump, says Northeastern University law professor Daniel Urman. By far the most litigious president in American history, Trump and his various business entities have been involved in as many as 4,000 lawsuits over the years. Despite paying $ 25 million to settle three fraud lawsuits against Trump University just days before his inauguration, the new president faces, according to a USA Today count two weeks prior to the inauguration, 75 ongoing cases.
As the Jones case makes clear, Trump will not be able to lean on his duties as president to excuse himself from the proceedings in these cases or to shield himself from liability. The pending litigation will take up time, draw additional scrutiny to his business practices and give political opponents plenty of opportunities to conduct discovery and dig up more dirt, including perhaps a Lewinsky-level smoking gun. And, let’s face it, as with Clinton, one major weapon for attacking the policies of a sitting president is through litigating his private conduct, both in court and in the court of public opinion.
Which brings up a fascinating side note: Many of the same folks who will be helping to defend Trump in these matters have some very close ties to the group of young conservatives — who call themselves “the Elves” (as in Santa’s hidden magical workers) — that spent years lobbing legal grenades at President Clinton from the other side. Case in point: George Conway III, a high-powered D.C. lawyer at the prestigious firm Wachtell, Lipton, Rosen & Katz, and — you guessed it — husband of senior Trump adviser and “alternative facts” proponent Kellyanne Conway. Conway helped write Jones’ Supreme Court brief and also penned an influential op-ed in the Los Angeles Times at the very beginning of the Jones ordeal arguing that Clinton was on shaky legal ground. Granting the president immunity “would place presidents above the law,” Conway observed, and such a situation “smacks of the privilege of a sovereign or an autocrat — not a president of a democratic republic.”
Of course, there is one way that Trump could rise above the law and avoid facing the barrage of private lawsuits — and it’s an escape hatch that comes straight from the Supreme Court’s opinion in Jones v. Clinton itself: “If Congress deems it appropriate to afford the President stronger protection, it may respond with appropriate legislation.”
Let’s hope the Republicans in Congress, some of whom once led the pursuit of Clinton, heed Conway’s words about privilege and autocracy in the litigious days ahead, and abstain from revisiting the 1990s in reverse by taking action again — this time to shield a sitting president from the consequences of his private conduct.

NEW YORK (Reuters) – When former reality television contestant Summer Zervos accused Donald Trump of sexual misconduct last fall, she pursued her claims solely in the court of public opinion, since the allegations dated too far back to allow a lawsuit.
But last month, she found a fresh approach to fight the former host of “The Apprentice,” who has vehemently denied her allegations that he groped her in 2007. By professing his innocence, the man who is now president of the United States had effectively called her a liar, Zervos alleges in a defamation lawsuit.
The suit copied a rare legal tactic employed most notably by several women who have accused the actor and comedian Bill Cosby of sexual assault: using his denials as the basis for a defamation claim.
It is not uncommon for high-profile allegations against celebrities to prompt defamation lawsuits, but they are usually filed by the star against the accuser.
In 2014, however, Joseph Cammarata, the attorney for Cosby accuser Tamara Green, realized he could adapt that strategy for his own purposes after Cosby’s lawyer issued a statement calling the allegations “fantastical.”
Like many other Cosby accusers, Green was unable to sue for assault because the alleged incident occurred decades ago.
“A direct claim for the assault is not available, so I came up with the idea that a defamation claim would be the appropriate vehicle to use to address the underlying harm,” said Cammarata, whose lawsuit now includes seven Cosby accusers as plaintiffs. All told, 10 Cosby accusers filed four defamation lawsuits in three states.
In simple terms, the argument is that Trump and Cosby have effectively branded the women as liars by denying the incidents occurred. But the women face a difficult challenge in making their cases, experts say.
“Merely saying, ‘I didn’t do it,’ is traditionally not seen in defamation law as calling your accuser a liar, even though logically that’s what it means,” said Rod Smolla, dean of the Delaware Law School and a First Amendment scholar.
“But if you go beyond that – if you go from, ‘I didn’t do it,’ to, ‘She’s a liar,’ now you have arguably made a statement of fact” that could be subject to liability, he added.
Trump’s status as president does not shield him from civil liability for actions he took prior to assuming office.
In a statement on Tuesday, the attorney defending Trump in the Zervos lawsuit, Marc Kasowitz, said he and Trump’s personal lawyer would soon file a response to the lawsuit.
“President Trump continues to deny any allegation of wrongdoing raised in said complaint,” he said.
Cosby, 79, who faces allegations of sexual misconduct from approximately 50 women, has also denied any wrongdoing.

The Cosby and Trump plaintiffs are taking on a tough double burden, experts said.
First, the only way to show the denials by both men are untrue is to prove the incidents took place as described.
“The burden is going to be on her to show that Trump is actually saying something that’s false,” Clay Calvert, a First Amendment expert at the University of Florida, said of Zervos.
In addition, the women must show Trump and Crosby crossed the line into defamation by deliberately making false statements that seriously harmed the accusers’ reputations.
In defamation cases, courts typically examine statements to determine whether they were factual or opinion, as expressing an opinion is generally protected by the First Amendment.
Making that distinction can be challenging. In the Cosby cases, for instance, judges have split on whether the lawsuits should proceed, even coming to opposite conclusions regarding the same statement from his attorney.
U.S. District Judge Mark Mastroianni in Massachusetts rejected Cosby’s attempts to have two cases, including Green’s lawsuit, thrown out. In his rulings, the judge found that a November 2014 statement from Cosby’s lawyer calling the allegations “unsubstantiated, fantastical stories” could be reasonably seen as factual, and therefore potentially defamatory.
By contrast, a Pittsburgh federal judge, Arthur Schwab, tossed a similar case against Cosby, finding that the same statement was “pure opinion” and thus protected.
Unlike Cosby, who has been fairly circumspect in his public statements, Trump has aggressively attacked his accusers, calling the claims “100 percent fabricated and made-up.” His rhetoric could make him more vulnerable to a defamation claim, experts said.
Trump has said he never met Zervos at a hotel, despite her allegation that he groped her at a hotel in Beverly Hills, California.
That type of specific fact-based assertion can also make it easier to show defamation if it can be proven false, according to Eugene Volokh, a law professor at the University of California in Los Angeles.
“So much depends on the particular statement and the particular context surrounding that statement,” he said.
